which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Northwestern New Mexico Rural Water Projects Act to make improvements to that Act, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id47ebe3bc-aa75-4614-96cf-a3a1f1130cad" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Navajo-Gallup Water Supply Project Amendments Act of 2025</short-title></quote>.</text></section><section id="idfcc50273-637d-4283-9107-528639c38054" changed="not-changed"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 10302 of the Northwestern New Mexico Rural Water Projects Act (<external-xref legal-doc="usc" parsable-cite="usc/43/407">43 U.S.C. 407</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id9eca599d-4ef6-4d7e-b955-5d947661e46d" changed="not-changed"><enum>(1)</enum><text>by striking paragraph (29);</text></paragraph><paragraph id="idd4bedb88-5623-4974-a0e6-e295a3ae5118" changed="not-changed"><enum>(2)</enum><text>by redesignating paragraphs (12), (13), (14), (15), (16), (17), (18), (19), (20), (21), (22), (23), (24), (25), (26), (27), (28), and (30) as paragraphs (13), (14), (15), (16), (17), (18), (19), (20), (21), (22), (23), (24), (25), (27), (28), (30), (31), and (32), respectively;</text></paragraph><paragraph id="id4e2a08f3-ab0e-423a-8640-54a98a0032ac" changed="not-changed"><enum>(3)</enum><text>by inserting after paragraph (11) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8dd226d0-ad73-483f-afd0-8dc0cbc8a3a0" changed="not-changed"><paragraph id="id842a081f-a75c-43c2-80fe-f99bcb10b397" changed="not-changed"><enum>(12)</enum><header>Deferred Construction Fund</header><text>The term <term>Deferred Construction Fund</term> means the Navajo Nation's Navajo-Gallup Water Supply Project Deferred Construction Fund established by section 10602(i)(1)(A).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idc43973be-f23b-4b42-892b-9221ba6cd853" changed="not-changed"><enum>(4)</enum><text>in paragraph (14) (as so redesignated)—</text><subparagraph id="idc3d3d150-95c6-4114-a3a5-edc77550c67b" changed="not-changed"><enum>(A)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">Draft</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Final Environmental</header-in-text></quote>;</text></subparagraph><subparagraph id="id12e326df-1c78-4b4f-901f-f8cea9b69339" changed="not-changed"><enum>(B)</enum><text>by striking <quote>Draft Impact</quote> and inserting <quote>Final Environmental</quote>;</text></subparagraph><subparagraph id="id7280f09b-b167-431e-8111-27b1a0157845" changed="not-changed"><enum>(C)</enum><text>by striking <quote>draft environmental</quote> and inserting <quote>final environmental</quote>; and</text></subparagraph><subparagraph id="id4bfb5ef5-4e6f-4c7f-aa2e-f0c587ad7b4c" changed="not-changed"><enum>(D)</enum><text>by striking <quote>March 2007</quote> and inserting <quote>July 6, 2009</quote>;</text></subparagraph></paragraph><paragraph id="id2318d980-acf5-4447-90b4-054a18a0b1ca" changed="not-changed"><enum>(5)</enum><text>in paragraph (19) (as so redesignated), by striking <quote>Draft</quote> and inserting <quote>Final Environmental</quote>;</text></paragraph><paragraph id="idfa42d428-914a-472c-8618-7b2cdb3114fa" changed="not-changed"><enum>(6)</enum><text>by inserting after paragraph (25) (as so redesignated) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id7c1c68e5-d8dc-46b0-be55-fc2084185ac5" changed="not-changed"><paragraph id="id963c7579-b2b6-4dc2-aa61-e8f7c4a842ba" changed="not-changed"><enum>(26)</enum><header>Project Service Area</header><text>The term <term>Project Service Area</term> means the area that encompasses the 43 Nation chapters, the southwest portion of the Jicarilla Apache Reservation, and the City that is identified to be served by the Project, as illustrated in figure IV–5 (Drawing No. 1695–406–49) of the Final Environmental Impact Statement.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="id6be57d65-7ad8-4dc6-ad11-03f914cc1392" changed="not-changed"><enum>(7)</enum><text>by inserting after paragraph (28) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd2a8cee3-dc4a-4daf-ac28-589ebc2ebf73" changed="not-changed"><paragraph commented="no" display-inline="no-display-inline" id="id00234b57-2854-4d14-8623-3a6708718dd4" changed="not-changed"><enum>(29)</enum><header>Settlement trust funds</header><text display-inline="yes-display-inline">The term <term>Settlement Trust Funds</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0770540c-e39e-48c3-b955-66dd8e981187" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the Navajo Nation Water Resources Development Trust Fund established by subsection (a)(1) of section 10702;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id546476aa-857c-4c02-8709-ecb06cc8c1eb" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">the Navajo Nation Operations, Maintenance, and Replacement Trust Fund established under subsection (b)(1) of that section; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id51e766de-017a-40bb-9631-dcf184f2b83e" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">the Jicarilla Apache Nation Operations, Maintenance, and Replacement Trust Fund established under subsection (c)(2) of that section.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idfc5b6046-9438-4098-bb35-9a38795a0b19" changed="not-changed"><enum>(8)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idcaf90299-4bc4-4abe-b16d-7ef67a053875" changed="not-changed"><paragraph id="id0382f515-1a52-423a-a1a7-7797b05395ef" changed="not-changed"><enum>(33)</enum><header>Working Cost Estimate</header><text>The term <term>Working Cost Estimate</term> means the Bureau of Reclamation document entitled <quote>NGWSP October 2022 WCE</quote> and dated February 26, 2023, that details the costs totaling $2,138,387,000, at the October 2022 price level, of the Project, as configured on that date.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idbc4a890a-bb63-48e6-9b70-acb1bcef3ff8" changed="not-changed"><enum>3.</enum><header>Navajo-Gallup water supply project</header><subsection id="id1cda54f6-3c5a-4522-aa30-f94ec66f01b2" changed="not-changed"><enum>(a)</enum><header>Authorization of Navajo-Gallup water supply project</header><text>Section 10602 of the Northwestern New Mexico Rural Water Projects Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1379) is amended—</text><paragraph id="idb93ca1d5-9322-495e-9fd2-3e92a640bb0e" changed="not-changed"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id11e8bc4b-c132-4645-85f3-385de3285654" changed="not-changed"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">In general</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Authorization</header-in-text></quote>;</text></subparagraph><subparagraph id="id8ad3c341-5ab0-467b-a6c6-f140db9712dc" changed="not-changed"><enum>(B)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc61308c9-ac39-4dee-8077-ba34ae3833b5" changed="not-changed"><paragraph id="id1a569b06-9e19-4f1a-a151-364e0e4a0439" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The Secretary</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idbeec1f3e-d405-4eb7-aff1-47aef437543f" changed="not-changed"><enum>(C)</enum><text>in paragraph (1) (as so designated), by striking <quote>Draft Impact Statement</quote> and inserting <quote>Final Environmental Impact Statement, as further refined in, and including the facilities identified in, the Working Cost Estimate and any subsequent supplemental documents prepared in accordance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</quote>; and</text></subparagraph><subparagraph id="iddcbb1208-2ad5-4fc7-a3a2-9a49f8f65e29" changed="not-changed"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idca7da5e2-da29-45ed-a320-174c5bad7340" changed="not-changed"><paragraph id="id9d27a666-ea14-4ead-bae7-37747675e943" changed="not-changed"><enum>(2)</enum><header>Additional service areas</header><subparagraph id="id4e175c1b-fd56-42e4-b5be-f742c3f80ee1" changed="not-changed"><enum>(A)</enum><header>Findings</header><text>Congress finds that—</text><clause id="id78ab27e0-49bd-43fd-adb0-7ff7278b6aa9" changed="not-changed"><enum>(i)</enum><text>expanding the Project Service Area would create opportunities to increase service for additional Nation Tribal members and would not increase the cost of the Project beyond authorization levels described in section 10609(a); and</text></clause><clause id="id51ab3081-e238-4c6a-b358-c005400d4068" changed="not-changed"><enum>(ii)</enum><text>the unit operations and maintenance costs of the Project would be reduced by adding more customers to the Project.