<section id="H4B2BCEED12A040C4A60F1DE532AEF12C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Readiness Permitting Efficiency Act of 2026</short-title></quote>.</text></section> <section id="HC2C995BD86EF4AFE9154682CD836CE7F"><enum>2.</enum><header>Interagency agreements to execute certain reviews of priority Department of Defense programs and projects</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/159">Chapter 159</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/2672">section 2672</external-xref> the following new section:</text>

<section id="HFA00799A8633460DA590A0C403AADB65"><enum>2673.</enum><header>Interagency agreements to execute reviews of priority programs and projects</header> 
<subsection id="HA5A87BE31BCF4A16B1158C4F92214554">
                        <enum>(a)</enum>
                        <header>Agreements authorized</header>
                        <paragraph id="HC4FA5EB452E14B1C9C70DEE925FF94C0" display-inline="yes-display-inline">
                            <enum>(1)</enum>
 <text>Subject to the requirements of paragraph (2), the Secretary of Defense or the Secretary of a military department may enter into an agreement with the Director of the National Marine Fisheries Service or the Director of the United States Fish and Wildlife Service under which—</text>
                            <subparagraph id="H27A391B5A197453BBF2FDADDCFA636B2" indent="up1">
                                <enum>(A)</enum>
 <text>the Director agrees to execute a review process under a law specified in paragraph (2) for a priority military program or project, as designated by the Secretary; and</text>
                            </subparagraph>
                            <subparagraph id="H0AA5968DCBD041279C54CD2E51E0BD2E" indent="up1">
                                <enum>(B)</enum>
 <text display-inline="yes-display-inline">the Secretary of Defense or the Secretary of a military department agrees to provide to the Director direct financial assistance in such amounts as may be necessary to hire personnel to execute the review process, provided such amounts are used only for such purpose.</text>
                            </subparagraph>
                        </paragraph>
                        <paragraph id="HE79B940B3DA8471FB995E75DE66CD6F2" indent="up1">
                            <enum>(2)</enum>
 <text>The Secretary of Defense or the Secretary of a military department may enter into an agreement under this subsection with respect to a program or project only if—</text>
                            <subparagraph id="H11D31DB5DA59461CAEF45C665D6431BE">
                                <enum>(A)</enum>
 <text>the Secretary determines that it is in the interest of national defense to carry out a review process for the program or project within a particular period of time; and</text>
                            </subparagraph>
                            <subparagraph id="H9EA3EDB9663F407CB91F55AD23255A34">
                                <enum>(B)</enum>
 <text display-inline="yes-display-inline">the Director of the National Marine Fisheries Service or the Director of the United States Fish and Wildlife Service provides notice to the Secretary that the National Marine Fisheries Service or the United States Fish and Wildlife Service, as the case may be, does not have sufficient funds or adequate personnel to carry out the review process within such period without the receipt of assistance under the agreement.</text>
                            </subparagraph>
                        </paragraph>
                        <paragraph id="H80321ECE363A437A86EC9AC255BD697D" indent="up1">
                            <enum>(3)</enum>
 <text>The laws specified in this paragraph are each of the following:</text>
                            <subparagraph id="H27DE1F36686F4C409F13DED8564359CC">
                                <enum>(A)</enum>
 <text>The Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1361">16 U.S.C. 1361 et seq.</external-xref>).</text>
                            </subparagraph>
                            <subparagraph id="HEDAC9920541E4A15986750342BC588A1">
                                <enum>(B)</enum>
 <text>The Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text>
                            </subparagraph>
                            <subparagraph id="HFEC6637590024940B11214D164A69FDA">
                                <enum>(C)</enum>
 <text>The Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801 et seq.</external-xref>).</text>
                            </subparagraph>
                        </paragraph>
                    </subsection> 
<subsection id="H72ED9415801247F693387C13F037AF01"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HA75C1D222C2D456A8BBB3C70590B3CEF"><enum>(1)</enum><text>The term <quote>eligible expense</quote>, with respect to a review process, includes an expense for—</text> 
<subparagraph id="H32604085E7D74BFE851F0C30040725C7"><enum>(A)</enum><text>support of or participation in military planning activities that precede the initiation of the review process;</text></subparagraph> <subparagraph id="HF6079301C6AE4CCCAF886517D71A465B"><enum>(B)</enum><text>activities directly related to the review process, including any associated consultation process; and</text></subparagraph> 
<subparagraph id="H0C1B1BDBC8D24FFF83DEF83B30FA19DA"><enum>(C)</enum><text>development of programmatic agreements.</text></subparagraph></paragraph> <paragraph id="HF580EA10384D4326BC43EB6A8CE70C45"><enum>(2)</enum><text>The term <quote>review process</quote>, with respect to a law, means the process of reviewing the potential environmental impacts of a program or project to determine whether the program or project meets the requirements of the law, including any requirement for a consultation, plan, permit, or approval.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
