Guard.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H471C3527B7D44D2396014C121D74A560"><section section-type="section-one" id="H60822B400B4C46208B997DC3874361F1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Space National Guard Establishment Act of 2025</short-title></quote>.</text></section><section id="H732D72A868CC434EB0708CDF611E8291"><enum>2.</enum><header>Establishment of Space National Guard</header><subsection id="H64B777116508403D8CC98C612D651B3D"><enum>(a)</enum><header>Establishment</header><paragraph id="H26B087F92F5B4795B702BADFA7DC2CB7"><enum>(1)</enum><header>In general</header><text>There is established a Space National Guard that is part of the organized militia of the States specified in paragraph (3), active and inactive, that—</text><subparagraph id="HAD545A5F62E04C46A6D1776B60A1AE07"><enum>(A)</enum><text>is a space force;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id94d61e903ae94408bce05dccaf61c340"><enum>(B)</enum><text display-inline="yes-display-inline">is trained, and has its officers appointed, under the sixteenth clause of section 8, article I of the Constitution;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5cb0af0d08e5416b97f0dbedf9ebf655"><enum>(C)</enum><text display-inline="yes-display-inline">is organized, armed, and equipped wholly or partly at Federal expense; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4260a92e2051470c9e23a75b9e2ec0f5"><enum>(D)</enum><text display-inline="yes-display-inline">is federally recognized. </text></subparagraph></paragraph><paragraph id="HC715C5009E6D4126BF26F6A496B121A3"><enum>(2)</enum><header>Reserve component</header><text display-inline="yes-display-inline">The Space National Guard shall be the reserve component of the Space Force all of whose members are members of the Space National Guard. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id458997d524374647a8d230fed8710346"><enum>(3)</enum><header>States specified</header><text>The States specified in this paragraph are—</text><subparagraph commented="no" display-inline="no-display-inline" id="id27a36c9f3eb447cc92c69299b57f639a"><enum>(A)</enum><text>Alaska.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id55d1eb9a8a0248de827c1c4ad1ed50ab"><enum>(B)</enum><text>California.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4e8d17e4fe8b43caaa9188fa24d91433"><enum>(C)</enum><text>Colorado.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf35d684f5e8a403e8b9e09568565563f"><enum>(D)</enum><text>Florida.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id750d8d48e1a24b7286853034714f1b95"><enum>(E)</enum><text>Hawaii.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd0f6d513896a443a9e02f363aa296bea"><enum>(F)</enum><text>New York.</text></subparagraph><subparagraph id="id4f1dfe890cc6477ab2cc3768e79128ba" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text>Ohio. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida90c7b881a03434685e34e2a2f14e240"><enum>(b)</enum><header>Composition</header><paragraph commented="no" display-inline="no-display-inline" id="idcff0d0d07c724036a43eafb71c7ee83e"><enum>(1)</enum><header>Director of the Space National Guard</header><subparagraph commented="no" display-inline="no-display-inline" id="id6dc9ff01faa74df7aeab7a5b2fb31de3"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of Space Operations for the National Guard Bureau shall be transferred to the Space National Guard and be known as the Director of the Space National Guard.</text></subparagraph><subparagraph id="id1ad89eb8d9e24332b0f8448fd591291c" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Rank</header><text display-inline="yes-display-inline">The Director of the Space National Guard shall carry the rank of Brigadier General and shall report to the Director of the Air National Guard. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7357204b0b25495e9a6827deb3f4e137"><enum>(2)</enum><header display-inline="yes-display-inline">Transfer of Space Operations</header><subparagraph commented="no" display-inline="no-display-inline" id="id954c9084ad5f4742a6f63b026c1a1790"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The staff assigned to space operations in the National Guard Bureau and the units specified in subparagraph (B) shall be transferred to the Space National Guard. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id99cb962cd57f483180b16d17c4d1c05f"><enum>(B)</enum><header>Units specified</header><text>The units specified in this subparagraph are the following:</text><clause id="id67db2f0503104a1593381cfef7307823"><enum>(i)</enum><text>213th Space Warning Squadron, Alaska Air National Guard.