which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Older Americans Act of 1965 to enhance the longevity, dignity, empowerment, and respect of older individuals who are Native Americans, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhancing Native Elders' Longevity, Dignity, Empowerment, and Respect Act</short-title></quote> or the <quote><short-title>Native ELDER Act</short-title></quote>.</text></section><section id="id4d86bb28ddf646038f6c7ee252df169c"><enum>2.</enum><header>Older Americans Tribal Advisory Committee</header><text display-inline="no-display-inline">Section 201(c) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3011">42 U.S.C. 3011(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBBB97C5DD8364A1FA51359CCF3FC02AF"><paragraph commented="no" display-inline="no-display-inline" id="id4a00a744d54e427090bf8a20c950806d" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id6e0d2ed23f6e4c05928960472cd33bea"><enum>(A)</enum><text>In this paragraph:</text><clause commented="no" display-inline="no-display-inline" id="idf73beb0e887748e98090bb40c96ee99e" indent="up1"><enum>(i)</enum><text>The term <term>Native Hawaiian</term> has the meaning given such term in section 625.</text></clause><clause id="HF804544E780843A98DC7F0CD843C36C3" indent="up1"><enum>(ii)</enum><text>The term <term>relevant committees of Congress</term> means—</text><subclause id="H966CC30170CC47488403F6A06973B0AB"><enum>(I)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id68dde6a0502c428dacff20c9d1ddac55"><enum>(II)</enum><text>the Committee on Education and Workforce of the House of Representatives; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idad3c173ff59a4fb79bf5932730370233"><enum>(III)</enum><text>the Committee on Indian Affairs of the Senate; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc7a8242e48f748c3b1c29dfc3d9f8c3c"><enum>(IV)</enum><text>the Subcommittee on Indian and Insular Affairs of the Committee on Natural Resources of the House of Representatives.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idf6347a9f77eb43e19cc66191c659a910"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id2dbd60880cd74e86a302ee9b8807fbd9"><enum>(i)</enum><text>From amounts appropriated pursuant to section 216(a), the Assistant Secretary shall establish, within the Office for American Indian, Alaskan Native, and Native Hawaiian Programs, an advisory committee, to be known as the <quote>Older Americans Tribal Advisory Committee</quote> (referred to in this paragraph as the <term>Committee</term>) to provide advice and guidance to the Assistant Secretary on matters relating to Native Americans under this Act. </text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id01ce78b0783e463ebadaeacd32473dd0"><enum>(ii)</enum><text>The Committee shall facilitate, but not supplant, government-to-government consultation between the Administration and Indian tribes and confer with organizations representing Native Hawaiians.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id756969327f004a028ec29a0478d1abe7"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id8949d28d51094470bd19d14f202f7275"><enum>(i)</enum><text>The Committee shall be composed of 11 members, of whom—</text><subclause id="HC870FBC64C444AC8B379FCEE4653008E" indent="up1"><enum>(I)</enum><text>3 shall be appointed by the Assistant Secretary;</text></subclause><subclause id="H71075E1680144B3CB6F077205E71F3DE" indent="up1"><enum>(II)</enum><text>1 shall be appointed by the chairperson of the Committee on Indian Affairs of the Senate;</text></subclause><subclause id="H1B3C66E6895A441A9446D4F5B430B8E2" indent="up1"><enum>(III)</enum><text>1 shall be appointed by the ranking member of the Committee on Indian Affairs of the Senate;</text></subclause><subclause id="HF4B91B53A3A14E5FB5ED78153008352A" indent="up1"><enum>(IV)</enum><text display-inline="yes-display-inline">1 shall be appointed by the chairperson of the Committee on Health, Education, Labor, and Pensions of the Senate;</text></subclause><subclause id="H74FCE88E14BF4432B5F02BCD90A623A3" indent="up1"><enum>(V)</enum><text>1 shall be appointed by the ranking member of the Committee on Health, Education, Labor, and Pensions of the Senate;</text></subclause><subclause id="HA80DDCBB28B34CEDA46759869E4B27AD" indent="up1"><enum>(VI)</enum><text>1 shall be appointed by the chairperson of the Committee on Education and Workforce of the House of Representatives; </text></subclause><subclause id="HCFA8CBF30BC748F79E3682C25A7CF67E" indent="up1"><enum>(VII)</enum><text>1 shall be appointed by the ranking member of the Committee on Education and Workforce of the House of Representatives;</text></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="idc13210609f334f6eadef58c5300078ca"><enum>(VIII)</enum><text>1 shall be appointed by the chairperson of the Subcommittee on Indian and Insular Affairs of the Committee on Natural Resources of the House of Representatives; and</text></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="id33f971837c6647f8ad2e826b214899b1"><enum>(IX)</enum><text>1 shall be appointed by the ranking member of the Subcommittee on Indian and Insular Affairs of the Committee on Natural Resources of the House of Representatives.