which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish an Outdoor Restoration Fund for restoration and resilience projects, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H83D67BB5571042A98BF7EA06852E00F0"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect the West Act of 2025</short-title></quote>.</text></section><section id="idDAA98F84328E4168884B2D5C03ECF48B"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text><paragraph id="id3AD4C470D03046A493727CAF31C4C2F5"><enum>(1)</enum><header>Council</header><text>The term <term>Council</term> means the Restoration Fund Advisory Council established by section 4(a).</text></paragraph><paragraph id="idFC9ADB3C2D17467EB59F6C4DD57B0D7A"><enum>(2)</enum><header>Covered authority</header><text>The term <term>covered authority</term> means—</text><subparagraph id="id4ce1f4390ce0491085050ee18089bdb0"><enum>(A)</enum><text>the good neighbor authority established by section 8206 of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/16/2113a">16 U.S.C. 2113a</external-xref>);</text></subparagraph><subparagraph id="id5ec0f1ce8f374d1784c2a63c3fa91246"><enum>(B)</enum><text>the Water Source Protection Program under section 303 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6542">16 U.S.C. 6542</external-xref>);</text></subparagraph><subparagraph id="id611d5d0c2c4e48aa820cd8a14298064d"><enum>(C)</enum><text>the Watershed Condition Framework established under section 304 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6543">16 U.S.C. 6543</external-xref>); </text></subparagraph><subparagraph id="iddc7772b33ffe4a938759f4a1f51a7a1f"><enum>(D)</enum><text>the stewardship end result contracting program under section 604 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591c">16 U.S.C. 6591c</external-xref>); </text></subparagraph><subparagraph id="id69cd5a13ff64470b8d3ed3a285009b0b"><enum>(E)</enum><text>the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2101">16 U.S.C. 2101 et seq.</external-xref>);</text></subparagraph><subparagraph id="id44be0242747549a6a71e44337999565e"><enum>(F)</enum><text>the Joint Chiefs' Landscape Restoration Partnership program; </text></subparagraph><subparagraph id="id08B97292B358478D87BBC7801CD18B32"><enum>(G)</enum><text>the Watershed Protection and Flood Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1001">16 U.S.C. 1001 et seq.</external-xref>); </text></subparagraph><subparagraph id="idCE78E532BF6149DA8BD61D222461D722"><enum>(H)</enum><text>the emergency watershed protection program established under section 403 of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2203">16 U.S.C. 2203</external-xref>);</text></subparagraph><subparagraph id="idd746175f62ab42008500d222540c5e0a"><enum>(I)</enum><text>the Collaborative Forest Landscape Restoration Program established under section 4003 of <external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/7303">16 U.S.C. 7303</external-xref>); </text></subparagraph><subparagraph commented="no" id="ide78388ebae334adb8f6b32adb0dc0763"><enum>(J)</enum><text>the legacy roads and trails program of the Department of Agriculture;</text></subparagraph><subparagraph commented="no" id="id1906684b56054abdb74e598c1d45a04a"><enum>(K)</enum><text>the working lands for wildlife program of the Department of Agriculture; and</text></subparagraph><subparagraph id="id64fd8f423ccb4ee99c1b997f351ce393"><enum>(L)</enum><text>a conservation program under title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3801">16 U.S.C. 3801 et seq.</external-xref>), including the Regional Conservation Partnership program under subtitle I of that title (<external-xref legal-doc="usc" parsable-cite="usc/16/3871">16 U.S.C. 3871 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="ida454a40532b1447aa3c9e0ac16408f2d"><enum>(3)</enum><header>Ecological integrity</header><text>The term <term>ecological integrity</term> has the meaning given the term in section 219.19 of title 36, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text></paragraph><paragraph id="id118EDE9827C14F239726206A98B5BC84"><enum>(4)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id68B4B4AFE5BC4D1E80DAC4C443CF97E1"><enum>(A)</enum><text>a State agency;</text></subparagraph><subparagraph id="id6D2076442FD24245992D040FFFF10D99"><enum>(B)</enum><text>a unit of local government;</text></subparagraph><subparagraph id="id6C4218084BBC482BAE2D70DC2818A425"><enum>(C)</enum><text>a Tribal government;</text></subparagraph><subparagraph id="id6206BA673E024100AC578E9D28B735B2"><enum>(D)</enum><text>a regional government or quasi-governmental organization;</text></subparagraph><subparagraph id="idB86B7166C035400B8A849056AB571638"><enum>(E)</enum><text>a special district; or</text></subparagraph><subparagraph id="id02E1203E7D9B41E19B8989ED93D6E87F"><enum>(F)</enum><text>a nonprofit organization.