to address liability for payment of charges or costs associated with the provision of purchased/referred care services, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6C8237E4CADD4CC5804DE38F1971A798"><section section-type="section-one" id="H3187F57EFB774FBFB957487F98F11393"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Purchased and Referred Care Improvement Act of 2025</short-title></quote>.</text></section><section section-type="subsequent-section" id="H0BF27D4BED714AFAAC7F9CA7AA753FD0"><enum>2.</enum><header>Changes to liability for payment</header><subsection id="HB276C7BC638C46E5ABB00BCC1276F385"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 222 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1621u">25 U.S.C. 1621u</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="HEFFC37658AA740078AEF151E4AC52A5B"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida7c747076fbb403bba2a87940c290091"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>A patient who receives contract health care services</quote> and inserting <quote>Notwithstanding any other provision of law or any agreement, form, or other written or electronic document signed by a patient, a patient who receives purchased/referred care</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idec642f41bc3a4744afce06e0484fc0a3"><enum>(B)</enum><text>by striking <quote>such services</quote> and inserting <quote>the purchased/referred care</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF989A152A18446B097182319E860E226"><enum>(2)</enum><text>by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF44A22A48FEA4FDF8B816D895FFBB588"><subsection commented="no" display-inline="no-display-inline" id="id53cc2b37f67c4447b246cdbe26bd12f2"><enum>(b)</enum><header>Notification</header><text>The Secretary shall notify a purchased/referred care provider and any patient who receives purchased/referred care authorized by the Service that, notwithstanding any other provision of law or any agreement, form, or other written or electronic document signed by the patient, the patient is not liable to any provider, debt collector, or any other person for the payment of any charges or costs associated with the provision of the purchased/referred care not later than 5 business days after receipt of a notification of a claim by a provider of the purchased/referred care.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5EAC2EF2D1124C32973E4E17131A1A80"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7620f0787eef4265b271cd9f1ea89e05"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>, debt collector, or any other person, as applicable,</quote> after <quote>the provider</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf90db677a3104e9eb0ce0883128dbff7"><enum>(B)</enum><text>by striking <quote>the services</quote> and inserting <quote>the purchased/referred care</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H582A630246A347FA834DFBBB58D9514C"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD498030487C84C28BF06A5F47A7C19EC"><subsection id="H3145768B75A04391B311AA2E442BE6EA"><enum>(d)</enum><header>Reimbursement</header><paragraph commented="no" display-inline="no-display-inline" id="H31D31FA6F5B340D4B9DF6C3AADE25A80"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment of procedures</header><subparagraph commented="no" display-inline="no-display-inline" id="id02e6516404584611b5235ab4bd9f9678"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of the <short-title>Purchased and Referred Care Improvement Act of 2025</short-title>, in consultation with Indian tribes, and except as provided in paragraph (2), the Secretary shall establish and implement procedures to allow a patient that paid out-of-pocket for purchased/referred care authorized by the Service under this Act to be reimbursed by the Service for that payment not later than 30 days after the date on which the patient submits documentation to the Service in accordance with subparagraph (B).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF9331F57D0FB41D9B0C827F461CFBF65"><enum>(B)</enum><header>Submitting documentation</header><text>The Secretary shall accept documentation from a patient seeking reimbursement under paragraph (1) that was submitted—</text><clause commented="no" display-inline="no-display-inline" id="HFD5709C6542C4713A82925C734217CEC"><enum>(i)</enum><text display-inline="yes-display-inline">electronically; or </text></clause><clause commented="no" display-inline="no-display-inline" id="H66FA8B0394834D96AAC3AB2F06C51DA5"><enum>(ii)</enum><text display-inline="yes-display-inline">in-person at a Service facility.</text></clause></subparagraph></paragraph><paragraph id="H071A33038D1A4465915104240C5E7234"><enum>(2)</enum><header>Limitation</header><text>Paragraph (1) shall not apply to purchased/referred care furnished under a purchased/referred care services program operated by an Indian tribe under a contract or compact entered into under the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301 et seq.</external-xref>) unless expressly agreed to by the Indian tribe.</text></paragraph></subsection><subsection id="HFD282E15D81E42B5BE0EE0D755341D71"><enum>(e)</enum><header>Updating authorities</header><text>Not later than 180 days after the date of enactment of the <short-title>Purchased and Referred Care Improvement Act of 2025</short-title>, the Secretary, in consultation with Indian tribes, shall update applicable provisions of and exhibits to the Indian Health Manual, contracts with providers, and other relevant documents and administrative authorities to incorporate the provisions of this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H87B539F0918D4F8199BBB58E6E51B664"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply to purchased/referred care (as defined in section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>)) authorized by the Indian Health Service furnished on, before, or after the date of enactment of this Act.</text></subsection></section><section id="HEE242F6D67CD4CB3869C469CB21BD133"><enum>3.