<official-title display="yes">To amend the Immigration and Nationality Act to clarify that aliens who have been convicted of defrauding the United States Government or the unlawful receipt of public benefits are inadmissible and deportable.</official-title>

<section id="H8276565FDAB64C288182F5A861DDA103" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Deporting Fraudsters Act of 2026</short-title></quote>. </text></section> <section id="H68BDED576B25486891202E871AE2A15E" section-type="subsequent-section"><enum>2.</enum><header>Inadmissibility and deportability related to defrauding the United States Government or the unlawful receipt of public benefits</header> <subsection id="HEAEB75AB7AEC435791D63EB497A3DB87" display-inline="no-display-inline"><enum>(a)</enum><header>Inadmissibility</header><text display-inline="yes-display-inline">Section 212(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)</external-xref>) is amended by adding at the end the following: </text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HEB045F7FAD1F4E0C8F60EF0EFB0FC392"> 
<subparagraph id="H6DBEB0448F404E469B4ABB3E5B4ACCB8"><enum>(J)</enum><header>Defrauding the United States Government or the unlawful receipt of public benefits</header><text display-inline="yes-display-inline">Any alien who has been convicted of, who admits having committed, or who admits committing acts which constitute the essential elements of—</text> <clause id="HDD1596D9EDD0487788A711E4D39EBEA7"><enum>(i)</enum><text>an offense described in section 15 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2024">7 U.S.C. 2024</external-xref>) (relating to violations of Supplemental Nutrition Assistance Program benefits);</text></clause> 
<clause id="H6C978648218F417B86D62B460A6439D2"><enum>(ii)</enum><text>an offense described in section 208 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/408">42 U.S.C. 408</external-xref>) (relating to fraud involving social security account numbers or social security cards);</text></clause> <clause id="HC275B6E6F24E4FB49CBAA7D2BEDD5E7F"><enum>(iii)</enum><text display-inline="yes-display-inline">an offense described in section 666 of title 18, United States Code (relating to theft or bribery concerning programs receiving Federal funds);</text></clause> 
<clause id="HF215558ED596456082A73CA0AEF7BD41"><enum>(iv)</enum><text>an offense described in section 1028 of title 18, United States Code (relating to fraud and related activity in connection with identification documents, authentication features, and information);</text></clause> <clause id="HD38F1365D38A42C68F7070144DA8271B"><enum>(v)</enum><text display-inline="yes-display-inline">an offense described in section 1031 of title 18, United States Code (relating to major fraud against the United States);</text></clause> 
<clause id="H5D2634C001BB4C92AC8E2529625B46D4"><enum>(vi)</enum><text display-inline="yes-display-inline">an offense described under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/63">chapter 63</external-xref> of title 18, United States Code (relating to mail fraud and other fraud offenses);</text></clause> <clause id="HFCA5B2D255AB4091BE7F89EC2E56D2EF"><enum>(vii)</enum><text display-inline="yes-display-inline">an offense described in section 371 of title 18, United States Code (relating to conspiracy to commit offense or to defraud United States);</text></clause> 
<clause id="H8292E80AC84E4FB08F4F894F1F799418"><enum>(viii)</enum><text>any other offense that involves defrauding the United States Government or the unlawful receipt of a Federal public benefit (as such term is defined in section 401(c) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1611">8 U.S.C. 1611</external-xref>) or a State or local public benefit (as such term is defined in section 411(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1621">8 U.S.C. 1621</external-xref>)); or</text></clause> <clause id="HD7DCAC9732134848AFC91C48CE9A4FE1"><enum>(ix)</enum><text display-inline="yes-display-inline">a conspiracy to commit an offense described in clause (i) through (viii),</text></clause><continuation-text continuation-text-level="subparagraph">is inadmissible. </continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H93E18D410DE6470F997F2CA5C8C2CB01"><enum>(b)</enum><header>Deportability</header><text display-inline="yes-display-inline">Section 237(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)</external-xref>) is amended by adding at the end the following: </text> <quoted-block style="OLC" display-inline="no-display-inline" id="H3C8DC751040F42ACAD8E1869804BAD34"> <subparagraph id="H4B3B617D3EB347178696C684FD53FEC9"><enum>(G)</enum><header>Defrauding the United States government or the unlawful receipt of public benefits</header><text display-inline="yes-display-inline">Any alien who has been convicted of, who admits having committed, or who admits committing acts which constitute the essential elements of—</text> 
<clause id="H76FC0A4DC81E418BA719EFE5F8596625"><enum>(i)</enum><text display-inline="yes-display-inline">an offense described in section 15 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2024">7 U.S.C. 2024</external-xref>) (relating to violations of Supplemental Nutrition Assistance Program benefits);</text></clause> <clause id="H95E31FA5BA4342969FA6A1F200B7BCB0"><enum>(ii)</enum><text>an offense described in section 208 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/408">42 U.S.C. 408</external-xref>) (relating to fraud involving social security account numbers or social security cards);</text></clause> 
<clause id="HAB334B16904647A28B6D61D9B12E4989"><enum>(iii)</enum><text display-inline="yes-display-inline">an offense described in section 666 of title 18, United States Code (relating to theft or bribery concerning programs receiving Federal funds);</text></clause> <clause id="H147C630616A442EBA3D5904C75914D75"><enum>(iv)</enum><text>an offense described in section 1028 of title 18, United States Code (relating to fraud and related activity in connection with identification documents, authentication features, and information);</text></clause> 
<clause id="H1DC5D4B1F65346C0BBF18BFE5E7705A9"><enum>(v)</enum><text display-inline="yes-display-inline">an offense described in section 1031 of title 18, United States Code (relating to major fraud against the United States);</text></clause> <clause id="HE80AB05DEE684690AA49CF2343E1065C"><enum>(vi)</enum><text display-inline="yes-display-inline">an offense described under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/63">chapter 63</external-xref> of title 18, United States Code (relating to mail fraud and other fraud offenses);</text></clause> 
<clause id="H957E37D3BBEF4FB498D3564CAF44AF48"><enum>(vii)</enum><text display-inline="yes-display-inline">an offense described in section 371 of title 18, United States Code (relating to conspiracy to commit offense or to defraud United States);</text></clause> <clause id="H1FE178775F29435E955E46D9A2BD2135"><enum>(viii)</enum><text>any other offense that involves defrauding the United States Government or the unlawful receipt of a Federal public benefit (as such term is defined in section 401(c) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1611">8 U.S.C. 1611</external-xref>)) or a State or local public benefit (as such term is defined in section 411(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1621">8 U.S.C. 1621</external-xref>)); or</text></clause> 
<clause id="H741877B44A79477693E68C21D90B43B1"><enum>(ix)</enum><text display-inline="yes-display-inline">a conspiracy to commit an offense described in clause (i) through (viii), </text></clause><continuation-text continuation-text-level="subparagraph">is deportable.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H01AF79D0B84F477DB22427C762BDBB63"><enum>(c)</enum><header>Ineligibility for any immigration relief</header><text display-inline="yes-display-inline">Any alien described in subparagraph (J) of section 212(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1128">8 U.S.C. 1128(a)(2)(J)</external-xref>) or subparagraph (G) of section 237(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)</external-xref>) shall be ineligible for any relief under the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)), including under section 2242 of the Omnibus Consolidated and Emergency Supplemental Appropriations Act, 1999 (112 Stat. 2681).</text></subsection></section>