</text></clause><clause id="idaa2064a35a784174bcf9e42fba5335cf"><enum>(ii)</enum><text>148th Space Operations Squadron, California Air National Guard.</text></clause><clause id="id7dad86ea6d644202bca2492fdfc7190b"><enum>(iii)</enum><text>216th Electromagnetic Warfare Squadron, California Air National Guard.</text></clause><clause id="id286d71ab44e54508b9df70ed4dd63e79"><enum>(iv)</enum><text>234th Intelligence Squadron, California Air National Guard.</text></clause><clause id="id27ca4cd972fb4c63be6f92252f12c3f1"><enum>(v)</enum><text>137th Space Warning Squadron, Colorado Air National Guard.</text></clause><clause id="id95e68891ffee4324b952adea6097b4a4"><enum>(vi)</enum><text>138th Electromagnetic Warfare Squadron, Colorado Air National Guard.</text></clause><clause display-inline="no-display-inline"><enum>(xiv)</enum><text>222nd Command and Control Squadron, New York Air National Guard.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id20bbc9e19a1d40d5866bd27d42a74daa"><enum>(3)</enum><header>Prohibition on additional personnel</header><subparagraph commented="no" display-inline="no-display-inline" id="idf2b53fd9a5124627b5fa0c39f3625b0d"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>There shall be no personnel assigned or allocated to the Space National Guard other than the personnel provided for by paragraphs (1) and (2).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4997b0575d334bd3a3ad0b63db0b1621"><enum>(B)</enum><header>Assistant Adjutant General</header><text display-inline="yes-display-inline">Each Space National Guard unit shall be organized under the Assistant Adjutant General for the Air Force in the State in which the unit is located on the day before the enactment of this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5b8686e629e147689f90e7587201ed77"><enum>(C)</enum><header>Effect on States</header><text>Except as provided in paragraphs (1) and (2), no State shall receive any additional personnel, to include any general officer or staff, to assist with the administration and operation of the Space National Guard.</text></subparagraph></paragraph></subsection></section><section display-inline="no-display-inline" section-type="subsequent-section" id="H69E3B2D630334B22BC4D46A66B233129"><enum>3.</enum><header>No effect on military facilities, infrastructure, and installations</header><subsection display-inline="no-display-inline" commented="no" id="id13982885d16c4720a59a31f12a343ee4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Space National Guard shall make use of facilities, infrastructure, and installations constructed before the date of the enactment of this Act.</text></subsection><subsection id="id7e1b4cc595664972a73fd4fa17c857c9"><enum>(b)</enum><header>Prohibition on new construction</header><text>Except as provided by subsection (a), no additional facility, infrastructure, or installation shall be constructed or modified to accommodate the Space National Guard. </text></subsection></section><section id="H9843B8AE450340C68160591136795470"><enum>4.</enum><header>Implementation of Space National Guard</header><subsection id="H5016CA6A778045DE8FC274B4575165E3"><enum>(a)</enum><header>Requirement</header><text>Except as specifically provided by this Act, the Secretary of the Air Force and the Chief of the National Guard Bureau shall implement this Act and the amendments made by this Act not later than one year after the date of the enactment of this Act.</text></subsection><subsection id="H20B9DE0FEB4D49C1954C342614E5443B"><enum>(b)</enum><header>Briefing required</header><paragraph id="id88AE943046A44777B9835FCCC63C7629"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, and annually thereafter for 5 years, the Secretary of the Air Force, the Chief of the Space Force, and the Chief of the National Guard Bureau shall jointly provide to the congressional defense committees (as defined in section 101 of title 10, United States Code) a briefing on the status of the implementation of the Space National Guard pursuant to this Act and the amendments made by this Act. </text></paragraph><paragraph id="id84217033F44245038F71FC640D389D3D"><enum>(2)</enum><header>Elements</header><text>The briefing required by paragraph (1) shall address—</text><subparagraph id="idE7470B7021054A5CA683093546F990C7"><enum>(A)</enum><text>the current missions, operations and activities, personnel requirements and status, and budget and funding requirements and status of the Space National Guard; and </text></subparagraph><subparagraph id="id2FCBC7CAFD4D402BA7B1DB425BE5E356"><enum>(B)</enum><text>such other matters with respect to the implementation and operation of the Space National Guard as the Secretary and the Chiefs jointly determine appropriate to keep Congress fully and currently informed on the status of the implementation of the Space National Guard. </text></subparagraph></paragraph></subsection></section><section display-inline="no-display-inline" section-type="subsequent-section" id="H81D49A83450F410882963450ADA48250"><enum>5.