<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 779</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250227">February 27, 2025</action-date><action-desc><sponsor name-id="S413">Mr. Padilla</sponsor> (for himself, <cosponsor name-id="S384">Mr. Tillis</cosponsor>, <cosponsor name-id="S362">Mr. Kaine</cosponsor>, and <cosponsor name-id="S288">Ms. Murkowski</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XIX of the Public Health Service Act to provide for prevention and early intervention services under the Block Grants for Community Mental Health Services program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H282EC7A8B408493A847ED2CEAC5A2107"><section section-type="section-one" id="HC17A85739B2C4720A5AF3B76CADB92FE"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Early Action and Responsiveness Lifts Youth Minds Act</short-title></quote> or the <quote><short-title>EARLY Minds Act</short-title></quote>. </text></section><section id="H925447B7BA1F4D76B987CD73F4EAFCE4"><enum>2.</enum><header>Early intervention</header><subsection id="HB08FAEFA8AD043EA85486867055D523E"><enum>(a)</enum><header>State plan option</header><text>Section 1912(b)(1)(A)(vii) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-1">42 U.S.C. 300x–1(b)(1)(A)(vii)</external-xref>) is amended—</text><paragraph id="H18B22C68A21544BC87FFF037FF27CCBD"><enum>(1)</enum><text>in subclause (III), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H7C0DF61EE3C847A08FE100E96FEEAD90"><enum>(2)</enum><text>in subclause (IV), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HA6F25C2F8BA541C88A932DBC63CE110D"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H37C1D25BBB274554B63B9F3754D4E3BC"><subparagraph id="H444CA9D1084F4505AC686F641C37E9EB"><enum>(V)</enum><text>a description of any evidence-based prevention and early intervention strategies and programs the State provides to prevent, delay, or reduce the severity and onset of mental illness and behavioral problems, including for children and adolescents, irrespective of experiencing a serious mental illness or serious emotional disturbance, as defined under subsection (c)(1).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H40E8A50A67A34064B4DCA073265E50D7"><enum>(b)</enum><header>Allocation allowance; reports</header><text>Section 1920 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-9">42 U.S.C. 300x–9</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HCF45EEE7E466418DB52763523CC7750B"><subsection id="HB0F5585AA1A043B0A137A3E1DC8B4742"><enum>(e)</enum><header>Prevention and early intervention services</header><text>In the case of a State with a State plan that provides for strategies and programs specified in section 1912(b)(1)(A)(vii)(V), such State may expend not more than 5 percent of the amount of the allotment of the State pursuant to a funding agreement under section 1911 for each fiscal year to support such strategies and programs.</text></subsection><subsection id="H2995EC343A0C45D3B52E240777A081FB"><enum>(f)</enum><header>Reports to congress</header><text>Not later than 1 year after the date of enactment of the <short-title>EARLY Minds Act</short-title>, and biennially thereafter, the Secretary shall submit to Congress a report on the prevention and early intervention strategies and programs pursued by States pursuant to subsection (e). Each such report shall include—</text><paragraph id="HB820D9C208BE4E5F923F5A6E83BF4466"><enum>(1)</enum><text display-inline="yes-display-inline">a list of the States that utilized the option to provide prevention and early intervention services; </text></paragraph><paragraph id="H4D14D919784B4683892B4A5AD1AFFEDC"><enum>(2)</enum><text>a description of the prevention and early intervention activities of each such State;</text></paragraph><paragraph id="H266FC3FB602249D8A704ED7A919AC9AF"><enum>(3)</enum><text>the population served, including information on demographics, including age;</text></paragraph><paragraph id="H4ECF616BEE0F4F658E34503E89155B20"><enum>(4)</enum><text>the outcomes of such activities, including—</text><subparagraph id="H054407DF9BDC48F0BEB0F41323BF1126"><enum>(A)</enum><text display-inline="yes-display-inline">how such activities reduced delays in access to mental and behavioral health care for children and adults; and</text></subparagraph><subparagraph id="HB9A407556F9B425498F5EF86202B326B"><enum>(B)</enum><text>how such activities reduced the severity of onset of serious mental illness and serious emotional disturbance; and</text></subparagraph></paragraph><paragraph id="H3C6999489A8A46D7A4DFDED9B3E76E74"><enum>(5)</enum><text>any other relevant information the Secretary determines necessary.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
