<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 961</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250311" legis-day="20250310">March 11 (legislative day, March 10), 2025</action-date><action-desc><sponsor name-id="S381">Mr. Rounds</sponsor> (for himself, <cosponsor name-id="S372">Mrs. Capito</cosponsor>, <cosponsor name-id="S323">Mr. Risch</cosponsor>, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, <cosponsor name-id="S344">Mr. Hoeven</cosponsor>, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, <cosponsor name-id="S437">Mr. Justice</cosponsor>, <cosponsor name-id="S417">Mr. Budd</cosponsor>, <cosponsor name-id="S395">Mrs. Hyde-Smith</cosponsor>, and <cosponsor name-id="S355">Mr. Cruz</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, to provide that a member of the Armed Forces and the spouse of that member shall have the same rights regarding the receipt of firearms at the location of any duty station of the member.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HCAC6B711C06A4A3CA1D35DE1420B5EBF"><section section-type="section-one" id="H919DEE84306B44C082D6E56221FEC34B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Our Military Families’ 2nd Amendment Rights Act</short-title></quote>.</text></section><section id="HA96F5F05777F40C19FBBB02D98DB3D1C"><enum>2.</enum><header>Receipt of firearm or ammunition by spouse of member of the Armed Forces at a duty station of the member outside the United States</header><text display-inline="no-display-inline">Section 925(a)(3) of title 18, United States Code, is amended—</text><paragraph id="HC6A769926B354258B96366BF0C4436D2"><enum>(1)</enum><text>by inserting <quote>or to the spouse of such a member</quote> before <quote>or to</quote>;</text></paragraph><paragraph id="H844A53A5039D4EE3B53D69B34812F668"><enum>(2)</enum><text>by striking <quote>members,</quote> and inserting <quote>members and spouses,</quote>;</text></paragraph><paragraph id="HEF939D8531BA42748B834C6DC84EF3F8"><enum>(3)</enum><text>by striking <quote>members or</quote> and inserting <quote>members, spouses, or</quote>; and</text></paragraph><paragraph id="H3A39E071C24A4832B835574922FF1D9E"><enum>(4)</enum><text>by striking <quote>member or</quote> and inserting <quote>member, spouse, or</quote>.</text></paragraph></section><section id="H011746CC587842CBBEF7891262AA7868"><enum>3.</enum><header>Residency of spouses of members of the Armed Forces to be determined on the same basis as the residency of such members for purposes of Federal firearms laws</header><text display-inline="no-display-inline">Section 921(b) of title 18, United States Code, is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H264895E8CD5645D6B59F1AACAF6C3743"><subsection id="HC6638826B05144269D7C7742EAB5FBA5"><enum>(b)</enum><text display-inline="yes-display-inline">For purposes of this chapter, a member of the Armed Forces on active duty, or a spouse of such a member, is a resident of—</text><paragraph id="H86563B995C0441D6A6B924C36B12174E"><enum>(1)</enum><text>the State in which the member or spouse maintains legal residence;</text></paragraph><paragraph id="H5059F4D58BD0405A857B7ADB5D68E666"><enum>(2)</enum><text>the State in which the permanent duty station of the member is located; and</text></paragraph><paragraph id="HC5A594F0A89E4DC7A04D176D4FD70EC8"><enum>(3)</enum><text>the State in which the member maintains a place of abode from which the member commutes each day to the permanent duty station of the member.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H6B02F125DF3049EB9DBF35E2E6C33B04"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply to conduct engaged in after the date that is 180 days after the date of enactment of this Act.</text></section></legis-body></bill>
