which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Combat-Injured Veterans Tax Fairness Act of 2016 to apply to members of the Coast Guard when the Coast Guard is not operating as a service in the Department of the Navy, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H12E400C8CDC544D98C9B40F206BA0574"><section section-type="section-one" id="H1346C2C22D144991871486390CBCD647"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coast Guard Combat-Injured Tax Fairness Act</short-title></quote>.</text></section><section id="H2765C82845D24D08B4E009CFF7A743A2"><enum>2.</enum><header>Restoration of amounts improperly withheld for tax purposes from severance payments to veterans of the Coast Guard with combat-related injuries</header><subsection id="HF740A214E99042E28147CED1EFB00A28"><enum>(a)</enum><header>Application to members of the Coast Guard when the Coast Guard is not operating as a service in the Department of the Navy</header><text display-inline="yes-display-inline">The Combat-Injured Veterans Tax Fairness Act of 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/292">Public Law 114–292</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/1212">10 U.S.C. 1212</external-xref> note) is amended—</text><paragraph id="HE56F283CCC86484AB4554B00F7670F21"><enum>(1)</enum><text display-inline="yes-display-inline">in section 3(a)—</text><subparagraph id="idA536E52E5C024B79937DE00B88DBEA99"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by inserting <quote>(and the Secretary of Homeland Security, with respect to the Coast Guard when it is not operating as a service in the Department of the Navy, and the Secretary of Transportation, with respect to the Coast Guard during the period in which it was operating as a service in the Department of Transportation)</quote> after <quote>the Secretary of Defense</quote>; and</text></subparagraph><subparagraph id="id84EC33421AD54EDDACFE16722B323C89"><enum>(B)</enum><text>in paragraph (1)(A)—</text><clause id="idCEA52DA823174018A529C42A5DEDFEA0"><enum>(i)</enum><text>in clause (i), by striking <quote>the Secretary</quote> and inserting <quote>the Secretary of Defense (or the Secretary of Homeland Security or the Secretary of Transportation, with respect to the Coast Guard, as applicable)</quote>; </text></clause><clause id="id9E8EAE1D23FF43478F272D1C72B87143"><enum>(ii)</enum><text>in clause (ii), by striking <quote>the Secretary</quote> and inserting <quote>the Secretary of Defense (or the Secretary of Homeland Security or the Secretary of Transportation, with respect to the Coast Guard, as applicable)</quote>; and </text></clause><clause id="idD2D1627AC98F43C89AFBCD59F1B95FFE"><enum>(iii)</enum><text>in clause (iv), by striking <quote>the Secretary</quote> and inserting <quote>the Secretary of Defense (or the Secretary of Homeland Security or the Secretary of Transportation, with respect to the Coast Guard, as applicable)</quote>;</text></clause></subparagraph></paragraph><paragraph id="HA76B693D4A2740428F5D33B170C2D463"><enum>(2)</enum><text>in section 4—</text><subparagraph id="H4DA316BC810346FAA880E68F724F6E6F"><enum>(A)</enum><text>in the section heading, by inserting <quote><header-in-text level="section" style="OLC">and Secretary of Homeland Security</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">Secretary of Defense</header-in-text></quote>;</text></subparagraph><subparagraph id="HC68AEF93590B4366B090D420443C2ED3"><enum>(B)</enum><text>by inserting <quote>(and the Secretary of Homeland Security with respect to the Coast Guard when it is not operating as a service in the Department of the Navy)</quote> after <quote>The Secretary of Defense</quote>; and</text></subparagraph><subparagraph id="HB780CDDBEEC74E0FABAA249CD490E0FB"><enum>(C)</enum><text>by striking <quote>made by the Secretary</quote> and inserting <quote>made by the Secretary of Defense (or the Secretary of Homeland Security with respect to the Coast Guard)</quote>; and </text></subparagraph></paragraph><paragraph id="id611DDD0EA1894722B032C4B1515EE2E7"><enum>(3)</enum><text>in section 5—</text><subparagraph id="idF2CD963753234251B390A9E50315D8E2"><enum>(A)</enum><text>in subsection (a)—</text><clause id="id08AA325A29C343658A6C5BD020E811A9"><enum>(i)</enum><text>by inserting <quote>(and the Secretary of Homeland Security, with respect to the Coast Guard when it is not operating as a service in the Department of the Navy, and the Secretary of Transportation, with respect to the Coast Guard during the period in which it was operating as a service in the Department of Transportation)</quote> after <quote>the Secretary of Defense</quote>; and</text></clause><clause id="idFD633AA598C44EBA903A6CA896750964"><enum>(ii)</enum><text>by striking <quote>the Secretary to</quote> and inserting <quote>the Secretary of Defense (or the Secretary of Homeland Security or the Secretary of Transportation, with respect to the Coast Guard, as applicable) to</quote>; and</text></clause></subparagraph><subparagraph id="id8D2CD07F221D4092BEBA4AB174C10261"><enum>(B)</enum><text>in subsection (b)—</text><clause id="id31F55E0172844090878F8ADFF269073E"><enum>(i)</enum><text>in paragraph (2), by striking <quote>the Secretary</quote> and inserting <quote>the Secretary of Defense (or the Secretary of Homeland Security or the Secretary of Transportation, with respect to the Coast Guard, as applicable)</quote>; and </text></clause><clause id="id4737A0DFBE87400DA938919A0AF9E4DC"><enum>(ii)</enum><text>in paragraph (3), by striking <quote>the Secretary</quote> and inserting <quote>the Secretary of Defense (or the Secretary of Homeland Security, with respect to the Coast Guard when it is not operating as a service in the Department of the Navy)</quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="H2DA6C8DEAD25457188C4B37CE5EC2756"><enum>(b)</enum><header>Deadlines</header><paragraph id="id1D426B0B04B9437897C4CAA8DC09E35A"><enum>(1)</enum><header>Identification of amounts improperly withheld and reporting</header><text display-inline="yes-display-inline">The Secretary of Homeland Security and the Secretary of Transportation shall carry out the requirements under—</text><subparagraph id="id6F06FA447CFA47059F5BC79E1ED412F2"><enum>(A)</enum><text display-inline="yes-display-inline">section 3(a) of the Combat-Injured Veterans Tax Fairness Act of 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/292">Public Law 114–292</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/1212">10 U.S.C. 1212</external-xref> note), as amended by subsection (a)(1), not later than one year after the date of the enactment of this Act; and</text></subparagraph><subparagraph id="idEE9B7ADCC1B247C9ABB873404C0353A1"><enum>(B)</enum><text>section 5 of that Act, as amended by subsection (a)(3), not later than one year after the date of the enactment of this Act.</text></subparagraph></paragraph><paragraph id="id9A35DD287BAA4D68896B28A83E5C14BD"><enum>(2)</enum><header>Ensuring amounts are not improperly withheld</header><text>The Secretary of Homeland Security shall carry out the requirements under section 4 of the Combat-Injured Veterans Tax Fairness Act of 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/292">Public Law 114–292</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/1212">10 U.S.C. 1212</external-xref> note), as amended by subsection (a)(2), beginning on the date of the enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