</text></clause></subparagraph><subparagraph id="id2ff8ccd4-85b1-4c11-87d7-2527163f9d23" changed="not-changed"><enum>(B)</enum><header>Authorizations for additional Project Service Areas</header><clause id="id93730d48-238a-454b-b3f8-392a5b19a5a8" changed="not-changed"><enum>(i)</enum><header>New Mexico</header><text>In addition to delivering water supply from the Project to the Nation communities in the San Juan River Basin, the Nation may expand the Project Service Area in order to deliver water supply from the Project to communities of the Nation within the Rio San Jose Basin, New Mexico.</text></clause><clause id="id7d076d6c-1eb4-4d2d-826f-8b3b8a6dc885" changed="not-changed"><enum>(ii)</enum><header>Arizona</header><text>In addition to delivering water supply from the Project to the Nation communities of Fort Defiance and Window Rock, Arizona, and subject to section 10603(c)(1), the Nation may expand the Project Service Area in order to deliver water supply from the Project to the Nation community of Lupton, Arizona, within the Little Colorado River Basin, Arizona.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idac238e64-ba21-4f6a-9e6a-13a18d52ebea" changed="not-changed"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id224d627e-5a82-44bd-832f-7c637246f7d5" changed="not-changed"><enum>(A)</enum><text>in the matter preceding paragraph (1)—</text><clause id="id050956cb-a398-493c-8b84-90aa280e36e7" changed="not-changed"><enum>(i)</enum><text>by inserting <quote>acquire,</quote> before <quote>construct,</quote>; and</text></clause><clause id="id550477b5-a242-4b9d-87d6-cbecfc6989e8" changed="not-changed"><enum>(ii)</enum><text>by striking <quote>Draft Impact Statement</quote> and inserting <quote>Final Environmental Impact Statement, as further refined in, and including the facilities identified in, the Working Cost Estimate and any subsequent supplemental documents prepared in accordance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>)</quote>;</text></clause></subparagraph><subparagraph id="id17e77601-8d8b-4855-825b-eac0be6fc3e1" changed="not-changed"><enum>(B)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id74174a17-6f11-4caa-b587-4dd74706ee62" changed="not-changed"><paragraph id="idf6cfb4c8-79d0-4fae-bfd2-957d7aa5ccdc" changed="not-changed"><enum>(1)</enum><text>The water conveyance and storage facilities associated with the San Juan Generating Station (the coal-fired, 4-unit electric power plant and ancillary features located by the San Juan Mine near Waterflow, New Mexico), including the diversion dam, the intake structure, the river pumping plant, the pipeline from the river to the reservoir, the dam and associated reservoir, and any associated land, or interest in land, or ancillary features.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id4960aad6-d4db-4f12-9e30-dee6f48e3fd6" changed="not-changed"><enum>(C)</enum><text>in paragraph (2)(A)—</text><clause id="idf9e8838b-137e-4113-82b4-c86102dbebdf" changed="not-changed"><enum>(i)</enum><text>by striking <quote>River near Kirtland, New Mexico,</quote> and inserting <quote>Generating Station Reservoir</quote>; and</text></clause><clause id="id45051e9b-cfd0-4dd2-820f-cc80399a6a45" changed="not-changed"><enum>(ii)</enum><text>by inserting <quote>generally</quote> before <quote>follows United States Highway 491</quote>;</text></clause></subparagraph><subparagraph id="id4a0601e7-b884-4c91-820e-c7e50e461b6d" changed="not-changed"><enum>(D)</enum><text>in paragraph (3)(A), by inserting <quote>generally</quote> before <quote>follows United States Highway 550</quote>; and</text></subparagraph><subparagraph id="ida58a38db-95ec-4d9f-829f-a82bc6f8c5e4" changed="not-changed"><enum>(E)</enum><text>in paragraph (5), by inserting <quote>(including any reservoir facility)</quote> after <quote>treatment facility</quote>;</text></subparagraph></paragraph><paragraph id="id78a81f39-0b93-434a-a1e7-5d8dc5f99dfa" changed="not-changed"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="idd3572ce2-3807-4fb4-a1cf-1d3526e7956f" changed="not-changed"><enum>(A)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="subsection" style="OLC">and Facilities</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">Land</header-in-text></quote>;</text></subparagraph><subparagraph id="id7eba858b-e73e-4a75-84ed-b6c06183c4f3" changed="not-changed"><enum>(B)</enum><text>in paragraph (1), by striking <quote>any land or interest in land that is</quote> and inserting <quote>any land or facilities, or interest in land or facilities, that are</quote>; and</text></subparagraph><subparagraph id="idf77dee58-703a-4f6a-9eb6-6b7a51806f7b" changed="not-changed"><enum>(C)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idbda7513a-4efe-4930-92cc-3b9332003a86" changed="not-changed"><paragraph id="id4636ffc1-ce5d-4207-9237-e9e6e792ab85" changed="not-changed"><enum>(4)</enum><header>Land to be taken into trust</header><subparagraph id="id6f8f3bbe-154b-4a8b-b956-4097e40c103c" changed="not-changed"><enum>(A)</enum><header>In general</header><text>On satisfaction of the conditions described in paragraph (7) of the Agreement and after the requirements of sections 10701(e) and 10703 are met, the Secretary shall take legal title to the following land and, subject to subparagraph (D), hold that land in trust for the benefit of the Nation:</text><clause id="id3d220f00-3d17-4675-9ac0-0d494e497c02" changed="not-changed"><enum>(i)</enum><text>Fee land of the Nation, including—</text><subclause id="id5b668617-d72c-4d23-9e23-eb184e63cb57" changed="not-changed"><enum>(I)</enum><text>the parcels of land on which the Tohlakai Pumping Plant, Reach 12A and Reach 12B, are located, including, in McKinley County, New Mexico—</text><item id="id7ad6245b-f8b5-470b-ae6f-b953981aeea7" changed="not-changed"><enum>(aa)</enum><text>sec. 5, T. 16 N., R. 18 W., New Mexico Prime Meridian; and </text></item><item id="id2342e9bf-66a0-437f-862b-796fcce12f05" changed="not-changed"><enum>(bb)</enum><text>sec. 33, T. 17 N., R. 17 W., New Mexico Prime Meridian (except lot 9 and the NW<fraction>1/4</fraction> of lot 4);</text></item></subclause><subclause id="id160069b7-c61b-491a-93a4-c89af9053b0d" changed="not-changed"><enum>(II)</enum><text>the parcel of land on which Reach 12.1 is located, including—</text><item id="id3f9a176d-2da2-41e2-8564-1f11b7369afa" changed="not-changed"><enum>(aa)</enum><text>NW<fraction>1/4</fraction> and SW<fraction>1/4</fraction> sec. 5, T. 16 N., R. 18 W.; </text></item><item id="id39e7d340-0a3d-44e2-b74e-0c79456908a3" changed="not-changed"><enum>(bb)</enum><text>N<fraction>1/2</fraction> sec. 11, T. 16 N., R. 19 W.; and</text></item><item id="id90952e97-b1b6-4e19-a25c-bffd77ffa50e" changed="not-changed"><enum>(cc)</enum><text>sec. 12, T. 16 N., R. 20 W.; and</text></item></subclause><subclause id="id8f469f36-5bac-4b5d-aa3a-57810f118df9" changed="not-changed"><enum>(III)</enum><text>the parcel of land on which Reach 12.2 is located, including NW<fraction>1/4</fraction>. sec. 2, T. 16 N., R. 21 W.