which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require agencies to publish an advance notice of proposed rule making for major rules.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" changed="not-changed" id="id4af35b1c-39ae-464b-875a-34042ce3b7a3"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Early Participation in Regulations Act of 2025</short-title></quote>.</text></section><section changed="not-changed" id="idb542322c-f784-479d-9bbe-d79b88752b16"><enum>2.</enum><header>Advance notice of proposed rule making</header><text display-inline="no-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, is amended—</text><paragraph id="ide95e249c-ec75-451b-800c-0af16fe2a672" changed="not-changed"><enum>(1)</enum><text>in section 551—</text><subparagraph id="id3924bdd9-eec2-48b7-8e83-fec0489d74a1" changed="not-changed"><enum>(A)</enum><text>in paragraph (13), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id7e616f43-60ce-4970-8242-6c16f1598847" changed="not-changed"><enum>(B)</enum><text>in paragraph (14), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="id5e086b7d-dbcb-473e-8610-7de1173f1374" changed="not-changed"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" changed="not-changed" id="ide784403e-375f-4571-be68-1ecc697ae7f1"><paragraph id="id6ef1897d-7c12-4b37-af99-2c503569db87" changed="not-changed"><enum>(15)</enum><text><term>major rule</term> means any rule that the Administrator of the Office of Information and Regulatory Affairs determines is likely to impose—</text><subparagraph id="idc88e9b21-c32e-4186-852a-30bdedd8f7ef" changed="not-changed"><enum>(A)</enum><text>an annual effect on the economy of $100,000,000 or more;</text></subparagraph><subparagraph id="idad3ef8c0-9328-4c1d-99b9-ff94e8c36df6" changed="not-changed"><enum>(B)</enum><text>a major increase in costs or prices for consumers, individual industries, Federal, State, local, or Tribal government agencies, or geographic regions; or</text></subparagraph><subparagraph id="id82dc2a05-92e5-4641-aa3e-033f5d828d71" changed="not-changed"><enum>(C)</enum><text>significant effects on competition, employment, investment, productivity, innovation, health, safety, the environment, or the ability of United States-based enterprises to compete with foreign-based enterprises in domestic and export markets; and</text></subparagraph></paragraph><paragraph id="id68e6ac10-1d98-4df0-a9d4-65108deddc65" changed="not-changed"><enum>(16)</enum><text><term>Office of Information and Regulatory Affairs</term> means the office established under section 3503 of title 44 and any successor to that office.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id9a619dac-020e-4249-8584-1d6fb6535ffe" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">in section 553, by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb95b9b53-8e10-4766-85c3-44f2b02d9270" changed="not-changed"><subsection id="id73bb8a59-6181-436c-94d1-a610f1a6fe3c" changed="not-changed"><enum>(f)</enum><header>Advance notice of proposed rule making for major rules</header><paragraph id="ida235e6ab-6083-45bb-92bf-4a8f70be3e00" changed="not-changed"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), not later than 90 days before the date on which an agency publishes a notice of proposed rule making for a major rule in the Federal Register, the agency shall publish an advance notice of proposed rule making for the major rule in the Federal Register.</text></paragraph><paragraph id="id78e8622c-937f-415e-a8cf-371d6ed14c8d" changed="not-changed"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">An advance notice of proposed rule making published under paragraph (1) shall—</text><subparagraph id="idaf42cf2d-f173-47f9-98dd-ee3c17eff134" changed="not-changed"><enum>(A)</enum><text>include a written statement identifying, at a minimum—</text><clause id="ide97cefd7-9113-47dd-94fc-de0babed9f29" changed="not-changed"><enum>(i)</enum><text>the nature and significance of the problem the agency may address with a major rule, including any data or categories of data that the agency has identified as relevant or that the agency intends to consult for the proposed major rule;</text></clause><clause id="ided6d32ed-4915-488b-ac4b-f69f590376b2" changed="not-changed"><enum>(ii)</enum><text>a general description of regulatory alternatives under consideration; and</text></clause><clause id="idf4bfd046-6345-48cd-adf8-1e146a3f18ac" changed="not-changed"><enum>(iii)</enum><text>the legal authority under which a major rule may be proposed;</text></clause></subparagraph><subparagraph id="id10d93492-466d-4000-8d19-e2b2a9d7b1b3" changed="not-changed"><enum>(B)</enum><text>solicit written data, views, and argument from interested persons concerning the information and issues identified in the advance notice; and</text></subparagraph><subparagraph id="id12b326a7-d4a6-4ec0-83a5-20ccb7d6d786" changed="not-changed"><enum>(C)</enum><text>provide for a period of not less than 30 days for interested persons to submit such written data, views, or argument to the agency.</text></subparagraph></paragraph><paragraph id="idc48abb53-f17d-4984-b142-f71606dc5796" changed="not-changed"><enum>(3)</enum><header>Exceptions</header><text>This subsection shall not apply to a major rule if—</text><subparagraph id="id90e73e1c-ee35-414f-8f4e-607ad262c171" changed="not-changed"><enum>(A)</enum><text>the agency proposing the major rule is not required to publish a notice of proposed rule making in the Federal Register for the major rule under subparagraph (A) or (B) of subsection (b);</text></subparagraph><subparagraph id="id8a3cf9a6-31c2-4017-9ade-97831e0454bf" changed="not-changed"><enum>(B)</enum><text>the Administrator of the Office of Information and Regulatory Affairs determines that complying with the requirements described in this subsection—</text><clause id="ideb77c6bf-4b60-4b24-9570-6bb4facd136a" changed="not-changed"><enum>(i)</enum><text>would not serve the public interest;</text></clause><clause id="id7be83cd2-4f89-4484-8c91-946d3e61ad9a" changed="not-changed"><enum>(ii)</enum><text>would be duplicative of processes as rigorous and effective as those prescribed in paragraph (2) and would be unnecessary to ensure meaningful public participation; or</text></clause><clause id="idD3585686666A46CC940AAFEDEC4C32A4" changed="not-changed"><enum>(iii)</enum><text>would not be practicable due to a statutory or court-imposed deadline; or</text></clause></subparagraph><subparagraph id="id342084CC9270470DB60C801A4FDDC1EF" changed="not-changed"><enum>(C)</enum><text>the Administrator of the Office of Information and Regulatory Affairs determines that the major rule falls within a category of major rules that are routine or periodic in nature.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id889ac855-d5da-41d8-a415-98a0afc955e9" changed="not-changed"><enum>(4)</enum><header>Judicial review</header><subparagraph commented="no" display-inline="no-display-inline" id="id81cc79f1-3304-481d-b5c6-76edfc77ac10" changed="not-changed"><enum>(A)</enum><header>In general</header><text>A determination made by the Administrator of the Office of Information and Regulatory Affairs in accordance with subparagraph (B) or (C) of paragraph (3) shall not be subject to judicial review.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide054b746-24b8-490a-8340-693b1b957759" changed="not-changed"><enum>(B)</enum><header>Arbitrary and capricious</header><text>Any difference between policies set forth in the written statement of an agency under paragraph (2)(A) and the notice of proposed rule making shall not be reviewable under section 706(2)(A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
