which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Indian Health Care Improvement Act to allow Indian Health Service scholarship and loan recipients to fulfill service obligations through half-time clinical practice, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="id858e1f0e-068d-476c-840d-d3f0d3a642ff" changed="not-changed"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>IHS Workforce Parity Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idd06717c6-822a-48ff-90eb-3477a98c7533" changed="not-changed"><enum>2.</enum><header display-inline="yes-display-inline">Indian Health Service scholarship and loan recipients</header><subsection commented="no" display-inline="no-display-inline" id="id371eba6f-b0ec-46b6-9f41-737b1b2af50a" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Indian health professions scholarships</header><text display-inline="yes-display-inline">Section 104(b)(3) of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1613a">25 U.S.C. 1613a(b)(3)</external-xref>) is amended by striking the paragraph designation and all that follows through the end of subparagraph (A) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idcc855ee1-b9c1-465b-b017-af3b8e0064b3" changed="not-changed"><paragraph commented="no" display-inline="no-display-inline" id="id8c925a49-ddf4-4042-b16f-67185d1030fc" indent="up1" changed="not-changed"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idb2221de6-a6f6-45f7-9b1d-0ef1e8b3fdd5" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">The active duty service obligation under a written contract with the Secretary under section 338A of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254l">42 U.S.C. 254l</external-xref>) that an individual has entered into under that section shall, if that individual is a recipient of an Indian Health Scholarship—</text><clause commented="no" display-inline="no-display-inline" id="idde0aa759-4aa0-4e6e-8ece-a93cc14dda56" indent="up1" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">be met by full-time (as defined in section 331(j) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254d">42 U.S.C. 254d(j)</external-xref>)) practice—</text><subclause commented="no" display-inline="no-display-inline" id="id41f956d2-66f6-40ab-b29e-bf91e8660747" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">in the Service;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb588ec77-f76e-4379-8266-4f59f23b89a7" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">in a program conducted under a contract entered into under the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301 et seq.</external-xref>);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idee389e28-bb2f-4015-abd0-0787e2407ed5" changed="not-changed"><enum>(III)</enum><text display-inline="yes-display-inline">in a program assisted under title V; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida15b59d9-be0c-403f-ba71-2f53e86b6700" changed="not-changed"><enum>(IV)</enum><text display-inline="yes-display-inline">in the private practice of the applicable profession if, as determined by the Secretary, in accordance with guidelines issued by the Secretary, the practice—</text><item commented="no" display-inline="no-display-inline" id="id060434bd-7a58-41ce-b63e-f4cb28e79ee9" changed="not-changed"><enum>(aa)</enum><text display-inline="yes-display-inline">is situated in a physician or other health professional shortage area; and</text></item><item commented="no" display-inline="no-display-inline" id="id90e3dd88-09f9-48ea-9e98-053be9cb7577" changed="not-changed"><enum>(bb)</enum><text display-inline="yes-display-inline">addresses the health care needs of a substantial number of Indians; or</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf0d3bec1-3047-4816-8af3-3b82c767e2e8" indent="up1" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">be met by half-time (as defined in section 331(j) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254d">42 U.S.C. 254d(j)</external-xref>)) practice in a program described in any of subclauses (I) through (IV) of clause (i) if the individual agrees, in writing—</text><subclause commented="no" display-inline="no-display-inline" id="idf67b018f-1202-4fd3-9f90-55ea3608083e" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">to double the period of obligated service that would otherwise be required if the individual were satisfying the period of obligated service through full-time (as so defined) practice; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide991411d-9bb3-4542-a2af-3fc4a5d8e05a" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">that if the individual fails to begin or complete the period of obligated service described in subclause (I), the procedures described in section 108(l)(2) for determining damages for breach of contract will be used after converting that period of obligated service or service performed into its full-time equivalent.</text></subclause></clause></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idF81BED4F621F4517BE157201C9079A5F" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Indian Health Service loan repayment program</header><text display-inline="yes-display-inline">Section 108 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1616a">25 U.S.C. 1616a</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idf17d4fb9ec0c4480aa19dc95fb1f16f9" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (f)(1)(B), by striking clause (iii) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id034736CE3AC54128BE7D4AAF7B5A0035" changed="not-changed"><clause commented="no" display-inline="no-display-inline" id="id1588d8d2-8485-4239-871c-186c96d4ad91" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">to serve for a period of time (referred to in this section as the <term>period of obligated service</term>) equal to—</text><subclause commented="no" display-inline="no-display-inline" id="id731efa99-a93c-430e-95bb-ad0fbe078f2c" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">2 years, or a longer period of time as the individual may agree to serve, in the full-time (as defined in section 331(j) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254d">42 U.S.C. 254d(j)</external-xref>)) clinical practice of the profession of the individual in an Indian health program to which the individual may be assigned by the Secretary;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id968dc3c5d31e497d8ad5da47020be9c9" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">4 years, or a longer period of time as the individual may agree to serve, in the half-time (as defined in that section) clinical practice of the profession of the individual in an Indian health program to which the individual may be assigned by the Secretary, subject to the condition that if the individual has agreed to serve for a period longer than 2 years of full-time (as so defined) service, as described in subclause (I), the half-time (as so defined) service obligation shall be the amount of time required for the individual to complete an equivalent amount of service on a half-time (as so defined) basis; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida3f5ae3b9bae4520b78acc45611ac71e" changed="not-changed"><enum>(III)</enum><text display-inline="yes-display-inline">2 years in the half-time (as so defined) clinical practice of the profession of the individual in an Indian health program to which the individual may be assigned by the Secretary with a loan payment amount equal to 50 percent of the amount that would otherwise be payable for full-time (as so defined) service for that same period of obligated service; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id65b4e27149ee49c0ae2e4610a8a81934" changed="not-changed"><enum>(iv)</enum><text display-inline="yes-display-inline">in the case of an individual completing a period of obligated service through half-time (as so defined) clinical practice, that if the individual fails to begin or complete that period of obligated service, the procedures described in subsection (l)(2) for determining damages for breach of contract under this section will be used after converting the period of obligated service or service performed into its full-time (as so defined) equivalent;</text></clause><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id692c0673c9a74162ab5d01b6c032a67a" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (l)(2), in the undesignated matter following subparagraph (D), by inserting the following before <quote>Amounts</quote>: <quote>Periods of obligated service completed in half-time (as defined in section 331(j) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254d">42 U.S.C. 254d(j)</external-xref>)) clinical practice shall be converted to their full-time (as defined in that section) equivalents for purposes of determining damages for breach of contract under this paragraph.</quote>.</text></paragraph></subsection></section></legis-body></bill>