</text></subclause></clause><clause id="id5ac8e141-6961-4e00-a5a9-bd33bb0e8837" changed="not-changed"><enum>(ii)</enum><text>Public domain land managed by the Bureau of Land Management, including—</text><subclause id="id6e8532f4-2690-4775-a8d2-5a20ebbb8e9f" changed="not-changed"><enum>(I)</enum><text>the parcel of land on which the Cutter Lateral Water Treatment Plant is located, including S<fraction>1/2</fraction> sec. 9, T. 25 N., R. 9 W., New Mexico Prime Meridian; and</text></subclause><subclause id="id68e7ccb4-fbf0-4519-bdca-ca100ae083f3" changed="not-changed"><enum>(II)</enum><text>the parcel of land on which the Navajo Agricultural Products Industry turnout is located, including NW<fraction>1/4</fraction> and NE<fraction>1/4</fraction> sec. 34, T. 26 N., R. 9 W., New Mexico Prime Meridian.</text></subclause></clause><clause id="idd7017a02-89c4-4a0c-ae52-a2addb7cfaac" changed="not-changed"><enum>(iii)</enum><text>The land underlying the San Juan Generating Station (the coal-fired, 4-unit electric power plant and ancillary features located by the San Juan Mine near Waterflow, New Mexico) acquired by the United States, as described in subsection (b)(1).</text></clause></subparagraph><subparagraph id="idffd7082b-0796-4693-9aac-e2f235d5e0cd" changed="not-changed"><enum>(B)</enum><header>Part of Navajo Nation</header><text>The land taken into trust under subparagraph (A) shall be part of the Navajo Reservation and administered in accordance with the laws and regulations generally applicable to land held in trust by the United States for the benefit of an Indian Tribe.</text></subparagraph><subparagraph id="id127c9ddb-8b36-463d-b4cf-cd19ea86f57a" changed="not-changed"><enum>(C)</enum><header>Restrictions</header><clause commented="no" display-inline="no-display-inline" id="id14bbe00f-0904-469a-a5f7-fcc97eed2c4b" changed="not-changed"><enum>(i)</enum><header>Fee land of the nation</header><text display-inline="yes-display-inline">The fee land of the Nation taken into trust under subparagraph (A)(i) shall be subject to valid existing rights, contracts, and management agreements, including easements and rights-of-way, unless the holder of the right, contract, lease, permit, or right-of-way requests an earlier termination in accordance with existing law.</text></clause><clause id="id9fc4d2e5-a761-4ab0-bedb-e4f5d8dce13b" changed="not-changed"><enum>(ii)</enum><header>Public domain land</header><subclause commented="no" display-inline="no-display-inline" id="id1e3fdc53-8f27-4934-aa20-fbf794f361c9" changed="not-changed"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The public domain land managed by the Bureau of Land Management taken into trust under subparagraph (A)(ii) shall be subject to valid existing rights, contracts, leases, permits, and rights-of-way, unless the holder of the right, contract, lease, permit, or right-of-way requests an earlier termination in accordance with existing law. </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1a6e3ce8-b74b-4249-b01c-4689723f4a22" changed="not-changed"><enum>(II)</enum><header>BIA assumption of benefits and obligations</header><text display-inline="yes-display-inline">The Bureau of Indian Affairs shall—</text><item commented="no" display-inline="no-display-inline" id="id54ecc782-0aa3-4d83-a358-ae5121193682" changed="not-changed"><enum>(aa)</enum><text display-inline="yes-display-inline">assume all benefits and obligations of the previous land management agency under the existing rights, contracts, leases, permits, or rights-of-way described in subclause (I); and</text></item><item commented="no" display-inline="no-display-inline" id="id4363aafc-9bbc-418b-95c5-1f23eefc9a9f" changed="not-changed"><enum>(bb)</enum><text display-inline="yes-display-inline">disburse to the Nation any amounts that accrue to the United States from those rights, contracts, leases, permits, or rights-of-ways after the date on which the land described in clause (ii) of subparagraph (A) is taken into trust for the benefit of the Nation from any sale, bonus, royalty, or rental relating to that land in the same manner as amounts received from other land held by the Secretary in trust for the Nation.</text></item></subclause></clause><clause id="id3c5dcea1-5ae8-4b7b-8d6e-6840e649c506" changed="not-changed"><enum>(iii)</enum><header>Land underlying the San Juan Generating Station</header><subclause commented="no" display-inline="no-display-inline" id="id29350b5d-9576-4480-9aa0-b4fe411c985f" changed="not-changed"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The land underlying the San Juan Generating Station (the coal-fired, 4-unit electric power plant and ancillary features located by the San Juan Mine near Waterflow, New Mexico) taken into trust under subparagraph (A)(iii) shall be subject to a perpetual easement on and over all of the land underlying the San Juan Generating Station reserved to the United States for use by the Bureau of Reclamation and its contractors and assigns—</text><item commented="no" display-inline="no-display-inline" id="id6e2e505d-b0ea-4395-bdf3-c5d496cbf475" changed="not-changed"><enum>(aa)</enum><text display-inline="yes-display-inline">for ingress and egress; </text></item><item commented="no" display-inline="no-display-inline" id="idf2b64c53-c13f-41b7-a2cb-fe62d5da7984" changed="not-changed"><enum>(bb)</enum><text display-inline="yes-display-inline">to continue construction of the Project; and </text></item><item commented="no" display-inline="no-display-inline" id="id9ef668cb-f2b6-4c56-a34b-340c787d94f0" changed="not-changed"><enum>(cc)</enum><text display-inline="yes-display-inline">for operation and maintenance of Project facilities located on that land. </text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id184aab0e-ab51-4022-918c-e94cc77f2bd5" changed="not-changed"><enum>(II)</enum><header>Reserved perpetual easement</header><text display-inline="yes-display-inline">The reserved perpetual easement described in subclause (I) shall remain vested in the United States unless title to the Project facilities and appropriate interests in land are conveyed pursuant to subsection (f).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4986bdfec4ac42cca92ccea4866c3623" changed="not-changed"><enum>(III)</enum><header>Reserved Federal facilities</header><text>The United States shall retain ownership of the San Juan Generating Station (the coal-fired, 4-unit electric power plant and ancillary features located by the San Juan Mine near Waterflow, New Mexico) water conveyance and storage facilities when the underlying land is taken into trust under subparagraph (A)(iii) and title to those facilities shall remain vested in the United States unless title to those facilities are conveyed pursuant to subsection (f). </text></subclause></clause></subparagraph><subparagraph id="idadbb1992-426b-47f6-8b85-cf648bdb245f" changed="not-changed"><enum>(D)</enum><header>Savings clause</header><text>Nothing in this paragraph affects any—</text><clause id="ida189e366-4f52-4a82-a061-6d5c860ef672" changed="not-changed"><enum>(i)</enum><text>water right of the Nation in existence on the day before the date of enactment of the <short-title>Navajo-Gallup Water Supply Project Amendments Act of 2025</short-title>; and</text></clause><clause id="id0b8ea168-df5f-485b-9dd1-1f2aaeb78480" changed="not-changed"><enum>(ii)</enum><text>right or claim of the Nation to any land or interest in land in existence on the day before the date of enactment of the <short-title>Navajo-Gallup Water Supply Project Amendments Act of 2025</short-title>.