<section id="H0BA9B03CB5D44A29BE6EC60FE074C3A8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting America from Chinese Cars Act of 2026</short-title></quote>.</text></section> <section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="HAECB90A2F782447CBC1CE205FED8F6BE"><enum>2.</enum><header display-inline="yes-display-inline">Prohibition on entry into the United States of connected vehicles associated with foreign adversaries</header> <subsection id="H0419B463910A40F3B5F82D25B9F9AC81"><enum>(a)</enum><header>In general</header><text>A connected vehicle may not enter, or otherwise be transported or conveyed into, the United States if—</text>
<paragraph id="H146253A5CA2345B7855757B878C5ECAA"><enum>(1)</enum><text>the country of origin of the connected vehicle is a covered country or the connected vehicle is designed within a covered country; or</text></paragraph> <paragraph id="HEF9AFADAC91142B0B48132F69E511DF0" commented="no"><enum>(2)</enum><text>the manufacturer of the connected vehicle is a joint venture, subsidiary, or other entity in which more than 15 percent of the equity interest, voting interest, board representation, or other indicia of control, whether directly or indirectly, is owned or controlled by an entity, or combination of entities, organized under the laws of, or with its principal place of business in, a covered country.</text></paragraph></subsection>
<subsection id="H388DC3B53D584F9EB3EA2F7B86F729EB"><enum>(b)</enum><header>Exception</header><text>The prohibition under subsection (a) shall not apply to the entry, or other transportation or conveyance, of a connected vehicle into the United States if the vehicle—</text> <paragraph commented="no" display-inline="no-display-inline" id="H74C1D31868654E80B16D07A4500223C6"><enum>(1)</enum><text display-inline="yes-display-inline">is not intended to be driven on public roads; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HA0FEE916FC6448B4935C07F332AA52DB"><enum>(2)</enum><text>is being brought into the United States for the sole purpose of testing and evaluation by an entity that—</text> <subparagraph id="H7746471F7FFA4BB29D6E31F66980FE8C"><enum>(A)</enum><text>is organized under the laws of a State in the United States;</text></subparagraph>
<subparagraph id="H891C5BFD72474089BBD2E13E870C724D"><enum>(B)</enum><text>does not have its principal place of business in a covered country; and</text></subparagraph> <subparagraph id="HBEDCF21281814094838FB42AD125B99D" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>is not 25 percent or more, whether directly or indirectly, owned or controlled by an entity, or combination of entities, organized under the laws of, or with its principal place of business in, a covered country.</text></subparagraph></paragraph></subsection>
<subsection id="H20CD510F5D95485792BD0BA11C56AF29"><enum>(c)</enum><header>Authorizations</header>
<paragraph id="HCBDF53A298C746338C4BE9E1A24F6561"><enum>(1)</enum><header>Issuance</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H555AF5098FE0466AB89348DBFCFD4283"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The Commissioner, in consultation with the Secretary of Commerce, may issue a general or specific authorization for a connected vehicle that would otherwise be subject to the prohibition under subsection (a) to enter the United States if—</text> <clause commented="no" display-inline="no-display-inline" id="H291BEDCC19E34FE7A086474B31519AAD"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary determines, based on clear and convincing evidence and a written risk assessment, that the vehicle does not pose, and is not reasonably likely to pose—</text>
<subclause id="HB123C5B7E9C3493CB32AC5D5E4374E4E" commented="no"><enum>(I)</enum><text>an undue risk of data exfiltration or of being remotely manipulated or operated;</text></subclause> <subclause id="HFFCF073FB678416D983080E278F8D2D0"><enum>(II)</enum><text>a risk to critical infrastructure or the integrity of the industrial base of the United States; or</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H60D101371D54416AA846600A13E537FB"><enum>(III)</enum><text>any other risk to the national security of the United States;</text></subclause></clause> <clause id="H818D5EF3CA4F4EB5888C7D6264B056B8"><enum>(ii)</enum><text>not less than 60 days before the authorization takes effect, the Commissioner submits to Congress a detailed written notification, including the determination under clause (i) and underlying analysis, including the written risk assessment; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HF8C922033532448CB72B5D9399008EF2"><enum>(iii)</enum><text>during the 60-day period described in clause (ii), there is not enacted into law a joint resolution of disapproval with respect to the authorization of the item.</text></clause></subparagraph> <subparagraph id="H8B71BCEDE62D4AE48A541EE3F9F64459"><enum>(B)</enum><header>Modification or revocation of general or specific authorizations</header><text>The Commissioner may, at any time, modify, suspend, or revoke a general or specific authorization issued under subparagraph (A) if the Secretary—</text>
<clause commented="no" display-inline="no-display-inline" id="H54F3F4DC71F0422EB6F9BBF67C08DA60"><enum>(i)</enum><text display-inline="yes-display-inline">determines that the authorization no longer satisfies the requirements of subparagraph (A)(i); and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H05800462E1AC4C20B6ECC55C37B56276"><enum>(ii)</enum><text display-inline="yes-display-inline">provides the public with an opportunity to comment before modifying, suspending, or revoking the authorization.</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HAA4B4C1074E44DA98193912146721C2D"><enum>(2)</enum><header>Publication of list of authorized items</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H55C8DEB15F38447D90EC0A9AFEDCBDC8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall publish, pursuant to section 553 of title 5, United States Code, and maintain a list of the connected vehicles with respect to which an authorization under paragraph (1) has been issued. The initial such list shall be published not later than January 1, 2027.</text></subparagraph> <subparagraph id="H52F23BC0C11C49199AE5F6FDB97F1360"><enum>(B)</enum><header>Inclusions</header> <clause id="HB0B0F514F48045B59394C34A63FBA883"><enum>(i)</enum><header>In general</header><text>To the extent possible, the Secretary shall include, in the list required by subparagraph (A), the manufacturer and make and model for each connected vehicle on the list.</text></clause>
