<section section-type="section-one" id="HA12EAB2F6D4B4904AA4A3E75965649CC"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Senior Hunger Prevention Act of 2026</short-title></quote>.</text></section> <section id="HA99284B2EEF64677A08CEA9FD73E30B9"><enum>2.</enum><header>Improving efficacy of the supplemental nutrition assistance program</header> <subsection commented="no" id="H932C7B652DA2499DA44F0CE7E89FF92C"><enum>(a)</enum><header>Certification period</header><text>Section 3(f) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(f)</external-xref>) is amended, in the second sentence, by striking <quote>24</quote> and inserting <quote>36</quote>.</text></subsection>
<subsection id="H5FE5D559727D48F6A44519F54B1074EC"><enum>(b)</enum><header>Standard medical expense deduction</header><text display-inline="yes-display-inline">Section 5(e)(5) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(e)(5)</external-xref>) is amended—</text> <paragraph commented="no" id="HBD6AD9AD93E64D418F48527B053853DC"><enum>(1)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">Excess medical</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Medical</header-in-text></quote>;</text></paragraph>
<paragraph commented="no" id="H233BA5493E0644F38E1920B82D05E129"><enum>(2)</enum><text>in subparagraph (A), by striking <quote>an excess medical</quote> and all that follows through the period at the end and inserting <quote>a standard medical deduction or a medical expense deduction of actual costs for the allowable medical expenses incurred by the elderly or disabled member, exclusive of special diets.</quote>;</text></paragraph> <paragraph commented="no" id="HC2A0E5919B9249AD84C5CFAE4016FA70"><enum>(3)</enum><text>in subparagraph (B)(i), by striking <quote>excess</quote>; and</text></paragraph>
<paragraph commented="no" id="H6DAB85DAFE8244FF89C2FBA1FB51E206"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HDF940965019546248849953B1351B1E0"> <subparagraph id="H03482EE9F4F44325A8A51AB59D359051"><enum>(D)</enum><header>Standard medical expense deduction amount</header> <clause id="HED7477886EBD45FF87EE77B78678C391"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the standard medical expense deduction shall be equal to—</text>
<subclause id="HE47CB312C79E4D9B8E9690F15C18D17E"><enum>(I)</enum><text>for fiscal year 2027, $155; and </text></subclause> <subclause id="HE234EA2F8D244B7BA19193AF18EFBAA8"><enum>(II)</enum><text>for each subsequent fiscal year, the applicable amount for the immediately preceding fiscal year, as adjusted to reflect changes for the 12-month period ending the preceding June 30 in the Consumer Price Index for All Urban Consumers: Medical Care published by the Bureau of Labor Statistics of the Department of Labor.</text></subclause></clause>
<clause commented="no" display-inline="no-display-inline" id="HF062C0852AD54BC58F96B4EDB9C2B5C5"><enum>(ii)</enum><header>Exception</header><text>For any fiscal year, a State agency may establish a greater standard medical expense deduction than the deduction described in clause (i) if the greater deduction satisfies the applicable cost-neutrality standards established by the Secretary for that fiscal year.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H790E87F8E969469997AF3443D4641AF4"><enum>(c)</enum><header>Value of allotment</header><text>Section 8(a) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2017">7 U.S.C. 2017(a)</external-xref>) is amended, in the proviso, by striking <quote>8 percent</quote> and inserting <quote><fraction>1/3</fraction></quote>.</text></subsection></section>
<section id="H7B61A8DDD03B4D7EA22A316236925CD9"><enum>3.</enum><header>Streamlining nutrition access for older adults and adults with disabilities</header>
<subsection id="HA3ECA5471C894A6E917E4A9077F4CC58"><enum>(a)</enum><header>Definition of elderly and disabled</header><text>Section 3(j)(2)(B) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(j)(2)(B)</external-xref>) is amended by inserting <quote>(which includes medical assistance provided to an individual described in section 1902(e)(14)(D)(i)(III) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(e)(14)(D)(i)(III)</external-xref>))</quote> after <quote>(<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>)</quote>.</text></subsection> <subsection id="H8232ED74052F4F9C8B1A98DF29B70ACE"><enum>(b)</enum><header>Elderly Simplified Application Program</header><text>The Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H827E714390B24CC7ADB66E03614D6D4D"><enum>31.</enum><header>Elderly Simplified Application Program</header>
<subsection id="H5D94623A88A745959743628AFBB45C51"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this section, the Secretary shall establish a program, to be known as the <quote>elderly simplified application program</quote> (referred to in this section as <quote>ESAP</quote>), under which a State, in carrying out the supplemental nutrition assistance program, may elect to implement a streamlined application and certification process for households in which all adult members—</text> <paragraph commented="no" display-inline="no-display-inline" id="HED99469B93344BC49725EA2B18224AB0"><enum>(1)</enum><text display-inline="yes-display-inline">are elderly or disabled members; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HA571A0268D5C45D89829AAF570318879"><enum>(2)</enum><text display-inline="yes-display-inline">have no earned income.</text></paragraph></subsection> <subsection id="HF7269FA799A146B1AC5D125D7598E88C"><enum>(b)</enum><header>Certification period</header><text>The certification period for participants in ESAP shall be 36 months.</text></subsection>
<subsection id="HC646B44AFF1E45F489888718BEC2DCCE"><enum>(c)</enum><header>Income and other data verification</header>
<paragraph commented="no" display-inline="no-display-inline" id="H1C37B8AFD39D433AB82CACA54555128F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A State agency determining the eligibility for an applicant household under ESAP shall, notwithstanding section 11(e)(3)—</text> <subparagraph id="HEF54A43A24224CF6852B8D7916857834"><enum>(A)</enum><text>to the maximum extent practicable, use data matching for income verification and household size; and</text></subparagraph>
<subparagraph id="HD302B7266F0F49C8A9D16C09C8697876"><enum>(B)</enum>
<clause commented="no" display-inline="yes-display-inline" id="HF41D6A6300224F1EA96E058BDB2F77E1"><enum>(i)</enum><text>allow self-declaration by the applicant of the information required under section 273.2(f) of title 7, Code of Federal Regulations (or a successor regulation); but</text></clause> <clause commented="no" display-inline="no-display-inline" indent="up1" id="HD8A83CD205FE4E42A98B65B8D42B4182"><enum>(ii)</enum><text>verify, prior to certification of the household, factors of eligibility provided by the applicant that the State agency determines are questionable.</text></clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4106D0615EA447C3B7EC91D9C66C7BC7"><enum>(2)</enum><header>Accountability and fraud prevention</header><text>In carrying out paragraph (1), a State agency shall establish accountability and fraud protection measures to deter fraud and ensure the integrity of ESAP and the supplemental nutrition assistance program.</text></paragraph></subsection> <subsection id="H7E821758BEA44C9C8A63006FA2523611"><enum>(d)</enum><header>Interviews</header><text>Notwithstanding section 11(e)(6)(A), for recertification of a household under ESAP, a State agency shall not require an interview unless requested by the household, which may be conducted virtually.</text></subsection>