</text></subparagraph></paragraph><paragraph id="idBC548F49D9E04AD2AA7513F21832E933"><enum>(5)</enum><header>Fund</header><text>The term <term>Fund</term> means the Outdoor and Watershed Restoration Fund established by section 3(a).</text></paragraph><paragraph id="id3ACD8E05C823491AA5A6B0CAE9EBB857"><enum>(6)</enum><header>Grant program</header><text>The term <term>grant program</term> means the restoration and resilience grant program established by section 5(b).</text></paragraph><paragraph id="id472ebf9a3c754dd89eafafb0609116f9"><enum>(7)</enum><header>Restoration</header><text>The term <term>restoration</term> has the meaning given the term in section 219.19 of title 36, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text></paragraph><paragraph id="id2386c0293a714252ae21970eca69df1f"><enum>(8)</enum><header>Restoration and resilience project</header><text>The term <term>restoration and resilience project</term> means a project carried out on Federal land, non-Federal land, or both, that is designed in accordance with the best available science to conduct restoration that measurably improves—</text><subparagraph id="idA9D8A1B7CA3D42EBB9C308F7BB75ECC0"><enum>(A)</enum><text>forest conditions;</text></subparagraph><subparagraph id="id5C2FCA2A49E2479EB3237157A6080A34"><enum>(B)</enum><text>rangeland and native grassland health;</text></subparagraph><subparagraph id="idC31F3B756AC0485AA0E54FB1F67D1F31"><enum>(C)</enum><text>watershed function; or</text></subparagraph><subparagraph id="id2A653271BB554B4B805783712241CE61"><enum>(D)</enum><text>wildlife habitat.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id83283BFEF62048F09269774BB692C840"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2312F32D4FD14F57AED970E8300F9234"><enum>(10)</enum><header>Wildland-urban interface</header><text>The term <term>wildland-urban interface</term> has the meaning given the term in section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>).</text></paragraph></section><section id="idD54F4C1B8F0C4800BC31C478BA9BC6F8"><enum>3.</enum><header>Outdoor and Watershed Restoration Fund</header><subsection id="id0F401FF5094D4A289CCB5635581ECA98"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury an Outdoor and Watershed Restoration Fund.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id21b07ad089f94606a651e456b1b7d937"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Fund is to provide funding for the grant program and the Restoration and Resilience Partnership Program under section 6.</text></subsection><subsection id="idC5A9455B446E471CB6A4D836EF23C693"><enum>(c)</enum><header>Use</header><text>Amounts in the Fund shall be used by the Secretary through a transparent process—</text><paragraph id="idC8E07424763249C5B5B4658DB1CB672D"><enum>(1)</enum><text>in coordination with the Council, to carry out the grant program; and</text></paragraph><paragraph id="idFD21665DA61A4A96B83C5420DD914D47"><enum>(2)</enum><text>to carry out the Restoration and Resilience Partnership Program under section 6.</text></paragraph></subsection><subsection id="idA7BAD7329E0A4D9BB3C02B7D61D00562"><enum>(d)</enum><header>Savings provisions</header><paragraph id="idED585A84A2DF4A288473FD26A923B4E8"><enum>(1)</enum><header>Complementary programs</header><text>Activities carried out under this Act shall complement, not duplicate or replace, existing Federal conservation, restoration, and resilience programs.</text></paragraph><paragraph id="id66858042992b4899b99c6bdf601a86b7"><enum>(2)</enum><header>Applicable law</header><text>A restoration and resilience project on Federal land or non-Federal land developed or implemented using amounts provided under this Act shall be carried out in accordance with applicable law and available authorities.</text></paragraph></subsection><subsection id="id3ED04BF009FC4CBE8A2608315F67AA7F"><enum>(e)</enum><header>Supplement, not supplant</header><text>Amounts provided under this Act shall supplement, not supplant, any Federal, State, or other funds otherwise made available to an eligible entity for activities described in this Act.