</enum><header>Technical and conforming amendments</header><subsection id="H845AE2AD29254F0A9C15876EA73137C5"><enum>(a)</enum><header>Definitions</header><text>Section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ide661023c38444776aae81ba7a72f6bc2"><enum>(1)</enum><text>by striking paragraph (5);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id207ebe9c95064b94ab6cd26b43e8d5ca"><enum>(2)</enum><text>by redesignating paragraphs (6) through (15) as paragraph (5) through (14), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6e6b04f3088445cf93b194e532379493"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (12) (as so redesignated), in the matter preceding subparagraph (A), by striking <quote>, as defined in subsection (d) hereof,</quote>;</text></paragraph><paragraph id="id5d58efdcb0bc40b99398df6dd23b2cbb"><enum>(4)</enum><text>by inserting after paragraph (14) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3EF1C60FD2174C6E85BA73F2871FB2A4"><paragraph commented="no" display-inline="no-display-inline" id="idbaeafc5334d345d784c50099fcb3f279"><enum>(15)</enum><header>Purchased/referred care</header><text>The term <term>purchased/referred care</term> means any health service that is—</text><subparagraph commented="no" display-inline="no-display-inline" id="id75de97c8d32043c8b57ef9c74ccb8e17"><enum>(A)</enum><text display-inline="yes-display-inline">delivered based on a referral by, or at the expense of, an Indian health program; and</text></subparagraph><subparagraph id="ID707DBF4CC71749E0B5E10C8D520AE572"><enum>(B)</enum><text>provided by a public or private medical provider or hospital that is not a provider or hospital of the Indian health program.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id458e4f57b582462f8e265ac36ca2dd1c"><enum>(5)</enum><text>in paragraph (25), by striking <quote>(<external-xref legal-doc="usc" parsable-cite="usc/25/450">25 U.S.C. 450 et seq.</external-xref>)</quote> and inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301 et seq.</external-xref>)</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3ff6824232b242199213d3bddfd8d1b0"><enum>(6)</enum><text>in paragraph (26), by striking <quote>(<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>)</quote> and inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1083a87255694c4cb8e675f21f0741fb"><enum>(7)</enum><text>in paragraph (28)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf18fbd1eda4b4a43ba667f392b633554"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>, as defined in subsection (g) hereof,</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd4aaa1267900408296e0bff392b67ba3"><enum>(B)</enum><text>by striking <quote>subsection (c)(1) through (4) of this section</quote> and inserting <quote>subparagraphs (A) through (D) of paragraph (12)</quote>.</text></subparagraph></paragraph></subsection><subsection id="H2CD8CB14DC37405E8A973A0A0FC87B72"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="idf317971a89ca44ea8abf26a1d485be88"><enum>(1)</enum><text display-inline="yes-display-inline">The Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1601">25 U.S.C. 1601 et seq.</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id57b7228d517c4e9db7c8d8a3748c646f"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>contract health service</quote> each place it appears and inserting <quote>purchased/referred care</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf0a0b178cf554103b4b663c8ada112b5"><enum>(B)</enum><text>by striking <quote>contract health services</quote> each place it appears and inserting <quote>purchased/referred care</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfd8c29f4661d44f0b8b97ae27bacd839"><enum>(C)</enum><text>by striking <quote>Contract Health Service</quote> each place it appears and inserting <quote>purchased/referred care</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9faeca7259d445e4a3273a994b8da5aa"><enum>(D)</enum><text>by striking <quote>Contract Health Services</quote> each place it appears and inserting <quote>purchased/referred care</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4f5f7a18ed104feaadb58645c5988dfe"><enum>(E)</enum><text>by striking <quote>contract care</quote> each place it appears and inserting <quote>purchased/referred care</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id60cddce91c7b4e0e951491ccbdc9041b"><enum>(2)</enum><text>Section 211 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1621j">25 U.S.C. 1621j</external-xref>) is amended by striking the section heading and designation and all that follows through <quote>(a) The Secretary</quote> and inserting the following:</text><quoted-block id="ide35b6f4226e441c8ad9a8538696ebcf9"><enum>(13)</enum><text>Section 506A(a) of the Public Health Service Act (42 U.S.C. 290aa–5a(a)) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id74f7adc5cd5e4255b65d3685fdd8aca9"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>Tribal health program</quote> the second place it appears and inserting <quote>tribal health program</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4e4dff2d3c3c4988a3ac656e67198ab6"><enum>(B)</enum><text>in paragraph (3)—</text><clause commented="no" display-inline="no-display-inline" id="idb97d5e78003849e78d5e3467b90f7b87"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>health program administered by the Service</quote> and inserting <quote>health program administered directly by the Service</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida568769d1d00406485749c6684c8e804"><enum>(ii)</enum><text>by id="HF3168875571743B19538D4347FBEE441"><enum>(c)</enum><header>Updating authorities</header><text>The Secretary of Health and Human Services is directed to ensure that the Indian Health Manual and all other relevant rules, guidance, manuals, and other materials are revised such that <quote>contract health service</quote> each place it appears (regardless of casing and typeface and including in the headings) is revised to read <quote>purchased/referred care</quote> (with appropriate casing and typeface).</text></subsection></section></legis-body></bill>
