which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require agencies to repeal ten existing regulations before issuing a new regulation, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H83E0BBC34D874F3986DDE7188519EA8D"><section section-type="section-one" id="H08927E9FA0154C7489D7ED366F566F95"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Regulation Decimation Act</short-title></quote>.</text></section><section id="HA0C5ABC132B24A1AB34E3968BA1787E0"><enum>2.</enum><header>Repeal of regulations required before issuance of a new rule</header><subsection id="HFB79CBD5D4EB4CD1B89FC31738B71EB9"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HE6401477813E413F80CB14F87D9F23EB"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given that term in section 551 of title 5, United States Code.</text></paragraph><paragraph commented="no" id="H0940C8D2DCDE4474BFF885474AB1137D"><enum>(2)</enum><header>Major rule</header><text display-inline="yes-display-inline">The term <term>major rule</term> has the meaning given that term in section 804 of title 5, United States Code.</text></paragraph><paragraph commented="no" id="H1B163EE266C146019A1D1668969D6C03"><enum>(3)</enum><header>Rule</header><text>The term <term>rule</term> has the meaning given that term in section 551 of title 5, United States Code.</text></paragraph><paragraph id="H5C53B5DBD80547AC8AD60770BB23FEAA" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, each territory or possession of the United States, and each federally recognized Indian Tribe.</text></paragraph></subsection><subsection id="HC0A7E18AEAE04EA8B660EFC7339EEBF6"><enum>(b)</enum><header>Requirement for rule</header><text display-inline="yes-display-inline">An agency may not issue a rule unless such agency has repealed 10 or more rules described in subsection (e) that, to the extent practicable, are related to the rule.</text></subsection><subsection id="H4E059B6FC79044F4A458AC766CAC1552"><enum>(c)</enum><header>Requirement for major rule</header><paragraph id="H1E282D7F3CD5455D95DEC6F235D03B05"><enum>(1)</enum><header>Repeal required</header><text display-inline="yes-display-inline">An agency may not issue a major rule unless—</text><subparagraph id="H97C7BACD97A942279368B6A817069742"><enum>(A)</enum><text display-inline="yes-display-inline">such agency has repealed 10 or more rules described in subsection (e) that, to the extent practicable, are related to the major rule; and</text></subparagraph><subparagraph id="H826AB6A3C89049CC87F4EA57F8A86703"><enum>(B)</enum><text>the cost of the new major rule is less than or equal to the cost of the rules repealed.</text></subparagraph></paragraph><paragraph commented="no" id="H4D6F10D6585148E2A3DBD3C1BB06D284"><enum>(2)</enum><header>Certified cost</header><text display-inline="yes-display-inline">For any rule issued in accordance with paragraph (1), the Administrator of the Office of Information and Regulatory Affairs of the Office of Management and Budget must have certified that the cost of the new major rule is equal to or less than the cost of the rules repealed.</text></paragraph></subsection><subsection id="H9865D1791BE24CC28212EBE54A9E217C"><enum>(d)</enum><header>Publication required</header><text>Any rule repealed under subsection (b) or (c) shall be published in the Federal Register.</text></subsection><subsection id="H5827B8ECA0274CB1B6CDBBDD90245209"><enum>(e)</enum><header>Applicability</header><text>This section—</text><paragraph id="HEA4A9FCA398F42AA9CF5570B39D5DAEB"><enum>(1)</enum><text display-inline="yes-display-inline">applies to any rule or major rule that imposes a cost or responsibility on a nongovernmental person or a State or local government; and</text></paragraph><paragraph id="H211837AA18004BEEB52303CD53B03D82"><enum>(2)</enum><text>shall not apply to any rule or major rule—</text><subparagraph id="H766CF1362B4245C6A96447B90E18CE06"><enum>(A)</enum><text>that relates to the internal policy or practice of an agency or procurement by the agency; or</text></subparagraph><subparagraph id="HDC0467A2F7694ABD95306ED0A32A542A"><enum>(B)</enum><text display-inline="yes-display-inline">that is being revised to be less burdensome to decrease requirements imposed by the rule or cost of compliance.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H9C591020A1B24639B81C14D070445A43"><enum>(f)</enum><header>Review of agency rules</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the head of each agency shall submit to Congress and the Director of the Office of Management and Budget a report that includes a review of each rule of the agency that identifies whether that rule is costly, ineffective, duplicative, or outdated, including a list of any other unnecessary regulatory restriction of the agency that is costly, ineffective, duplicative, or outdated.</text></subsection><subsection id="HF32103CCA71241C6A2B47B5E3F48AA75"><enum>(g)</enum><header>Report on rules</header><text>Not later than 5 years after the date of enactment of this Act, the President shall submit to Congress a report on the number of rules in effect and the status of the reduction of rules over the previous 5 years.</text></subsection></section></legis-body></bill>
