<section id="H11C4A678F60E401DB52626E9C035EF93" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Amtrak Grant Flexibility Act</short-title></quote>.</text></section> <section id="HE0373D899E09447BAEA1358FE9417AE5"><enum>2.</enum><header>Eligibility of grant funds to satisfy non-Federal share requirements</header> <subsection id="HE83701816E0B452A89995E22808FAC9D"><enum>(a)</enum><header>National infrastructure project assistance grants</header><text display-inline="yes-display-inline">Section 6701(i)(2) of title 49, United States Code, is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H0CB40FB3DD024143AB35C2B92856417C"><enum>(D)</enum><header>Allowable use of Amtrak grant funds</header>
<clause id="HEC95FA47C80C40B6AAED008B2A05FB0B">
                            <enum>(i)</enum>
                            <header>In general</header>
 <text display-inline="yes-display-inline">If Amtrak is the recipient of a grant under this section, Amtrak may use any Federal grant funds provided to Amtrak (other than grant funds awarded under the program and subject to any terms or conditions placed on such Federal grant funds) to carry out any activity described in subsection (h)(1), so long as the involvement of Amtrak in such activity is not limited to monetary contributions.</text>
                        </clause>
<clause id="H1454894A1E144652941249584AC2F097"><enum>(ii)</enum><header>Non-applicability of limitation</header><text>Any Federal grant funds used by Amtrak pursuant to clause (i) may not be treated as Federal assistance for purposes of subparagraph (B).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H611B3ADCE7504B96B979E9679FBBE81B"><enum>(b)</enum><header>Consolidated rail infrastructure and safety improvements grants</header><text>Section 22907(h) of title 49, United States Code, is amended by adding at the end the following new paragraph:</text>

<paragraph id="HDA9530F2535F49B1ACEA881177D8B4DA"><enum>(5)</enum><header>Treatment of Amtrak grant funds</header><text display-inline="yes-display-inline">If Amtrak is an applicant under this section, any Federal funds provided to Amtrak may be used to satisfy the non-Federal share requirements.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HB35C4D5716CA47CD9F762FF2C2FE8E23"><enum>(c)</enum><header>Federal-State partnership for intercity passenger rail grants</header><text display-inline="yes-display-inline">Section 24911(f)(3) of title 49, United States Code, is amended by striking <quote>may use</quote> and all that follows through the period at the end and inserting the following:</text>
<quoted-block style="USC" id="H66785B90884C4023B99C549C83C4749D" display-inline="yes-display-inline"><text>may satisfy the non-Federal share requirements using—</text> <subparagraph id="H5332979A7E054C8CB8C9D22170D8EFC6"> <enum>(A)</enum> <text display-inline="yes-display-inline">tickets and other revenues generated from its operations or other sources;</text>
                    </subparagraph>
<subparagraph id="H37F2EE9B26A44BCABC6FBB26F1544CBD"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to a project under this section associated the National Network, grant funds issued by the Secretary to Amtrak for use in activities associated with the National Network; and</text></subparagraph> <subparagraph id="H7B9D5D239C7D4B2390202FC71AC7852D"><enum>(C)</enum><text display-inline="yes-display-inline">with respect to a project under this section associated the Northeast Corridor, grant funds issued by the Secretary to Amtrak for use in activities associated with the Northeast Corridor.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