<subsection id="H828FE70B5E3D40C5A33047F3DCA73630"><enum>(e)</enum><header>Guidance</header><text>Prior to the establishment of ESAP under subsection (a), the Administrator of the Food and Nutrition Service shall develop guidance for States, including by consulting with States, to carry out ESAP, which shall include—</text> <paragraph commented="no" display-inline="no-display-inline" id="H65D6A00D9D49450B95198342C964A9F8"><enum>(1)</enum><text>general implementation guidelines;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HE358AFAD70654BC69BC6C88BB2B0F16A"><enum>(2)</enum><text display-inline="yes-display-inline">reporting requirements;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H4FA0BC7D669C4EAC80B9058B75AD2402"><enum>(3)</enum><text display-inline="yes-display-inline">quality control requirements; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H5F9BF201244A4F098171D08EE7F67105"><enum>(4)</enum><text display-inline="yes-display-inline">best practices.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" display-inline="no-display-inline" id="H92FFF0D981EF410B9451212ACFD335FE"><enum>(c)</enum><header display-inline="yes-display-inline">Combined Application Program</header><text>The Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) (as amended by subsection (b)) is amended by adding at the end the following:</text>

<section commented="no" display-inline="no-display-inline" id="HEE3327A4DBB7440C893EE127D2F81C72"><enum>32.</enum><header>Combined application program</header>
<subsection commented="no" display-inline="no-display-inline" id="H174011EF529B415CA78F4E9599D16BB4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, the Secretary, in coordination with the Commissioner of Social Security, shall establish a program, to be known as the ‘combined application program’ (referred to in this section as <quote>CAP</quote>), under which a State, in carrying out the supplemental nutrition assistance program, may elect to implement a streamlined application process for households in which all adult members are applicants for or recipients of benefits under title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>) on the basis of a disability or supplemental security income under title XVI of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>).</text></subsection> <subsection id="HE35CD8D1CE1E4E3DB4D7B385729A48B7"><enum>(b)</enum><header>Purposes</header><text>The purposes of CAP are—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HED377D96F50F48D7BA44471080EB3F27"><enum>(1)</enum><text display-inline="yes-display-inline">to reduce the need for households described in subsection (a) to have in-person interviews with State offices administering the supplemental nutrition assistance program; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HEBDDB2B4F63B481BB55FFC7EC485A060"><enum>(2)</enum><text display-inline="yes-display-inline">to increase participation in the supplemental nutrition assistance program by simplifying the application process for that program through increased automation and simplified calculation of benefits.</text></paragraph></subsection>
<subsection id="HE2ED3BDBA90C4C05AF9159002AB3846F"><enum>(c)</enum><header>CAP models</header><text>The Secretary, in coordination with the Commissioner of the Social Security Administration, shall offer, at a minimum, each of the following models for States to implement CAP:</text> <paragraph id="H04AB2F9611B64EA691F92BB613BEE076"><enum>(1)</enum><header>Standard model</header> <subparagraph commented="no" display-inline="no-display-inline" id="H74EF876C9070478F8754D1F52FE0C7A7"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Under the standard model, the Commissioner of the Social Security Administration and the State agency administering the supplemental nutrition assistance program shall coordinate—</text>
<clause commented="no" display-inline="no-display-inline" id="HA4D48F23E16A47ABBDAFEC56E625BF78"><enum>(i)</enum><text display-inline="yes-display-inline">to develop a simplified joint application process for the supplemental nutrition assistance program that uses standardized benefit amounts or standardized shelter expenses, in accordance with this paragraph; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H29219F8BF1974AB8832B274ADC68370F"><enum>(ii)</enum><text display-inline="yes-display-inline">to conduct outreach to adult members receiving supplemental security income under title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>) that are not receiving benefits under the supplemental nutrition assistance program.</text></clause></subparagraph>
<subparagraph id="H112A5781FF6946178CFE74ABF93C0385"><enum>(B)</enum><header>Standardized benefit amounts</header>
<clause commented="no" display-inline="no-display-inline" id="H93B41C1CB45740B385210375B2990125"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Under the standardized model described in subparagraph (A), applicants shall receive a standardized or automated benefit level under the supplemental nutrition assistance program based on the shelter expenses and other income of the applicants.</text></clause> <clause id="H956884EF4FFE40409408CE19E1B01842"><enum>(ii)</enum><header>Minimum standardized benefit levels</header><text>At a minimum, there shall be 2 standardized benefit levels under clause (i), including, as determined by the State—</text>
<subclause commented="no" display-inline="no-display-inline" id="H80E2A98BA17946DB810D4970946F8202"><enum>(I)</enum><text display-inline="yes-display-inline">a level for participants with low shelter expenses; and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HC737CC2FA21446058894D09C8F982DEB"><enum>(II)</enum><text display-inline="yes-display-inline">a level for participants with high shelter expenses.</text></subclause></clause>
<clause id="H415C1515C88E470395C66D8CF7DEF586"><enum>(iii)</enum><header>Comparable amount</header><text>A State shall ensure that the amount provided under a standardized benefit level under clause (i) is comparable to an amount that a participant would otherwise receive under the supplemental nutrition assistance program.</text></clause> <clause id="HCF9083F8C6524C0AA26BD5B66A3BB224"><enum>(iv)</enum><header>Referral</header><text>A State shall refer a household described in subsection (a) to the supplemental nutrition assistance program instead of enrolling that household in CAP if the standardized amount that the household would receive under CAP would be significantly less than the amount of benefits that the household would receive under the supplemental nutrition assistance program.</text></clause></subparagraph>
