which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Clean Air Act to prevent the elimination of the sale of motor vehicles with internal combustion engines, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preserving Choice in Vehicle Purchases Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id4a67dc7625f7469a884a3828910e5efb"><enum>2.</enum><header>State standards</header><subsection commented="no" display-inline="no-display-inline" id="id689833b7fa754403b77c4b71b0e27714"><enum>(a)</enum><header display-inline="yes-display-inline">Amendments</header><text display-inline="yes-display-inline">Section 209(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7543">42 U.S.C. 7543(b)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id9a6b7941e7cd4340bf377db5abb8c313"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id44cf73c6f91c40eeabcb122fa9176244"><enum>(A)</enum><text>in subparagraph (A), by striking the comma at the end and inserting a semicolon;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5d2465539588446d82fe1aed1282252e"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>, or</quote> at the end and inserting a semicolon;</text></subparagraph><subparagraph id="id9f1fbf9e8e3f4841a1673acb21019937"><enum>(C)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="idf2de517467c4434f955e70b3bbe95554"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="id087B97E3412B4AB6B547975C7EDDF0B5" act-name=""><subparagraph id="idC76F19AF048540C0868D8136DE3627E6" indent="up1"><enum>(D)</enum><text>the State standards directly or indirectly limit the sale or use of new motor vehicles with internal combustion engines (as defined in section 63.9375 of title 40, Code of Federal Regulations (as in effect on January 1, 2023)).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id17e126cb0bee44009a92cb4f470c22cc"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="id81FBDDBB3C974B52A8DD76642D5D9C20" act-name=""><paragraph id="id37273AF0EDA24F809FCE8029F6516421" indent="up1"><enum>(4)</enum><header>Scope of waivers</header><text>The Administrator may not determine that any State standard amended after the date of enactment of this paragraph is within the scope of a waiver granted under paragraph (1) before that date of enactment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id5cd2b8cc82ee4ceba96c6545496cf5d6"><enum>(b)</enum><header>Effect on certain existing waivers</header><text>The Administrator of the Environmental Protection Agency shall revoke a waiver that was granted under section 209(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7543">42 U.S.C. 7543(b)</external-xref>) during the period that begins on January 1, 2022, and ends on the date of enactment of this Act if the Administrator of the Environmental Protection Agency finds that the waiver does not comply with subparagraph (D) of paragraph (1) of that section (as amended by subsection (a)(1)(D)).</text></subsection></section></legis-body></bill>