</text></subsection><subsection id="id42aeec47a857442bbf525916fd1913e2"><enum>(f)</enum><header>Interagency flexibility and leverage</header><text>To facilitate interagency cooperation and enhance the speed and scale of results of activities carried out using amounts in the Fund—</text><paragraph id="id5814ee163584484896b9705eadfe5acf"><enum>(1)</enum><text>matching funds or cost-sharing requirements of a covered authority may be satisfied through the contribution of funding from—</text><subparagraph id="idDF03EC3299AE480D8766FF14D4BAD149"><enum>(A)</enum><text>1 or more other covered authorities; or </text></subparagraph><subparagraph id="id0E2EBF3CE1E548DCA7574B34CE7BABA0"><enum>(B)</enum><text>funds appropriated under section 8; and</text></subparagraph></paragraph><paragraph id="id40965cb5ac9741a392402bd9e8bd3eae"><enum>(2)</enum><text>the Secretary shall modify, expand, or streamline eligibility and verification criteria for covered authorities to maximize flexibility, speed, and use of Federal funds in the most effective manner to achieve outcomes of activities using amounts in the Fund.</text></paragraph></subsection><subsection id="id15a078fe74404aa1af112c8fd907e60e"><enum>(g)</enum><header>Pay-for-Performance contract authority</header><text>In using amounts in the Fund, the Secretary may use a contract, grant agreement, or fixed amount award to purchase successfully implemented restoration and resilience project outcomes from qualifying projects, as determined by the Secretary, at a negotiated per-unit price. </text></subsection><subsection commented="no" id="id3B2A3F7FD1CF4269951717D61FCC0DF0"><enum>(h)</enum><header>Acceptance and use of contributions</header><paragraph commented="no" id="id8B080D8CB2F146E5A1EB371988579685"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury, or a designee, may establish in the Treasury an account to accept contributions of non-Federal funds for the Fund.</text></paragraph><paragraph commented="no" id="idDD237F91A466416D997A9B9D32B56C1E"><enum>(2)</enum><header>Deposit and use of contributions</header><text>Contributions of non-Federal funds received for the Fund shall be—</text><subparagraph commented="no" id="id3DF10EA5FF814DE280CB8BD7E68AE41B"><enum>(A)</enum><text>deposited into the account established under paragraph (1); and</text></subparagraph><subparagraph commented="no" id="id68319842F08E49B19A4B52BABB679F83"><enum>(B)</enum><text>available to the Secretary, without further appropriation and until expended, to carry out activities described in subsection (c).</text></subparagraph></paragraph></subsection><subsection id="id2668AD8367214AE98844C9C093359D88"><enum>(i)</enum><header>Oversight</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Inspector General of the Department of Agriculture shall prepare and submit to the Committees on Agriculture, Nutrition, and Forestry and Appropriations of the Senate and the Committees on Agriculture, Natural Resources, and Appropriations of the House of Representatives a report describing the use, and any abuse or misuse, as applicable, of the Fund by the Secretary with respect to—</text><paragraph id="idFB529356933E45799DD84E43E2C8C43A"><enum>(1)</enum><text> the grant program; and</text></paragraph><paragraph id="id54199F0EFD9241F0ACD44DB4F0AE3C5F"><enum>(2)</enum><text> the Restoration and Resilience Partnership Program established by section 6.</text></paragraph></subsection></section><section id="id45cbcbaace8a4948b8076744032e11d3"><enum>4.</enum><header>Restoration Fund Advisory Council</header><subsection id="id4d37eb0bf44345448a3404ed4c23488c"><enum>(a)</enum><header>Establishment</header><text>There is established a Restoration Fund Advisory Council to provide recommendations to the Secretary with respect to—</text><paragraph id="idA0B13EE9F1A7488AB9F5E912564B43A5"><enum>(1)</enum><text>the disbursement of amounts from the Fund for the grant program;</text></paragraph><paragraph id="id1b6f31c86fa6407492b6c488f547ab93"><enum>(2)</enum><text>priority-setting for landscapes; and </text></paragraph><paragraph id="idAA7993FAECFD45FDBE3DA8E6A683268E"><enum>(3)</enum><text>evaluation and monitoring for restoration and resilience project success.</text></paragraph></subsection><subsection id="id5c9229f36cad471ba3f4cae55c90c392"><enum>(b)</enum><header>Membership</header><text>The Council shall be composed of—</text><paragraph id="id66297f58fddd433abfcc9801b199e9ad"><enum>(1)</enum><text>the Secretary;</text></paragraph><paragraph id="id352106d437804450bc9d52a0d6396de2"><enum>(2)</enum><text>12 members, to be appointed by the Secretary, of whom—</text><subparagraph id="ide6e4fdc4b7114629a59a5e5a2c41a696"><enum>(A)</enum><text>3 shall be representatives from resource-dependent industries, including the agriculture, oil and gas, outdoor recreation, or forest products industries;</text></subparagraph><subparagraph id="idaa04f5d5a7bf44438bae33645d68649a"><enum>(B)</enum><text>3 shall be national experts from each of the