which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Truth in Lending Act to address certain issues relating to the extension of consumer credit, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="id050c9953ea80495386d0c41c3f6ac19e" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stopping Abuse and Fraud in Electronic Lending Act of 2025</short-title></quote> or the <quote><short-title>SAFE Lending Act of 2025</short-title></quote>.</text></section><section id="id9d609392b8794076ab6496f0a4dddc1b"><enum>2.</enum><header>Consumer control over bank accounts</header><subsection id="idfc241c678be94f27bed7bfc417b850d4"><enum>(a)</enum><header>Prohibiting unauthorized remotely created checks</header><text>Section 905 of the Electronic Fund Transfer Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1693c">15 U.S.C. 1693c</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id55a7ea5972894532b1ea3bb0cdb678d0"><subsection id="idd00c7c0b4c464afa90d895ed2c384e41"><enum>(d)</enum><header>Limitations on remotely created checks</header><paragraph id="ida673877423124221ab4d1fe150ec9636"><enum>(1)</enum><header>Definition</header><text>In this subsection—</text><subparagraph id="id02E1338A02F54724A491304E5A9E1A20"><enum>(A)</enum><text>the term <term>Federal consumer financial law</term> has the meaning given the term in section 1002 of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5481">12 U.S.C. 5481</external-xref>); and</text></subparagraph><subparagraph id="idB120B3F06C6A4F81A6D53B718B82788F"><enum>(B)</enum><text>the term <term>remotely created check</term> means a check, including a paper or electronic check and any other payment order that the Bureau, by rule, determines is appropriately covered under this subsection, that—</text><clause id="iddbdf0c897ebd44048ed4ecf108ece8ad"><enum>(i)</enum><text>is not created by the financial institution that holds the customer account from which the check is to be paid; and</text></clause><clause id="id066fdad4f5774d3daedbf52dd13d6e59"><enum>(ii)</enum><text>does not bear a signature applied, or purported to be applied, by the person from whose account the check is to be paid.</text></clause></subparagraph></paragraph><paragraph id="idE4801E3A0E844E1DBE6987836AF40726"><enum>(2)</enum><header>Limitations</header><text>Subject to the limitations in paragraph (3) and any additional limitations that the Bureau may establish, by rule, a remotely created check may only be issued by a person designated in writing by a consumer, with that written designation specifically provided by the consumer to the insured depository institution at which the consumer maintains the account from which the check is to be drawn.</text></paragraph><paragraph id="id16a79d77c83148e6bd9ed5639e325cb4"><enum>(3)</enum><header>Additional limitations</header><subparagraph id="idf2bb6ecbc4a64592ab97c081fe56fc71"><enum>(A)</enum><header>In general</header><text>A designation provided by a consumer under paragraph (2) may be revoked at any time by the consumer.</text></subparagraph><subparagraph id="id3d183b13ea4743ba9b853f639f7f3f78"><enum>(B)</enum><header>Consumer financial protection laws</header><text>No payment order, including a remotely created check, may be issued by any person in response to the exercise of, or attempt to exercise, any right by a consumer under—</text><clause id="id3B9D2D6E7A124865AA40D5405479F1C3"><enum>(i)</enum><text>any Federal consumer financial law; or</text></clause><clause id="id4191F227BE5D4058B006856A15897FF5"><enum>(ii)</enum><text>any other provision of any law or regulation within the jurisdiction of the Bureau.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id221f51d75abd4164a71f403e0317cdfc"><enum>(b)</enum><header>Consumer protections for certain one-Time electronic fund transfers</header><text>Section 913 of the Electronic Fund Transfer Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1693k">15 U.S.C. 1693k</external-xref>) is amended—</text><paragraph id="idc6b0cb3f87714c74bde00628d0b39bbe"><enum>(1)</enum><text>in the matter preceding paragraph (1), by inserting <quote>(a) <header-in-text level="subsection">In general.