<committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 31, United States Code, to prevent fraudulent transactions at virtual currency kiosks, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Crypto ATM Fraud Prevention Act of 2025</short-title></quote>.</text></section><section id="id5fdd16bf4c824cdd95fcf87ff1a2a73e"><enum>2.</enum><header>Registration with the Secretary of the Treasury</header><text display-inline="no-display-inline">Section 5330 of title 31, United States Code, is amended—</text><paragraph id="id3508daa555c64e05910078d1f87c170c"><enum>(1)</enum><text>in subsection (d)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id845c9b45c2ab491aa4cc7449d7c11404"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)(A), by inserting <quote>, any person who owns, operates, or manages a virtual currency kiosk in the United States or its territories,</quote> after <quote>similar instruments</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1f90dc9a8061487aa4a658629bd999ff"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id770218d577f04d828076df936b29a1a5"><paragraph id="id56cc9f095dea44ecadb501726192dc0f"><enum>(3)</enum><header>Virtual currency; virtual currency address; virtual currency kiosk; virtual currency kiosk operator</header><text>The terms <term>virtual currency</term>, <term>virtual currency address</term>, <term>virtual currency kiosk</term>, and <term>virtual currency kiosk operator</term> have the meanings given those terms, respectively, in section 5337.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id97d7512a2cd54ebaa6792b988422ccbf"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8922d888eab3479886e712277de109c7"><subsection id="id6aed884e4ca345cfafce66dccf9316a6"><enum>(f)</enum><header>Registration of virtual currency kiosk locations</header><paragraph id="idc73fc95e2c70407c838d13081196c87a"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the effective date of this subsection, and not less than once every 90 days thereafter, the Secretary of the Treasury shall require virtual currency kiosk operators to submit an updated list containing the physical address of each virtual currency kiosk owned or operated by the virtual currency kiosk operator.</text></paragraph><paragraph id="idf46b850be350418ea71f2a063e130c5b"><enum>(2)</enum><header>Form and manner of registration</header><text>Each submission by a virtual currency kiosk operator pursuant to paragraph (1) shall include—</text><subparagraph id="id1dc779d4a2f745c8b05b2f51ebd34e9b"><enum>(A)</enum><text>the legal name of the virtual currency kiosk operator;</text></subparagraph><subparagraph id="ida051c088adbd4e9599dac8a6314c2eb0"><enum>(B)</enum><text>any fictitious or trade name of the virtual currency kiosk operator;</text></subparagraph><subparagraph id="id1d969b4c19ee4a50a5bbc6cd2a8f77b3"><enum>(C)</enum><text>the physical address of each virtual currency kiosk owned, operated, or managed by the virtual currency kiosk operator that is located in the United States or the territories of the United States;</text></subparagraph><subparagraph id="id943f81830cb24f89a05d09ecf108547d"><enum>(D)</enum><text>the start date of operation of each virtual currency kiosk;</text></subparagraph><subparagraph id="idb991dcf31fc1450481c0936c0f39fbc9"><enum>(E)</enum><text>the end date of operation of each virtual currency kiosk, if applicable; and</text></subparagraph><subparagraph id="id51996ad6708247848b8a124359dd0a30"><enum>(F)</enum><text>each virtual currency address used by the virtual currency kiosk operator.</text></subparagraph></paragraph><paragraph id="idce16726878b947d4938fa715689a6613"><enum>(3)</enum><header>False and incomplete information</header><text>The filing of false or materially incomplete information in a submission required under paragraph (1) shall be deemed a failure to comply with the requirements of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idcd8b7ac13bf74479bb22d18002ec9ad7"><enum>3.</enum><header>Preventing fraudulent transactions at virtual currency kiosks</header><subsection commented="no" display-inline="no-display-inline" id="id54739f89a26a4e58963dc4f4f80a9d00"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter II of Chapter 53 of Title 31, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id8c2d1360aa344d12962f49ec261b4a5f"><section id="id1a0bd38283b34bd6ba420eb0292af10d"><enum>5337.