which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of the Interior to co-locate renewable energy projects on certain existing Federal leased areas, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H01B4DD6D7BE24A2BBF3F386120B52347"><section section-type="section-one" id="H1EBECB2C6AE74EF990783A85A1234D96"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Co-Location Energy Act</short-title></quote>.</text></section><section id="H2AA71F2851B44FCC90012D408E3A7A66"><enum>2.</enum><header>Co-location of renewable energy projects</header><subsection id="HEA477258CDE24D659ABA0945997458FC"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H056BD4AFE3154E0486582B20392394F0"><enum>(1)</enum><header>Existing Federal energy lease</header><text>The term <term>existing Federal energy lease</term> means a lease, easement, or right-of-way, as applicable—</text><subparagraph commented="no" id="HF8F7C28AE06148A5BED9F9208F93DA9C"><enum>(A)</enum><text>on land managed by the Secretary; and</text></subparagraph><subparagraph commented="no" id="HB8E371575DB44EF68AD14FE09E8F09BE"><enum>(B)</enum><text>that was issued, granted, or renewed on or before the date of enactment of this Act under—</text><clause commented="no" id="H0D6FFFE7180146E6B2CA0A7819FDAC7E"><enum>(i)</enum><text display-inline="yes-display-inline">the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>); or</text></clause><clause commented="no" id="HC1EA08B1016749F192EEB7A2C500AD21"><enum>(ii)</enum><text display-inline="yes-display-inline">the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4c24655bbbe0448d8d09e8d970b8d144"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></subsection><subsection id="H3D87722387824967B6C61A950B2F9088"><enum>(b)</enum><header>Authorization To evaluate leased areas for renewable energy development</header><paragraph id="HFC6B631A26684FFC815D55BEF5267E63"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to the authority of the Secretary under section 8(p) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(p)</external-xref>) and section 501(a)(4) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1761">43 U.S.C. 1761(a)(4)</external-xref>), the Secretary may authorize a person to evaluate an area of an existing Federal energy lease for solar or wind energy development.</text></paragraph><paragraph id="HCEDC9CCF840E47E7890F6C1716E2E8DC"><enum>(2)</enum><header>Consent of leaseholder</header><text>The Secretary may not authorize a person to evaluate an area under paragraph (1) unless the applicable leaseholder consents to that authorization.</text></paragraph></subsection><subsection id="H0C4A71FE1943482AAF09901024EE6C9B"><enum>(c)</enum><header>Permits for renewable energy development on existing oil, gas, coal, and geothermal lease areas</header><paragraph id="H643508C2E8EE46A4BBB003B5BF64B96C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to the authority of the Secretary under section 8(p) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(p)</external-xref>) and section 501(a)(4) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1761">43 U.S.C. 1761(a)(4)</external-xref>), the Secretary may issue a permit to authorize a person to construct or operate systems or facilities for the production, transportation, storage, or transmission of energy from solar or wind resources on an area of an existing Federal energy lease.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H04833A0D728C412F93DBEE41E0D727EF"><enum>(2)</enum><header>Consent of leaseholder</header><text>The Secretary may not issue a permit for an activity described in paragraph (1) unless the applicable leaseholder consents to the issuance of that permit.</text></paragraph></subsection><subsection commented="no" id="H23B2D4F2E9394F7EB7E545D98B313907"><enum>(d)</enum><header>Categorical exclusions</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall determine whether any of the actions for which a permit may be issued under subsection (c)(1), or any actions that may be carried out pursuant to constructing or operating systems or facilities for the production, transportation, storage, or transmission of energy from solar or wind resources on areas not subject to an existing Federal energy lease, are a category of actions that normally do not significantly affect the quality of the human environment within the meaning of section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>).</text></subsection><subsection commented="no" id="H3A6B3386BC034997B0F72B4BD2CD4735"><enum>(e)</enum><header>Rulemaking</header><text>The Secretary shall issue a rule to carry out this section.</text></subsection></section></legis-body></bill>
