which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a grant program within the Office of Juvenile Justice and Delinquency Prevention to award grants to States that require the recording of all child welfare interviews with children and adults, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Generate Recordings of All Child protective Interviews Everywhere Act</short-title></quote> or the <quote><short-title>GRACIE Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id167c7d19a8ef4d968ee94f1cc54a3186"><enum>2.</enum><header>Child protective service interview recording grants</header><subsection id="id87588911fc77416ca51b1c97a5483bda"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idd7064b163efc45e7aadb4b68f34e8a35"><enum>(1)</enum><header>Child welfare interview</header><text>The term <term>child welfare interview</term> means a documented interview with all relevant parties, including a child and an adult, conducted by a child protective services agency of a State in order to elicit information regarding concerns of abuse, neglect, or exposure to violence.</text></paragraph><paragraph id="id344b8d0103ae4d448c235ea3da0d452f"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Juvenile Justice and Delinquency Prevention of the Department of Justice.</text></paragraph><paragraph id="id9829aad5632f4516928357205332b58f"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a child protective services agency of a State that has in effect a statute, ordinance, policy, or practice that requires—</text><subparagraph id="id093ff01b312b4f02ad4e269e10aa26fa"><enum>(A)</enum><text>any child welfare interview conducted by a child protective services agency of the State to be recorded through—</text><clause id="id00b14846bd294c9cae7b4f8eae20017c"><enum>(i)</enum><text>electronic audio recording;</text></clause><clause id="id1ce573f0bb8b45358117ae04e6685b94"><enum>(ii)</enum><text>body camera video; or</text></clause><clause id="id04f0467467c2443785920e95f7e26db9"><enum>(iii)</enum><text>any other reasonable means of recording; and</text></clause></subparagraph><subparagraph id="id7c30a1018a924913bf87e730a0ec8123"><enum>(B)</enum><text>the retention and storage of a recording described in subparagraph (A)— </text><clause id="id778BB330506D4800B6EA7DBC04AA4FCD"><enum>(i)</enum><text>for not less than 5 years; and </text></clause><clause id="id231684EB8BDD4FB6A973067850271F0F"><enum>(ii)</enum><text>in a manner consistent with the protocols established by the State for such recordings, which shall include that— </text><subclause id="idDFEBCB340E9841A09A4A34A6D79C8E04"><enum>(I)</enum><text>a copy of such a recording— </text><item id="idF43A17DA7758442E8D261500E7A0B778"><enum>(aa)</enum><text>subject to item (bb), may only be released to those investigating an allegation; and</text></item><item id="id19E08F0ED0354C35870B088C09CA03D5"><enum>(bb)</enum><text>upon a request by a caregiver or guardian in connection with a judicial proceeding, shall be made available to the caregiver or guardian, unless the court orders otherwise; </text></item></subclause><subclause id="id4BD94E46FF7A4112AA787F25FCB212D0"><enum>(II)</enum><text>a penalty is imposed for a violation of a limitation described in subclause (I); and</text></subclause><subclause id="id0BDA488C0C4D47F5A6E7924A7FBA0D92"><enum>(III)</enum><text>the retention systems of the child protective services agency securely manage the storage and distribution of such a recording with access controls and role-based permission management.</text></subclause></clause></subparagraph></paragraph><paragraph id="id27b1efb0dced4147b59a86a7e91e8ee0"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph id="id42bddb1f132048d581a4c7d0a47fe774"><enum>(A)</enum><text>each of the several States;</text></subparagraph><subparagraph id="idf5d9b1d7f04747079a2a56d934df56eb"><enum>(B)</enum><text>the District of Columbia;</text></subparagraph><subparagraph id="id31a23e0773b1425daddea5811190e047"><enum>(C)</enum><text>the Commonwealth of Puerto Rico; and</text></subparagraph><subparagraph id="ida04acc1e50e24ef58e21432f28b9edc8"><enum>(D)</enum><text>any territory or possession of the United States.</text></subparagraph></paragraph></subsection><subsection id="idc54385b9e7b64f2cb70c336dc1749d7b"><enum>(b)</enum><header>Grants</header><text>The Director may award a grant to an eligible entity for the purpose of recording and storing all child welfare interviews conducted by the eligible entity.</text></subsection><subsection id="id1c773d0116884f29b3626c9fb027f5a5"><enum>(c)</enum><header>Application</header><text>An eligible entity seeking a grant under this section shall submit to the Director an application at such time, in such manner, and containing such information as the Director may require.</text></subsection><subsection id="ID28c47b5281614dc1909fc048251e9997"><enum>(d)</enum><header>Use of funds</header><text>Amounts received under a grant under this section shall be used exclusively for costs directly associated with conducting and retaining for 5 years the recording of all child welfare interviews by a child protective services agency of a State, including initial interviews conducted during a family assessment.</text></subsection><subsection id="ID72caa3e77b2246a798ada9879056a653"><enum>(e)</enum><header>Funding</header><text>The Director shall carry out this section using amounts otherwise available to the Director. </text></subsection></section></legis-body></bill>