</enum><header>Virtual currency kiosk fraud prevention</header><subsection id="id87e976d646aa47c5a4678af7bcab598d"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id85445c4e87534f678745f92f8fbf8096"><enum>(1)</enum><header>Blockchain analytics</header><text>The term <term>blockchain analytics</term> means the analysis of data from blockchains or public distributed ledgers, and associated transaction information, to provide risk-specific information about virtual currency transactions and virtual currency addresses.</text></paragraph><paragraph id="id0595472ef79b4b60922ea8511b98487d"><enum>(2)</enum><header>Customer</header><text>The term <term>customer</term> means any person that purchases or sells virtual currency through a virtual currency kiosk.</text></paragraph><paragraph id="id4a372e20d1df42d18a2f80a54ebec2f0"><enum>(3)</enum><header>Existing customer</header><text>The term <term>existing customer</term> means a customer other than a new customer.</text></paragraph><paragraph id="id3b2afe3ed49e4824b2243fb31e7a75cf"><enum>(4)</enum><header>FinCEN</header><text>The term <term>FinCEN</term> means the Financial Crimes Enforcement Network of the Department of the Treasury.</text></paragraph><paragraph id="iddff63d2a8c6b4d0ab15206ae553fc024"><enum>(5)</enum><header>New customer</header><text>The term <term>new customer</term>, with respect to a virtual currency kiosk operator, means a customer during the 14-day period beginning on the date of the first virtual currency kiosk transaction of the customer with the virtual currency kiosk operator.</text></paragraph><paragraph id="idc053d99220674730b7b6c3bb10bdc11d"><enum>(6)</enum><header>Transaction hash</header><text>The term <term>transaction hash</term> means a unique identifier made up of a string of characters that act as a record of and provide proof that a transaction was verified and added to the blockchain.</text></paragraph><paragraph id="id1dad375b7a424de1ba8c33b0c028886b"><enum>(7)</enum><header>Virtual currency</header><text>The term <term>virtual currency</term> means any digital representation of value that is recorded on a cryptographically secured distributed ledger or any similar technology or another implementation, which was designed and built as part of a system to leverage or replace blockchain, distributed ledger technology, or their derivatives.</text></paragraph><paragraph id="id6e7dafa2a9844e1b839fbb109d437228"><enum>(8)</enum><header>Virtual currency address</header><text>The term <term>virtual currency address</term> means an alphanumeric identifier associated with a virtual currency wallet identifying the location to which virtual currency purchased through a virtual currency kiosk can be sent or from which virtual currency sold through a virtual currency kiosk can be accessed.</text></paragraph><paragraph id="idb403050bc1c34c3192feccbde19afb2a"><enum>(9)</enum><header>Virtual currency kiosk</header><text>The term <term>virtual currency kiosk</term> means a stand-alone machine that is capable of accepting or dispensing legal tender in exchange for virtual currency.</text></paragraph><paragraph id="id5d248f36fe1f450fab2c471afbda8581"><enum>(10)</enum><header>Virtual currency kiosk operator</header><text>The term <term>virtual currency kiosk operator</term> means a person who owns, operates, or manages a virtual currency kiosk located in the United States or its territories.</text></paragraph><paragraph id="idd525455ed34342048c5e8b1f46d0608d"><enum>(11)</enum><header>Virtual currency kiosk transaction</header><text>The term <term>virtual currency kiosk transaction</term> means the purchase or sale of virtual currency via a virtual currency kiosk.</text></paragraph><paragraph id="id5960830173064ffeb6444b2fdd285bd5"><enum>(12)</enum><header>Virtual currency wallet</header><text>The term <term>virtual currency wallet</term> means a software application or other mechanism providing a means for holding, storing, and transferring virtual currency. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id54cea0d0946a49dbae43f5d88ed9dbad"><enum>(b)</enum><header>Disclosures</header><text display-inline="yes-display-inline">Before entering into a virtual currency transaction with a customer, a virtual currency kiosk operator shall disclose in a clear, conspicuous, and easily readable manner—</text><paragraph id="idd66b2db38b8447f68765b056ea1d09c9"><enum>(1)</enum><text>all relevant terms and conditions of the virtual currency kiosk transaction, including—</text><subparagraph id="iddb8541bea76d4520b859efd3227b40eb"><enum>(A)</enum><text>the amount of the virtual currency kiosk transaction;</text></subparagraph><subparagraph id="id700d4f535b1c441893605a5ad9641eed"><enum>(B)</enum><text>the