<subparagraph id="H7654C586C55B4D6A94AB16DD56E27F4F"><enum>(C)</enum><header>Standardized shelter expenses</header><text>In computing an excess shelter expense deduction under section 5(e)(6), a State agency may use a standard utility allowance in accordance with regulations promulgated by the Secretary.</text></subparagraph></paragraph> <paragraph id="H7D42FDF1D1334CA9AD3C48755F7F3EE3"><enum>(2)</enum><header>Modified model</header><text>Under the modified model, a State agency administering the supplemental nutrition assistance program shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H5478B1B515CA4C11A8A8BEA7351FDCE1"><enum>(A)</enum><text display-inline="yes-display-inline">conduct outreach to prospective participants in the supplemental nutrition assistance program using information from the Social Security Administration to identify households described in subsection (a) that are not participants in the supplemental nutrition assistance program; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H9044785305E649C99120B95A964614CB"><enum>(B)</enum><text display-inline="yes-display-inline">send to those households simplified application forms for the supplemental nutrition assistance program.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="H6576584843B341E98CEF66552F98E47B"><enum>4.</enum><header>Enrollment and outreach pilot program for older adults, kinship families, and adults with disabilities</header><text display-inline="no-display-inline">The Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) (as amended by section 3(c)) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HCA4AFE786E174A0196325030A12D56A4"> <section id="H5DCE9B4440FD449CB13C134CD04CE40C"><enum>33.</enum><header>Enrollment and outreach pilot program for older adults, kinship families, and adults with disabilities</header> <subsection id="H47373870E26044A4B5C7DD2FD483F88E"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph commented="no" id="H3F6EA4C5068A4D688EEB35BBC0F536A5"><enum>(1)</enum><header>Disability</header><text>The term <quote>disability</quote> has the meaning given the term in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text></paragraph> <paragraph id="H90552EC2C8BD40CD80FC8ACD8C9D1273"><enum>(2)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means—</text>
<subparagraph id="H86E39AABA32D42748B7E7F4E70B24C06"><enum>(A)</enum><text>a State or local government agency;</text></subparagraph> <subparagraph id="H0BAA2C5512BA49E5B0CC2E806EFEA4B9"><enum>(B)</enum><text>an Indian tribe or Tribal organization;</text></subparagraph>
<subparagraph id="H51EB2080D9F148F88F52F1223A740B51"><enum>(C)</enum><text>a nonprofit organization, including a public or nonprofit provider of services;</text></subparagraph> <subparagraph id="HD2274C8B55724934A62CE5AE9AA49074"><enum>(D)</enum><text>a community-based organization; and</text></subparagraph>
<subparagraph id="HBEB128F2FDF84E758224F9FCF80E74A8"><enum>(E)</enum><text>an educational provider.</text></subparagraph></paragraph> <paragraph commented="no" id="H66A4E62A0A4E448985ECEA3E9D82E2E2"><enum>(3)</enum><header>Kinship family</header><text>The term <quote>kinship family</quote> means a family in which a child resides with, and is being raised by, a grandparent, another extended family member, or an adult with whom the child has a close family-like relationship, such as a godparent or a close family friend.</text></paragraph>
<paragraph commented="no" id="H94A09F2478E040F3A34A259AA1BCC532"><enum>(4)</enum><header>Older adult</header><text>The term <quote>older adult</quote> has the meaning given the term <quote>older individual</quote> in section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>).</text></paragraph> <paragraph commented="no" id="HD882152809BB4E83B04EA6823F65AA0B"><enum>(5)</enum><header>Pilot program</header><text>The term <quote>pilot program</quote> means the Enrollment and Outreach Pilot Program for Older Adults, Kinship Families, and Adults with Disabilities established under subsection (b).</text></paragraph></subsection>
<subsection commented="no" id="HDE4F018AE67C4AC28161EDBF120243EB"><enum>(b)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this section, the Secretary shall establish a pilot program, to be known as the <quote>Enrollment and Outreach Pilot Program for Older Adults, Kinship Families, and Adults with Disabilities</quote>, under which the Secretary shall award grants to eligible entities—</text> <paragraph commented="no" id="H3E075A84E4BC4E48817B57353936BD86"><enum>(1)</enum><text>to raise awareness among older adults, kinship families, and adults with disabilities of the availability, eligibility requirements, application procedures, and benefits of the supplemental nutrition assistance program; and</text></paragraph>
<paragraph commented="no" id="H3C53C5805F7E446F8355A50B0CE90185"><enum>(2)</enum><text>to support older adults, kinship families, and adults with disabilities in enrolling in the supplemental nutrition assistance program.</text></paragraph></subsection> <subsection commented="no" id="H5D8D3A64723E41E1AA14EA77E16543F6"><enum>(c)</enum><header>Priority</header><text>In awarding grants under the pilot program, the Secretary shall give priority to—</text>
<paragraph commented="no" id="H027D34EF3B8946B7BC86CE4E2B1DDE1A"><enum>(1)</enum><text>eligible entities that—</text> <subparagraph id="H1A0B7754548641D9B9E77E50230BCD26"><enum>(A)</enum><text>provide services to older adults or adults with disabilities;</text></subparagraph>
<subparagraph id="H821D376B766046829FCE03B2C1FF685A"><enum>(B)</enum><text>provide services to kinship families, including kinship navigator programs;</text></subparagraph> <subparagraph id="HBB24F8A7BB1C402AA1CC0B49D5423623"><enum>(C)</enum><text>have experience implementing programs that receive funding under the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3001">42 U.S.C. 3001 et seq.</external-xref>);</text></subparagraph>
<subparagraph id="HD0C3A05087A04ABB84290D9C66AEA55F"><enum>(D)</enum><text>have experience implementing programs administered by the Food and Nutrition Service; or</text></subparagraph> <subparagraph id="H6C844FA3A8CD4965B51BC48F710D3867"><enum>(E)</enum><text>receive, plan to receive, or demonstrate an ability to partner with a program that receives, funding under—</text>
<clause commented="no" display-inline="no-display-inline" id="HAA2D1BFA97634DBCB1C7AB1E5BE7A2F6"><enum>(i)</enum><text display-inline="yes-display-inline">the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3001">42 U.S.C. 3001 et seq.</external-xref>);</text></clause> <clause commented="no" display-inline="no-display-inline" id="H0D716927560F46709F65FB6F8D151243"><enum>(ii)</enum><text display-inline="yes-display-inline">the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>); or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H4A889C41B95B4E0BB30BA9F5DB6288FA"><enum>(iii)</enum><text display-inline="yes-display-inline">1 or more nutrition programs administered by the Secretary; and</text></clause></subparagraph></paragraph> <paragraph id="H920C82C92EA14F28B59B8F0C4418A3F8"><enum>(2)</enum><text>projects that will—</text>
<subparagraph id="H5168B31EB2FC4AC1A801C1B7B75C415F"><enum>(A)</enum><text>serve communities with high rates of food insecurity, malnutrition, or low food access;</text></subparagraph> <subparagraph id="H6AB5186DA8A34DA0A65F7293CC2EAAB5"><enum>(B)</enum><text>serve rural communities, indigenous communities, or communities of color;</text></subparagraph>
<subparagraph id="H4F65F6A22887444082DE551A417E9F65"><enum>(C)</enum><text>serve members of the lesbian, gay, bisexual, transgender, and queer community;</text></subparagraph> <subparagraph id="HB829ACB623FC436DA576087CF65DDCDE"><enum>(D)</enum><text>serve adults with limited English proficiency;</text></subparagraph>
<subparagraph id="HDC99E3FD5D5D4041AC5E7E0C67691F49"><enum>(E)</enum><text>serve veterans;</text></subparagraph> <subparagraph id="HEC840040CE574717BE4D84BA0E45DE38"><enum>(F)</enum><text>serve residents in federally subsidized housing, including federally subsidized housing units for older adults and adults with disabilities;</text></subparagraph>
<subparagraph commented="no" id="HC924D353836D443E98DED6EE3BACED1F"><enum>(G)</enum><text>serve residents living in housing serving kinship families; and</text></subparagraph> <subparagraph id="H58759C9F56F04889AA50889F9CBACE0E"><enum>(H)</enum><text>incorporate nutrition education activities that promote healthy eating and active lifestyles.</text></subparagraph></paragraph></subsection>