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id228ea406-2a7c-4dd6-9c8e-a344e56becfb" changed="not-changed"><enum>(4)</enum><text>in subsection (d)(1)(D), by striking <quote>Draft</quote> and inserting <quote>Final Environmental</quote>;</text></paragraph><paragraph id="id5909d333-b6ba-4440-bacf-8eb0398679e9" changed="not-changed"><enum>(5)</enum><text>in subsection (e)—</text><subparagraph id="id6ae8193c-2d7a-47b3-83ed-33ec7a461537" changed="not-changed"><enum>(A)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id00d59511-01fc-4e48-94a3-9e207bdbb03b" changed="not-changed"><paragraph id="idd11be731-5780-44a8-91c5-b87f7120056e" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The Secretary</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idfe0568e0-a854-4712-b82d-d440d1c90b77" changed="not-changed"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id19ef83c5-c787-40c3-856c-6e357311f843" changed="not-changed"><paragraph id="id4ad005fd-2646-4b6c-962f-39d35617ca6b" changed="not-changed"><enum>(2)</enum><header>Renewable energy and hydroelectric power</header><subparagraph id="iddd15c073-0f42-4e8b-9a59-9d54c55cc28f" changed="not-changed"><enum>(A)</enum><header>Renewable energy</header><text>For any portion of the Project that does not have access to Colorado River Storage Project power, the Secretary may use not more than $6,250,000 of the amounts made available under section 10609(a)(1) to develop renewable energy.</text></subparagraph><subparagraph id="idbe29fb5b-9888-4e31-a37b-cbdb8b07b8b2" changed="not-changed"><enum>(B)</enum><header>Hydroelectric power</header><text>Notwithstanding whether a Project facility has access to Colorado River Storage Project power, the Secretary may use not more than $1,250,000 of the $6,250,000 authorized to be used to develop renewable energy under subparagraph (A) to develop hydroelectric power for any Project facility that can use hydraulic head to produce electricity.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id5f30a239-8bd9-4dfa-b869-629fb91efe58" changed="not-changed"><enum>(6)</enum><text>in subsection (h)(1), in the matter preceding subparagraph (A), by inserting <quote>, store,</quote> after <quote>treat</quote>; and</text></paragraph><paragraph id="ide5db4fa8-1913-4b25-a7cc-3b1b302694f6" changed="not-changed"><enum>(7)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idcea285d8-0286-4fd1-8431-0b64aac03674" changed="not-changed"><subsection id="id6dd265a2-c689-488f-a419-f83d83910830" changed="not-changed"><enum>(i)</enum><header>Deferred construction of Project facilities</header><paragraph id="id7f90b6b6-e195-4fd3-b768-69dd211c29cf" changed="not-changed"><enum>(1)</enum><header>Deferred construction of Project facilities</header><text>On mutual agreement between the Nation and the Secretary, and the Jicarilla Apache Nation if the deferred Project facilities benefit the Jicarilla Apache Nation, construction of selected Project facilities may be deferred to save operation and maintenance expenses associated with that construction.</text></paragraph><paragraph id="id8385c552-66c5-4881-8f8b-1326ec080cfc" changed="not-changed"><enum>(2)</enum><header>Deferred Construction Fund</header><subparagraph id="id77d567b8-c363-4669-976a-2b10fe98c344" changed="not-changed"><enum>(A)</enum><header>Establishment</header><text>There is established in the Treasury a fund, to be known as the <quote>Navajo Nation’s Navajo-Gallup Water Supply Project Deferred Construction Fund</quote>, to consist of—</text><clause id="ida26fdf21-4381-4d77-8d07-422517f3278a" changed="not-changed"><enum>(i)</enum><text>amounts that correspond to portions of the Project that have been deferred under paragraph (1); and</text></clause><clause id="idf1b50ae2-bc3a-4a61-a849-09996eadbce6" changed="not-changed"><enum>(ii)</enum><text>any interest or other gains on amounts referred to in clause (i).</text></clause></subparagraph><subparagraph id="idead587d9-cfbc-4c95-af0f-885e211757bf" changed="not-changed"><enum>(B)</enum><header>Use of the Deferred Construction Fund</header><text>The Nation may use amounts in the Deferred Construction Fund—</text><clause id="id55b50d92-be25-480c-9e6d-e788da1e17a0" changed="not-changed"><enum>(i)</enum><text>to construct Project facilities that have been deferred under paragraph (1); or</text></clause><clause id="ida81933fa-5e5d-41c4-9fde-d87ecf649eb4" changed="not-changed"><enum>(ii)</enum><text>to construct alternate facilities agreed on under subparagraph (C).</text></clause></subparagraph><subparagraph id="idace0c658-e2bf-407b-bf68-f43031a9464b" changed="not-changed"><enum>(C)</enum><header>Alternate facilities consistent with the purpose of the Project</header><text>On agreement between the Nation and the Secretary, and the Jicarilla Apache Nation if the deferred Project facilities benefit the Jicarilla Apache Nation, and in compliance with all applicable environmental and cultural resource protection laws, facilities other than those previously agreed to be deferred under paragraph (1) may be constructed if those alternate facilities are consistent with the purposes of the Project described in section 10601.</text></subparagraph></paragraph><paragraph id="iddc860e16-bb0a-45e0-8b9c-bcff8f0e424f" changed="not-changed"><enum>(3)</enum><header>Amounts to be deposited</header><text>Funds allocated from the amounts made available under section 10609(a)(1) to build facilities referred to in paragraph (1) shall be deposited into the Deferred Construction Fund.</text></paragraph><paragraph id="idcdf0b506-3912-4fa7-b121-a0c31d4be4c9" changed="not-changed"><enum>(4)</enum><header>Adjustments</header><text>On deposit of amounts into the Deferred Construction Fund under paragraph (3), the adjustments to authorized appropriations under section 10609(a)(2) shall no longer apply to those amounts. </text></paragraph><paragraph id="idee646f20-f588-4cc2-bd41-5911eb037ea8" changed="not-changed"><enum>(5)</enum><header>Deadline to construct Project facilities</header><text>On deposit of all amounts into the Deferred Construction Fund for construction of Project facilities agreed on under paragraph (1), the Secretary shall be deemed to have met the obligation under section 10701(e)(1)(A)(ix).</text></paragraph><paragraph id="id1c7449f2-bef3-43f1-b3d9-e8b0ef27e15e" changed="not-changed"><enum>(6)</enum><header>Future construction of Project facilities</header><text>On agreement between the Nation and the Secretary, and the Jicarilla Apache Nation if the deferred Project facilities benefit the Jicarilla Apache Nation, the Nation shall use amounts deposited into the Deferred Construction Fund to construct—</text><subparagraph id="id136022bf-b82e-4ef5-9fa0-bb890d33188b" changed="not-changed"><enum>(A)</enum><text>Project facilities deferred under paragraph (1); or</text></subparagraph><subparagraph id="id1bc78067-3d1d-4f85-821c-a5a5852e83af" changed="not-changed"><enum>(B)</enum><text>alternate Project facilities described in paragraph (2)(C).