—</header-in-text></quote> before <quote>No person</quote>;</text></paragraph><paragraph id="id995a74d0a57c466abdc77e3b6b7aecff"><enum>(2)</enum><text>in subsection (a)(1), as so designated, by striking <quote>preauthorized electronic fund transfers</quote> and inserting <quote>an electronic fund transfer</quote>; and</text></paragraph><paragraph id="id2bb15fb2c7a146439cc5f10717c85d88"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf5dc62e304d84973884e72c6d7baf6f5"><subsection id="id6f57ed597b744eab8dc77c9c1765d9e4"><enum>(b)</enum><header>Treatment for electronic fund transfers in credit extensions</header><text>If a consumer voluntarily agrees to repay an extension of a small-dollar consumer credit transaction, as defined in section 110(a) of the Truth in Lending Act, by means of an electronic fund transfer, the electronic fund transfer shall be treated as a preauthorized electronic fund transfer subject to the protections of this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id9f8cac9c1aa54ec590ce07d8a4a3e5fb"><enum>3.</enum><header>Transparency and consumer empowerment in small-dollar lending</header><subsection id="id1171984FA1CD47BA846440369812B570"><enum>(a)</enum><header>Small-Dollar consumer credit transactions</header><paragraph id="id671ADB5E5D504474A856D620914540B2"><enum>(1)</enum><header>In general</header><text>The Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1601">15 U.S.C. 1601 et seq.</external-xref>) is amended—</text><subparagraph id="idE534EC1B8A674B92BD251E4718C42A6A"><enum>(A)</enum><text>by inserting after section 109 (<external-xref legal-doc="usc" parsable-cite="usc/15/1608">15 U.S.C. 1608</external-xref>) the following:</text><quoted-block style="OLC" act-name="" id="id4B66005A86D44C53B5C0DB46D8D52EF9"><section id="id8F65D75B533449ACA307B1E37B54D3F7"><enum>110.</enum><header>Registration requirement for small-dollar lenders</header><subsection id="id2DDD457B5C294F328D08F92A826AB18B"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>small-dollar consumer credit transaction</term>—</text><paragraph id="id182E1365303D4CEDA3550FB8922901B6"><enum>(1)</enum><text>means any transaction that extends credit that is—</text><subparagraph id="idfaf5298c25a54cf5bab7bb4a763e24ad"><enum>(A)</enum><text>made to a consumer in an amount that is not more than—</text><clause id="id4C7D97C58A134BBA9C0EE385FB17CF23"><enum>(i)</enum><text>$5,000; or</text></clause><clause id="idB6743DC8849542248A73F02A4425BB7A"><enum>(ii)</enum><text>such greater amount as the Bureau may, by rule, determine to reflect changes in the Consumer Price Index for all urban consumers published by the Department of Labor; and</text></clause></subparagraph><subparagraph id="id09d38cf172364cc19220c4680b439294"><enum>(B)</enum><text>extended pursuant to an agreement that is—</text><clause id="iddb3a2c959d5e432a9d30bd1d3b0ad8ff"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="idFECFC79AC0BC45F780941A313A7DF017"><enum>(I)</enum><text>other than an open end credit plan; and</text></subclause><subclause id="id08B60D93C5224B5C958A3B22D10616D6" indent="up1"><enum>(II)</enum><text>payable in 1 or more installments of less than 12 months;</text></subclause></clause><clause id="id58e63130e60e41e7bc1abe149277125d"><enum>(ii)</enum><text>an open end credit plan in which each advance is fully repayable within a defined time or in connection with a defined event, or both; or</text></clause><clause id="idc4b068f1fb35432f93dfd2bc0428763f"><enum>(iii)</enum><text>any other plan as the Bureau determines, by rule; and</text></clause></subparagraph></paragraph><paragraph id="id113DE995B7144EE98A755E58644C8A29"><enum>(2)</enum><text>includes any action that facilitates, brokers, arranges, or gathers applications for a transaction described in paragraph (1).</text></paragraph></subsection><subsection id="id32D4EA31E6C749A8B99FB0A218147D92"><enum>(b)</enum><header>Registration requirement</header><text>A person shall register with the Bureau before issuing credit in a small-dollar consumer credit transaction.