<subsection commented="no" id="H54170F54CF514D67A97072B36DEDDB09"><enum>(d)</enum><header>Eligible activities</header><text>An eligible entity receiving a grant under the pilot program shall use the grant to carry out 1 or more of the following activities:</text> <paragraph id="H98E7A3B29ADC4E02B30FCDE996E7D0D7"><enum>(1)</enum><text>Application assistance, including—</text>
<subparagraph id="H2EAF4E468D064E9B930ED7DAA97BCF11"><enum>(A)</enum><text>eligibility prescreening;</text></subparagraph> <subparagraph id="H302C8BB17D1B4912AB67EEB1E8B3F3BA"><enum>(B)</enum><text>assistance in completing an application for the supplemental nutrition assistance program;</text></subparagraph>
<subparagraph id="H08CA4B8FE2664170982A3E9D8A2DAA59"><enum>(C)</enum><text>assistance in obtaining application verification documents;</text></subparagraph> <subparagraph id="H268611CFE95248D78CE214863EC69B1C"><enum>(D)</enum><text>medical expense deduction counseling; and</text></subparagraph>
<subparagraph id="H12D7A6B5035F41BCA4DCF9DF4B510BE3"><enum>(E)</enum><text>translation of materials and bilingual accommodation.</text></subparagraph></paragraph> <paragraph id="H921C7AB9B577475F8BBB74C30EF09F5D"><enum>(2)</enum><text>Tailored dissemination of information relating to the supplemental nutrition assistance program, including through—</text>
<subparagraph id="H986FD77868E44BC6A7EDAC302D26EA24"><enum>(A)</enum><text>community-based outreach workshops and events;</text></subparagraph> <subparagraph id="H44BE259172E449B0A8B138F42FED42B0"><enum>(B)</enum><text>a toll-free hotline to provide information about Federal, State, and local food resources;</text></subparagraph>
<subparagraph id="HA33965B764854DA592E16A02B019A13F"><enum>(C)</enum><text>informational websites and other social media sites; and</text></subparagraph> <subparagraph id="H5A62A560E83546AAB163AE8BA1E0C265"><enum>(D)</enum><text>printed or digital informational content.</text></subparagraph></paragraph>
<paragraph id="H95ECED4DB2D94DDB80AA74AFBB4389FE"><enum>(3)</enum><text>Transportation, including—</text> <subparagraph id="H91C4A2075BD84F18883155F67841F9C2"><enum>(A)</enum><text>transportation to or from a local office of the supplemental nutrition assistance program; and</text></subparagraph>
<subparagraph id="H82A091164D5F430B8E6AF04E58231750"><enum>(B)</enum><text>administration of vouchers or similar items for the transportation described in subparagraph (A).</text></subparagraph></paragraph> <paragraph id="H0724BD8ADE9244C5898B9A81C6A70DE7"><enum>(4)</enum><text>Identification, implementation, analysis, and dissemination of replicable and scalable models for increasing enrollment in the supplemental nutrition assistance program among older adults, kinship families, and adults with disabilities.</text></paragraph></subsection>
<subsection id="H621D9F922CA34C6BAC221225F7E8B5E6"><enum>(e)</enum><header>Grants</header>
<paragraph id="H51694A55BDBA439898C876C2AAF5F06F"><enum>(1)</enum><header>Maximum amount</header><text>A grant awarded under the pilot program to an eligible entity for a fiscal year shall be not less than $50,000, but not more than $250,000.</text></paragraph> <paragraph id="H6B80E0944DD447098361CA40571F5369"><enum>(2)</enum><header>Duration</header><text>An eligible entity may be awarded a grant under the pilot program for not more than 5 years.</text></paragraph></subsection>
<subsection id="HBC5157B3B48A4C1CB4424EEBD93B1EC2"><enum>(f)</enum><header>Evaluation</header><text>Not later than 2 years after the date of establishment of the pilot program, the Secretary shall conduct an evaluation of the pilot program.</text></subsection> <subsection id="HB04D61D1379D4539A3436B618B3A6CCE"><enum>(g)</enum><header>Funding</header> <paragraph id="H22F0673AA2624D95A17871C456E80A99"><enum>(1)</enum><header>In general</header><text>In addition to amounts otherwise available, there is appropriated, out of any funds in the Treasury not otherwise appropriated, $12,250,000, to remain available until expended, to carry out the pilot program, of which not more than $250,000 shall be used to carry out the evaluation under subsection (f).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HBF98676488C44DCD81965666FE3A701F"><enum>(2)</enum><header>Administrative costs</header><text>Of the amounts made available under paragraph (1) (excluding the amount made available to carry out subsection (f)), not more than 3 percent may be used by the Secretary for administrative costs.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H40BDA5F41E90428DAE812F5C978EA874"><enum>5.</enum><header>Food delivery under supplemental nutrition assistance program</header><text display-inline="no-display-inline">The Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) (as amended by section 4) is amended by adding at the end the following:</text>

<section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H2945469204D94E4D9B0497A24459D5ED"><enum>34.</enum><header>Food delivery</header>
<subsection id="HADA78E3703E3459DADAF8A4DC4F42351"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="H5CE7AE0AEDD4403A9043B6C284B79F47"><enum>(1)</enum><header>Covered retail food store</header><text>The term <quote>covered retail food store</quote> means a retail food store, a public or private nonprofit meal delivery service, or a public or nonprofit meal delivery provider participating in the supplemental nutrition assistance program that is unable to cover the cost of food delivery for participants of that program.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HAED73D64E67A4A888A32CFEF8469C1BE"><enum>(2)</enum><header display-inline="yes-display-inline">Employee</header><text>The term <term>employee</term> has the meaning given the term in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>).</text></paragraph></subsection> <subsection id="H19E79412022C47F5BBB9A06145A62197"><enum>(b)</enum><header>Program modifications</header> <paragraph id="H1FCFA09A5C4F46A7A6D420B1777D0D1B"><enum>(1)</enum><header>In general</header><text>In carrying out the supplemental nutrition assistance program, the Secretary shall—</text>
<subparagraph id="HB2CC16865B574339A42268C42B65F96E"><enum>(A)</enum><text>notify retail food stores participating in the supplemental nutrition assistance program of existing opportunities through which the retail food stores can deliver food to program participants, including by—</text> <clause id="H04514C38C2A2420EA2CEDA5B81A608A9"><enum>(i)</enum><text>allowing an EBT card to be swiped on delivery of food to the home (with a mobile device); and</text></clause>
<clause id="H31AA134423BC41CABADC60FC058E1B5A"><enum>(ii)</enum><text>preparing food for pick-up;</text></clause></subparagraph> <subparagraph id="HF9267EA0CA4B4CDBBB47DA628DCBD0FD"><enum>(B)</enum><text>authorize public-private partnerships between the Department of Agriculture, retail food stores participating in the supplemental nutrition assistance program, and community-based organizations to provide free or low-cost food delivery, including through the use of private funds;</text></subparagraph>
<subparagraph id="H423140AAB16841ABB1094164E77BB405"><enum>(C)</enum><text>in the case of a covered retail food store, use funds made available under subparagraph (E) of paragraph (3) to provide, in accordance with that paragraph, free grocery delivery for program participants who are older adults or adults with disabilities (as those terms are defined in section 33(a)) who are unable to shop for food or lack safe and accessible transportation options to the covered retail food store; and</text></subparagraph> <subparagraph id="HAF3F352E8DC0405FBE7C9671A48460D6"><enum>(D)</enum><text>require each State to submit to the Secretary a State plan that describes how the State will—</text>
