<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 745</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250226">February 26, 2025</action-date><action-desc><sponsor name-id="S420">Mr. Schmitt</sponsor> (for himself, <cosponsor name-id="S324">Mrs. Shaheen</cosponsor>, and <cosponsor name-id="S413">Mr. Padilla</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Individuals with Disabilities Education Act to require notification with respect to individualized education program teams, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HBA9E264DAB0241CCB5FE77B8897F3550"><section section-type="section-one" id="H2F8105DC5B7349F89CA4756F5AB3D1B4"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Empowering Families in Special Education Act</short-title></quote>.</text></section><section id="HD3086F53593A4133930A197893B66538"><enum>2.</enum><header>Notification requirement for IEP teams</header><text display-inline="no-display-inline">Section 614(d)(1)(B) of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1414">20 U.S.C. 1414(d)(1)(B)</external-xref>) is amended—</text><paragraph id="H96742AEC20D4442A9366E3AFE6C59199"><enum>(1)</enum><text>in clause (iv), by redesignating subclauses (I) through (III) as items (aa) through (cc), respectively (and by conforming the margins accordingly);</text></paragraph><paragraph id="H4983A964B9034BCFBEDF3B3ACAFB8A16"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating clauses (i) through (vii) as subclauses (I) through (VII), respectively (and by conforming the margins accordingly);</text></paragraph><paragraph id="HC3767D4E0F204F46A56EB96C069E6536"><enum>(3)</enum><text>in the matter preceding subclause (I), as so redesignated, by striking <quote>The term</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA2811C4F83B94A4798ADB044AC34619A"><clause id="H4D2D5AF6BCA6427BBDB18696D8881708"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H71E56B54FB144A57A31E2ADBCE6C4B88"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF44FAB56DC2C43A9817C87EDAE11138F"><clause id="HB547CEB41EBE41F593D8C31035AFF741"><enum>(ii)</enum><header>Notification required</header><text display-inline="yes-display-inline">Within a reasonable timeframe prior to the first convening of the individualized education program team for a child with a disability for a school year, the local educational agency that serves such child shall notify the parent of such child that such parent may, under clause (i)(VI), include other individuals who have knowledge or special expertise regarding the child, including related services personnel as appropriate, as part of the individualized education program team.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
