<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 938</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250311" legis-day="20250310">March 11 (legislative day, March 10), 2025</action-date><action-desc><sponsor name-id="S433">Mr. McCormick</sponsor> (for himself, <cosponsor name-id="S337">Mr. Coons</cosponsor>, <cosponsor name-id="S416">Mrs. Britt</cosponsor>, and <cosponsor name-id="S418">Mr. Fetterman</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Joint Task Force to Counter the Illicit Synthetic Narcotics.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H953B2A5BA6934C9387F9D450539AF36E"><section section-type="section-one" id="H1C1A0EA72B5D4701910E48D2FE04186E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Joint Task Force to Counter Illicit Synthetic Narcotics Act of 2025</short-title></quote>.</text></section><section id="H8EAC0ACA170B4687B3BC9E92D9E46A1E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H45AA14F6D69D434587F2A737E55448F2"><enum>(1)</enum><text>The United States is experiencing a crisis of substance abuse and addiction resulting in the deaths of hundreds of thousands of people of the United States. Most of these deaths involve some form of opioids.</text></paragraph><paragraph id="HAB0D465F37A641B59B7F8B421DADE0C6"><enum>(2)</enum><text>There are many elements of Federal, State, territorial, Tribal, and local governments working to combat the opioid epidemic.</text></paragraph><paragraph id="H1EF63029DC274A8FA51955D49D7504B8"><enum>(3)</enum><text>No central entity exists at the appropriate level whereby different agencies can share information and coordinate efforts to combat the opioid crisis.</text></paragraph></section><section id="H8F118A60D61A418A849A5E98C95C19DB"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id34aabc086d7d4e0ebdea0ae2c31cc7e8"><enum>(1)</enum><header>Controlled substance; listed chemical</header><text>The terms <term>controlled substance</term> and <term>listed chemical</term> have the meanings given the terms in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id57d0168488c24ac780026d6735ee5098"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the JTF–ISN.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0089366ca0d545ab8dd64b3b69bd5c92"><enum>(3)</enum><header display-inline="yes-display-inline">Illicit synthetic narcotic</header><text display-inline="yes-display-inline">The term <term>illicit synthetic narcotic</term> means—</text><subparagraph id="HF1CB149DD5334E92BB9F19802DAF4E54"><enum>(A)</enum><text>a controlled substance with the exception of—</text><clause id="HC2D755BCAF144B6B895D4BD167F0F54F"><enum>(i)</enum><text>a substance of natural origin; or</text></clause><clause id="HEBD1CC689E8548D89DB98E24D5198C69"><enum>(ii)</enum><text>a medication—</text><subclause commented="no" display-inline="no-display-inline" id="id9eaddf616f8241a89e71677461ba3202"><enum>(I)</enum><text display-inline="yes-display-inline">that is lawful under the laws of the United States; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4834a62046ce41c18e58764767e6c66f"><enum>(II)</enum><text display-inline="yes-display-inline">for which the Drug Enforcement Administration has provided an import permit to the importing organization for the import of the medication;</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id767987b68f304b278917445b0e2e83b3"><enum>(B)</enum><text>a listed chemical; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6524dac739e9486d8096bd7357657865"><enum>(C)</enum><text>an active pharmaceutical ingredient or chemical that is used in the production of a controlled substance or listed chemical in subparagraphs (A) and (B). </text></subparagraph></paragraph><paragraph id="idbb189ccd51a343dfb656a4a6cb34d702"><enum>(4)</enum><header>JTF–ISN</header><text>The term <term>JTF–ISN</term> means the Joint Task Force to Counter Illicit Synthetic Narcotics established under section 4.</text></paragraph></section><section id="HC7215A021A3D4D87B0EF43575ADF161B"><enum>4.</enum><header>Establishment of joint task force to counter illicit synthetic narcotics</header><subsection id="H707D978AAE0B4EC2B7829FC090715035"><enum>(a)</enum><header>In general</header><text>There is established a Joint Task Force to Counter Illicit Synthetic Narcotics.