</text></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id8CBF6EFBEB3842239BC72DC0D772AEA3"><enum>(B)</enum><text>in section 173 (<external-xref legal-doc="usc" parsable-cite="usc/15/1666j">15 U.S.C. 1666j</external-xref>), by adding at the end the following:</text><quoted-block style="OLC" act-name="" id="id9FD91D87D8A849458A5F3C871436671C"><subsection id="id6ABAAA854D6E41E6B1E54C662AC81E6F"><enum>(d)</enum><text>Notwithstanding any other provision of this title, any small-dollar consumer credit transaction, as defined in section 110(a), shall comply with the laws of the State in which the consumer to which credit in the transaction is extended resides with respect to annual percentage rates, interest, fees, charges, and such other similar or related matters as the Bureau may, by rule, determine if the small-dollar consumer credit transaction is—</text><paragraph id="id45D59468E16E485D98CBF88BA1E1F87A"><enum>(1)</enum><text>made—</text><subparagraph id="id03C6FAED74504C1C9E5C849F152A8C4C"><enum>(A)</enum><text>over the internet;</text></subparagraph><subparagraph id="id6FB95AC1B5944F419F9E71E189AC2CEC"><enum>(B)</enum><text>by telephone;</text></subparagraph><subparagraph id="id82DF953E6B6B4FD3B8F2545E26A4053B"><enum>(C)</enum><text>by facsimile;</text></subparagraph><subparagraph id="id33ECC9977C7C4F07BFF30D11C13846DE"><enum>(D)</enum><text>by mail;</text></subparagraph><subparagraph id="idE40490E05B734324891CF94F90AD4F5E"><enum>(E)</enum><text>by electronic mail; or</text></subparagraph><subparagraph id="idD8320AB2343A44A58E334D36AA94D5CF"><enum>(F)</enum><text>through another electronic communication; or</text></subparagraph></paragraph><paragraph id="id6F201BB73B204F6D9F9D6B93EAC0F8BA"><enum>(2)</enum><text>conducted by a national bank.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id51D3DB41871A4DD681AD2DD1649EAA2B"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of sections for chapter 1 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1601">15 U.S.C. 1601 et seq.</external-xref>) is amended by inserting after the item relating to section 109 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id895E0C4DC27F4E568D5F7E18094D131E"><toc><toc-entry bold="off" level="section">110. Registration requirement for small-dollar lenders.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idAA222B0635EF4CF5AE5A49568D1438FC"><enum>(b)</enum><header>Prohibition on certain fees</header><text>Section 915 of the Electronic Fund Transfer Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1693l-1">15 U.S.C. 1693l–1</external-xref>) is amended—</text><paragraph id="id469C8E95498D4B67AB841527E1A03DE3"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e); and</text></paragraph><paragraph id="idA73A9B72873D4D2586319D48CBD90BFA"><enum>(2)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" act-name="" id="id77A92138690B4E429EF5D7B6859F7053"><subsection id="id389C0B4874FC48179A5D7A728F0BE54C"><enum>(d)</enum><header>Additional fees prohibited</header><paragraph id="idE79CFB85DA7F41F2A4E55A4DE49FBBD8"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>prepaid account</term> has the meaning given the term in section 1005.2 of title 12, Code of Federal Regulations, or any successor regulation.</text></paragraph><paragraph id="id8dc738490dbf48928104a89135bf4dae"><enum>(2)</enum><header>Prohibition</header><text>With respect to the use of a prepaid account by a consumer—</text><subparagraph id="id615ED406CA484A9089C0D5230412337E"><enum>(A)</enum><text>it shall be unlawful for any person to charge the consumer a fee for an overdraft with respect to the prepaid account;</text></subparagraph><subparagraph id="id16C1362B769148E7922BA6DC39649118"><enum>(B)</enum><text>any transaction for an amount that exceeds the account balance of the prepaid account may be declined by the financial institution holding the prepaid account; and</text></subparagraph><subparagraph id="idA7C80DC1202648BDBAB7699636B85AF8"><enum>(C)</enum><text>the Bureau may, by rule, prohibit any person from charging a fee with respect to the prepaid account (other than a fee described in subparagraph (A)) so that the Bureau may—</text><clause id="id06FD35439D7541BE9762862F3D80E10D"><enum>(i)</enum><text>prevent unfair, deceptive, or abusive practices; and</text></clause><clause id="id84B8052A96064AC9A84D0D8D955F8F57"><enum>(ii)</enum><text>promote the ability of the consumer to understand and compare the costs of prepaid accounts.