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id3bb6f46c-5485-43a4-8996-2344dd430272" changed="not-changed"><enum>(b)</enum><header>Delivery and use of Navajo-Gallup water supply project water</header><text>Section 10603 of the Northwestern New Mexico Rural Water Projects Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1382) is amended—</text><paragraph id="id21f3e8cb-805d-4a28-a2a7-4f5a622cf20f" changed="not-changed"><enum>(1)</enum><text>in subsection (a)(3)(B)— </text><subparagraph id="id3817edcf-2f0f-473d-b2b4-a84a3d687075" changed="not-changed"><enum>(A)</enum><text>in clause (i), by inserting <quote>or, if generated on City-owned facilities, by the City</quote> after <quote>the Nation</quote>; and</text></subparagraph><subparagraph id="id2381055e-227a-4d28-894b-04c5e525ec47" changed="not-changed"><enum>(B)</enum><text>in clause (ii), by inserting <quote>, except that the City shall retain all revenue from the sale of hydroelectric power that is generated on City-owned facilities</quote> after <quote>hydroelectric power</quote>; and</text></subparagraph></paragraph><paragraph id="id3b768cb0-c8e0-4847-b549-a0df96cf109a" changed="not-changed"><enum>(2)</enum><text>in subsection (g)(2), by striking <quote>, except as provided in section 10604(f)</quote>.</text></paragraph></subsection><subsection id="id6a8443dd-40aa-40d7-ab4a-53d752e70ba2" changed="not-changed"><enum>(c)</enum><header>Project contracts</header><text>Section 10604 of the Northwestern New Mexico Rural Water Projects Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; and</text></paragraph><paragraph id="id316b73db-5993-4fbc-bf6d-9d60c0ea8e66" changed="not-changed"><enum>(7)</enum><text>by redesignating subsection (g) as subsection (f). </text></paragraph></subsection><subsection id="id9fc9d69f-ff25-43ef-bbb4-5a24b4ec6ec3" changed="not-changed"><enum>(d)</enum><header>Authorization of appropriations</header><text>Section 10609 of the Northwestern New Mexico Rural Water Projects Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1395; 129 Stat. 528) is amended—</text><paragraph id="idea48be4f-9ed6-4fd7-95f9-d832fe42c81d" changed="not-changed"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id65580f9c-acd2-4284-b6e4-1624fb2585cd" changed="not-changed"><enum>(A)</enum><text>in paragraph (1), by striking <quote>$870,000,000 for the period of fiscal years 2009 through 2024</quote> and inserting <quote>$2,175,000,000 for the period of fiscal years 2009 through 2029</quote>;</text></subparagraph><subparagraph id="id4a241c0e-ecc4-49ed-b56e-e85db6e0d026" changed="not-changed"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ided83491f-7638-4418-a3cd-264ffea6fb58" changed="not-changed"><paragraph id="id1a501de0-caea-4749-bb67-f3f22c154deb" changed="not-changed"><enum>(2)</enum><header>Adjustments</header><subparagraph id="id68466183-b797-4a65-b7f2-40e735c70052" changed="not-changed"><enum>(A)</enum><header>In general</header><text>The amount under paragraph (1) shall be adjusted by such amounts as may be required—</text><clause id="ida2e61e94-fd8f-41e1-b7ad-f9ead03d53fb" changed="not-changed"><enum>(i)</enum><text>by reason of changes since October 2022 in construction cost changes in applicable regulatory standards, as indicated by engineering cost indices applicable to the types of construction involved; and</text></clause><clause id="id81cedee7-bb88-45a7-9a56-7f0caf9860fa" changed="not-changed"><enum>(ii)</enum><text>to address construction cost changes necessary to account for unforeseen market volatility that may not otherwise be captured by engineering cost indices described in clause (i), as determined by the Secretary, including repricing applicable to the types of construction and current industry standards involved.</text></clause></subparagraph><subparagraph id="ida4b00bdb-4ff9-46cf-b5c7-f0f74cdf5982" changed="not-changed"><enum>(B)</enum><header>Deferred Construction Fund</header><text>Amounts deposited in the Deferred Construction Fund shall not be adjusted pursuant to this paragraph.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="ide000550d-f40a-4473-9f2d-4e8903f5a685" changed="not-changed"><enum>(C)</enum><text>in paragraph (4)(B), by striking <quote>10 years</quote> and inserting <quote>15 years</quote>; 123 Stat. 1379) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2f6562ea-521a-4cc2-ab97-f13dea409302" changed="not-changed"><section id="id4af27589-3ef0-4d29-98ef-83d748d7ce5c" changed="not-changed"><enum>10610.</enum><header>Taxation of construction, operation, and maintenance of Project facilities</header><subsection id="id161a0873-92c5-4cc7-8de7-0da9bc1bbf1a" changed="not-changed"><enum>(a)</enum><header>Nation land</header><text>Any activity constituting the construction, operation, or maintenance of Project facilities—</text><paragraph id="id845229ea-792c-4c81-8b10-8ce6a916c7d7" changed="not-changed"><enum>(1)</enum><text>shall, if the activity takes place on land that is held in trust by the United States for the benefit of the Nation, be subject to taxation by the Nation; and </text></paragraph><paragraph id="id559d7b43-5ce4-4b14-a526-897131f9c85b" changed="not-changed"><enum>(2)</enum><text>shall not be subject to any fee, tax, assessment, levy, or other charge imposed by any State or political subdivision of a State.</text></paragraph></subsection><subsection id="idc9970c77-dbd8-474e-92b0-37bba6a80c3b" changed="not-changed"><enum>(b)</enum><header>Other land</header><text>Any activity constituting the construction, operation, or maintenance of Project facilities—</text><paragraph id="idd5e0eddd-45db-482e-9b50-bfaa6672f9cf" changed="not-changed"><enum>(1)</enum><text>shall, if the activity takes place on land other than the land described in subsection (a)(1), be subject to taxation by the State in which the land is located, or by a political subdivision of that State to the extent authorized by the laws of that State; changed="not-changed"><enum>(a)</enum><header>Agreement</header><text>Section 10701(e) of the Northwestern New Mexico Rural Water Projects Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1400; 129 Stat. 528) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id9b6c2961-8931-44e2-ad18-b72bc40d2473" changed="not-changed"><enum>(1)</enum><text>in paragraph (1)(A)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1d4c52c6-c33e-4250-8cd2-60d434e18a29" changed="not-changed"><enum>(A)</enum><text>by striking clause (vii) and inserting the following:</text><quoted-block style="OLC" general</header><text>Not later than December 31, 2029, the United States shall make all deposits into the Deferred Construction Fund in accordance with section 111–11</external-xref>; 123 Stat. 1402) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1fa1e391-b602-4490-8cc8-8c60f2f1da87" changed="not-changed"><section id="id91da5db1-f545-43dc-bdd3-e8de2840ce75" changed="not-changed"><enum>10702.</enum><header>Settlement trust funds</header><subsection id="idf8ad642c-cb21-4062-ad9b-be19d7e553a0" changed="not-changed"><enum>(a)</enum><header>Navajo nation water resources development trust fund</header><paragraph id="ide41496a0-e22a-4fdc-ae8f-2b7687712c63" changed="not-changed"><enum>(1)</enum><header>Establishment</header><text>There is established in the Treasury a fund, to be known as the <quote>Navajo Nation Water Resources Development Trust Fund</quote>, consisting of—</text><subparagraph id="id6bbf4155-fbea-4410-9720-2b8bd1e04458" changed="not-changed"><enum>(A)</enum><text>such amounts as are appropriated to the Navajo Nation Water Resources Development Trust Fund under paragraph (5); and</text></subparagraph><subparagraph id="id0dd875e2-116f-4bae-af0a-88f2b8f8aadc" changed="not-changed"><enum>(B)</enum><text>any interest earned on investment of amounts in the Navajo Nation Water Resources Development Trust Fund under paragraph (3).