</text></subsection><subsection id="HC502CF424040457AB8218F1D75B8A4B2"><enum>(b)</enum><header>Membership</header><text>The JTF–ISN shall be composed of representatives of the following entities:</text><paragraph id="H0B21A3CB64924D2B8336E1E54546A4F5"><enum>(1)</enum><text>The Department of Justice, including—</text><subparagraph id="H545D108E5B1D43058C2B2727C95A0231"><enum>(A)</enum><text>the Drug Enforcement Administration;</text></subparagraph><subparagraph id="HA933BDACEB72440297F5824534690B12"><enum>(B)</enum><text>the Federal Bureau of Investigation; and</text></subparagraph><subparagraph id="HB374892F08944B0ABA32806CA8E8C65B"><enum>(C)</enum><text>assistant United States attorneys and trial attorneys, as the Director determines are appropriate.</text></subparagraph></paragraph><paragraph id="HF549068FFD8B40C6A2F545E96D9EA143"><enum>(2)</enum><text>The Department of the Treasury, including—</text><subparagraph id="H7E6864864FF144558990937732CEAC68"><enum>(A)</enum><text>the Counter-Fentanyl Strike Force;</text></subparagraph><subparagraph id="H0707343FF13B4D1CB85726D52C0BEB98"><enum>(B)</enum><text>the Internal Revenue Service Criminal Investigation;</text></subparagraph><subparagraph id="H6F8F199AF1E54609948AFCDBCD11C67B"><enum>(C)</enum><text>the Financial Crimes Enforcement Network;</text></subparagraph><subparagraph id="H7AA7FBFEB05A4BDC81C1AAF275D5F04C"><enum>(D)</enum><text>the Office of Foreign Assets Control; and</text></subparagraph><subparagraph id="H3C532296062641FBB388D29F76D030F4"><enum>(E)</enum><text>Office of Intelligence and Analysis.</text></subparagraph></paragraph><paragraph id="HDB2971C8A4374AB588040A4C37795C46"><enum>(3)</enum><text>The Department of Homeland Security, including—</text><subparagraph id="H43A7AEAA3B29410CA4865E874561D7FD"><enum>(A)</enum><text>Homeland Security Investigations;</text></subparagraph><subparagraph id="H26C2A5A14C0143EBAC3A5A8C4C537A08"><enum>(B)</enum><text>U.S. Customs and Border Protection, including the National Targeting Center;</text></subparagraph><subparagraph id="HDF2B24922FF54B69B4CEFFA39A8BFC7D"><enum>(C)</enum><text>Immigration and Customs Enforcement; and</text></subparagraph><subparagraph id="H7EF4925AA9874AF7BFC9B94FF69D8368"><enum>(D)</enum><text>the United States Coast Guard.</text></subparagraph></paragraph><paragraph id="HF2E038A36DD04F159ADF8CC5E0A0AE12"><enum>(4)</enum><text>The Department of State.</text></paragraph><paragraph id="H04E1563416004EADB2FD4CC9C542495D"><enum>(5)</enum><text>The Department of Commerce.</text></paragraph><paragraph id="H7AD9EAACFB1341C39E66C156F5432D83"><enum>(6)</enum><text>The Department of Defense.</text></paragraph><paragraph id="H198B2F4C3E074F6D965C3880E4723B4D"><enum>(7)</enum><text>The Office of the Director of National Intelligence.</text></paragraph><paragraph id="H3F68C71A86C0425FA11DE635BF42B04B"><enum>(8)</enum><text>Any other agency the Director deems appropriate.</text></paragraph></subsection><subsection id="H6D38C59C8B4E4B8EA6292F8C291B0F0B"><enum>(c)</enum><header>Director</header><paragraph id="H270D5960123E47EAA9D234428EA91E92"><enum>(1)</enum><header>In general</header><text>The JTF–ISN shall be led by a Director who shall be appointed by the President, by and with the advice and consent of the Senate.</text></paragraph><paragraph id="H0244AD44579344AE90C3A9BA55D0E4AB" commented="no"><enum>(2)</enum><header>Compensation</header><text>The Director shall be compensated at the rate of basic pay prescribed for level II of the Executive Schedule under section 5313 of title 5, United States Code.</text></paragraph></subsection><subsection id="H12866B3062534C3AB9A303E635171145"><enum>(d)</enum><header>Reporting</header><paragraph id="H9A5B07CAB93D4E83A1578392AFB2CE33"><enum>(1)</enum><header>In general</header><text>The Director shall report to the Attorney General.