<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 634</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250219">February 19, 2025</action-date><action-desc><sponsor name-id="S386">Ms. Duckworth</sponsor> (for herself, <cosponsor name-id="S361">Ms. Hirono</cosponsor>, <cosponsor name-id="S362">Mr. Kaine</cosponsor>, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, <cosponsor name-id="S413">Mr. Padilla</cosponsor>, <cosponsor name-id="S354">Ms. Baldwin</cosponsor>, <cosponsor name-id="S353">Mr. Schatz</cosponsor>, <cosponsor name-id="S427">Mr. Schiff</cosponsor>, <cosponsor name-id="S247">Mr. Wyden</cosponsor>, <cosponsor name-id="S259">Mr. Reed</cosponsor>, <cosponsor name-id="S229">Mrs. Murray</cosponsor>, <cosponsor name-id="S369">Mr. Markey</cosponsor>, <cosponsor name-id="S313">Mr. Sanders</cosponsor>, <cosponsor name-id="S311">Ms. Klobuchar</cosponsor>, <cosponsor name-id="S422">Mr. Welch</cosponsor>, <cosponsor name-id="S385">Ms. Cortez Masto</cosponsor>, <cosponsor name-id="S390">Mr. Van Hollen</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S394">Ms. Smith</cosponsor>, and <cosponsor name-id="S253">Mr. Durbin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure due process protections of individuals in the United States against unlawful detention based solely on a protected characteristic.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H8A2DAA7A39664CA6B3870D3ED1752877"><section section-type="section-one" id="HD16505CFB0764B77ADA8E85311812998"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Korematsu-Takai Civil Liberties Protection Act of 2025</short-title></quote>.</text></section><section id="H3A00CD2E6BA3409283E262099112CF4A"><enum>2.</enum><header>Prohibition against unlawful detention</header><text display-inline="no-display-inline">Section 4001 of title 18, United States Code, is amended—</text><paragraph id="HB1ED688589824E6C8D46017F6922F30D"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (b) as subsection (c); and</text></paragraph><paragraph id="HCFE2CC08AF93488583A10F4CBA113878"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H5326C0F7E57C420296013D563F625A6D"><subsection id="H0AA207D750A34926BF8CACB92607640F"><enum>(b)</enum><header>Prohibition on detention based on protected characteristics</header><paragraph id="H7F5D16D867864D89923CEA7F8DD1A615"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>protected characteristic</term> includes each of the following:</text><subparagraph id="HAD08A9170A364C13A3B9E54CB64E5D17"><enum>(A)</enum><text>Race.</text></subparagraph><subparagraph id="H10A81447AFAA486FB82564BB6E8A4452"><enum>(B)</enum><text>Ethnicity.</text></subparagraph><subparagraph id="HABB7ADB8D3D24F00903DB49DDA912A0C"><enum>(C)</enum><text>National origin.</text></subparagraph><subparagraph id="H847D901D86BA48508EBB0B4DCDEE6F43"><enum>(D)</enum><text>Religion.</text></subparagraph><subparagraph id="HAD4BF87FCF6B42DF96662907FE8C0E22"><enum>(E)</enum><text>Sex.</text></subparagraph><subparagraph id="HE2189549333D484D86D3BC4C76182855"><enum>(F)</enum><text>Gender identity.</text></subparagraph><subparagraph id="H018A72F035D84F83A79CDBCCDCAC04A1"><enum>(G)</enum><text>Sexual orientation.</text></subparagraph><subparagraph id="H3F400AA6A3FA4DB38FB1CF7F75B8FBD9"><enum>(H)</enum><text>Disability.</text></subparagraph><subparagraph id="H505E9D99E1EC4B1C94CDC49A2C7862C7"><enum>(I)</enum><text>Any additional characteristic that the Attorney General determines to be a protected characteristic.</text></subparagraph></paragraph><paragraph id="HC4539F752C494B71887D3CBC79744CC8"><enum>(2)</enum><header>Prohibition</header><text>No individual may be imprisoned or otherwise detained based solely on an actual or perceived protected characteristic of the individual. </text></paragraph><paragraph id="H3092A9B14DF646F1931850B5054AFB3F"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to allow the Attorney General to remove a characteristic described in subparagraphs (A) through (H) of paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