fields of natural resource restoration, economic development, and community and climate resilience; </text></subparagraph><subparagraph id="id17f685ff8a494944879382b073fdc1ad"><enum>(C)</enum><text>3 shall be representatives of conservation, wildlife, or watershed organizations;</text></subparagraph><subparagraph id="idf4db09b8937f4fe58a141fb195f88a01"><enum>(D)</enum><text>1 shall be a representative of State government;</text></subparagraph><subparagraph id="id948a142c94ea461788f9eb74bf130bb8"><enum>(E)</enum><text>1 shall be a representative of a unit of local government; and</text></subparagraph><subparagraph id="id8bb7687b1f704efb843b30d12b093b48"><enum>(F)</enum><text>1 shall be a representative of a Tribal government; and</text></subparagraph></paragraph><paragraph id="idbada7644d5194a4cb414425ee7461c4f"><enum>(3)</enum><text>as determined to be necessary by the Secretary, not more than 3 representatives from other Federal agencies.</text></paragraph></subsection><subsection id="idae8b858aabdd46c5be766e7f930a54db"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary, in consultation with the Council, shall submit to the Committee on Agriculture, Nutrition, and Forestry and the Committee on Appropriations of the Senate and the Committee on Agriculture, the Committee on Natural Resources, and the Committee on Appropriations of the House of Representatives a report describing—</text><paragraph id="id07c1cbba8a234f30925991f94ee2b02d"><enum>(1)</enum><text>the status of any restoration and resilience projects that received amounts from the Fund, including—</text><subparagraph id="idd13a02964a9142f884c8b5856a4469a3"><enum>(A)</enum><text>environmental and climate benefits;</text></subparagraph><subparagraph id="id0f815da5d92a41f79485c03c04e92623"><enum>(B)</enum><text>restoration achievements;</text></subparagraph><subparagraph id="id9d21bf2896904399b7d8f9a4955d398c"><enum>(C)</enum><text>attainment of restoration and habitat improvement objectives;</text></subparagraph><subparagraph id="id8e62f11112004009a88700ad48d22bc3"><enum>(D)</enum><text>jobs created and retained;</text></subparagraph><subparagraph id="ide29c58f325be4190917e51a6fc30358b"><enum>(E)</enum><text>the growth in outdoor industries that provide capacity to carry out restoration and resilience projects; and </text></subparagraph><subparagraph id="id256b9aae48ea4272bb9d0116b1bc94a3"><enum>(F)</enum><text>progress towards State-, Tribal-, and community-level resilience goals; and</text></subparagraph></paragraph><paragraph id="idf15944df3efb4327adf7a0ddfb6e72da"><enum>(2)</enum><text>recommendations to improve coordination, align Federal, State, or Tribal resources or existing authorities, and expand workforce capacity in outdoor industries that provide capacity to carry out restoration and resilience projects through legislative and administrative changes.</text></paragraph></subsection></section><section id="idf925942b2c11414b8f5d75404f7e7822"><enum>5.</enum><header>Restoration and resilience grant program</header><subsection id="id7a42d23ff9f548aca5f72d2038a7002b"><enum>(a)</enum><header>Purposes</header><text>The purposes of this section are—</text><paragraph id="id4b05fa98afc345f28ec6c2f929f2ec88"><enum>(1)</enum><text>to increase the capacity for—</text><subparagraph id="id8bd11082661e4e418723a99401ca4ce8"><enum>(A)</enum><text>planning, coordinating, and monitoring restoration and resilience projects on non-Federal land; and</text></subparagraph><subparagraph id="id458f01976ac54058a4d4738d878f70cb"><enum>(B)</enum><text>providing support for collaboration and monitoring on Federal land; and</text></subparagraph></paragraph><paragraph id="id0c9568b2a40f49b3b57a8b9b2393edf1"><enum>(2)</enum><text>to support, on non-Federal land—</text><subparagraph id="id32c058d2b7fd485bbf6e5702a5a2d9f9"><enum>(A)</enum><text>restoration and resilience projects;</text></subparagraph><subparagraph id="id96d58ac66e464fdc9ef79756287b0ed4"><enum>(B)</enum><text>efforts to improve wildfire resistive construction and reduce risks within the home ignition zone; and</text></subparagraph><subparagraph id="id863df03b591045d7968406e54587d646"><enum>(C)</enum><text>projects to expand equitable outdoor access.</text></subparagraph></paragraph></subsection><subsection id="idcf2d41ac8a2049a4a05dc0eb57a619ef"><enum>(b)</enum><header>Establishment</header><text>There is established a restoration and resilience grant program, to be administered by the Secretary, with the guidance of the Council, to provide grants or pay-for-performance contracts from the Fund to eligible entities for the purposes described in subsection (a).