<clause id="HD4273014006F415E9C1FDCBDA1DC80C0"><enum>(i)</enum><text>work with retail food stores participating in the supplemental nutrition assistance program and other community-based partners to establish a process for food delivery for program participants;</text></clause> <clause commented="no" id="H1B1EB4B01BEE4ECABE07BBFB4C485632"><enum>(ii)</enum><text>administer the reimbursements described in paragraph (3), including timing, eligibility, and distribution processes; and</text></clause>
<clause commented="no" id="H019EC2B1271B436A933910F4D480D6FC"><enum>(iii)</enum><text>ensure that retail food stores participating in the supplemental nutrition assistance program that are reimbursed for delivery costs under paragraph (3) adhere to the requirements described in subparagraph (B) of that paragraph.</text></clause></subparagraph></paragraph> <paragraph id="H4F2F853B814B40FF98E0F23D7404C8B2"><enum>(2)</enum><header>State plans</header><text>Not later than 10 days after the date on which the Secretary receives a State plan under paragraph (1)(D), the Secretary shall—</text>
<subparagraph id="H244AA722233D4DF0A8B69AC350DE5A05"><enum>(A)</enum><text>approve or deny the State plan; and</text></subparagraph> <subparagraph id="HC5DDDBD9354B4A8E92A5B099812C7FC0"><enum>(B)</enum><text>make publicly available on the website of the Department of Agriculture—</text>
<clause id="HB2843FFBE942485C97F34CFF6C06C4FD"><enum>(i)</enum><text>the State plan;</text></clause> <clause id="H9E9E8BBAB4434B78997227BC2E486A9F"><enum>(ii)</enum><text>the determination made under subparagraph (A) with respect to that plan; and</text></clause>
<clause id="HB44CAC8AC8FA46D2BF30346747D5D6AF"><enum>(iii)</enum><text>any guidance issued to the State with respect to that plan.</text></clause></subparagraph></paragraph> <paragraph id="H0D08263C223A4A178606778CF6F2AAEB"><enum>(3)</enum><header>Reimbursement of covered retail food stores</header> <subparagraph id="HE3879EE6DCC249E59F767FBF4E2711CB"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law (including sections 274.7(f) and 278.2(b) of title 7, Code of Federal Regulations (or successor regulations), and any other regulations), subject to the availability of funds, a State agency shall reimburse a covered retail food store for the cost of food delivery to participants described in paragraph (1)(C) if—</text>
<clause id="HFE6EC0E73E0B48229C9E5CF53CB16693"><enum>(i)</enum><text>the covered retail food store meets the requirements under subparagraph (B); and</text></clause> <clause id="HEDA8341C861D41A4812A7D80D155E13E"><enum>(ii)</enum><text>the majority of the number of food items delivered by the covered retail food store are eligible for redemption using benefits under the supplemental nutrition assistance program, regardless of whether the delivery includes nonfood items, subject to the condition that those nonfood items are of de minimis value.</text></clause></subparagraph>
<subparagraph id="H452EF36E75F442D79B764806886636A2"><enum>(B)</enum><header>Requirements</header><text>A covered retail food store may receive reimbursement for the cost of food delivery to participants described in paragraph (1)(C) if the following requirements are met:</text> <clause id="H543A43FB20454E0EAE778E827BDB0F6A"><enum>(i)</enum><text>Food delivery is performed by employees of the covered retail food store or employees of an entity contracted by the covered retail food store to perform deliveries.</text></clause>
<clause id="H441653E5CC6F406FA2D53FF2D974DED0"><enum>(ii)</enum><text>Before any employee described in clause (i) begins making food deliveries, that employee receives employer-provided health and safety training that reflects the most recent guidelines of the Centers for Disease Control and Prevention.</text></clause> <clause id="H4E9723E97EA341C79EFCD6BCC6CCA40E"><enum>(iii)</enum><text>All employees described in clause (i) performing deliveries are paid at a rate that is not less than the greater of—</text>
<subclause id="HB1BBA51100C34088AE70B752BB6F0227"><enum>(I)</enum><text>the minimum wage rate established under section 6(a)(1) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)(1)</external-xref>); and</text></subclause> <subclause id="HEBF1744B116E4C89BA085ACB388440CB"><enum>(II)</enum><text>the minimum wage rate established by the applicable State or locality in which the employee works.</text></subclause></clause>
<clause commented="no" display-inline="no-display-inline" id="HF0D2CFD6DA314DB4A585B36E508BF1F2">
                                    <enum>(iv)</enum>
 <text>The covered retail food store meets the size standard determined by the Small Business Administration for a supermarket or other grocery retailer or a convenience retailer under section 121.201 of title 13, Code of Federal Regulations (or a successor regulation).</text>
                                </clause>
<clause commented="no" display-inline="no-display-inline" id="H2B6CF302DCE84B15A879B7D577322954"><enum>(v)</enum><text>The covered retail food store does not—</text> <subclause commented="no" display-inline="no-display-inline" id="HA7285734A6CE42F59BB7396116D1707A"><enum>(I)</enum><text display-inline="yes-display-inline">charge the supplemental nutrition assistance program participant for delivery costs for which the covered retail food store will be reimbursed;</text></subclause>
<subclause commented="no" id="H5587F2FFA529453D84D8B4403E94CE65"><enum>(II)</enum><text>require minimum purchase thresholds in order to provide free delivery;</text></subclause> <subclause commented="no" id="HB2AED2A64E3F43F7A8DFEB0CC09CB4F7"><enum>(III)</enum><text>restrict delivery times to least-favorable windows for supplemental nutrition assistance program participants; or</text></subclause>
<subclause commented="no" id="H1201D4BBB8F741D5A8734E5C794D8168"><enum>(IV)</enum><text>charge surge pricing.</text></subclause></clause></subparagraph> <subparagraph id="H0F7EEE1E5D1244A4BE1A1D6F552B9152"><enum>(C)</enum><header>Reimbursable costs</header><text>Reimbursable costs under subparagraph (A) include costs associated with purchasing point-of-sale devices or receiving technical assistance relating to point-of-sale devices.</text></subparagraph>
<subparagraph id="H9598DF0B59474CF482E76CB722FADD85"><enum>(D)</enum><header>Maximum reimbursement per delivery</header><text>The maximum amount of reimbursement under subparagraph (A) for a food delivery fee shall be $10 per delivery, which may be adjusted by the Secretary for inflation.</text></subparagraph> <subparagraph id="HF513562205C2485E8C2FE389DC29B581"><enum>(E)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary $500,000,000 for fiscal year 2027, and each fiscal year thereafter, to remain available until expended, to cover the cost of food delivery described in paragraph (1)(C), to be distributed among States to fund reimbursements by States under subparagraph (A).</text></subparagraph></paragraph>