</text></subparagraph></paragraph><paragraph id="id59377629-7f0c-460a-9dbb-163be92e40dc" changed="not-changed"><enum>(2)</enum><header>Use of funds</header><text>The Nation may use amounts in the Navajo Nation Water Resources Development Trust Fund—</text><subparagraph id="id2dd95532-0de1-4e4e-a856-3081ed76ba5b" changed="not-changed"><enum>(A)</enum><text>to investigate, construct, operate, maintain, or replace water project facilities, including facilities conveyed to the Nation under this subtitle and facilities owned by the United States for which the Nation is responsible for operation, maintenance, and replacement costs; and</text></subparagraph><subparagraph id="id3675c3b3-246f-40aa-a093-9e6b351da6e8" changed="not-changed"><enum>(B)</enum><text>to investigate, implement, or improve a water conservation measure (including a metering or monitoring activity) necessary for the Nation to make use of a water right of the Nation under the Agreement.</text></subparagraph></paragraph><paragraph id="id3644f561-adea-4995-857a-a73307422225" changed="not-changed"><enum>(3)</enum><header>Investment</header><text>Beginning on October 1, 2019, the Secretary shall invest amounts in the Navajo Nation Water Resources Development Trust Fund in accordance with subsection (e).</text></paragraph><paragraph id="id96c09817-2356-4348-982f-93f4a25d24a9" changed="not-changed"><enum>(4)</enum><header>Investment earnings</header><text>Any investment earnings, including interest, credited to amounts held in the Navajo Nation Water Resources Development Trust Fund are authorized to be used in accordance with paragraph (2).</text></paragraph><paragraph id="id01a3a25f-ed5d-4de0-89a9-f4af2fabdc88" changed="not-changed"><enum>(5)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated for deposit in the Navajo Nation Water Resources Development Trust Fund—</text><subparagraph id="idd910f7bc-5685-4372-aa23-bd02eb879d76" changed="not-changed"><enum>(A)</enum><text>$6,000,000 for each of fiscal years 2010 through 2014; and</text></subparagraph><subparagraph id="id62867421-b467-4218-a1e2-ba60eab0ee16" changed="not-changed"><enum>(B)</enum><text>$4,000,000 for each of fiscal years 2015 through 2019.</text></subparagraph></paragraph><paragraph id="id11017bad-8b83-42ce-a37b-d0be38f9a25b" changed="not-changed"><enum>(6)</enum><header>Availability</header><text>Any amount authorized to be appropriated to the Navajo Nation Water Resources Development Trust Fund under paragraph (5) shall not be available for expenditure or withdrawal—</text><subparagraph id="id5e2f07ce-ca82-4afa-9540-7fca243389a2" changed="not-changed"><enum>(A)</enum><text>before December 31, 2019; and</text></subparagraph><subparagraph id="id452b1d68-80dd-43d9-a6cc-07c98bb41f66" changed="not-changed"><enum>(B)</enum><text>until the date on which the court in the stream adjudication has entered—</text><clause id="id40402bf0-0261-466b-88be-75028c389414" changed="not-changed"><enum>(i)</enum><text>the Partial Final Decree; and</text></clause><clause id="id5aae4735-3156-4025-b4fe-9cb87c50f769" changed="not-changed"><enum>(ii)</enum><text>the Supplemental Partial Final Decree.</text></clause></subparagraph></paragraph><paragraph id="id7e013bbb-4539-4789-91bb-2768262cd6f6" changed="not-changed"><enum>(7)</enum><header>Management</header><text>The Secretary shall manage the Navajo Nation Water Resources Development Trust Fund in accordance with subsection (d).</text></paragraph><paragraph id="id18112461-f8bd-409b-a2b7-947051387d67" changed="not-changed"><enum>(8)</enum><header>Conditions for expenditure and withdrawal</header><text>After the funds become available pursuant to paragraph (6), all expenditures and withdrawals by the Nation of funds in the Navajo Nation Water Resources Development Trust Fund must comply with the requirements of subsection (f).</text></paragraph></subsection><subsection id="id48977b6b-1ee4-4465-b0d1-cd7db0aa48ef" changed="not-changed"><enum>(b)</enum><header>Navajo nation operations, maintenance, and replacement trust fund</header><paragraph id="id48ff9b5e-4975-4234-8a07-436a8dea69bd" changed="not-changed"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish a trust fund to be known as the <quote>Navajo Nation Operations, Maintenance, and Replacement Trust Fund</quote> for the purposes set forth in paragraph (2), to be managed, invested, and distributed by the Secretary, and to remain available until expended, withdrawn, or reverted to the general fund of the Treasury, consisting of the amounts deposited in the trust fund under paragraph (3), together with any interests earned on those amounts under paragraph (4).</text></paragraph><paragraph id="id15d79391-f8df-4712-9dd2-c4c25a6014c6" changed="not-changed"><enum>(2)</enum><header>Use of funds</header><text>The Nation may use amounts in the Navajo Nation Operations, Maintenance, and Replacement Trust Fund to pay operation, maintenance, and replacement costs of the Project allocable to the Nation under section 10604.</text></paragraph><paragraph id="id87d1a4e9-334f-4aca-bfa8-443a80825586" changed="not-changed"><enum>(3)</enum><header>Authorization of 10603(g).</text></paragraph><paragraph id="id2580a4a6-d2c8-4b94-b629-d9bd57ef4265" changed="not-changed"><enum>(7)</enum><header>Fluctuation in costs</header><subparagraph id="idefddb02f-9899-4728-8202-531a98cdd3bd" changed="not-changed"><enum>(A)</enum><header>In general</header><text>The amounts authorized to be appropriated under paragraph (3) shall be increased or decreased, as appropriate, by such amounts as may be justified by reason of ordinary fluctuations in costs occurring after October 2022 as indicated by the Bureau of Reclamation Operation and Maintenance Cost Index.</text></subparagraph><subparagraph id="idadec01a3-a158-4461-a55f-1d33c5dc7bf4" changed="not-changed"><enum>(B)</enum><header>Repetition</header><text>The adjustment process under this subparagraph shall be repeated for each subsequent amount appropriated until the amount authorized, as adjusted, has been appropriated.</text></subparagraph><subparagraph id="id56a651cd-acde-461b-ab45-4c9ed3a8d1ac" changed="not-changed"><enum>(C)</enum><header>Period of indexing</header><text>The period of indexing adjustment under this subparagraph for any increment of funding shall end on the date on which the funds are deposited into the Navajo Nation Operations, Maintenance, and Replacement Trust Fund.</text></subparagraph></paragraph><paragraph id="ide26c9341-151a-4b99-87ce-e11b3685019e" changed="not-changed"><enum>(8)</enum><header>Management</header><text>The Secretary shall manage the Navajo Nation Operations, Maintenance, and Replacement Trust Fund in accordance with subsection (d).</text></paragraph><paragraph id="idfce37dac-09eb-417b-8515-fac83a344759" changed="not-changed"><enum>(9)</enum><header>Conditions for expenditure and withdrawal</header><text>All expenditures and withdrawals by the Nation of funds in the Navajo Nation Operations, Maintenance, and Replacement Trust Fund must comply with the requirements of subsection (f).</text></paragraph></subsection><subsection id="idd4a5c38c-f5c3-43d4-b81f-e5b8ed66788b" changed="not-changed"><enum>(c)</enum><header>Jicarilla apache nation operations, maintenance, and replacement trust fund</header><paragraph id="id528283f5-6b72-4ab8-9023-8bb058a7d945" changed="not-changed"><enum>(1)</enum><header>Prerequisite to establishment</header><text>Prior to establishment of the trust fund under paragraph (2), the Secretary shall conduct an Ability to Pay study to determine what operation, maintenance, and replacement costs of that section of the Project serving the Jicarilla Apache Nation are in excess of the ability of the Jicarilla Apache Nation to pay.