<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 922</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250310">March 10, 2025</action-date><action-desc><sponsor name-id="S429">Mr. Banks</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Workforce Innovation and Opportunity Act to define the term evidence-based.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H36D91F2968654DC1854D6889CDA160DA"><section section-type="section-one" id="H1C1C68125D2E4599B3BB211C1F1FAA00"><enum>1.</enum><header>Evidence-based definition</header><subsection id="H5BF3526880DC4780AFC4502CE1764022"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HCA299A81C10642E59644FB836B0142E3"><paragraph id="H211AB06CDFFD4A6E84F73CEC1255353C"><enum>(72)</enum><header>Evidence-based</header><text>The term <quote>evidence-based</quote>, when used with respect to an activity, service, strategy, or intervention, or content of materials, means an activity, service, strategy, or intervention, or content of materials that—</text><subparagraph id="H9243E55A9664497DA7A6E9ECD46E1964"><enum>(A)</enum><text>demonstrates a statistically significant effect on improving participant outcomes or other relevant outcomes based on—</text><clause id="H71642B9333ED46279F10CFFF90A83532"><enum>(i)</enum><text>strong evidence from at least 1 well-designed and well-implemented experimental study;</text></clause><clause id="H8D19A9F32A9A424EA21FC1BFA84F9EBD"><enum>(ii)</enum><text>moderate evidence from at least 1 well-designed and well-implemented quasi-experimental study; or</text></clause><clause id="HA440E5DB72D44E629BE9D505B3A16562"><enum>(iii)</enum><text>promising evidence from at least 1 well-designed and well-implemented correlational study with statistical controls for selection bias; or</text></clause></subparagraph><subparagraph id="HDF3A4774CB144D33B4AAD2810190A82D"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H8C34751FB72B4B85BACD6423D3DD5FF7"><enum>(i)</enum><text>demonstrates a rationale based on high-quality research findings or positive evaluation that such activity, service, strategy, intervention, or content is likely to improve student outcomes or other relevant outcomes; and</text></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="id3621eab1a9744dee9bd1fe4eb9ed65db"><enum>(ii)</enum><text>includes ongoing efforts to examine the effects of such activity, service, strategy, intervention, or content.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4A77E9CAFEE2457790691CDC0A238A45"><enum>(b)</enum><header>Description of evidence-Based programs</header><text display-inline="yes-display-inline">Section 102(b)(1) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3112">29 U.S.C. 3112(b)(1)</external-xref>) is amended—</text><paragraph id="H2A0294DD2C6A4705AF55D4C479EE6375"><enum>(1)</enum><text>in subparagraph (C), by inserting <quote>the extent to which such activities are evidence-based,</quote> after <quote>of such activities,</quote>;</text></paragraph><paragraph commented="no" id="H12632B31E4F143AA9290CBABAAF4FED4"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" id="H5EB8FF88441A4204AB93E8D79080A7D0"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HF0F3636AE8FC4348A3038206192B4709"><enum>(4)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H62ED74AE09C64EF3B6106CD63565241E"><subparagraph id="H73C5BF4F04FA495FBB1931289E28A3AB"><enum>(F)</enum><text>a description of any strategies the State will use to prioritize the funding of evidence-based programs through the funds reserved as described in section 128(a) and available for statewide workforce development activities.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
