<section id="H549FE75223784601A6EB31E86B6D54FE" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Critical Access Hospital Roadway Impact Protections Act of 2026</short-title></quote> or the <quote><short-title>Critical Access Hospital RIP Act of 2026</short-title></quote>.</text></section> 
<section id="H6457994D6C8E42DB87E840A7B101C2B9"><enum>2.</enum><header>Ensuring that facilities do not lose critical access hospital status as a result of a roadway or transportation infrastructure improvement</header><text display-inline="no-display-inline">Section 1820(c)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-4">42 U.S.C. 1395i–4(c)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" id="H2D62D87EB2304BD2A6DF60F3C1077B10" display-inline="no-display-inline"> <subparagraph id="HD63D635DB1CD464F846B0DB2F6A3B2B7"><enum>(F)</enum><header>Disregard of subsequent roadway or transportation infrastructure improvements</header> <clause id="HA1173699C1E443ABB826C3DFA73578F6"><enum>(i)</enum><header>In general</header><text>A facility that is or at any point was designated as a critical access hospital by a State under subparagraph (B) that would meet the criterion specified in clause (i)(I) of such subparagraph but for a roadway or transportation infrastructure improvement completed on or after the date of such designation shall be deemed to continue to meet such criterion.</text></clause> 
<clause id="H349DC948C14243BB8571D00C02A5CB9B"><enum>(ii)</enum><header>Roadway or transportation infrastructure improvement defined</header><text>For purposes of clause (i), the term <quote>roadway or transportation infrastructure improvement</quote> includes—</text> <subclause id="HCA4659F0CEC645138C77AC84B3CE3492"><enum>(I)</enum><text display-inline="yes-display-inline">the construction, realignment, widening, or enhancement of a highway or roadway; and</text></subclause> 
<subclause id="H3EC1439E4A4348E59534946B811BD9AD"><enum>(II)</enum><text display-inline="yes-display-inline">the construction or modification of a bridge, overpass, or tunnel.</text></subclause> </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </section> </legis-body></bill>