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id46a02fe487ef4f42a4d65884f62d3fe5"><enum>4.</enum><header>Restrictions on lead generation in small-dollar consumer credit transactions</header><subsection id="idCA82EDABE85642A3B6E011C06972B336"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 2 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1631">15 U.S.C. 1631 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBE6A520319DC41BCB45ABC2B2A1F404E"><section id="id0618ee513a5d4f84b2b0ba9035226a4f"><enum>140B.</enum><header>Restrictions on lead generation in small-dollar consumer credit transactions</header><subsection id="idafa7a78e48bb4bc3a4bce69425fe2d0d"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idD5E69E3B814A46B98EEFA5E4B2FF37D9"><enum>(1)</enum><text>the terms <term>Internet access service</term> and <term>Internet information location tool</term> have the meanings given those terms in section 231(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/231">47 U.S.C. 231(e)</external-xref>);</text></paragraph><paragraph id="id0c601050278f4c4e89e39957b2ce2b0c"><enum>(2)</enum><text>the term <term>sensitive personal financial information</term> means a social security number, financial account number, bank routing number, bank account number, or security or access code that is immediately necessary to permit access to the financial account of an individual; and</text></paragraph><paragraph id="id66ebfb0325bd434693e0b2550e9a6c40"><enum>(3)</enum><text>the term <term>small-dollar consumer credit transaction</term> has the meaning given the term in section 110(a).</text></paragraph></subsection><subsection id="id13c4ca5e1eaa44138ed0d3fd82d5192a"><enum>(b)</enum><header>Identification information</header><text>Any person facilitating, brokering, arranging for, or gathering applications for the distribution of sensitive personal financial information in connection with a small-dollar consumer credit transaction shall prominently disclose information by which the person may be contacted or identified, including for service of process and for identification of the registrant of any domain name registered or used.</text></subsection><subsection id="id8a7b5bd446134ca1b6ed497d7579ac3f"><enum>(c)</enum><header>Prohibition on lead generation in small-Dollar consumer credit transactions</header><text>No person may facilitate, broker, arrange for, or gather applications for the distribution of sensitive personal financial information in connection with a small-dollar consumer credit transaction unless the person is directly providing the small-dollar consumer credit to a consumer.</text></subsection><subsection id="id95c7d836fb9e4542bcbaa0a03b4e6979"><enum>(d)</enum><header>Rule of construction</header><paragraph id="iddae1a83b68ff4b248b01235638fccb7f"><enum>(1)</enum><header>In general</header><text>Nothing in this section may be construed to limit the authority of the Bureau to further restrict activities covered by this section.</text></paragraph><paragraph id="idbf8c39988b6e43c486c469e357558376"><enum>(2)</enum><header>Clarification</header><text>For the purposes of this section, it shall not be considered facilitating, brokering, arranging for, or gathering applications for the distribution of sensitive personal financial information in connection with a small-dollar consumer credit transaction to be engaged solely in one of the following activities:</text><subparagraph id="id3de1bb426c324723ad942b679e9d2389"><enum>(A)</enum><text>The provision of a telecommunications service, an Internet access service, or an Internet information location tool.</text></subparagraph><subparagraph id="id59b26cb734d146449f807a211095eda2"><enum>(B)</enum><text>The transmission, storage, retrieval, hosting, formatting, or translation (or any combination thereof) of a communication, without selection or alteration of the content of the communication, except the deletion of a particular communication or material made by another person in a manner that is consistent with section 230(c) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(c)</external-xref>).