which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Foreign Agents Registration Act of 1938, as amended to clarify that the obligation of individuals who formerly served as agents of foreign principals to register as foreign agents under the Act is continuing with respect to activities carried out previously on behalf of such foreign principals, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H006E0DDD8C3D4F4396820C36A1F2B4EC"><section section-type="section-one" id="HFF046E2AC0AC47CEA89FC7891CC54319"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign Agents Transparency Act</short-title></quote>.</text></section><section id="HB294D0CFB0AC458599F8DD703077305E"><enum>2.</enum><header>Clarifying the continuing obligation to register as an agent of a foreign principal</header><subsection id="HC782A89CC3934B2692ED70F302CAD5ED"><enum>(a)</enum><header>Obligation</header><text display-inline="yes-display-inline">The third sentence of section 2(a) of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/612">22 U.S.C. 612(a)</external-xref>) is amended by striking <quote>for the period</quote> and inserting <quote>covering the period</quote>.</text></subsection><subsection id="H248867C6967441198CA7BCB683C8D91C"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply with respect to any individual who serves as the agent of a foreign principal under the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611 et seq.</external-xref>)—</text><paragraph commented="no" display-inline="no-display-inline" id="id5e4a27ef5b6145dbb8d8ed82076bb63b"><enum>(1)</enum><text display-inline="yes-display-inline">during the 5-year period ending on the date of enactment of this Act;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide73078265ed6443fae0cc0225a3375ef"><enum>(2)</enum><text display-inline="yes-display-inline">on the date of enactment of this Act; or </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9c7a7154709647f497f7266bf63fa887"><enum>(3)</enum><text display-inline="yes-display-inline">after the date of enactment of this Act.</text></paragraph></subsection></section><section id="H8C210122E2F1461592F69D0873E088BC"><enum>3.</enum><header>Permitting order requiring compliance to apply after FARA activities have ended</header><subsection id="H2DC3EED756634554A322FF63166A8ABC"><enum>(a)</enum><header>Continual compliance</header><text display-inline="yes-display-inline">Section 8(f) of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/618">22 U.S.C. 618(f)</external-xref>) is amended—</text><paragraph id="H1475403B632B4FB7AB5566B1A6558475"><enum>(1)</enum><text>by inserting after the first sentence the following: <quote>The Attorney General may make application for an order requiring a person to comply with any appropriate provision of this Act or any regulation thereunder while the person acts as an agent of a foreign principal or at any time thereafter.</quote>; and</text></paragraph><paragraph id="H168F3A0609964221B98C00B19799E390"><enum>(2)</enum><text>by striking the period at the end and inserting the following: <quote>, including an order requiring a person to comply with section 2 with respect to any period during which the person acts as the agent of a foreign principal notwithstanding that the person does not act as the agent of a foreign principal at the time the court issues the order.</quote>.</text></paragraph></subsection><subsection id="id4BD4D5CC067944EB91F2BD79ABD0CF72"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply with respect to any individual who serves as the agent of a foreign principal under the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611 et seq.</external-xref>)—</text><paragraph commented="no" display-inline="no-display-inline" id="idF6AC47C675CB4D3586621BC70123B2A3"><enum>(1)</enum><text display-inline="yes-display-inline">during the 5-year period ending on the date of enactment of this Act;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id85D0D1DE4C3A44559579E32902F66559"><enum>(2)</enum><text display-inline="yes-display-inline">on the date of enactment of this Act; or </text></paragraph><paragraph id="idEBD28D505B9D4A7594C5B82FD828D7FA" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">after the date of enactment of this Act.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ide324ba482bb54ce38535eea3c2f3da4d"><enum>4.</enum><header>Annual reports relating to compliance</header><subsection commented="no" display-inline="no-display-inline" id="id959b4023a2ef4281a8a24fed02a62c84"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="id239c7279e82b447abfb842573c2f5850"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>covered action</quote> means an action taken by the Attorney General against a covered individual to enforce the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611 et seq.</external-xref>), as amended by sections 2 and 3 of this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3d67755d1503456da992ff5e586eba9a"><enum>(2)</enum><text>the term <quote>covered individual</quote> means an individual who served as the agent of a foreign principal under the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611 et seq.</external-xref>) during the 5-year period ending on the date of enactment of this Act.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id623b91fd3e9f4b448f96e898a300aa23"><enum>(b)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and each year from that date thereafter, the Attorney General shall submit to the Committee on the Judiciary and the Committee on Foreign Relations of the Senate and the Committee on the Judiciary of the House of Representatives, as well as any other Member of Congress upon request of such Member, a written, machine-readable report that describes each covered action taken by the Attorney General. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id92922724e38a4a42aa76edd9a1f8305d"><enum>(c)</enum><header>Organization</header><text>Each report submitted under subsection (b) shall be organized by each covered action taken and shall include, with respect to each covered action—</text><paragraph commented="no" display-inline="no-display-inline" id="idf9d07e2da49c46c3bbd5598c2d8da49b"><enum>(1)</enum><text display-inline="yes-display-inline">the name of each covered individual against whom the covered action was taken;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide7a3b1bf9c6c4242957d00747382c28b"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the rationale behind taking the covered action; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3c6a2eb46f284a3c8af793b861720696"><enum>(3)</enum><text display-inline="yes-display-inline">the status of the covered action. </text></paragraph></subsection></section></legis-body></bill>