</enum><header>Conforming amendments and clarification of authorities</header><subsection id="HEDBFF7006134403D99C549491457807C"><enum>(a)</enum><header>Definitions</header><paragraph id="HD57C5B8D76B64F508D4D5F8E7E80B177"><enum>(1)</enum><header>Title 10, United States Code</header><text>Title 10, United States Code, is amended—</text><subparagraph id="H9873CEF8B24C4DC18627380A2B794773"><enum>(A)</enum><text display-inline="yes-display-inline">in section 101—</text><clause id="H3F6887D51C97463EA0E445DE98A941DC"><enum>(i)</enum><text>in subsection (c)—</text><subclause display-inline="no-display-inline" id="H34A775834CD141B7B95230D4CD4A714D"><enum>(I)</enum><text>in paragraph (1), by striking <quote>and the Air National Guard</quote> and inserting <quote>, the Air National Guard, and the Space National Guard</quote>;</text></subclause><subclause display-inline="no-display-inline" commented="no" id="ided020859356a464dadc3524c38b911cd"><enum>(II)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (6) and (7) as paragraphs (8) and (9), respectively; and</text></subclause><subclause id="H1F453066DDF940069154C524BE4CD138"><enum>(III)</enum><text>by inserting after paragraph (5) the following new paragraphs:</text><quoted-block style="OLC" id="H93B0E545C8E24D2796D8C307435B4998"><paragraph id="H803BEE7AF9CE4F53BFD639E78B055899"><enum>(6)</enum><text>The term <term>Space National Guard</term> means that part of the organized militia of the States specified in section 2(a)(3) of the <short-title>Space National Guard Establishment Act of 2025</short-title>, active and inactive, that—</text><subparagraph id="HBBE9CE7D27A549E5A6D458702066A70F"><enum>(A)</enum><text>is a space force;</text></subparagraph><subparagraph id="H204AE58E247247948C1A6AD89CDF2957"><enum>(B)</enum><text>is trained, and has its officers appointed under the sixteenth clause of section 8, article I of the Constitution;</text></subparagraph><subparagraph id="H4AF06DB8BAC443D9AE1B914D073A988A"><enum>(C)</enum><text>is organized, armed, and equipped wholly or partly at Federal expense; and</text></subparagraph><subparagraph id="HE3C837F94C684518A004508715A96A1E"><enum>(D)</enum><text>is federally recognized.</text></subparagraph></paragraph><paragraph id="H1B837A0881544A96A325D55281CC8090"><enum>(7)</enum><text display-inline="yes-display-inline">The term <term>Space National Guard of the United States</term> means the reserve component of the Space Force all of whose members are members of the Space National Guard.</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subclause></clause><clause id="H7CC662AB2173462393BE74ADC9EA7F9F"><enum>(ii)</enum><text>in subsection (d)—</text><subclause commented="no" display-inline="no-display-inline" id="ide040c07f745c42ec95abe1a6b6470801"><enum>(I)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>or inactive Air National Guard</quote> and inserting <quote>, in the inactive Air National Guard, in the inactive Space National Guard,</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2630d0d6dcb6405eb9ad7d8a715bd753"><enum>(II)</enum><text>in paragraph (5), by striking <quote>or the Air National Guard of the United States</quote> and inserting <quote>, the Air National Guard of the United States, or the Space National Guard of the United States</quote>; and </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id10ddaebddf0941af8e957a5748ba0d42"><enum>(B)</enum><text display-inline="yes-display-inline">in section 10101—</text><clause id="H045A181D486D45C0938C4DDA5BC4CB0D"><enum>(i)</enum><text>in the matter preceding paragraph (1), by inserting <quote>the following</quote> before the colon; and</text></clause><clause id="H3AED7C158A1141A1BD64E363572612D4"><enum>(ii)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="USC" display-inline="no-display-inline" id="H35413A9BD1F14A3184EB4F502294750B"><paragraph id="H51B6BC0C65BA4338969D295D5882CBC3"><enum>(8)</enum><text display-inline="yes-display-inline">The Space National Guard of the United States.