</text></paragraph><paragraph id="HF19B5B3CE4284D5CB149423394724A90"><enum>(2)</enum><header>Reports and briefings</header><text>Not later than 180 days after the date of enactment of this Act, and every 180 days thereafter, the Director shall submit to the Committee on the Judiciary and the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on the Judiciary and the Committee on Homeland Security of the House of Representatives a report, and upon request of the chairman or ranking member of any such committee, a briefing that includes—</text><subparagraph id="HDC5041417BAC4FC2ACADD31B8B9C0448"><enum>(A)</enum><text>a comprehensive plan covering the 2-year period beginning on the date on which the report is submitted or the briefing is made, as applicable, that includes—</text><clause id="HAE8C28FB673C40A3BF231761927C38D3"><enum>(i)</enum><text>a description of the goals of the JTF–ISN;</text></clause><clause id="H82EF854CA64C4E20BA706F0C06F87B7A"><enum>(ii)</enum><text>description of areas of improvement with respect to collaboration among the participating agencies; and</text></clause><clause id="HB3C744F8B1D4447B9D91B3B41A55D371"><enum>(iii)</enum><text>an estimate of the funding and staff needed for the continued work of the JTF–ISN;</text></clause></subparagraph><subparagraph id="HCC024A12ED784A1BB1A4BF98ECE302CF"><enum>(B)</enum><text>a statement of the budget priorities of the JTF–ISN for each year in the 2-year period;</text></subparagraph><subparagraph id="H78DCE65E2E4B4F4EB946AEA07D0327F0"><enum>(C)</enum><text>a description of the efforts of the JTF–ISN to investigate and prosecute illicit synthetic narcotics trafficking crimes, including raids conducted, assets seized, assets forfeited and indictments brought and convictions; and</text></subparagraph><subparagraph id="HCA0E9FBDEEBF4A1891B9AD2D5201CCC2"><enum>(D)</enum><text>efforts of the JTF–ISN to address matters related to the role of the People’s Republic of China in the opioids crisis.</text></subparagraph></paragraph></subsection></section><section id="H980F0DCD244349A99B99FC8AB8F8ADA5"><enum>5.</enum><header>Primary missions of JTF–ISN</header><text display-inline="no-display-inline">The primary mission of the JTF–ISN shall be to direct counter opioid and synthetic narcotics activities, including disruption activities and associated investigations, and provide strategic coordination on related activities, including sanctions enforcement, conducting joint operations, raids, and other tactical actions in coordination with Federal, State, territorial, Tribal, and local law enforcement agencies through memorandums of understanding such as legal actions against traffickers and foreign entities, particularly in the People’s Republic of China, complicit in the opioid trade.</text></section><section id="H384EAA6878C240699B456AD58ACAE1DF"><enum>6.</enum><header>Authority and limitations</header><subsection id="HD76D062AF11646C187447E617DB42E3E"><enum>(a)</enum><header>Authority</header><text>The JTF–ISN shall be vested with power and authority to—</text><paragraph id="H14972C98A5884FEFABA7CF9EE99A0970"><enum>(1)</enum><text>investigate and prosecute violations of Federal law relating to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf7ab753039d4472d8c8c0ef1f7abd9e5"><enum>(A)</enum><text display-inline="yes-display-inline">the trafficking of illicit synthetic narcotics and related offenses, such as money laundering and other financial crimes; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id967951ea37034dd5a40e4d9ccccbf965"><enum>(B)</enum><text display-inline="yes-display-inline">smuggling, false statements, and any matter that arises or might arises directly from its investigations;</text></subparagraph></paragraph><paragraph id="HD789B466BFC44C61B24F0475848DA3AE"><enum>(2)</enum><text>in the case of a prosecution relating to non-United States persons outside of the United States, bring a case—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida2cedda139ee44adbaaeafb7b277e114"><enum>(A)</enum><text display-inline="yes-display-inline">in the district where the crime was committed;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0058745f69e44215a43cebd2e5006812"><enum>(B)</enum><text display-inline="yes-display-inline">in the district where the Drug Enforcement Administration is located; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7e1de3c3ebd445d89d4fa00a607f9d5a"><enum>(C)</enum><text>in a district described in section 3238 of title 18, United States Code;</text></subparagraph></paragraph><paragraph id="HBC09D398C0124D9BA3285EDE625F4267"><enum>(3)</enum><text>facilitate the sharing of information between members of the JTF–ISN in a timely manner;</text></paragraph><paragraph id="H455F427917BC42F78791975B4F363867"><enum>(4)</enum><text>establish protocols for interagency referrals and procedures for referring cases to prosecuting and sanctions designating authorities as appropriate;</text></paragraph><paragraph id="H282D2BC560D44DBA9CC5BB46F4FC97C2"><enum>(5)</enum><text>develop