<paragraph id="H59063A7FCA56439B8D1D0D5DF6FAC26E"><enum>(4)</enum><header>Report</header><text>Not later than April 30, 2028, and April 30 of each year thereafter, the Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry and the Special Committee on Aging of the Senate, and the Committee on Agriculture of the House of Representatives, a report that describes, for the period covered by the report, as applicable—</text> <subparagraph id="HA7526C57CCB34B71B080477A61A98C99"><enum>(A)</enum><text>the number of supplemental nutrition assistance program participants using food delivery services, including the percentage of those participants that are older adults and adults with disabilities (as those terms are defined in section 33(a));</text></subparagraph>
<subparagraph id="HCB96DC07B94F4B36840A0667BBC1C49F"><enum>(B)</enum><text>the covered retail food stores that were reimbursed under paragraph (3), including the amount of each reimbursement;</text></subparagraph> <subparagraph id="H1304E479AC404C7FA43F062070E0A62E"><enum>(C)</enum><text>any complications or difficulties experienced by States in administering reimbursements under paragraph (3); and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H4214AEB98547442BA102070237C017AB"><enum>(D)</enum><text>recommendations or best practices to assist States in implementing food delivery programs.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HFFF14928BAF34A1BB8B3A622AB9E3C56"><enum>6.</enum><header>Commodity supplemental food program</header> <subsection id="H10693356A531438CAAF7813852375B26"><enum>(a)</enum><header>Funds</header><text display-inline="yes-display-inline">Section 4 of the Agriculture and Consumer Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c">7 U.S.C. 612c</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/93/86">Public Law 93–86</external-xref>) is amended—</text>
<paragraph id="H4595F52ACCA44EAC8A57D7D4A3CE3ADC"><enum>(1)</enum><text>in subsection (a), in the first sentence, by striking <quote>2023</quote> and inserting <quote>2031</quote>; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H277D80C4E56A42368B2C5E18EE61D9FB"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

<paragraph id="H4AFD1AC3CC584AC6886E120623BF2491"><enum>(1)</enum><text>by striking <quote>2023</quote> each place it appears and inserting <quote>2031</quote>;</text></paragraph> <paragraph id="HD485B6A1ACFC4FFC92A0801AA9351676"><enum>(2)</enum><text>in subsection (g)—</text>

<paragraph commented="no" display-inline="no-display-inline" id="H9D3CCAF1645440F78381714656F16086"><enum>(2)</enum><header>Income eligibility</header><text>For purposes of paragraph (1), a low-income individual described in subparagraph (A) or (B) of that paragraph shall have a gross income level that is less than 185 percent of the Federal poverty line.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HABEB217BC6B24DE4B198C1E20DD31C23"><enum>(D)</enum><text>in subparagraph (B) of paragraph (3) (as so redesignated), in the matter preceding clause (i), by striking <quote>of—</quote> and all that follows through the period at the end of clause (ii) and inserting <quote>of 36 months.</quote>; and</text></subparagraph></paragraph>

<subparagraph commented="no" id="HD59EC28D3D5F4C39840A7A058B614DBE"><enum>(B)</enum><text>by striking <quote>to each elderly participant in, or applicant for, the commodity supplemental food program for the elderly</quote> and inserting <quote>to each participant in, or applicant for, such a program</quote>.</text></subparagraph></paragraph></subsection></section> <section id="H51F8565448BD4350B9FC9AD35C0B797B"><enum>7.</enum><header>Seniors farmers' market nutrition program</header> <subsection commented="no" display-inline="no-display-inline" id="H09AE15115EF14BFE8CEAD7EF22EE0441"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 4402 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/3007">7 U.S.C. 3007</external-xref>) is amended—</text>
<paragraph id="HD73B6951FA49401896555365F4049D36"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="H4445FD73FDC84E89BFED6B3490A50E71"><enum>(A)</enum><text>by striking <quote>Of the funds</quote> and inserting the following:</text>

<subparagraph id="H8A83C1A0CBB546C3A17499A259DBB6EA"><enum>(C)</enum><text>not less than $100,000,000 for each of fiscal years 2029 through 2031.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H693B0DE27D174CF79AAAD3474D9D783A"><enum>(2)</enum><text>in subsection (b)(1), by inserting <quote>and adults with disabilities (as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>))</quote> before the semicolon at the end;</text></paragraph>

<paragraph commented="no" id="H3C74062648AC4C1B89A0BC27219E5DE2"><enum>(2)</enum><text>the maximum individual benefit shall be $80.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="HFAE0059FD7974CA3AB2257BD0E8A44C8"><enum>(d)</enum><header>Certification period</header><text>The certification period for participants in the seniors farmers' market nutrition program shall be 36 months.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HE77E11EBEB094C5CA2B1E447097D8458"><enum>(e)</enum><header>Modernization grants</header>
<paragraph commented="no" display-inline="no-display-inline" id="H98650FBD006D4B8097BC63443478F717"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the <short-title>Senior Hunger Prevention Act of 2026</short-title>, the Secretary shall establish a grant program under which the Secretary shall award grants to State agencies, including Tribal organizations (as defined in section 3 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012</external-xref>)) and territories, that administer the senior farmers’ market nutrition program to modernize program operations, including—</text> <subparagraph id="H53453D36A49846CF889AF9BA362D1A13"><enum>(A)</enum><text>by transitioning from paper-based coupons to an electronic transaction technology, such as a web-based service or installable software; and</text></subparagraph>
<subparagraph id="HDABCD8DCB3DD47EE9FD9F62ED5259BA0"><enum>(B)</enum><text>by increasing benefit use at farmers’ markets.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H91E26F0B185545D8A6EB40A57BC7BDCA"><enum>(2)</enum><header>Grant amount</header> <subparagraph commented="no" display-inline="no-display-inline" id="HFA3E87DA8BE44DA594897FE8FBDDB423"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The amount of a grant awarded under paragraph (1) shall not exceed $350,000.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H533835A8809C4BBB94CE0E2C6B1C67F7"><enum>(B)</enum><header>Supplies</header><text>Not more than $25,000 may be used to carry out subparagraph (F) of paragraph (3).</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H6BBFE2693D6B466083BAAB94870BB416"><enum>(3)</enum><header>Eligible expenses</header><text display-inline="yes-display-inline">An entity receiving a grant under paragraph (1) may use the grant for—</text>
<subparagraph id="H88A9C1870C6A44C9BB4F732D1848E056"><enum>(A)</enum><text>costs associated with the procurement of electronic transaction technology;</text></subparagraph> <subparagraph id="H9018E8A421E14329B8298D5BBEA5F589"><enum>(B)</enum><text>planning costs, including personnel costs, relating to electronic transaction technology procurement and implementation;</text></subparagraph>
<subparagraph id="H30FE09137CAB453F85CE1FE1DED4EC19"><enum>(C)</enum><text>costs associated with evaluating the impact of transitioning from coupon-based operations to an electronic transaction technology;</text></subparagraph> <subparagraph id="H77263371A5B2442F92884A899810C6EE"><enum>(D)</enum><text>training, outreach, and promotional material costs, including the costs associated with translating materials;</text></subparagraph>
