which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require U.S. Immigration and Customs Enforcement to take into custody certain aliens who have been charged in the United States with a crime that resulted in the death or serious bodily injury of another person, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Sarah's Law</short-title></quote>.</text></section><section id="id3B8DA993688842248D9749D79795A0BB"><enum>2.</enum><header>Mandatory detention of certain aliens charged with a crime resulting in death or serious bodily injury</header><text display-inline="no-display-inline">Section 236(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226(c)</external-xref>) is amended—</text><paragraph id="idFDDD9C3295C741AB984B559B07C73FFA"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="id3CD82C62169B4BA799DF5BAAA630F609"><enum>(A)</enum><text>in subparagraph (A), by striking the comma at the end and inserting a semicolon;</text></subparagraph><subparagraph id="idEA77C59017764726AF62127D8660BD73"><enum>(B)</enum><text>in subparagraph (B), by striking the comma at the end and inserting a semicolon; </text></subparagraph><subparagraph id="id4D4C5E86A39B4F71BF604C4871B1E2F7"><enum>(C)</enum><text>in subparagraph (C)—</text><clause id="id61EB01ABE38C4A16AED019F1F074B90C"><enum>(i)</enum><text>by striking <quote>sentence</quote> and inserting <quote>sentenced</quote>; and</text></clause><clause id="idEF04BBA744044846970F661B4B08FFEA"><enum>(ii)</enum><text>by striking <quote>, or</quote> and inserting a semicolon;</text></clause></subparagraph><subparagraph id="id8B1CA5E75E6E4B07AF2C1FBA4C8A9ABA"><enum>(D)</enum><text>in subparagraph (D), by striking the comma at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="id1F76C34E1675442B96FFD7EAC644073B"><enum>(E)</enum><text>by inserting after subparagraph (D) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA1E5DFA0F3B743B38125C8918BABA946"><subparagraph id="idADB9D8CEB5814B7982E5BF0260992696"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="id13E76E896C7D4502A72AC8ACCBC2735B"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id9993D488EAE04B2CB2A159589388B269"><enum>(I)</enum><text>was not inspected and admitted into the United States;</text></subclause><subclause id="idBD30E64D0604425D9C30783FE3EC0717" indent="up2"><enum>(II)</enum><text>held a nonimmigrant visa (or other documentation authorizing admission into the United States as a nonimmigrant) that has been revoked under section 221(i); or</text></subclause><subclause id="id6A355DBBE8F7486EA3DE4AED07EB8568" indent="up2"><enum>(III)</enum><text>is described in section 237(a)(1)(C)(i); and</text></subclause></clause><clause id="idB53658B8BFF440F989ADBEA1650350A5" indent="up1"><enum>(ii)</enum><text>has been charged by a prosecuting authority in the United States with any crime that resulted in the death or serious bodily injury (as defined in section 1365(h)(3) of title 18, United States Code) of another person,</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idA4242D47C7124200B7D0CF6D3A816E02"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3F1C6C138DC2408DB8C117B3F556285F"><paragraph id="id30E1280199524FEF94326B6766D93721"><enum>(3)</enum><header>Notification requirement</header><text>Upon encountering or gaining knowledge of an alien described in paragraph (1), the Assistant Secretary of Homeland Security for Immigration and Customs Enforcement shall make reasonable efforts—</text><subparagraph id="id73A6D9CEACD64CB4BC9CF69B40779530"><enum>(A)</enum><text>to obtain information from law enforcement agencies and from other available sources regarding the identity of any victims of the crimes for which such alien was charged or convicted; and</text></subparagraph><subparagraph id="id9E853285649C49379B6D5F4B33D8577B"><enum>(B)</enum><text>to provide the victim or, if the victim is deceased, a parent, guardian, spouse, or closest living relative of such victim, with information, on a timely and ongoing basis, including—</text><clause id="idD781CCEF7E63462B8D4CE043DE89A47B"><enum>(i)</enum><text>the alien’s full name, aliases, date of birth, and country of nationality;</text></clause><clause id="id5253B817FC00444AA542A459C84939A5"><enum>(ii)</enum><text>the alien’s immigration status and criminal history;</text></clause><clause id="idBD348489AFEB4B8CAD2265BBB1EB28D7"><enum>(iii)</enum><text>the alien’s custody status and any changes related to the alien’s custody; and</text></clause><clause id="id75003DFFB74D4B6D95A000894EFA7413"><enum>(iv)</enum><text>a description of any efforts by the United States Government to remove the alien from the United States.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idA6C8C9A0BBD64EDB8B97969426FC9F30"><enum>3.</enum><header>Savings provision</header><text display-inline="no-display-inline">Nothing in this Act, or the amendments made by this Act, may be construed to limit the rights of crime victims under any other provision of law, including section 3771 of title 18, United States Code.</text></section></legis-body></bill>