type and nature of the virtual currency kiosk transaction;</text></subparagraph><subparagraph id="id29270f1aecb849ed8630c9ab8a2ebdee"><enum>(C)</enum><text>a warning that the virtual currency kiosk transaction is final, is not refundable, and may not be reversed; and</text></subparagraph><subparagraph id="id1b55219f4772427caed9b5b41ce1e889"><enum>(D)</enum><text>the type and amount of any fees or other expenses paid by the customer;</text></subparagraph></paragraph><paragraph id="id51ea117ab46e432cba58596f9b85e078"><enum>(2)</enum><text>a warning relating to consumer fraud including—</text><subparagraph id="id79c6bb25e2cb4f1a932ab7b2787bd5a3"><enum>(A)</enum><text>a warning that consumer fraud often starts with contact from a stranger, and that the customer should never send money to someone they do not know;</text></subparagraph><subparagraph id="iddd81461de428495a8293abcd62afd701"><enum>(B)</enum><text>a warning about the most common types of fraudulent schemes involving virtual currency kiosks, such as—</text><clause id="id86f611ab90074c8093b145887342a5f1"><enum>(i)</enum><text>impersonation of a government official or a bank representative;</text></clause><clause id="id8cb1d037da044ab5abd2c3146bf004d2"><enum>(ii)</enum><text>threats of jail time or financial penalties;</text></clause><clause id="id7d4fcaf28a4a4b069e84a24da6d75b51"><enum>(iii)</enum><text>offers of a job or reward in exchange for payment, or offers of deals that seem too good to be true;</text></clause><clause id="id2ff76d79377f407a8a094db5f7f17fd1"><enum>(iv)</enum><text>claims of a frozen bank account or credit card; or</text></clause><clause id="id6110ba4e1a78465da7c9572fe85a001e"><enum>(v)</enum><text>requests for donations to charity or disaster relief; and</text></clause></subparagraph><subparagraph id="id8e07733d744a4168b8ba3b6e178e537b"><enum>(C)</enum><text>a statement that the customer should contact the virtual currency kiosk operator’s customer service helpline or State or local law enforcement if they suspect fraudulent activity.</text></subparagraph></paragraph></subsection><subsection id="idc09097c43ade466f8aac4c4b46aa60d6"><enum>(c)</enum><header>Acknowledgment of disclosures</header><text>Each time a customer uses a virtual currency kiosk, the virtual currency kiosk operator shall ensure acknowledgment of all disclosures required under subsection (b) via confirmation of consent of the customer at the virtual currency kiosk.</text></subsection><subsection id="idbfcdcbd7702c4ad28018e066b84de855"><enum>(d)</enum><header>Receipts</header><text>Upon completion of each virtual currency kiosk transaction, the virtual currency kiosk operator shall provide the customer with a receipt, which shall include the following information:</text><paragraph id="id5d9d48b2f12349bb988b827fbeb1ad25"><enum>(1)</enum><text>The name and contact information of the virtual currency kiosk operator, including a telephone number for a customer service helpline.</text></paragraph><paragraph id="id222cc9647932418e92de33f01511cc8f"><enum>(2)</enum><text>The name of the customer.</text></paragraph><paragraph id="idb0b8f759a81d405ea255a34f3cde0847"><enum>(3)</enum><text>The type, value, date, and precise time of the virtual currency kiosk transaction, transaction hash, and each applicable virtual currency address.</text></paragraph><paragraph id="ideb9de89facb94f48a2e10908a6a1c4b8"><enum>(4)</enum><text>The amount of the virtual currency kiosk transaction expressed in United States dollars.</text></paragraph><paragraph id="id310ade04868343b4a7232adc58cd7fa8"><enum>(5)</enum><text>All fees charged.</text></paragraph><paragraph id="id841f9fd78a154cac9f19cd3816d92ad4"><enum>(6)</enum><text>A statement that the customer may be entitled by law to a refund if the customer reports fraudulent activity in conjunction with the virtual currency kiosk transaction not later than 30 days after the date of the virtual currency kiosk transaction.</text></paragraph><paragraph id="ide0224a8a79a74c329e1bb1234e90ff34"><enum>(7)</enum><text>The refund policy of the virtual currency kiosk operator or a Uniform Resource Locator where the refund policy of the virtual currency kiosk operator can be found.</text></paragraph><paragraph id="idfe83bc28fd394cf2bfe7f9b273979f70"><enum>(8)</enum><text>A statement that the customer should contact law enforcement if they suspect fraudulent activity, such as scams, including contact information for a relevant law enforcement or government agency.