</text></subsection><subsection id="idb8458c86309543a59c5dd0e80ee4d8a1"><enum>(c)</enum><header>Regional coordination</header><text>The Secretary and the Council shall, to the maximum extent practicable—</text><paragraph commented="no" display-inline="no-display-inline" id="id0e3902855a3249a28d1b944366c96385"><enum>(1)</enum><text display-inline="yes-display-inline">seek input from and coordinate with State or regional efforts, initiatives, and partnerships to restore ecological integrity on Federal land and non-Federal land; and</text></paragraph><paragraph id="id7e23887dc20d4cca81ece81968488431"><enum>(2)</enum><text>complement or support existing State or regional efforts, initiatives, and partnerships to restore ecological integrity on Federal land and non-Federal land. </text></paragraph></subsection><subsection id="idb75cee91703f4542a007dc0570e3f3c5"><enum>(d)</enum><header>Use of funds</header><paragraph id="id1fe14669f26647b7a827b6402ce65d3b"><enum>(1)</enum><header>In general</header><text>The Secretary shall use amounts in the Fund to provide capacity grants or pay-for-performance contracts under paragraph (2) and implementation grants or pay-for-performance contracts under paragraph (3).</text></paragraph><paragraph id="idf4b41879f39c4f4690be3c1242b6769a"><enum>(2)</enum><header>Capacity grants</header><subparagraph id="id5defeb20a2e7491396926990675e9c00"><enum>(A)</enum><header>In general</header><text>Capacity grants or pay-for-performance contracts shall be made available to eligible entities for the purpose described in subsection (a)(1).</text></subparagraph><subparagraph id="idba8aa7bb7f8c4b7fb8872bc4d59a173a"><enum>(B)</enum><header>Application</header><clause id="id005addedaedd4aa5820bf90db0818ecc"><enum>(i)</enum><header>In general</header><text>A grant or pay-for-performance contract under this paragraph may only be made to an eligible entity that submits to the Secretary an application at such time, in such manner, and containing or accompanied by such additional information as the Secretary, in consultation with the Council, may require, including the information required under clause (ii).</text></clause><clause id="ida065b289de8e4d739656d1d3650812c4"><enum>(ii)</enum><header>Contents</header><text>An application submitted under clause (i) shall contain—</text><subclause id="idb73bb9ac369b4628906258ca114f211d"><enum>(I)</enum><text>a clear and concise expression of interest;</text></subclause><subclause id="idcda36b62be604b59ab3e6227e92ace1e"><enum>(II)</enum><text>an explanation for how funds would complement existing Federal funds; </text></subclause><subclause id="idcccc704e76e44d4dbcef3d5655aac5bd"><enum>(III)</enum><text>a description of how the proposed planning, coordinating, or monitoring of restoration and resilience projects would be carried out in accordance with the best available ecological restoration science; and</text></subclause><subclause id="id79a0bf694a4c47aeb679b3501b0f3896"><enum>(IV)</enum><text>an estimate of the number and duration of jobs that provide capacity to carry out restoration and resilience projects that would be created, or sustained, with the funds. </text></subclause></clause></subparagraph><subparagraph id="ide1d330eb43f140b0be7fcb2c168f10ad"><enum>(C)</enum><header>Condition</header><text>To the maximum extent practicable, the Secretary shall provide grant-writing training and mentoring opportunities for lower-capacity, less collaborative experience, or underserved communities and organizations to help lower the barriers to participation in, and create more inclusion in and opportunities under, the grant program.</text></subparagraph></paragraph><paragraph id="idc8f1f6feef1f4b21962f15255108f404"><enum>(3)</enum><header>Implementation grants</header><subparagraph id="id1de43d0ad0ff45d0af6baaffd0a13aeb"><enum>(A)</enum><header>In general</header><text>Implementation grants or pay-for-performance contracts shall be made available to eligible entities for the purpose described in subsection (a)(2).</text></subparagraph><subparagraph id="id9b07d0dec6c243b0bba5ba9a13a06593"><enum>(B)</enum><header>Application</header><text>A grant or pay-for-performance contract under this paragraph may be made only to an eligible entity that submits to the Secretary an application at such time, in such manner, and containing or accompanied by such information as the Secretary, in consultation with the Council, may require.