which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Camp Lejeune Justice Act of 2022 to make technical corrections.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H75B341E79AB64DF2AAF448BD7CA3E07C"><section section-type="section-one" id="H0F79DC8606024A3C9ED58C1DA36DE97E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Justice for Camp Lejeune Victims Act of 2025 </short-title></quote>. </text></section><section id="HA5D2489BA25B4C8C95AA8CD66DB7CFBB"><enum>2.</enum><header>Technical corrections to the Camp Lejeune Justice Act of 2022</header><text display-inline="no-display-inline">Section 804 of the Camp Lejeune Justice Act of 2022 (<external-xref legal-doc="usc" parsable-cite="usc/28/2671">28 U.S.C. 2671</external-xref> note prec.) is amended—</text><paragraph id="H88E41557BAC24505B7569AF418531D20"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph id="H93A0ED38AEC44A2AB8899E2890A9B020"><enum>(A)</enum><text>by striking <quote>in the United States District Court for the Eastern District of North Carolina</quote>; and</text></subparagraph><subparagraph id="H9D6DC1362C4148CB8C84409A25C37DCC"><enum>(B)</enum><text>by inserting <quote>, including a latent or potential harm,</quote> after <quote>appropriate relief for harm</quote>; </text></subparagraph></paragraph><paragraph id="HC75657C6DDFF4FABA9B0D9F9740BC845"><enum>(2)</enum><text>by amending subsection (c) to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HC1655033CDF643818AB3773D90005595"><subsection id="HA26C902C94744BD79B6A75E0F418F3C4"><enum>(c)</enum><header>Burdens and standard of proof</header><paragraph commented="no" display-inline="no-display-inline" id="id62beb6f075d549588afe60e30731e67b"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The party filing an action under this section shall be entitled to appropriate relief upon showing—</text><subparagraph id="H64DB8F8D80C84F4EB107584204CCCA4D"><enum>(A)</enum><text display-inline="yes-display-inline">the existence of 1 or more relationships between the type of contaminant in any water at Camp Lejeune and the type of harm suffered by the individual, including latent or potential harm; and</text></subparagraph><subparagraph id="H6D0A181C7F5844D98FBA31B923E3A63E"><enum>(B)</enum><text>that the individual was present at Camp Lejeune for a period of not less than 30 days, whether or not consecutive.</text></subparagraph></paragraph><paragraph id="idd1e00aee1f6b43c28ca1c529bce68915"><enum>(2)</enum><header>Evidentiary standards</header><text>To meet the burden of proof described in paragraph (1), a party shall produce evidence showing that the relationship between exposure to any level of contaminants of a type in any water at Camp Lejeune and the type of harm is—</text><subparagraph id="idd8d07f415c0341678586d473e4f2e49b"><enum>(A)</enum><text>sufficient to conclude that a causal relationship exists; or</text></subparagraph><subparagraph id="id8a69b757520049928f4248b0d70780a2"><enum>(B)</enum><text>sufficient to conclude that a causal relationship is at least as likely as not.</text></subparagraph></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="HE75A078647F94E5C802B04094326F5B0"><enum>(3)</enum><text>by amending subsection (d) to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id5AE63FD664C7426DBB8555AB1FC03928"><subsection id="H715F422D9DEF480CBF02ED9AD9DEFC88"><enum>(d)</enum><header>Exclusive jurisdiction and venue</header><paragraph commented="no" display-inline="no-display-inline" id="idde9d8eddf76c4d898052223bf7fc6205"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The United States District Court for the Eastern District of North Carolina shall have exclusive jurisdiction and venue for coordinated or consolidated pretrial administrative and procedural matters and resolution over any action filed under subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id831756b8c31c4fc1a1f05350beba6e97"><enum>(2)</enum><header>Transfer</header><text>A party filing an action under subsection (b) may transfer such action to any district court of the United States situated within the fourth judicial circuit for pretrial and trial of such action, including the adjudication of all evidentiary motions.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id31b730a641624037a0c4ca757cfa2095"><enum>(3)</enum><header>Jury trial</header><text display-inline="yes-display-inline">Any action against the United States under subsection (b) shall, at the request of either party to such action, be tried by the court with a jury.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61115bef29b04e608f4c8849b254dbba"><enum>(4)</enum><header>Expedited disposition</header><text display-inline="yes-display-inline">The court shall advance an action filed under subsection (b) on the docket, and expedite the disposition of such action to the greatest extent possible.