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="HDF7316EF5D9C4F938A74F9A0B2C78AB9"><enum>(2)</enum><header>Title 32, United States Code</header><text>Section 101 of title 32, United States Code is amended—</text><subparagraph id="H0DE5AF6108134AD5A397258198822AFC"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and the Air National Guard</quote> and inserting <quote>the Air National Guard of the United States, and the Space National Guard</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6ec3a75d86c0454e99ae1264e17423a3"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>and the Air National Guard</quote> and inserting <quote>, the Air National Guard, and the Space National Guard</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfbdac17fe2c54d04b05dd125337dc391"><enum>(C)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (8) through (19) as paragraphs (10) through (21), respectively; and</text></subparagraph><subparagraph id="H5D5E16297E3841319FD308B8B71B1411"><enum>(D)</enum><text>by inserting after paragraph (7) the following new paragraphs:</text><quoted-block style="OLC" id="HA6D1C3A8F4A641C2B7035DD0CF8BF3CB"><paragraph id="HFF44699B976D488EACE4099336DB5133"><enum>(8)</enum><text display-inline="yes-display-inline">The term <term>Space National Guard</term> means that part of the organized militia of the States specified in section 2(a)(3) of the <short-title>Space National Guard Establishment Act of 2025</short-title>, active and inactive, that—</text><subparagraph id="H08E17C4477C34C1AAB454AAE065D05BB"><enum>(A)</enum><text>is a space force;</text></subparagraph><subparagraph id="H48ECD6B06062482CB13F4ED49C3B4536"><enum>(B)</enum><text>is trained, and has its officers appointed under the sixteenth clause of section 8, article I of the Constitution;</text></subparagraph><subparagraph id="H7A60025757BD43F78FC236401C8D2335"><enum>(C)</enum><text>is organized, armed, and equipped wholly or partly at Federal expense; and</text></subparagraph><subparagraph id="HA204B9BFB55448AA9A37091502E68D1F"><enum>(D)</enum><text>is federally recognized.</text></subparagraph></paragraph><paragraph id="HD0D9924EAA8740CC80A93D116CC6BD5B"><enum>(9)</enum><text display-inline="yes-display-inline">The term <term>Space National Guard of the United States</term> means the reserve component of the Space Force all of whose members are members of the Space National Guard.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd2d74cf2c13b4bbaa1d603c3874054a1"><enum>(E)</enum><text>in paragraph (21), as redesignated by subparagraph (C), by striking <quote>or the Air National Guard of the United States</quote> and inserting <quote>, the Air National Guard of the United States, or the Space National Guard of the United States</quote>.</text></subparagraph></paragraph></subsection><subsection id="HAF9B27FEB47E459EBC1F3FD1DBC85D48"><enum>(b)</enum><header>Reserve components</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/1003">Chapter 1003</external-xref> of title 10, United States Code, is amended—</text><paragraph id="HAAA17C129A234AE28AD53032C977FB1F"><enum>(1)</enum><text>by adding at the end the following new sections:</text><quoted-block style="USC" display-inline="no-display-inline" id="HC749BE66FF584B5DAF77ADED03838E61"><section id="H73F7AE832F16437F9182EC769B3CFCA7"><enum>10115.</enum><header>Space National Guard of the United States: composition</header><text display-inline="no-display-inline">The Space National Guard of the United States is the reserve component of the Space Force that consists of—</text><paragraph id="H1B64AB6A3A4E46569C3B0A139885D7D0"><enum>(1)</enum><text display-inline="yes-display-inline">federally recognized units and organizations of the Space National Guard; and</text></paragraph><paragraph id="H02548511B6874FBE84E1DFF43C798C1B"><enum>(2)</enum><text display-inline="yes-display-inline">members of the Space National Guard who are also Reserves of the Space Force.</text></paragraph></section><section id="HB41216AB3AFB4835B67FE466A0556D48"><enum>10116.</enum><header>Space National Guard: when a component of the Space Force</header><text display-inline="no-display-inline">The Space National Guard while in the service of the United States is a component of the Space Force.</text></section><section id="H35587979326846EB92A0B2EA5CBC3E63"><enum>10117.</enum><header>Space National Guard of the United States: status when not in Federal service</header><text display-inline="no-display-inline">When not on active duty, members of the Space National Guard of the United States shall be administered, armed, equipped, and trained in their status as members of the Space National Guard.</text></section><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="H324706D9F59F4538B1383E7B58031CEC"><enum>(2)</enum><text>in the table of sections at the beginning of such chapter, by adding at the end the following new items:</text><quoted-block style="USC" display-inline="no-display-inline" id="H1290968A6AA942BDB9ED1B9505448C6F"><toc regeneration="no-regeneration"><toc-entry level="section">10115.