</text></paragraph><paragraph id="id0b42bab11e4a4983bfa92007684cfb47"><enum>(9)</enum><text>Any additional information the virtual currency kiosk operator determines appropriate.</text></paragraph></subsection><subsection id="id444a74edd30d4da8b01c8dee53de0a61"><enum>(e)</enum><header>Physical receipts required</header><text>Not later than 1 year after the effective date of this section, each receipt required under subsection (d) shall be issued to the customer as a physical receipt at the virtual currency kiosk at the time of the virtual currency kiosk transaction, but such receipt may also be provided in additional forms or communications.</text></subsection><subsection id="id009a58bbd304435ca2ba15576b3ecc64"><enum>(f)</enum><header>Anti-Fraud policy</header><paragraph commented="no" display-inline="no-display-inline" id="ide99d3df09c9e477a9e150258f6506d15"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each virtual currency kiosk operator shall take reasonable steps to detect and prevent fraud, including establishing and maintaining a written anti-fraud policy that includes—</text><subparagraph id="idacaab1ed99444dd29136691bff361c69"><enum>(A)</enum><text>the identification and assessment of fraud-related risk areas;</text></subparagraph><subparagraph id="idcbbe143c17d64ad391f61af0a75c6784"><enum>(B)</enum><text>procedures and controls to protect against risks identified under subparagraph (A);</text></subparagraph><subparagraph id="id9bdd8625c1f0494cb21341e052e05560"><enum>(C)</enum><text>allocation of responsibility for monitoring the risks identified under subparagraph (A); and</text></subparagraph><subparagraph id="id06c505b506d94445b4d51a70f6d398e7"><enum>(D)</enum><text>procedures for the periodic evaluation and revision of the anti-fraud procedures, controls, and monitoring mechanisms under subparagraphs (B) and (C).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24b307c610cf4a91b66618475546179e"><enum>(2)</enum><header>Submission of anti-fraud policy to FinCEN</header><text display-inline="yes-display-inline">Each virtual currency kiosk operator shall submit to FinCEN the anti-fraud policy required under paragraph (1) not later than 90 days after the later of—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide7999e3804af4f08bf812fd7fa752d7d"><enum>(A)</enum><text display-inline="yes-display-inline">the effective date of this section; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4d73bdce5e744c8ba053cc4ef0fbbc40"><enum>(B)</enum><text display-inline="yes-display-inline">the date on which the virtual currency kiosk operator begins operating.</text></subparagraph></paragraph></subsection><subsection id="idce6be8fa1b1141ed9c5bf057ddecb3d9"><enum>(g)</enum><header>Appointment of compliance officer</header><text>Each virtual currency kiosk operator shall designate and employ a compliance officer who—</text><paragraph id="id0628d94918e442d685f3277715e14351"><enum>(1)</enum><text>is qualified to coordinate and monitor compliance with this section and all other applicable Federal and State laws, rules, and regulations;</text></paragraph><paragraph id="id4fb5ef1eb1494fd3b5b6bc59dbbca726"><enum>(2)</enum><text>is employed full-time by the virtual currency kiosk operator; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id189aec43b5034e1189b021e37542270a"><enum>(3)</enum><text display-inline="yes-display-inline">is not the chief executive officer of the virtual currency kiosk operator; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb79ce1d808d749d5b7a6dd3d7b2de065"><enum>(4)</enum><text display-inline="yes-display-inline">does not own or control more than 20 percent of any interest in the virtual currency kiosk operator.</text></paragraph></subsection><subsection id="id5d18d9990769408fa6bfad1e0be724fd"><enum>(h)</enum><header>Use of blockchain analytics</header><paragraph commented="no" display-inline="no-display-inline" id="idaa8fc1b047a740b78a54a96b112c9e67"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each virtual currency kiosk operator shall use blockchain analytics to prevent sending virtual currency to a virtual currency wallet known to be affiliated with fraudulent activity at the time of a virtual currency kiosk transaction and to detect transaction patterns indicative of fraud or other illicit activities. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6d285a73aaa44afc9efd0edb6233da3a"><enum>(2)</enum><header>Compliance</header><text display-inline="yes-display-inline">The Director of FinCEN may request evidence from any virtual currency kiosk operator to confirm compliance with this subsection.