<clause id="H5B2815D8ACD54484A7EECD744C015E4B"><enum>(ii)</enum><header>Risk assessment</header><text>To the extent possible, the Secretary shall include, in the list required by subparagraph (A), a detailed explanation about why each connected vehicle on the list does not pose a risk described in paragraph (1)(A).</text></clause></subparagraph></paragraph> <paragraph id="H7F63006E945A4F0CB476E1DB4EBA9772" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Requests for authorization</header><text>Not later than January 1, 2027, the Commissioner shall establish a procedure pursuant to which a manufacturer of connected vehicles may seek authorization under paragraph (1) for the entry in the United States of a connected vehicle that would otherwise be subject to the prohibition under subsection (a).</text></paragraph></subsection>
<subsection id="H186443F6C3C34E6AADC5101F776952DB"><enum>(d)</enum><header>Regulations</header><text>Not later than 90 days after the date of the enactment of this Act, the Commissioner, in consultation with the Secretary of Commerce, shall prescribe regulations to implement this section that include—</text> <paragraph commented="no" display-inline="no-display-inline" id="HFD3A46AB24CC4BBE94D32E49BEE647D1"><enum>(1)</enum><text display-inline="yes-display-inline">a list of connected vehicles subject to the prohibition under subsection (a); and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H18B92B2D80DD4BE7961241B61AA0366D"><enum>(2)</enum><text>a plan for disseminating information about those vehicles to the public.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H8E28B55B6FD94D72BD9F713427639765"><enum>(e)</enum><header>Effective date; applicability</header><text>The prohibition under subsection (a) shall—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H55364185E0D645988C115F32E3709111"><enum>(1)</enum><text display-inline="yes-display-inline">take effect on the date that is 30 days after the regulations required by subsection (d) are published in the Federal Register; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H5E33765CB50148D18FD2516F689A1FEE"><enum>(2)</enum><text>apply to connected vehicles attempted to be entered, or otherwise transported or conveyed into, the United States on and after the date described in paragraph (1).</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H63E384D039B345ADB44CA1C42754EDF1"><enum>(f)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="HB7A5E676903F41C1B0FEC46B777978A5"><enum>(1)</enum><header>Commissioner</header><text>The term <term>Commissioner</term> means the Commissioner of U.S. Customs and Border Protection.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H24983DAF723E477E977E33508539F832"><enum>(2)</enum><header display-inline="yes-display-inline">Connected vehicle</header>
<subparagraph commented="no" display-inline="no-display-inline" id="HB414D9CE869C416ABD7260DB02717962"><enum>(A)</enum><header>In general</header><text>Except as provided by subparagraph (B), the term <term>connected vehicle</term> means a vehicle driven or drawn by mechanical power and manufactured primarily for use on public streets, roads, and highways, that integrates onboard networked hardware with automotive software systems to communicate via dedicated short-range communication, cellular telecommunications connectivity, satellite communication, or other wireless spectrum connectivity with any other network or device.</text></subparagraph> <subparagraph id="HB0FB9FBA7724443AA7086C18B5BA0F5D"><enum>(B)</enum><header>Exclusion</header><text>The term <term>connected vehicle</term> does not include a vehicle operated only on a rail line.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H04879127A5344A238EF201425F1FFECB"><enum>(3)</enum><header>Country of origin</header><text>The term <term>country of origin</term>, with respect to a vehicle, means the country—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H86ED5C7910F648EE962969100E64B2B3"><enum>(A)</enum><text display-inline="yes-display-inline">in which the vehicle is manufactured; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H334F1681BBA7467983A1FA61D3D1D9CB"><enum>(B)</enum><text>the government of which owns or controls, or has jurisdiction or direction over—</text> <clause commented="no" display-inline="no-display-inline" id="H45D28BD4AB4945749458F114785EB032"><enum>(i)</enum><text display-inline="yes-display-inline">the entity manufacturing the vehicle; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HA34C31A375024F2986F72C07443BA56C"><enum>(ii)</enum><text>the entity supplying the vehicle.</text></clause></subparagraph></paragraph> <paragraph id="H31504490E4364185B6CAD306EBBEEEB9"><enum>(4)</enum><header>Covered country</header><text>The term <term>covered country</term> means—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H3A7ABEBE6E2946B78216AE7D5ADA6077"><enum>(A)</enum><text display-inline="yes-display-inline">the Democratic People's Republic of North Korea;</text></subparagraph> <subparagraph id="H3919832425C5438B8B3704AF2784CF8E"><enum>(B)</enum><text>the People's Republic of China;</text></subparagraph>
<subparagraph id="HEAE67B6E8AE842D5A2087EC6C1447EFF"><enum>(C)</enum><text>the Russian Federation; and</text></subparagraph> <subparagraph id="HA1D74712CE554D1BA21DE28746DC51B1"><enum>(D)</enum><text>the Islamic Republic of Iran.</text></subparagraph></paragraph></subsection></section>