</text></paragraph><paragraph id="id886d855a-47b9-423c-9716-ea0bfede5820" changed="not-changed"><enum>(2)</enum><header>Establishment</header><text>Upon completion of the Ability to Pay study as set forth in paragraph (1), the Secretary shall establish a trust fund to be known as the <quote>Jicarilla Apache Nation Operations, Maintenance, and Replacement Trust Fund</quote> for the purposes set forth in paragraph (3), to be managed, invested, and distributed by the Secretary and to remain available until expended, withdrawn, or reverted to the general fund of the Treasury, consisting of the amounts deposited in the trust fund under paragraph (4), together with any interests earned on those amounts under paragraph (5).</text></paragraph><paragraph id="id4d96cb73-27d4-476a-a541-a1d0d38db67d" changed="not-changed"><enum>(3)</enum><header>Use of funds</header><text>The Jicarilla Apache Nation may use amounts in the Jicarilla Apache Nation Operations, Maintenance, and Replacement Trust Fund to pay operation, maintenance, and replacement costs of the Project allocable to the Jicarilla Nation under section 10604.</text></paragraph><paragraph id="id5cbc7e90-4321-46b4-a069-98eb58948247" changed="not-changed"><enum>(4)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated for deposit in the Jicarilla Apache Nation Operations, Maintenance, and Replacement Trust Fund the amounts the Secretary has determined are in excess of the ability of the Jicarilla Apache Nation to pay in the Ability to Pay study required under paragraph (1) up to a maximum of $10,000,000.</text></paragraph><paragraph id="id2afef19b-cb75-4944-a7ed-b883b804ae44" changed="not-changed"><enum>(5)</enum><header>Investment</header><text>Upon deposit of funding into the Jicarilla Apache Nation Operations, Maintenance, and Replacement Trust Fund pursuant to paragraph (4), the Secretary shall invest amounts in the fund in accordance with subsection (e).</text></paragraph><paragraph id="idc700716b-2695-43d9-a2a5-4dbdbaf4ad10" changed="not-changed"><enum>(6)</enum><header>Investment earnings</header><text>Any investment earnings, including interest, credited to amounts held in the Jicarilla Apache Nation Operations, Maintenance, and Replacement Trust Fund are authorized to be used in accordance with paragraph subsection (d).</text></paragraph><paragraph id="id4fe21214-2d67-4a60-94d4-9b7cd0a30419" changed="not-changed"><enum>(10)</enum><header>Conditions for expenditure and withdrawal</header><text>All expenditures and withdrawals by the Jicarilla Apache Nation of funds in the Jicarilla Apache Nation Operations, Maintenance, and Replacement Trust Fund must comply with the requirements of subsection (f).</text></paragraph></subsection><subsection id="idc775031c-121d-4dc3-9a79-0c54ec2277d4" changed="not-changed"><enum>(d)</enum><header>Management</header><text>The Secretary shall manage the Settlement Trust Funds, invest amounts in the Settlement Trust Funds pursuant to subsection (e), and make amounts available from the Settlement Trust Funds for distribution to the Nation and the Jicarilla Apache Nation in accordance with the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>). </text></subsection><subsection id="idff4e69a8-cb0a-41a7-9458-146053befdd0" changed="not-changed"><enum>(e)</enum><header>Investment of the trust funds</header><text>The Secretary shall invest amounts in the Settlement Trust Funds in accordance with—</text><paragraph id="id7d07e419-0648-4b7a-b30f-9d458e9db201" changed="not-changed"><enum>(1)</enum><text>the Act of April 1, 1880 (<external-xref legal-doc="usc" parsable-cite="usc/25/161">25 U.S.C. 161</external-xref>);</text></paragraph><paragraph id="id46ff7682-926d-4b31-b06e-9d50d46f0077" changed="not-changed"><enum>(2)</enum><text>the first section of the Act of June 24, 1938 (<external-xref legal-doc="usc" parsable-cite="usc/25/162a">25 U.S.C. 162a</external-xref>); and</text></paragraph><paragraph id="id18bfd312-ac0b-44eb-80d6-0ee03e4254e6" changed="not-changed"><enum>(3)</enum><text>the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>).</text></paragraph></subsection><subsection id="id1dd2a7e3-a56e-4723-a54a-796b184f9b03" changed="not-changed"><enum>(f)</enum><header>Conditions for expenditures and withdrawals</header><paragraph id="id5c61918b-ddd8-4b7c-90c4-64381859a5bd" changed="not-changed"><enum>(1)</enum><header>Tribal management plan</header><subparagraph id="id7d7cf547-91cd-4cc3-b5d2-53ce6c84c140" changed="not-changed"><enum>(A)</enum><header>In general</header><text>On approval by the Secretary of a Tribal management plan in accordance with the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>), the Nation and the Jicarilla Apache Nation may withdraw all or a portion of the amounts in the Settlement Trust Funds.</text></subparagraph><subparagraph id="id7dfa064e-30b2-4b87-86b5-cd7cd3e07b25" changed="not-changed"><enum>(B)</enum><header>Requirements</header><text>In addition to any requirements under the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>), a Tribal management plan shall require that the Nation and Jicarilla Apache Nation only use amounts in the Settlement Trust Funds for the purposes described in subsection (a)(2), (b)(2), or (c)(3), as applicable.</text></subparagraph></paragraph><paragraph id="id5cf01a22-5645-4219-b975-8a9100e3f7f6" changed="not-changed"><enum>(2)</enum><header>Enforcement</header><text>The Secretary may take judicial or administrative action to enforce the provisions of any Tribal management plan to ensure that any amounts withdrawn from the Settlement Trust Funds are used in accordance with this subtitle.</text></paragraph><paragraph id="id35205529-02b5-4163-a7b2-fc129d8290c9" changed="not-changed"><enum>(3)</enum><header>No liability</header><text>The Secretary or the Secretary of the Treasury shall not be liable for the expenditure or investment of any amounts withdrawn from the Settlement Trust Funds by the Nation or the Jicarilla Apache Nation.</text></paragraph><paragraph id="id398d7120-9ba6-4712-8725-ec42f6621bd4" changed="not-changed"><enum>(4)</enum><header>Expenditure plan</header><subparagraph id="id37a0b719-66d0-499f-ae05-62d46c1cb33e" changed="not-changed"><enum>(A)</enum><header>In general</header><text>The Nation and Jicarilla Apache Nation shall submit to the Secretary for approval an expenditure plan for any portion of the amounts in the Settlement Trust Funds made available under this section that the Nation or the Jicarilla Apache Nation does not withdraw under this subsection.</text></subparagraph><subparagraph id="ide6179ec8-7451-4e5d-94b5-06de7a6537f7" changed="not-changed"><enum>(B)</enum><header>Description</header><text>An expenditure plan submitted under subparagraph (A) shall describe the manner in which, and the purposes for which, funds of the Nation or the Jicarilla Apache Nation remaining in the Settlement Trust Funds will be used.</text></subparagraph><subparagraph id="idfd4d36e9-9549-49b4-a841-e09d20ca8a4c" changed="not-changed"><enum>(C)</enum><header>Approval</header><text>On receipt of an expenditure plan under subparagraph (A), the Secretary shall approve the plan if the Secretary determines that the plan is reasonable and consistent with this subtitle.</text></subparagraph></paragraph><paragraph id="id3cb6f768-4078-4612-91b8-9370131f79f7" changed="not-changed"><enum>(5)</enum><header>Annual report</header><text>The Nation and Jicarilla Apache Nation shall submit to the Secretary an annual report that describes any expenditures from the Settlement Trust Funds during the year covered by the report.