</text></subparagraph><subparagraph id="id17a22f3aae3449019a0578f998ccc117"><enum>(C)</enum><header>Waiver</header><text>The Secretary may waive matching requirements under covered authorities for applicants for grants or pay-for-performance contracts under this paragraph representing lower-capacity, less collaborative experience, or underserved communities and organizations and rural communities. </text></subparagraph></paragraph></subsection><subsection id="id5ba392e135bb4a8d9c2729c30b3cce30"><enum>(e)</enum><header>Priority</header><text>In carrying out the grant program, the Secretary, in consultation with the Council, shall give priority to projects that would—</text><paragraph id="idb956a1cd2c934e9d9857b3b40b55e876"><enum>(1)</enum><text>create or sustain jobs, employ local or regional labor, or expand the outdoor workforce to provide capacity to carry out restoration and resilience projects or equitable outdoor access through training and education programs; </text></paragraph><paragraph id="id1d6fbd10e5b948148e8322c7fe6fa5d0"><enum>(2)</enum><text>be developed through a collaborative process, relying on the best available social ecological restoration science, with multiple stakeholders representing diverse interests; </text></paragraph><paragraph id="id4e99841cdfd64920a4dc065af22934c2"><enum>(3)</enum><text>address shared priorities for Federal and non-Federal partners;</text></paragraph><paragraph id="idd849fbdff9d749ad9c99e7121f27cd7b"><enum>(4)</enum><text>advance State, local, and Tribal plans relating to forests, water, wildlife, or equitable outdoor access; </text></paragraph><paragraph id="ide7c56323381b418487a026abf866c29d"><enum>(5)</enum><text>utilize watershed data analytics to quantify, prioritize, and measure expected outcomes from proposed restoration activities;</text></paragraph><paragraph id="idfa19b19739954f6eb357d425b7bcb66b"><enum>(6)</enum><text>be carried out by or in lower-capacity, less collaborative experience, or underserved communities and organizations; or </text></paragraph><paragraph id="id2571b47b391d4d66acb920c0a3ed403e"><enum>(7)</enum><text>improve long-term economic security in the geographic region through restoration and resilience projects, equitable outdoor access, and the indirect benefits of those projects and access, particularly in geographic regions transitioning from fossil-fuel extraction. </text></paragraph></subsection><subsection id="idb2932d95e5e147d7a7cccdfc111107b3"><enum>(f)</enum><header>Authorities</header><text>Eligible entities may use existing authorities when carrying out a restoration and resilience project, including a covered authority.</text></subsection></section><section id="idf607528e9d9b4886a7a4061ba61f0cbc"><enum>6.</enum><header>Restoration and resilience partnership program</header><subsection id="id6cd1781265ce47c880d752b0506fb52d"><enum>(a)</enum><header>Purposes</header><text>The purposes of this section are—</text><paragraph id="id9c20a3e223bd452bbe5b8cbb3345732f"><enum>(1)</enum><text>to restore and improve the ecological integrity of forest, grassland, and rangeland ecosystems across the United States in partnership with State, local, and Tribal governments;</text></paragraph><paragraph id="id0de81a85abf3499ea72981510df7f818"><enum>(2)</enum><text>to create or sustain outdoor jobs by reducing the backlog of restoration and resilience projects on Federal land and non-Federal land;</text></paragraph><paragraph id="idcc41b2c44d0a45be96992e749bcb2666"><enum>(3)</enum><text>to improve the resilience and carrying capacity of rangelands in the United States by preventing or mitigating invasive species, such as cheatgrass, that contribute to rangeland fire; and</text></paragraph><paragraph id="idfeed45e5e87146edb2539734f8aa9b33"><enum>(4)</enum><text>to reduce uncharacteristic wildfires in the highest risk areas of the United States by carrying out, in accordance with applicable law, restoration and resilience projects.</text></paragraph></subsection><subsection id="idfd35706c3b3a4b43b112389fc277a075"><enum>(b)</enum><header>Establishment</header><text>There is established a Restoration and Resilience Partnership Program, under which the Secretary shall carry out restoration and resilience projects in partnership areas designated under subsection (c)(1).</text></subsection><subsection id="id0445def17e704440aea1ad426ff6cec4"><enum>(c)</enum><header>Designation of partnership areas</header><paragraph id="idacd1318fd9244a2496ca8592ae329448"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this Act, the Secretary shall designate, for the purposes of carrying out restoration and resilience projects under subsection (e), any areas of Federal land and non-Federal land that the Secretary determines to be appropriate.