</text></paragraph></subsection><subsection id="idfe572d6c9cb54331bb8d20211c76d15d"><enum>(i)</enum><header>Verbal confirmation required before new customer transactions</header><paragraph commented="no" display-inline="no-display-inline" id="idb64ebeecb4af41fe80fb44546a984a97"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Before entering into a virtual currency kiosk transaction valued at 500 dollars or more with a new customer, a virtual currency kiosk operator shall obtain verbal confirmation from the new customer that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb129ef6f6dce405b807f38d0cdcbe7a0"><enum>(A)</enum><text display-inline="yes-display-inline">the new customer wishes to proceed with the virtual currency kiosk transaction;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6530c6f1253b4829a121d059b851e12c"><enum>(B)</enum><text display-inline="yes-display-inline">the new customer understands the nature of the virtual currency kiosk transaction; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9eb39ac57110414ab61f6e0c1bbe15d9"><enum>(C)</enum><text display-inline="yes-display-inline">the new customer is not being fraudulently induced to engage in the transaction. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id628ccd6d5e6b49808b4be187297062af"><enum>(2)</enum><header>Reasonable effort</header><text display-inline="yes-display-inline">A virtual currency kiosk operator shall make a reasonable effort to determine whether the customer is being fraudulently induced to engage in the virtual currency kiosk transaction.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide78a2467cdb74c02b6f8ac372e94c127"><enum>(3)</enum><header>Method of confirmation</header><text display-inline="yes-display-inline">Each verbal confirmation required under paragraph (1) shall be given by way of a live telephone or video call to a person employed by, or on behalf of, the virtual currency kiosk operator. </text></paragraph></subsection><subsection id="id733051d0835748e6be2698e99aa05c69"><enum>(j)</enum><header>Refunds</header><paragraph id="id4df4232a918e48b9ad6e9ec944e66edd"><enum>(1)</enum><header>In general</header><subparagraph commented="no" display-inline="no-display-inline" id="id172e3c43723e4549bd61488161dc8245"><enum>(A)</enum><header>New customers</header><text display-inline="yes-display-inline">Not later than 30 days after receiving an application under paragraph (2), a virtual currency kiosk operator shall issue a refund to a customer for the full amount of each virtual currency kiosk transaction, including the dollar value of virtual currency exchanged and all transaction fees, made during the period in which the customer was a new customer and for which the customer was fraudulently induced to engage in the virtual currency kiosk transaction.</text></subparagraph><subparagraph id="idde783f577e1440eda4529b5556bf8b8c"><enum>(B)</enum><header>Existing customers</header><text>Not later than 30 days after receiving an application under paragraph (2), a virtual currency kiosk operator shall issue a refund to a customer for the full amount of all transaction fees associated with each virtual currency kiosk transaction made during the period in which the customer was an existing customer and for which the customer was fraudulently induced to engage in the virtual currency kiosk transaction. </text></subparagraph></paragraph><paragraph id="idb6f1c4099bb64ea6a34ca11337ead96b"><enum>(2)</enum><header>Application</header><text>A customer seeking a refund under paragraph (1) shall, not later than 30 days after the date of the virtual currency kiosk transaction, submit an application to the virtual currency kiosk operator that includes the following:</text><subparagraph id="id53c4f98117cf48aea4d120127438ff1d"><enum>(A)</enum><text>The name, address, and phone number of the customer.</text></subparagraph><subparagraph id="id0acedb91df014d4eb497fbcfee765fe7"><enum>(B)</enum><text>The transaction hash of the virtual currency kiosk transaction or information sufficient to determine the type, value, date, and time of the virtual currency kiosk transaction.</text></subparagraph><subparagraph id="ida5711da178f24bfd87f0c44582e619ab"><enum>(C)</enum><text>A copy of a report to a State or local law enforcement or government agency, made not later than 30 days after the virtual currency kiosk transaction, that includes a sworn affidavit attesting that the customer was fraudulently induced to engage in the virtual currency kiosk transaction.