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="idf9008d2b3f124fb6b6a8c471f521b748"><enum>(ii)</enum><text>Nominations for members of the Committee shall be from any of the following:</text><subclause id="HA4BA052928A045A0B0CD26F665636B68"><enum>(I)</enum><text>Indian tribes.</text></subclause><subclause id="HE83F0DEDB7B3445C9C9F7A329AFB4576"><enum>(II)</enum><text>Tribal organizations.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide1a7f270341342aab5de106d2bfa76d7"><enum>(III)</enum><text>Organizations representing Native Hawaiians.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id1f19aee0bb0f4a40833d3b89aed05022"><enum>(iii)</enum><text>To the maximum extent feasible, the Assistant Secretary shall work with the individuals making appointments under clause (i) to ensure—</text><subclause commented="no" display-inline="no-display-inline" id="ide3dc50cbb21049b79e6a513a3a9c6ca9"><enum>(I)</enum><text display-inline="yes-display-inline">that the members of the Committee represent a diverse set of expertise on issues relating to geographic regions, Indian tribes, organizations representing Native Hawaiians, and the health and well-being of Native Americans; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id35ce74b46fb34e01bbef31b494a02de5"><enum>(II)</enum><text>that not less than one member is an Alaskan Native; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id25058d0642564284915607d7b4521dd6"><enum>(III)</enum><text>that not less than one member is a Native Hawaiian.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id698ac7dd7cbd4c69a1beed3bec92f760"><enum>(iv)</enum><text>No member of the Committee shall be an officer or employee of the Federal Government.</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id84164db3d78f43cea69a58689c93edf8"><enum>(v)</enum><subclause commented="no" display-inline="yes-display-inline" id="ide4c15056094a46f7b8526c98a06121b7"><enum>(I)</enum><text>Each member of the Committee—</text><item commented="no" display-inline="no-display-inline" indent="up1" id="id621458d6a8944bf980bd0237f0088323"><enum>(aa)</enum><text>subject to subclause (II), shall be appointed to a 3-year term; and</text></item><item commented="no" display-inline="no-display-inline" indent="up1" id="id2b732d9063d74c2bacc895efff1eedc1"><enum>(bb)</enum><text>may be reappointed to not more than 3 consecutive terms.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="idfd165bd648eb498bbae8806a7ceab355"><enum>(II)</enum><text>The first 3 appointments by the Assistant Secretary under clause (i)(I) shall be for a 2-year term.</text></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="id0f1ed93f003349499383f58b1b80a721"><enum>(III)</enum><text>Any vacancy in the Committee shall be filled in the same manner as the original appointment not more than 90 days after the date on which the position becomes vacant.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id1730dc5c19d14abb87ebdde1e72ca716"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="id9dbc522f11574997bcc21efdb43da675"><enum>(i)</enum><text>The Committee shall meet in person not less than twice each year.</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id6d591f5bf4cb4a61925f2c03bbae78e0"><enum>(ii)</enum><text>Not fewer than 1 representative from the Office for American Indian, Alaskan Native, and Native Hawaiian Programs shall be present at each meeting of the Committee. <italic></italic></text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="id2efc4cdd262442fd865b20f97c801c38"><enum>(iii)</enum><text display-inline="yes-display-inline">Any representatives from the Office for American Indian, Alaskan Native, and Native Hawaiian Programs shall be nonvoting representatives at meetings of the Committee.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id71c66d0d32904ceb95d535bc20019260"><enum>(E)</enum><text>The Committee shall—</text><clause commented="no" display-inline="no-display-inline" id="id6557536a0ee24c32ada2231cfc44e1e4"><enum>(i)</enum><text>identify evolving issues of relevance to Native Americans relating to programs of the Administration under this Act;</text></clause><clause commented="no" display-inline="no-display-inline" id="id699c1ecf516944448e3c6994f0e90b40"><enum>(ii)</enum><text>communicate to the Assistant Secretary the issues identified under clause (i);</text></clause><clause commented="no" display-inline="no-display-inline" id="idfd6ef194ecbb4e7fb1f4f1254b641bae"><enum>(iii)</enum><text>submit to the Assistant Secretary recommendations for, and solutions to—</text><subclause commented="no" display-inline="no-display-inline" id="id79975755bc0c4b64a59619e52ef09f8e"><enum>(I)</enum><text>the issues identified under clause (i);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd154dcf40b1e4a2da511b09efbc0f829"><enum>(II)</enum><text>issues relating to this Act involving Native Americans raised at the Tribal, regional, or national level; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6e88cab575c34154aabbfc2b482a812d"><enum>(III)</enum><text>issues relating to any Tribal consultation carried out by the Administration under this