<subparagraph id="H7E3712FD61D34B95B95BAF5858F50FB7"><enum>(E)</enum><text>maintenance and operation of electronic transaction technology procured using the grant during the period of performance of the grant;</text></subparagraph> <subparagraph id="H92865B810E694A449A8234387BAA59C3"><enum>(F)</enum><text>the purchase of supplies needed to perform electronic transactions onsite; and</text></subparagraph>
<subparagraph id="HDE4DB806E7FD49DBBB6B6979BDC89C2A"><enum>(G)</enum><text>additional costs associated with modernizing program operations, as determined appropriate by the Secretary.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H6DFC379AFA1A408DB9C92AE220B55163"><enum>(4)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">Each entity that receives a grant under paragraph (1) shall submit to the Secretary and the Administrator of the Food and Nutrition Service quarterly performance progress reports on the use of the grant.</text></paragraph>
<paragraph commented="no" id="H50EDF232D6994BBE8FAB1ACB5EACFCAA"><enum>(5)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this subsection $15,000,000 for fiscal year 2027 and each fiscal year thereafter.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HBE7F53843EE94C418B0F4B021C98A57B"><enum>(b)</enum><header>Income guidelines</header><text>The Secretary of Agriculture shall revise section 249.6(a)(3) of title 7, Code of Federal Regulations (or a successor regulation), to ensure that income eligibility under that section is at or below 200 percent of the poverty income guidelines.</text></subsection></section>
<section id="HCD1DCF95056F472B9EEE94494E6D1FD8"><enum>8.</enum><header>Infrastructure funding for farmers' markets; local procurement pilot program</header><text display-inline="no-display-inline">The Farm Security and Rural Investment Act of 2002 is amended by inserting after section 4402 (<external-xref legal-doc="usc" parsable-cite="usc/7/3007">7 U.S.C. 3007</external-xref>) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H33834551F79D4AD98C55F838D8A370CB"> <section id="HE933BC98255F4DC99902F9EB2A7DF9B1"><enum>4403.</enum><header>Infrastructure funding for farmers' markets; local procurement pilot program</header> <subsection id="HA5839E331B5B4AF5B83351DBC321DC24"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph commented="no" id="HEE972DE2CC58441EBBDFA645E2C3596E"><enum>(1)</enum><header>Disability</header><text>The term <quote>disability</quote> has the meaning given the term in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text></paragraph> <paragraph commented="no" id="H798623589516474984175B3DA5F0D896"><enum>(2)</enum><header>Financial assistance</header><text>The term <quote>financial assistance</quote> means—</text>
<subparagraph commented="no" id="HC089927842A4464DA2BE75869841EF3C"><enum>(A)</enum><text>a loan;</text></subparagraph> <subparagraph commented="no" id="HB7E8768B21C84EA594A35093F448B45B"><enum>(B)</enum><text>a loan guarantee; and</text></subparagraph>
<subparagraph commented="no" id="HDAA52BD486F24AB6BB7B4D127D714228"><enum>(C)</enum><text>a grant.</text></subparagraph></paragraph> <paragraph commented="no" id="HC40140378C9C46E38D79D8EDCFE2436B"><enum>(3)</enum><header>Older adult</header><text>The term <quote>older adult</quote> has the meaning given the term <quote>older individual</quote> in section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>).</text></paragraph>
<paragraph commented="no" id="H30E0372DF3CE43129518DCF00F82102F"><enum>(4)</enum><header>Program</header><text>The term <quote>program</quote> means the program established under subsection (b)(2).</text></paragraph> <paragraph commented="no" id="HE90EF72403BA4EBCAF391B9241CFD8FA"><enum>(5)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture.</text></paragraph></subsection>
<subsection id="HD777F07B93264A89A121947524CBE218"><enum>(b)</enum><header>Infrastructure funding for farmers' markets</header>
<paragraph commented="no" display-inline="no-display-inline" id="H0A4F3D35145940BCB01D8955D1E81EA8"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of eligible entity</header><text>In this subsection, the term <quote>eligible entity</quote> means an entity that—</text> <subparagraph id="H7649EDAF591B46FD92CC459CD33711B7"><enum>(A)</enum><text>is—</text>
<clause id="H96540712984D46898B8AEA1397140E7D"><enum>(i)</enum><text>an agricultural cooperative or other agricultural business entity or a producer network or association, including a community-supported agriculture network or association;</text></clause> <clause id="HD0919BB9741146B5A3C1C04DDAFAA5AE"><enum>(ii)</enum><text>a local or Tribal government;</text></clause>
<clause id="HA2265D20873D4313BC76BF5B4957D7EB"><enum>(iii)</enum><text>a nonprofit corporation;</text></clause> <clause id="H86F39C1CE96C40E6B46CBBDD32B80AA6"><enum>(iv)</enum><text>a public benefit corporation;</text></clause>
<clause id="HA4A4F920DFB049E08F47F872C0737113"><enum>(v)</enum><text>an economic development corporation;</text></clause> <clause id="HF5974A0848B044738676A48403E74EED"><enum>(vi)</enum><text>a regional farmers' market authority;</text></clause>
<clause id="H740910D717B84F1E8552913D316FB507"><enum>(vii)</enum><text>a food council; or</text></clause> <clause id="H5018D3D20FC64BD59A9613E6BD938941"><enum>(viii)</enum><text>any other entity as determined by the Secretary; and</text></clause></subparagraph>
<subparagraph commented="no" id="HB1D2EAAF34B14E64BC2A913060A062FA"><enum>(B)</enum><text>can demonstrate financial need, as determined by the Secretary.</text></subparagraph></paragraph> <paragraph id="HB583A53FA0B9450A887A882FC6CE0E2A"><enum>(2)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of the <short-title>Senior Hunger Prevention Act of 2026</short-title>, the Secretary shall establish a program under which the Secretary shall provide financial assistance to eligible entities for—</text>
<subparagraph id="H0B4AAC404C2F4307896277BEB08C6A7D"><enum>(A)</enum><text>the establishment of new farmers' markets;</text></subparagraph> <subparagraph id="HD4BCC65051A048D2963FFD9297A8FD3F"><enum>(B)</enum><text>the improvement or rehabilitation of existing farmers' markets, including by adding or improving payment technologies used in those farmers' markets; and</text></subparagraph>
<subparagraph id="H6A99385982314B99B323C76774CDE1B7"><enum>(C)</enum><text>the expansion of community supported agriculture to serve older adults and adults with disabilities.</text></subparagraph></paragraph> <paragraph id="HAFC587317A184F41A73E65713105428A"><enum>(3)</enum><header>Requirements</header><text>An eligible entity that receives financial assistance under the program shall be required—</text>
<subparagraph id="H9635232201014CD7A15EF06103925A4E"><enum>(A)</enum><text>to host farmers’ markets or related activities at locations accessible—</text> <clause id="HCC5A3BF98F9A4F6096A2F13D39EEE00C"><enum>(i)</enum><text>by public transportation;</text></clause>
<clause id="H27E2A96694304E9EA39CB9A572D19C91"><enum>(ii)</enum><text>by paratransit; or</text></clause> <clause id="H9B765F0CCD134F16B91AA738C616B4EF"><enum>(iii)</enum><text>through transportation services provided under the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3001">42 U.S.C. 3001 et seq.</external-xref>); and</text></clause></subparagraph>
<subparagraph id="HEFBA17D25A214782B006F20467EA1ED1"><enum>(B)</enum><text>to reserve not less than 50 percent of the floor area of an applicable farmers' market for the sale of products that are produced locally, as determined by the Secretary, by—</text> <clause id="H4269D5B21FD944EB8E1310E44502B80A"><enum>(i)</enum><text>farmers, ranchers, or aquaculture, mariculture, or fisheries operators; or</text></clause>
