which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Fair Credit Reporting Act to prohibit consumer reporting agencies from furnishing consumer reports containing adverse items of information about a consumer that resulted from that consumer being unlawfully or wrongfully detained abroad or held hostage abroad.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id805296fb66a443718108d3790bd5db97"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Credit for American Hostages Act of 2025</short-title></quote>.</text></section><section id="S1"><enum>2.</enum><header>Adverse information about consumers unlawfully or wrongfully detained abroad or held hostage abroad</header><subsection id="id54d9e112665242a48ecb8f378ee62b62"><enum>(a)</enum><header>In general</header><text>The Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681 et seq.</external-xref>) is amended by inserting after section 605C the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idb48de65c90464a8aa2804348addb0419"><section id="id57258c236e0940ab96c4503c6283a0fa"><enum>605D.</enum><header>Adverse information about consumers unlawfully or wrongfully detained abroad or held hostage abroad</header><subsection id="id1e2d61f8f2c5440d8d59ba44ae973054"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id689566ad32114631a2ecb0bfd9f59139"><enum>(1)</enum><header>Covered consumer</header><text>The term <term>covered consumer</term> means an individual who has been—</text><subparagraph commented="no" id="id8e37fbed35ed4889ba88df51c13fca67"><enum>(A)</enum><text>a United States national unlawfully or wrongfully detained abroad, as determined under section 302(a) of the Robert Levinson Hostage Recovery and Hostage-Taking Accountability Act (<external-xref legal-doc="usc" parsable-cite="usc/22/1741">22 U.S.C. 1741(a)</external-xref>); or</text></subparagraph><subparagraph commented="no" id="idb32b59b47a104a418c98a9ec5a1c3f36"><enum>(B)</enum><text>a United States national taken hostage abroad, as determined by the Hostage Recovery Fusion Cell established by section 304 that Act (<external-xref legal-doc="usc" parsable-cite="usc/22/1741b">22 U.S.C. 1741b</external-xref>).</text></subparagraph></paragraph><paragraph id="idc14b472d477e4a2d8d0ad8d9f8737906"><enum>(2)</enum><header>Detention or hostage documentation</header><text>The term <term>detention or hostage documentation</term> means documentation that—</text><subparagraph id="id1a93ed99d4b94ca492953c8c7d2adb4a"><enum>(A)</enum><text>certifies a consumer is a covered consumer under this section;</text></subparagraph><subparagraph id="id702f7e9b2d104592bca62b4fe8079d2e"><enum>(B)</enum><text>identifies the time period during which the covered consumer was unlawfully or wrongfully detained abroad or held hostage abroad; and</text></subparagraph><subparagraph id="id0ffb6150515b4e1a981fff1db5db4b49"><enum>(C)</enum><text>is authenticated by—</text><clause id="id863c800c6ce54175876336d2424430de"><enum>(i)</enum><text>the Special Presidential Envoy for Hostage Affairs established by section 303 of the Robert Levinson Hostage Recovery and Hostage-Taking Accountability Act (<external-xref legal-doc="usc" parsable-cite="usc/22/1741a">22 U.S.C. 1741a</external-xref>); or</text></clause><clause id="ide6979970faf645fa8054acb183b9fc19"><enum>(ii)</enum><text>the Hostage Recovery Fusion Cell established by section 304 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/22/1741b">22 U.S.C. 1741b</external-xref>).</text></clause></subparagraph></paragraph></subsection><subsection id="iddd46f92cf17c4d9c8689f55cd1ba1251"><enum>(b)</enum><header>Adverse information</header><text>If a consumer reporting agency described in section 603(p) is able to authenticate detention or hostage documentation provided by a covered consumer, the consumer reporting agency may not furnish a consumer report containing any adverse item of information about the covered consumer dating during the time period the covered consumer was unlawfully or wrongfully detained abroad or held hostage abroad.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8f0edc1422844a82a0dc6a17230305a2"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of contents of the Fair Credit Reporting Act is amended by inserting after the item relating to section 605C the following:</text><quoted-block style="USC" id="id4b1f482e-a333-4a5e-a237-1652c3931dc2"><toc><toc-entry level="section" idref="id57258c236e0940ab96c4503c6283a0fa">605D.