Act;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id4aa9064078044b91b10e6721ed8c59af"><enum>(iv)</enum><text>discuss issues and proposals for changes to the regulations, policies, and procedures of the Administration under this Act that impact Native Americans;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9de3a8e0bef44afe9fa1cf370983918b"><enum>(v)</enum><text>identify priorities and provide advice on appropriate strategies for Tribal consultation on issues under this Act at the Tribal, regional, or national level regarding the Administration;</text></clause><clause commented="no" display-inline="no-display-inline" id="id19a7227c37a54842b29c03e9ce8ab0a2"><enum>(vi)</enum><text>ensure that pertinent issues of the Administration under this Act are brought to the attention of an Indian tribe and organization representing Native Hawaiians in a timely manner so that timely feedback from an Indian tribe and organization representing Native Hawaiians can be obtained; </text></clause><clause commented="no" display-inline="no-display-inline" id="id90e0c2bf5e5f41eab88c29561a6a1766"><enum>(vii)</enum><text>identify and propose solutions to any interdepartmental barrier between the Administration and other Federal agencies; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idca5b426a8c7140b1aaecc9c69f08c559"><enum>(viii)</enum><text>coordinate with the Secretary of Labor, the Administrator of the Centers for Medicare &amp; Medicaid Services, and the Director of the Indian Health Service on relevant issues.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idd5a221b0c1ac4f749e06082c4052a606"><enum>(F)</enum><clause commented="no" display-inline="yes-display-inline" id="idc3479bb8eb7f4a338ab3e42e6dc4d5cb"><enum>(i)</enum><text>Not less frequently than once each year, the Committee shall submit to the Assistant Secretary and the relevant committees of Congress a report that describes—</text><subclause commented="no" display-inline="no-display-inline" indent="up1" id="idafb9ec6ccd8342289dc9240be4a9da61"><enum>(I)</enum><text>the activities of the Committee during the previous year; and</text></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="id580111716b8748bc8751cb852fc6bb4a"><enum>(II)</enum><text>recommendations for legislative or administrative action for the following year.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="idc58b460e2d3b4669898687c7f2984f53"><enum>(ii)</enum><text>Not more than 45 days after the date on which the Assistant Secretary receives a report under clause (i), the Assistant Secretary shall submit a written response to that report to—</text><subclause commented="no" display-inline="no-display-inline" id="idbaf29846352b4b838bfaea2bcd636b20"><enum>(I)</enum><text>the Committee; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4354428b66a9423abfb4f7d8904a7a85"><enum>(II)</enum><text>the relevant committees of Congress.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id451828329c224e8cbbc80f2ba8e6117e"><enum>(G)</enum><text>Members of the Committee shall be compensated at a rate equal to the daily equivalent of the annual rate of basic pay prescribed for level IV of the Executive Schedule under section 5315 of title 5, United States Code, for each day (including travel time) during which the member is engaged in the performance of the duties of the Committee.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id3000e452d0fa4837bdbe2608e4e3bc6a"><enum>(H)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code, shall not apply to the Committee.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idd272f35a27be44dbb35661931631803f"><enum>3.</enum><header>Supporting services for healthy aging and independence</header><text display-inline="no-display-inline">Section 636(b)(2) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3057k-21">42 U.S.C. 3057k–21(b)(2)</external-xref>) is amended by striking <quote>in-home assistance</quote> and inserting <quote>in-home assistance (including for the modification of homes that is necessary to facilitate the ability of older individuals to remain at home)</quote>.<italic></italic></text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id1a1f91f04a3842c5ab6d8403e9cea77b"><enum>4.</enum><header>Funding set aside</header><text display-inline="no-display-inline">Section 644 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3057o">42 U.S.C. 3057o</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id17c09d3ce7de4a1091c1640d108ac475"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>not more than</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6c4d2e4553c3419da0c1b50a19145359"><enum>(2)</enum><text>in paragraphs (1) and (2), by striking <quote>2019</quote> and inserting <quote>2025</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id6845595cc20a432190f3129794e5b6dc"><enum>5.