BILL</legis-type><official-title>To ensure that there are no reductions in funding for critical education programs for fiscal years 2025, 2026, and 2027, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Cuts to Public Schools Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idad1fd281d0f44de893db086869ebc146"><enum>2.</enum><header>Maintaining funding for certain education programs</header><subsection commented="no" display-inline="no-display-inline" id="id40bd715250fc492c8016fe33be756fce"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id2aa1d41c5d3d42c7a9c10257b39a97e5"><enum>(1)</enum><header display-inline="yes-display-inline">Critical education program</header><text>The term <term>critical education program</term> means each of the following:</text><subparagraph id="id8329f0ce21664270ae337f404b79c1c4"><enum>(A)</enum><text>The Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400 et seq.</external-xref>).</text></subparagraph><subparagraph id="id93ba0cca2c384010a0d730b3dd7a61bf"><enum>(B)</enum><text>Part A of title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd8218c71625547b59ad5e6d282178c0a"><enum>(C)</enum><text>Part B of title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6361">20 U.S.C. 6361 et seq.</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd25be7c79b324cbf82928645c4ecd23c"><enum>(D)</enum><text display-inline="yes-display-inline">Part C of title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6391">20 U.S.C. 6391 et seq.</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf65c855899104d3e8e47126a0ec0cf5c"><enum>(E)</enum><text display-inline="yes-display-inline">Part D of title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6421">20 U.S.C. 6421 et seq.</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddb1cf66ddb034b938bc96acaff5a7f26"><enum>(F)</enum><text display-inline="yes-display-inline">Part A of title II of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6611">20 U.S.C. 6611 et seq.</external-xref>).</text></subparagraph><subparagraph id="idc5cb0f0963394b869fb36ee09580a63c"><enum>(G)</enum><text>Title III of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6801">20 U.S.C. 6801 et seq.</external-xref>).</text></subparagraph><subparagraph id="id097b4bc69f494979a3cab99f356139e7"><enum>(H)</enum><text>Part A of title IV of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7101">20 U.S.C. 7101 et seq.</external-xref>). </text></subparagraph><subparagraph id="idf9238e33d2f2499eb391a86a6c511b00"><enum>(I)</enum><text>Part B of title IV of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7171">20 U.S.C. 7171 et seq.</external-xref>).</text></subparagraph><subparagraph id="id9043f4e30e634ec09171d61c29ebae40"><enum>(J)</enum><text>Part B of title V of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7341">20 U.S.C. 7341 et seq.</external-xref>).</text></subparagraph><subparagraph id="id42962f1c78024184befcd4aaaca0e155"><enum>(K)</enum><text>Part A of title VI of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7401">20 U.S.C. 7401 et seq.</external-xref>).</text></subparagraph><subparagraph id="id8531e8f2bbfe48ca85a40ce345fc31e3"><enum>(L)</enum><text>Title VII of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7701">20 U.S.C. 7701 et seq.</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idde417fe595754046a2a5b6897138e8ba"><enum>(M)</enum><text>Subtitle B of title VII of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11431">42 U.S.C. 11431 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2671508e4a9b4387be710a063a92be86"><enum>(2)</enum><header display-inline="yes-display-inline">Reduction in funding</header><text display-inline="yes-display-inline">The term <term>reduction in funding</term>, when used with respect to a critical education program for a fiscal year, means the amount by which—</text><subparagraph commented="no" display-inline="no-display-inline" id="id55677c035bd748c3bdddf1086dd09ff5"><enum>(A)</enum><text>the total amount of funding appropriated for the critical education program for fiscal year 2024 under title III of division D of the Further Consolidated Appropriations Act, 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/47">Public Law 118–47</external-xref>; 138 Stat. 681), which shall be determined based on the funding allocation specified for the critical education program in the explanatory statement described in section 4 of such Act (<external-xref legal-doc="public-law" parsable-cite="pl/118/47">Public Law 118–47</external-xref>; 138 Stat. 461); exceeds</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id63062de525fd403da84aad58caaa6486"><enum>(B)</enum><text display-inline="yes-display-inline">the total amount of funding appropriated for the critical education program for the fiscal year for which the determination is being made under the applicable regular appropriation Act for such fiscal year, which shall be determined based on the funding allocation specified for the critical education program in the explanatory statement regarding such regular appropriation Act.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfa92e4f3e804490c87d8b9237c44b19f"><enum>(3)</enum><header>Regular appropriation Act</header><text display-inline="yes-display-inline">The term <term>regular appropriation Act</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbf105f5bcc8c4706a26770e521c245f2"><enum>(A)</enum><text display-inline="yes-display-inline"> means an annual appropriation Act providing new budget authority (as defined in section 3 of the Congressional Budget and Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/622">2 U.S.C. 622</external-xref>)) for the programs, projects, and activities under the jurisdiction of a subcommittee of the Committee on Appropriations of the Senate through September 30 of a fiscal year; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0821046bfc67459d8e54a41fddf150c4"><enum>(B)</enum><text display-inline="yes-display-inline">includes—</text><clause commented="no" display-inline="no-display-inline" id="id662256e42c574817b67621fd3dabac3e"><enum>(i)</enum><text>an Act referred to in section 105 of title 1, United States Code;</text></clause><clause commented="no" display-inline="no-display-inline" id="id3928bbbcf6c94b2f89036efdffacc574"><enum>(ii)</enum><text display-inline="yes-display-inline">a title, division, or other subdivision of an Act or resolution that, if it were a separate Act, would be an Act described in subparagraph (A); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1a922590830e44729c695ce850b4bbec"><enum>(iii)</enum><text display-inline="yes-display-inline">a resolution or Act, or a title, division, or other subdivision of a resolution or Act, making continuing appropriations through September 30 of a fiscal year.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6d1a973555114274a7a60d0989a05a8d"><enum>(b)</enum><header display-inline="yes-display-inline">Ensuring adequate funding for critical education programs</header><paragraph commented="no" display-inline="no-display-inline" id="id3d7558b013194fa4a339a4f3323c0b14"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For each of fiscal years 2025, 2026, and 2027, effective on the date that is 30 days after the date of enactment of a regular appropriation Act appropriating funding for all critical education programs for such fiscal year, there is appropriated, out of any money in the Treasury not otherwise appropriated, for each critical education program an amount equal to any reduction in funding for the critical education program for such fiscal year. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcab61da20c3a449ba4070395e942894e"><enum>(2)</enum><header>Availability</header><text display-inline="yes-display-inline">Amounts appropriated under paragraph (1) for a fiscal year shall remain available until expended. </text></paragraph></subsection><subsection id="id25b754ac3b204696955ce22e77aafc0d"><enum>(c)</enum><header>Budgetary effects</header><paragraph id="idba77d35c00b847458ee6c01f0bb0ad24"><enum>(1)</enum><header>Statutory paygo scorecards</header><text>The budgetary effects of this section shall not be entered on either PAYGO scorecard maintained pursuant to section 4(d) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(d)</external-xref>).</text></paragraph><paragraph id="idd839b227f75146de8b3804a1a12c3a8f"><enum>(2)</enum><header>Senate paygo scorecards</header><text>The budgetary effects of this section shall not be entered on any PAYGO scorecard maintained for purposes of section 4106 of H. Con. Res. 71 (115th Congress). </text></paragraph></subsection></section></legis-body></bill>