<clause id="HC3369B03312F4ED9A5626D7A6524B3A6"><enum>(ii)</enum><text>associations of farmers, ranchers, or aquaculture, mariculture, or fisheries operators.</text></clause></subparagraph></paragraph> <paragraph id="HCCCD5DF76C0D409390DDE39D42D92900"><enum>(4)</enum><header>Cost sharing</header><text>The non-Federal share of a grant provided under the program shall be 20 percent of the amount of the grant, which may comprise transportation costs, volunteer contributions, and in-kind staffing.</text></paragraph>
<paragraph id="H66A66426AF574F17B22D6991BB9C7E75"><enum>(5)</enum><header>Funding</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out the program $50,000,000 for each of fiscal years 2027 through 2031.</text></paragraph></subsection> <subsection id="H65C4C154B7264534B107619151D4C0E2"><enum>(c)</enum><header>Local procurement pilot program</header> <paragraph id="HE68149F42DC84FC19BCB3BEF3DA8263E"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H94B04A9EFF4943878947D7A1FFB5E64B"><enum>(A)</enum><header display-inline="yes-display-inline">Agricultural producer</header><text>The term <term>agricultural producer</term> includes—</text> <clause id="H02F59172B94E479C8741FFEE83CC969E"><enum>(i)</enum><text>an agricultural cooperative;</text></clause>
<clause id="H7C50D508B65B477393EB4EFFDA42C6D0"><enum>(ii)</enum><text>a person engaged in farming, ranching, or aquaculture;</text></clause> <clause id="H03E33F95F91645EA91C4E995CEECE439"><enum>(iii)</enum><text>a person engaged in the packing of a food product; and</text></clause>
<clause id="H5299F1A1A8F84E27864D28883A0606B1"><enum>(iv)</enum><text>a person engaged in the minimal processing of a food product, as determined by the Secretary.</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H9BF42B1AEBEA410C89197EA3F0055D84"><enum>(B)</enum><header display-inline="yes-display-inline">Eligible entity</header><text>The term <quote>eligible entity</quote> means an entity that—</text>
<clause commented="no" display-inline="no-display-inline" id="HD825F4D470FB499AB567A4DC1E007DA1"><enum>(i)</enum>
<subclause commented="no" display-inline="yes-display-inline" id="H700218D12B7847B4A59CAFF3E348EEBA"><enum>(I)</enum><text display-inline="yes-display-inline">coordinates enrollment in, and distribution of, benefits under the seniors farmers’ market nutrition program; or</text></subclause> <subclause commented="no" display-inline="no-display-inline" indent="up1" id="H13F2D4927475468E8D55E3C87CE13AD9"><enum>(II)</enum><text>demonstrates an ability to partner with an entity that coordinates enrollment in and distribution of benefits under the seniors farmers’ market nutrition program; and</text></subclause></clause>
<clause commented="no" display-inline="no-display-inline" id="H89DEFDC9E8A6455CB5194DCB8DC1FC60"><enum>(ii)</enum><text>is—</text> <subclause commented="no" display-inline="no-display-inline" id="H3C993AC7E40B40CC90A816D780F96C53"><enum>(I)</enum><text display-inline="yes-display-inline">a public or nonprofit provider of nutrition services or support to older adults or adults with disabilities, including—</text>
<item commented="no" display-inline="no-display-inline" id="HA5002CFE8D5D4430988E573413C18C88"><enum>(aa)</enum><text display-inline="yes-display-inline">an Aging and Disability Resource Center (as defined in section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>));</text></item> <item commented="no" display-inline="no-display-inline" id="HDC8D1452831F4372900AF197354570C4"><enum>(bb)</enum><text display-inline="yes-display-inline">an area agency on aging (as defined in that section);</text></item>
<item commented="no" display-inline="no-display-inline" id="H26F21CF77C57457EAB08F3A789BFEF97"><enum>(cc)</enum><text display-inline="yes-display-inline">a State health insurance program;</text></item> <item commented="no" display-inline="no-display-inline" id="H7EDB5EA3CC5A44BB9F9F765060E6CADC"><enum>(dd)</enum><text display-inline="yes-display-inline">a State unit on aging;</text></item>
<item commented="no" display-inline="no-display-inline" id="HB14E3045457046E799682B00D5BD81FF"><enum>(ee)</enum><text display-inline="yes-display-inline">a center for independent living;</text></item> <item commented="no" display-inline="no-display-inline" id="H2BA7BB1F35E349EE858C53A4DD8F53CF"><enum>(ff)</enum><text display-inline="yes-display-inline">a community health center;</text></item>
<item commented="no" display-inline="no-display-inline" id="H7D1996DC78944E149287A7E50DBD1845"><enum>(gg)</enum><text display-inline="yes-display-inline">a multipurpose senior center; and</text></item> <item commented="no" display-inline="no-display-inline" id="HE95B7BCF6D7A47AC8320E9CA167E262A"><enum>(hh)</enum><text>federally subsidized housing, including federally subsidized housing units for older adults and adults with disabilities; or</text></item></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H1D2AC1E1B0844EBDAD23C058784E1777"><enum>(II)</enum><text display-inline="yes-display-inline">a local, State, or national parks and recreation department.</text></subclause></clause></subparagraph></paragraph> <paragraph id="HEC06BD0C767D4EC880BB711C7BDE2345"><enum>(2)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of the <short-title>Senior Hunger Prevention Act of 2026</short-title>, the Secretary shall establish a pilot program under which the Secretary shall award grants to eligible entities to contract with agricultural producers that will grow produce to support the local procurement and contracting of produce for eligible entities.</text></paragraph>
<paragraph id="HD8177D612BDB4EEA8D1B8A62BAD727D1"><enum>(3)</enum><header>Priority</header><text>In awarding grants under paragraph (2), the Secretary shall give priority to an eligible entity that will use the grant funds to benefit underserved communities, including communities that are located in areas of concentrated poverty with limited access to fresh locally or regionally grown food.</text></paragraph> <paragraph id="HB16F39C4A48341B29F228166219A4C7C"><enum>(4)</enum><header>Methods</header><text>Under a contract described in paragraph (2), an agricultural producer may grow produce through traditional or controlled environmental agriculture farming.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H986E7373D8334320BE669B7BDC197D76"><enum>(5)</enum><header display-inline="yes-display-inline">Evaluation</header><text display-inline="yes-display-inline">Not later than 2 years after the date of establishment of the pilot program under paragraph (2), the Secretary shall conduct an evaluation of the pilot program.</text></paragraph> <paragraph id="H3DEDD38DFD024AD4A3153C231481207E"><enum>(6)</enum><header>Funding</header> <subparagraph id="H65191A8E0E9E445792FCFD0242D04D7B"><enum>(A)</enum><header>In general</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this subsection $350,000 for each of fiscal years 2027 through 2031.</text></subparagraph>
<subparagraph id="HFE8989CDB28B4DFB967754855E6EAF61"><enum>(B)</enum><header>Administrative costs</header><text>Of the amounts made available under subparagraph (A) for a fiscal year, not more than 5 percent may be used for administrative costs.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H9538EA0FECDF40779D74F28DCFFD5EDD"><enum>(C)</enum><header>Evaluation</header><text>In addition to amounts made available under subparagraph (A), there is appropriated to the Secretary, out of any funds in the Treasury not otherwise appropriated, $25,000 to carry out paragraph (5).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