</enum><header>Technical assistance and training programs</header><text display-inline="no-display-inline">Section 201(c)(3)(H) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3011">42 U.S.C. 3011(c)(3)(H)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7EA8F3C087D24F5688A4598DF25D59B6"><subparagraph commented="no" display-inline="no-display-inline" id="idcf234b71c1864fdbbc4bfdbda61abb82" indent="up1"><enum>(H)</enum><text>develop and provide technical assistance and training programs to grantees under title VI, which technical assistance and training programs—</text><clause commented="no" display-inline="no-display-inline" id="ide97f4ee5ba434735a6a61f1e4134b3b5"><enum>(i)</enum><text display-inline="yes-display-inline">shall ensure adequate organizational capacity to deliver the services under such title; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ide84eee28c6bf47779d4890af467a02da"><enum>(ii)</enum><text display-inline="yes-display-inline">may include topics such as program management, data development and use, basic business skills, grant development, program and service innovations, and staff training and certification;</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id3fa32a27acbc43d2985215ae32b7691d"><enum>6.</enum><header display-inline="yes-display-inline">Reports</header><subsection commented="no" display-inline="no-display-inline" id="id729f8429fb5f437f8acd32548eab858c"><enum>(a)</enum><header display-inline="yes-display-inline">Assistant Secretary for Aging</header><paragraph commented="no" display-inline="no-display-inline" id="id4dbdc59355e74b74b4f4d44a0c6998ee"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Assistant Secretary for Aging shall submit to the committees described in paragraph (2), and make publicly available, a report that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idecbf0d0df9c040c9a4a920214480c762"><enum>(A)</enum><text>evaluates the feasibility of modeling the Native American Caregiver Support Program under part C of title VI of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3057k-11">42 U.S.C. 3057k–11 et seq.</external-xref>) on the program of comprehensive assistance for family caregivers of eligible veterans under section 1720G(a) of title 38, United States Code; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9164770e43574a88aa9e13ebd28bb316"><enum>(B)</enum><text>evaluates the level of need for in-home services that include accessible home modifications for older individuals who are Native Americans, including the need for provisions under the Older Americans Act of 1965 to prioritize accessible home modifications as in-home services for such older individuals; and</text></subparagraph><subparagraph id="iddc1d4938f12643d2938161afc439973c"><enum>(C)</enum><text>evaluates and identifies barriers to Indian tribes accessing programs under title VI of the Older Americans Act of 1965, and coordination between programs funded under title III of such Act and programs funded under title VI of such Act, including by—</text><clause commented="no" display-inline="no-display-inline" id="id35d831852000484e9f2b94a25c1c9aa3"><enum>(i)</enum><text display-inline="yes-display-inline">assessing the impacts of population-based formulas and tribal service population requirements on program participation;</text></clause><clause commented="no" display-inline="no-display-inline" id="id481e62e0a67944959cf4ea6cdc3843a0"><enum>(ii)</enum><text display-inline="yes-display-inline">identifying the number of Indians unserved by programs under such title VI; </text></clause><clause commented="no" display-inline="no-display-inline" id="idabc59496ccc24bf8bd8e11f8287ea494"><enum>(iii)</enum><text display-inline="yes-display-inline">identifying the States making grants to Indian tribes under title III of such Act; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id1f65518f11294cbe87af33a98c876ecf"><enum>(iv)</enum><text display-inline="yes-display-inline">providing estimates of funding necessary to support programs under title VI of such Act for all tribal organizations not eligible under such title as in effect on the date of enactment of this Act.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb037a1c72e95422c8ad7ccec82212f47"><enum>(2)</enum><header>Committees of Congress</header><text>The committees described in this paragraph are—</text><subparagraph commented="no" display-inline="no-display-inline" id="idefb7a4f5d683477e8fb432de6fa7e458"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Health, Education, Labor, and Pensions of the Senate;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0740dc08204d49d9958e3566ef12ce3d"><enum>(B)</enum><text>the Committee on Education and Workforce of the House of Representatives; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb9517a380c284fe498e1fdd74162bea2"><enum>(C)</enum><text>the Committee on Indian Affairs of the Senate; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5449dbc7d6a54ee4afe30c980dd04cb8"><enum>(D)</enum><text>the Subcommittee on Indian and Insular Affairs of the Committee on Natural Resources of the House of Representatives. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id26996629c9bd4af08005f2ad93cef761"><enum>(b)</enum><header>Secretary of Labor</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Labor shall submit a report to Congress on how recipients of funding under title V of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3056">42 U.S.C. 3056 et seq.</external-xref>) are serving older individuals who are Native Americans with such funding. </text></subsection></section></legis-body></bill>