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id50A9AEC6BB82457F95C52452C4C01E9E"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for chapter 2 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1631">15 U.S.C. 1631 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1E07948F5D71432FA56E63CEBD2006E6"><toc><toc-entry bold="off" level="section">140B. Restrictions on lead generation in small-dollar consumer credit transactions.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id42634536524a4d9ca2952399609620f4"><enum>5.</enum><header>Studies</header><subsection id="id5E85F67DB9AA4532B2A40E9878D1A298"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idC2B9A028DFB141108DDAF2F3E6DD56FC"><enum>(1)</enum><text>the term <term>appropriate committees of Congress</term> means—</text><subparagraph id="id808BA33E866743B4B6EA4D0C7BBAF645"><enum>(A)</enum><text>the Committee on Banking, Housing, and Urban Affairs of the Senate;</text></subparagraph><subparagraph id="id2BBFD70207394918A9CB38645D069158"><enum>(B)</enum><text>the Committee on Indian Affairs of the Senate;</text></subparagraph><subparagraph id="id15A73E8626494A8AB9F74F258DED2B91"><enum>(C)</enum><text>the Committee on Financial Services of the House of Representatives; and</text></subparagraph><subparagraph id="id22EB77C871DE45DFABFC27FC4FD47B70"><enum>(D)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text></subparagraph></paragraph><paragraph id="id6FE98D82808A448F901A7CEB5F2C433C"><enum>(2)</enum><text>the term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph></subsection><subsection id="id700CF5B14B3B4666B409576A61819F32"><enum>(b)</enum><header>Study required</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Comptroller General of the United States shall conduct a study regarding—</text><paragraph id="id185196DFBBE349358DC922F81E3F01F6"><enum>(1)</enum><text display-inline="yes-display-inline">the availability of capital on reservations of Indian Tribes; and</text></paragraph><paragraph id="idA97070973DCE4F7E89769168CE01AABC"><enum>(2)</enum><text display-inline="yes-display-inline">the impact that small-dollar consumer credit extended through internet and non-internet means to members of Indian Tribes has had on economic opportunity and wealth for members of Indian Tribes.</text></paragraph></subsection><subsection id="id8A499F85BB064CA2B00F25E98984BE85"><enum>(c)</enum><header>Consultation</header><text display-inline="yes-display-inline">In conducting the study required under subsection (b), the Comptroller General of the United States shall consult, as appropriate, with—</text><paragraph id="id2455BDE05E594A4E8F44548F4BB97DA7"><enum>(1)</enum><text display-inline="yes-display-inline">the Bureau of Consumer Financial Protection;</text></paragraph><paragraph id="idBED03493FDBC4888869CA1A74182AF4F"><enum>(2)</enum><text display-inline="yes-display-inline">the Board of Governors of the Federal Reserve System;</text></paragraph><paragraph id="idE2BB4F7BE6274689BB4C129417D36D25"><enum>(3)</enum><text display-inline="yes-display-inline">the Director of the Bureau of Indian Affairs;</text></paragraph><paragraph id="idE6CEE760A09F448F92A0F5BFAC11610B"><enum>(4)</enum><text display-inline="yes-display-inline">federally recognized Indian Tribes; and</text></paragraph><paragraph id="id48527DA9E5CD44FC81E3A613FED7DA96"><enum>(5)</enum><text display-inline="yes-display-inline">community development financial institutions operating in Indian lands.</text></paragraph></subsection><subsection id="idB82720955D144C6BA1E5075A46C0B993" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Congressional consideration</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall submit to the appropriate committees of Congress the study required under subsection (b).</text></subsection></section><section id="iddac395be908b4d81a7a3a6f53b24fbfe"><enum>6.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Bureau of Consumer Financial Protection shall adopt any final rules that are necessary to implement the provisions of this Act and the amendments made by this Act.</text></section></legis-body></bill>