strategies to address the role of the People’s Republic of China in the illicit synthetic narcotics crisis;</text></paragraph><paragraph id="H5C3931D107964645A669873D0AF31FF4"><enum>(6)</enum><text>work cooperatively with State, territorial, Tribal, and local law enforcement agencies to combat and prosecute trafficking of illicit synthetic narcotics;</text></paragraph><paragraph id="H26EB27BF6133414EB7009676D367D075"><enum>(7)</enum><text>assess and improve existing methods of investigating and prosecuting illicit synthetic narcotics trafficking crimes; and</text></paragraph><paragraph id="HCAB58A8416294ECA891F8E94F50D3E8C"><enum>(8)</enum><text>conduct direct operational activities, including joint operations, raids, and other tactical actions, to disrupt illicit synthetic narcotics trafficking networks and bring offenders to justice.</text></paragraph></subsection><subsection id="HC55D5D2FD7624791813A301180CF8356"><enum>(b)</enum><header>Limitation</header><text>The Director may not direct the execution of operational activities outside the scope of counter-opioid efforts related to illicit synthetic narcotics suppliers and their networks pursuant to the primary missions of the JTF–ISN.</text></subsection></section><section id="H2D72F2B7666A407C8B642CDED74F6767"><enum>7.</enum><header>Internal structure of JTF–ISN</header><subsection id="HE3D5D70CE76C465DAA6E72307B105C58"><enum>(a)</enum><header>Intelligence coordination</header><text>The Director shall establish and maintain within the JTF–ISN an intelligence coordination element, which shall have primary responsibility within the United States Government for analysis of illicit synthetic narcotics and related trafficking organizations from all sources of intelligence, whether collected inside or outside the United States.</text></subsection><subsection id="H54D9A378B49141A0935F81B05013A7FF"><enum>(b)</enum><header>Strategic operational planning</header><paragraph commented="no" display-inline="no-display-inline" id="id585b2384e3ea49e3aad9bf465bc58e4d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director shall establish and maintain within the JTF–ISN a strategic operational planning element, which shall provide strategic operational plans for counter-opioid operations conducted by the United States Government, and include the mission, objectives to be achieved, tasks to be performed, interagency coordination of operational activities, and the assignment of roles and responsibilities.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id982a67e646b6432596fa51d0107ad2db"><enum>(2)</enum><header>Monitoring</header><text>The Director shall monitor the implementation of strategic operational plans and shall obtain information from each element of the intelligence community, and from each other department, agency, or element of the United States Government relevant for monitoring the progress of such entity in implementing such plans.</text></paragraph></subsection><subsection id="H536BB61FE4F64E3BAD16CC1F26A74508"><enum>(c)</enum><header>Office of General Counsel</header><text>The Director shall establish and maintain within the JTF–ISN an Office of General Counsel, which shall provide legal advice in support of the JTF–ISN and its directorates.</text></subsection><subsection id="HA803ABDDDB604CBFA99FDF21CFE45691"><enum>(d)</enum><header>Office of Congressional Coordination</header><text>The Director shall establish and maintain within the JTF–ISN an Office of Congressional Coordination, which shall coordinate communications of the JTF–ISN with Congress and ensure compliance with reporting and briefing obligations under this Act.</text></subsection></section><section id="HFE21BDC69B24417EA5C1BE59B6DFB838"><enum>8.</enum><header>Retention of existing authorities</header><text display-inline="no-display-inline">Each member of the JTF–ISN shall maintain their existing authorities to investigate and prosecute trafficking crimes relating to illicit synthetic narcotics.</text></section><section id="H4BFB54F48ED2451CAFD9018AF6D4AAE4"><enum>9.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to authorize the JTF–ISN to investigate, target, or prosecute individuals for personal drug use or to pursue enforcement actions against low-level drug dealing that does not involve significant connections to larger trafficking networks.</text></section></legis-body></bill>