</text></subparagraph></paragraph><paragraph id="id9d0cc48e8bcd4e758815ddbd70b91590"><enum>(3)</enum><header>Enhanced damages</header><text>Any person who willfully denies a refund to a customer in violation of paragraph (1) shall be liable to the customer for 3 times the amount of the refund owed under that paragraph or $10,000, whichever is greater. A penalty under this paragraph shall be in addition to any penalty under subsection (n).</text></paragraph></subsection><subsection id="id094aa70cbb684745b828a3973b0e457b"><enum>(k)</enum><header>Transaction limits with respect to new customers</header><paragraph id="id434cb114b22a422db09e77082c5ca6b3"><enum>(1)</enum><header>In a 24-hour period</header><text>A virtual currency kiosk operator shall not accept more than $2,000, or the equivalent amount in virtual currency, from any new customer during any 24-hour period.</text></paragraph><paragraph id="id02585233ef54410aabb331799bf93396"><enum>(2)</enum><header>Total</header><text>A virtual currency kiosk operator shall not accept a total of more than $10,000, or the equivalent amount in virtual currency, from any new customer.</text></paragraph></subsection><subsection id="id4942919a3c024eeb88f6529b749c607f"><enum>(l)</enum><header>Customer service helpline</header><text>Each virtual currency kiosk operator shall provide live customer service during all hours that the virtual currency kiosk operator accepts virtual currency kiosk transactions, the phone number for which is regularly monitored and displayed in a clear, conspicuous, and easily readable manner upon each virtual currency kiosk.</text></subsection><subsection id="id547ca8db42834dfcb6d49b9c4a0db7a7"><enum>(m)</enum><header>Communications with law enforcement</header><paragraph commented="no" display-inline="no-display-inline" id="idc271a4e100c54071aeb807dcc4be8f6a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each virtual currency kiosk operator shall provide a dedicated and frequently monitored phone number and email address for relevant law enforcement and government agencies to facilitate communication with the virtual currency kiosk operator in the event of reported or suspected fraudulent activity.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9d0aa5670c0c4f4ca0ad6c309e83479f"><enum>(2)</enum><header>Submission</header><text display-inline="yes-display-inline">Not later than 90 days after the effective date of this section, each virtual currency kiosk operator shall submit the phone number and email address described in paragraph (1) to FinCEN and all other relevant law enforcement and government agencies.</text></paragraph></subsection><subsection id="id72ab538e79ce4f419667802018ccdafe"><enum>(n)</enum><header>Civil penalties</header><paragraph id="id427a4257ea3143d8903db6ed0a6e0f75"><enum>(1)</enum><header>In general</header><text>Any person who fails to comply with any requirement of this section, or any regulation prescribed under this section, shall be liable to the United States for a civil monetary penalty of $10,000 for each such violation.</text></paragraph><paragraph id="id9bfe8eaaf7b945d08ab66f4269195799"><enum>(2)</enum><header>Continuing violation</header><text>Each day that a violation described in paragraph (1) continues shall constitute a separate violation for purposes of such paragraph.</text></paragraph><paragraph id="id0fd1ff13103b46a19d09ae7581e294e4"><enum>(3)</enum><header>Assessments</header><text>Any penalty imposed under this section shall be assessed and collected by the Secretary of the Treasury as provided in section 5321 and any such assessment shall be subject to the provisions of that section.</text></paragraph></subsection><subsection id="idea71acffa7d34a06a25e4f29a5373fe7"><enum>(o)</enum><header>Relationship to State laws</header><text>The provisions of this section shall preempt any State law, rule, or regulation only to the extent that such State law, rule, or regulation conflicts with a provision of this section. Nothing in this section shall be construed to prohibit a State from enacting a law, rule, or regulation that provides greater protection to customers than the protection provided by the provisions of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H912D3243ACB24C768B1A9311A6E34249" changed="not-changed"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/31/5336">section 5336</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6B78FCE69FC84C2DA9FA5F3840823187" changed="not-changed"><toc changed="not-changed"><toc-entry level="section" bold="off" changed="not-changed">5337.