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H01EA1ADA9EEB47CD85F3C01AC3891312"><enum>(4)</enum><text>in subsection (e)—</text><subparagraph id="H77D55841DA49439A8C1F1B8BB16AB452"><enum>(A)</enum><text>in paragraph (1), by striking <quote>latent disease</quote> and inserting <quote>latent or potential harm</quote>; and</text></subparagraph><subparagraph id="id127892e91a0c4e8e9c0403c51e56f8b7"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id47ae9880247c4bd89346d16c9bebb015"><paragraph id="id014d670cbdd3418e9dc497002687840a"><enum>(2)</enum><header>Health and disability benefits relating to water exposure</header><subparagraph id="idd3d5f4f720ed4b03b3e32b0b01caf3c3"><enum>(A)</enum><header>Claims settled before filing</header><text>An award to an individual, or legal representative of an individual, under this section that is made pursuant to a settlement entered before a civil action under subsection (b) is commenced shall not be offset.</text></subparagraph><subparagraph id="id6127886de50445298d5c2f49f886b89d"><enum>(B)</enum><header>Claims resolved after filing</header><text>An award to an individual, or legal representative of an individual, under this section that is made pursuant to a settlement entered or judgment rendered after a civil action under subsection (b) is commenced shall be offset to the extent permitted by applicable law by the amount of any disability award, payment, or benefit provided to the individual, or legal representative—</text><clause commented="no" display-inline="no-display-inline" id="id75d8bc2933f94bcfa98ccfec34731010"><enum>(i)</enum><text display-inline="yes-display-inline">under—</text><subclause id="id6694f6d98adc4c5f9ee0d266e44a7f6e"><enum>(I)</enum><text>any program under the laws administered by the Secretary of Veterans Affairs;</text></subclause><subclause id="id10b7138356a64b73bccb2dddf76027c7"><enum>(II)</enum><text>the Medicare program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>); or</text></subclause><subclause id="id92834eb47aec453b8e17972a3d256bfc"><enum>(III)</enum><text>the Medicaid program under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>); and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idc75b9bbe88964242836cb0133f69476f"><enum>(ii)</enum><text display-inline="yes-display-inline">in connection with health care or a disability relating to exposure to the water at Camp Lejeune.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H59042D0FF3E2428086212F9B4A78B346"><enum>(5)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HDCBD0BADEBEE4B8DA8502082C34A7A70"><subsection id="HE1C48C022D044B27877465189B807AAF"><enum>(k)</enum><header>Attorney fees</header><paragraph id="HA132E59904F34B34846B874A69440A4E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The total amount of attorneys fees under this section shall be in an amount that is not more than—</text><subparagraph id="HA3AAE25B08A6498783F3B1DBB32A6B90"><enum>(A)</enum><text display-inline="yes-display-inline">20 percent of any settlement entered into before a civil action under subsection (b) is commenced; or </text></subparagraph><subparagraph id="H3CAEB9AEBBC94CACB391EF0DBA3AF146"><enum>(B)</enum><text display-inline="yes-display-inline">25 percent of any judgement rendered or settlement entered into after a civil action under subsection (b) is commenced.</text></subparagraph></paragraph><paragraph id="H0FE2E44DF3854BBB9C8DD6623F9E5F7C"><enum>(2)</enum><header>Division of fees</header><text display-inline="yes-display-inline">A division of a fee under paragraph (1) between attorneys who are not in the same firm may be made only if the division is in proportion to the services performed by each attorney.</text></paragraph><paragraph id="id6a18cedcd33c44c3b35da704acc1235a"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this subsection shall prohibit an individual or the legal representative of an individual and such individual’s or representative’s attorney from agreeing to a fee award that is less than the maximum percentage specified in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HCD26070A505845E2BE2B3C2E5ED4F77F"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect as if enacted on August 10, 2022, and shall apply to any claim or action under section 804 of the Camp Lejeune Justice Act of 2022 that is pending on, or filed on or after, the date of enactment of this Act.</text></section><section id="id8f23abd9dce4448cb9baeded3d377c05"><enum>4.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act or an amendment made by this Act shall be construed to modify the applicability or statute of limitations provisions under section 804(j) of the Camp Lejeune Justice Act of 2022 (<external-xref legal-doc="usc" parsable-cite="usc/28/2671">28 U.S.C. 2671</external-xref> note prec.). </text></section></legis-body></bill>