</text></paragraph><paragraph id="id67a3fcefeef24b118da0a61bbef1dfec"><enum>(2)</enum><header>Submission of partnership areas by States and Tribes</header><subparagraph id="id8f208a9d0510498687f3bd3a4dd5b205"><enum>(A)</enum><header>In general</header><text>The Governor of a State or an authorized representative of an Indian Tribe may submit to the Secretary, in writing, a request to designate certain Federal land or non-Federal land in the State or Indian Country, respectively, for restoration and resilience projects under subsection (e).</text></subparagraph><subparagraph id="id6e7edcfc426a4620903c4c7a6d4548e9"><enum>(B)</enum><header>Inclusions</header><text>A written request submitted under subparagraph (A) may include 1 or more maps or recommendations.</text></subparagraph></paragraph></subsection><subsection id="id8a0fefe2a6884efaa313c251404313c9"><enum>(d)</enum><header>Requirements</header><text>To be eligible for designation under subsection (c), an area shall—</text><paragraph id="idb721e2184f924d12b3190e39526918d1"><enum>(1)</enum><text>have a high or very high wildfire potential as determined by—</text><subparagraph id="id652CB99C067643C4A45834EE1C47E611"><enum>(A)</enum><text>the map of the Forest Service entitled <quote>Wildfire Hazard Potential Version 2020</quote>; </text></subparagraph><subparagraph id="idACEA3518F36846448180C6CA5C902B73"><enum>(B)</enum><text>any other mapping resource or data source approved by the Secretary that depicts the risk of wildfires; or</text></subparagraph><subparagraph id="idcdf0df2609be432a87b4eba132bcfd67"><enum>(C)</enum><text>fire-risk assessment resources or mapping tools maintained by the applicable State;</text></subparagraph></paragraph><paragraph id="id1111b51f867746669313bccc4e53cd5b"><enum>(2)</enum><text>have high-priority wildlife habitat urgently in need of restoration, as determined by the Secretary, in consultation with eligible entities and the applicable Governor or representative of an Indian Tribe; or</text></paragraph><paragraph id="id9d7383a352d64fd2831711532e23924c"><enum>(3)</enum><text>in the case of Federal land, be in the wildland-urban interface.</text></paragraph></subsection><subsection id="id99e9b0a3c43a4d4d852781a427932eda"><enum>(e)</enum><header>Restoration and resilience projects</header><paragraph id="idf0aa51e049b24b4797ad2fe963bbf2c1"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) and (3), the Secretary shall carry out restoration and resilience projects on land designated under subsection (c).</text></paragraph><paragraph id="id1e56130d1e164194952a4ad401484eb9"><enum>(2)</enum><header>Priority</header><text>The Secretary shall give priority to restoration and resilience projects that would—</text><subparagraph id="id97e2ece3feb34085bfb83d26de7a1ed7"><enum>(A)</enum><text>focus on the reintroduction of characteristic, low-intensity fire in frequent fire regime ecosystems;</text></subparagraph><subparagraph id="idd55107e018644e738d3dfb85eeec4f52"><enum>(B)</enum><text>reduce hazardous fuels by focusing on small-diameter trees, thinning, and strategic fuel breaks;</text></subparagraph><subparagraph id="idf590b888d12647d78aac07a9a32af67d"><enum>(C)</enum><text>maximize the retention of old and large trees, as appropriate for the forest type;</text></subparagraph><subparagraph id="idfcda80d8ad774487912b850343317977"><enum>(D)</enum><text>measurably improve habitat conditions for at-risk wildlife;</text></subparagraph><subparagraph id="idcbeda12073a04a158d877496210edc5a"><enum>(E)</enum><text>measurably improve water quality or water quantity outcomes in waterways that flow through and out of priority areas;</text></subparagraph><subparagraph id="id03016bd71ac64e5ebcd8c112579e5fee"><enum>(F)</enum><text>establish plans for measuring project success and environmental outcomes; </text></subparagraph><subparagraph id="id388379ca70af4d3d981ca899fa872788"><enum>(G)</enum><text>promote community and homeowner involvement in planning and implementing actions to mitigate the risk posed by wildfire in the wildland-urban interface;</text></subparagraph><subparagraph id="id7a30e90b206845cb8559b59953c7e451"><enum>(H)</enum><text>emphasize proactive wildfire risk mitigation actions in the wildland-urban interface; and</text></subparagraph><subparagraph id="idfb444044964846a9b4e88d1fa0149738"><enum>(I)</enum><text>increase fire adaption in communities located within the wildland-urban interface. </text></subparagraph></paragraph><paragraph id="id45adeabcaa64433293e5914f7518a0f9"><enum>(3)</enum><header>Coordination</header><text>The Secretary shall carry out restoration and resilience projects under this subsection—</text><subparagraph id="id781bce4a122b4ecab910ae47e4d2f1a4"><enum>(A)</enum><text>on Federal