</text></paragraph><paragraph id="id6417fd2c-b5ad-472e-a042-3b8a3e8a7776" changed="not-changed"><enum>(6)</enum><header>Limitation</header><text>No portion of the amounts in the Settlement Trust Funds shall be distributed to any Nation or Jicarilla Apache Nation member on a per capita basis.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph changed="not-changed" commented="no" and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id56b8ced3380d4eb2b499c4e3c2ed76c3" changed="not-changed"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idee4cc5c81e9a4e25bc367c3ea945a288" changed="not-changed"><paragraph id="idfbcf771ed0c249348235de3a7785c408" changed="not-changed"><enum>(2)</enum><header>Conveyance of non-Project water to the State of Utah</header><subparagraph commented="no" display-inline="no-display-inline" id="idf56d5fb7704745d2b15d4f8c44c340ab" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this paragraph:</text><clause commented="no" display-inline="no-display-inline" id="id1e6a9d015a784048837a751fd191a621" changed="not-changed"><enum>(i)</enum><header>Navajo/Utah Settlement Agreement</header><text>The term <term>Navajo/Utah Settlement Agreement</term> means the agreement entitled <quote>Navajo Nation/State of Utah Water Rights Settlement Agreement</quote>, dated May 27, 2022, and authorized by section 1102 of title XI of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref> (134 Stat. 3224).</text></clause><clause commented="no" display-inline="no-display-inline" id="id67f9fa79c6d14299ab6081422d25ffd5" changed="not-changed"><enum>(ii)</enum><header>Navajo-Utah water rights</header><text>The term <term>Navajo-Utah water rights</term> has the meaning given the term <term>Navajo water rights</term> in section 1102(b) of title XI of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref> (134 Stat. 3225).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0748fb64675544c7bea8a28a85fd9737" changed="not-changed"><enum>(B)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (1), the Nation may provide non-Project water to communities of the Nation in the State of Utah, subject to the conditions that—</text><clause commented="no" display-inline="no-display-inline" id="iddf8c00ee299649efb0b7f257e36cdc5a" changed="not-changed"><enum>(i)</enum><text>not more than 2,000 acre-feet per year of non-Project water may be treated, stored, or conveyed through Project and non-Project infrastructure for the benefit of those communities;</text></clause><clause id="id9369e8732649493ab84747b2592207a7" changed="not-changed"><enum>(ii)</enum><text>any non-Project water treated or conveyed through Project and non-Project infrastructure and delivered to the New Mexico state line for the benefit of those communities shall—</text><subclause commented="no" display-inline="no-display-inline" id="idb69af78ee3fe452cb54ffb3de0add033" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">be considered part of the Navajo-Utah water rights as quantified in section 1102(d)(1)(A) of title XI of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref> (134 Stat. 3227); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id12c31f592ccc4b0e8d95cc68cc83bec9" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">be accounted for as a depletion by the Nation to be counted against the apportionment of the State of Utah under the Compact for purposes of the depletion accounting under the Navajo/Utah Settlement Agreement;</text></subclause></clause><clause id="idd5d2c461fbc5472ca61d3069bd0ab8c5" changed="not-changed"><enum>(iii)</enum><text>Project funds shall not be used to design, plan, construct, operate, maintain, or repair any additional infrastructure in the State of New Mexico or any infrastructure in the State of Arizona or Utah to join the Project infrastructure to the Sweetwater pipeline (non-Project infrastructure);</text></clause><clause commented="no" display-inline="no-display-inline" id="idad4196a04f5d417fa129c7b5f7c1d24e" changed="not-changed"><enum>(iv)</enum><text display-inline="yes-display-inline">the share of any Project Participants' Project operation, maintenance, and replacement costs shall not be increased in connection with the use of non-Project infrastructure;</text></clause><clause id="id271fa919133b4fe2b193f3cd9f2d2048" changed="not-changed"><enum>(v)</enum><text>the United States shall have no responsibility or obligation to provide non-Project water to those communities under this paragraph and no Federal funding shall be provided for the costs to construct, operate, maintain, and replace any non-Project infrastructure necessary for storage and conveyance of non-Project water from the State of New Mexico to serve those communities except for funds authorized under—</text><subclause commented="no" display-inline="no-display-inline" id="idc19fc74235ea48d09d8952c6c65044d8" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">section 1102 of title XI of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref> (134 Stat. 3224);</text></subclause><subclause id="idf0ade509bb2b43a6ad0879c590db926a" changed="not-changed"><enum>(II)</enum><text>section 7 of the Act of August 5, 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2004a">42 U.S.C. 2004a</external-xref>); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc6a85cb59dbd42ecb497adfe0189d28b" changed="not-changed"><enum>(III)</enum><text>the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1601">25 U.S.C. 1601 et seq.</external-xref>);</text></subclause></clause><clause id="idfe64e994ccaf48f58f70cd35b5e6b397" changed="not-changed"><enum>(vi)</enum><text>efforts associated with providing non-Project water to those communities shall not delay the Project, or any component of the Project, in a manner that would be prejudicial to any Project Participant; and</text></clause><clause id="ida8c7cd0cd296471ca631b80bc232868a" changed="not-changed"><enum>(vii)</enum><text>in addition to the requirements of this paragraph, delivery of non-Project water under this paragraph is subject to—</text><subclause id="id771c8e3ef6084f46b2d86b07548778a0" changed="not-changed"><enum>(I)</enum><text>the terms of the Navajo/Utah Settlement Agreement;</text></subclause><subclause id="idc516d720be9b4d3e8cfab1013a8caf56" changed="not-changed"><enum>(II)</enum><text>the State of Utah issuing a decreed water right pursuant to the terms of the Navajo/Utah Settlement Agreement;</text></subclause><subclause id="idc93aef6566744436b652827de69a64cb" changed="not-changed"><enum>(III)</enum><text>the State of Utah not incurring additional financial obligations beyond those identified in the Navajo/Utah Settlement Agreement; and</text></subclause><subclause id="id841c77fe558a485e89f5fd8f1bfa542c" changed="not-changed"><enum>(IV)</enum><text>the execution of an implementation agreement between the Nation and the State of Utah relating to accounting and measurement of non-Project water under this paragraph to be consistent with the terms of the Navajo/Utah Settlement Agreement.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide13f6a1586e14462a8bff4e3402d8ed4" changed="not-changed"><enum>(C)</enum><header>Clarification</header><text>The State of New Mexico shall have no responsibility or obligation to provide—</text><clause commented="no" display-inline="no-display-inline" id="id09d1445035ee42fb97100c4d24b33912" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">non-Project water to communities of the Nation in the State of Utah under this paragraph; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id3fdf77e602f0460f81eb9d2d7685b1bb" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">any funding under this paragraph.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
