which was referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>RESOLUTION</legis-type><official-title display="yes">Requesting information on El Salvador’s human rights practices pursuant to section 502B(c) of the Foreign Assistance Act of 1961.</official-title></form><resolution-body><section id="ide7dd043db84e4f1e83b320e2dafe9195" section-type="section-one"><enum>1.</enum><header>Request for information on El Salvador’s human rights practices</header><subsection id="ide6f5d974ba8a4e42807837fcfb268ec7"><enum>(a)</enum><header>Statement requested</header><text>The Senate requests that the Secretary of State, not later than 30 days after the date of the adoption of this resolution, submit to the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name> and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>, pursuant to section 502B(c) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2304">22 U.S.C. 2304(c)</external-xref>), a statement regarding El Salvador's human rights practices that has been prepared in collaboration with the Assistant Secretary of State for Democracy, Human Rights, and Labor and the Office of the Legal Adviser at the Department of State.</text></subsection><subsection id="id6767ccc6547c48de846f460bc2513796"><enum>(b)</enum><header>Elements</header><text>The statement submitted pursuant to subsection (a) should include—</text><paragraph id="id61191ab9414e401b9c6169d1e2a3cc2d"><enum>(1)</enum><text>all available credible information concerning alleged violations of internationally recognized human rights by the Government of the Republic of El Salvador, including—</text><subparagraph id="id3D4E556B0D894CFAB9B9D9B65B866F80"><enum>(A)</enum><text>torture and inhumane treatment of detainees, including detainees who are not citizens of El Salvador;</text></subparagraph><subparagraph id="idF7F7201F11E14723B852F82355BD76C0"><enum>(B)</enum><text>forced disappearances; </text></subparagraph><subparagraph id="id863BAB28691145079524D99C0E1E6B4B"><enum>(C)</enum><text>transnational repression;</text></subparagraph><subparagraph id="id4101D7466B9643298B8E528C8F833692"><enum>(D)</enum><text>the denial of due process for residents of El Salvador, including an evaluation of judicial independence in El Salvador; and</text></subparagraph><subparagraph id="id265df1b62a7e4c27a627605e2a9dfc0e"><enum>(E)</enum><text>the treatment of citizens or residents of other countries who are being detained or imprisoned in El Salvador, including any opportunity provided to such citizens or residents to demonstrate they are being wrongfully detained or imprisoned;</text></subparagraph></paragraph><paragraph id="ided53afcf2e0c4e56b79c7cc3924672ef"><enum>(2)</enum><text>a description of the steps the United States Government has taken—</text><subparagraph id="id7bf9526e14fb482d8ae4284637a1173d"><enum>(A)</enum><text>to promote respect for and observance of human rights as part of the Government of El Salvador’s activities, including in the context of El Salvador's ongoing State of Exception;</text></subparagraph><subparagraph id="id358305AA05E4466C821F284BFBD6FB48"><enum>(B)</enum><text>to discourage any practices that are inimical to internationally recognized human rights; and</text></subparagraph><subparagraph id="idf62a18c4ba34400bbf10acb5d7ab2b8c"><enum>(C)</enum><text>to publicly or privately call attention to, and disassociate the United States and any security assistance provided for the Republic of El Salvador from, any practices described in subparagraph (B); and</text></subparagraph></paragraph><paragraph id="id0298571eaa44444a92f11ec110e0cb52"><enum>(3)</enum><text>other information, including—</text><subparagraph id="idbef552b85652405fb31fa6d95ffbe0c4"><enum>(A)</enum><text>an assessment from the Secretary of State of the likelihood that United States security assistance (as defined in section 502B(d) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2304">22 U.S.C. 2304(d)</external-xref>)) provided to the Republic of El Salvador could be used in support of activities by government officials related to the rendition, trafficking, detention, or imprisonment of individuals who are not nationals of El Salvador; </text></subparagraph><subparagraph id="idb6853eac293b439ca424518263dce1aa"><enum>(B)</enum><text>an assessment from the Secretary of State of the conditions in El Salvador’s Centro de Confinamiento del Terrorismo (CECOT), including an assessment of allegations of torture and other gross violations of human rights;</text></subparagraph><subparagraph id="ideb47c7058b5a4dccb7e197afc4a848dc"><enum>(C)</enum><text>a description of any actions that the United States Government is taking to ensure that the Government of the Republic of El Salvador releases United States citizens or residents being detained or imprisoned in El Salvador in compliance with United States court orders regarding their return to the United States;</text></subparagraph><subparagraph id="idf88bac8f195b4641b7fd7dc2bb07c855"><enum>(D)</enum><text>a description of any actions that the United States Government is taking to address allegations of detention, torture, or forced disappearances of United States citizens or residents by the Republic of El Salvador or efforts to facilitate the detention, torture or forced disappearances of United States citizens or legal residents; </text></subparagraph><subparagraph id="id4d9006ef1fc44ee8b92135c485537888"><enum>(E)</enum><text>a description of actions the United States Government is taking to provide due process in compliance with United States law for relevant persons detained or imprisoned in El Salvador through an agreement with the United States Government; and</text></subparagraph><subparagraph id="id4f437aa1c1564acea2ef025191288635"><enum>(F)</enum><text>a description of any actions the United States Government is taking to protect United States citizens and residents from unlawful rendering, trafficking, or other means of removal from the United States to the Republic of El Salvador.</text></subparagraph></paragraph></subsection></section></resolution-body></resolution>