land, in coordination with the Secretary of the Interior, as applicable; and</text></subparagraph><subparagraph id="id668f58e0e8da44c389943d291d4ad793"><enum>(B)</enum><text>on non-Federal land, in coordination with eligible entities and other relevant stakeholders, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="id94fa13a8a2184d699638b3e330e2ecb8"><enum>(4)</enum><header>Requirements</header><subparagraph id="id6c2b17dc2f9f40519c01187163497090"><enum>(A)</enum><header>In general</header><text>A restoration and resilience project shall be carried out in accordance with—</text><clause id="id560A971FE99544A29D9A839813D1902A"><enum>(i)</enum><text>in the case of a restoration and resilience project carried out on Federal land, the management objectives of an applicable land or resource management plan; and</text></clause><clause id="idEC93C6CC0EC34A97962C91BC651BD000"><enum>(ii)</enum><text>applicable law.</text></clause></subparagraph><subparagraph id="idd546275a81bd4cb4910c9d63cc632ca1"><enum>(B)</enum><header>Inclusions</header><text>The Secretary may use existing authorities when carrying out a restoration and resilience project on land designated under subsection (c), including any covered authority.</text></subparagraph><subparagraph id="idbf7fdec78e2b4117be63dd354eaec1cd"><enum>(C)</enum><header>Exclusions</header><text>A restoration and resilience project may not be carried out—</text><clause id="idb86e355514be425a8d1825fcbeefda79"><enum>(i)</enum><text>in a wilderness area or designated wilderness study area;</text></clause><clause id="id2a808fc6a1ad4bfc87fa530ae7228cf9"><enum>(ii)</enum><text>to construct a permanent road or trail;</text></clause><clause id="id201770b00d49411e9d65f74e75a24ce7"><enum>(iii)</enum><text>on any Federal land on which, by an Act of Congress or Presidential proclamation, the removal of vegetation is restricted or prohibited;</text></clause><clause id="idf45d1e135c0f4eb5a8a5c82acb772f45"><enum>(iv)</enum><text>in an inventoried roadless area or comparable roadless area defined by a State-specific rule; or</text></clause><clause id="ida724b687bcac43978815a4f3d3a4d24d"><enum>(v)</enum><text>to remove old growth stands (as defined in section 102(e)(1) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6512">16 U.S.C. 6512(e)(1)</external-xref>)).</text></clause></subparagraph></paragraph></subsection></section><section id="idbcc125f7cf394dafa76734b98babcf87"><enum>7.</enum><header>Oversight</header><text display-inline="no-display-inline">Not later than 60 days after the date of enactment of this Act, the Secretary shall submit to Congress a report that, with respect to funding made available by the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>; 135 Stat. 429) or <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (commonly known as the <quote>Inflation Reduction Act of 2022</quote>) for purposes of forestry—</text><paragraph id="id5922700c76ff4758b17b95be421ef01f"><enum>(1)</enum><text>explains the methodology for priority landscapes set by the Secretary;</text></paragraph><paragraph id="id5f054514182c43b1a661781cae7a04d1"><enum>(2)</enum><text>describes the metrics the Secretary is using for measuring performance and outcomes; and</text></paragraph><paragraph id="id643fe50a55294441992ae0f85d5da500"><enum>(3)</enum><text>describes the allocation of funds to States, forests, and Indian Tribes. </text></paragraph></section><section id="id792c97111f8147158b30450101d9e1da"><enum>8.</enum><header>Funding</header><subsection id="id328e7da7f6534b18b82e47a24b6dd077"><enum>(a)</enum><header>In general</header><text>There is appropriated, out of any money in the Treasury not otherwise appropriated, $60,000,000,000 for the Fund, to remain available until expended, of which—</text><paragraph id="idf36a884d28404442af93ba96339521cf"><enum>(1)</enum><text>$20,000,000,000 shall be for the grant program; and</text></paragraph><paragraph id="id54fb802bc9064a04a12b08366aacc542"><enum>(2)</enum><text>$40,000,000,000 shall be for the Restoration and Resilience Partnership Program under section 6, of which not less than $20,000,000,000 shall be for the conduct of restoration and resilience projects on Federal land under that section.</text></paragraph></subsection><subsection id="idc23131f6b12744ff811195c7971f13d6"><enum>(b)</enum><header>Workforce needs and expenses</header><text>Funds made available under subsection (a)(2) shall be available for staffing, salary, and other workforce needs and expenses relating to the administration of the Restoration and Resilience Partnership Program under section 6.</text></subsection></section></legis-body></bill>
