which was read the first time</action-desc></action><action><action-date date="20250107">January 7, 2025</action-date><action-desc>Read the second time and placed on the calendar</action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Homeland Security to take into custody aliens who have been charged in the United States with theft, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HFC8173D785904E8B8E14982A7C826002"><section section-type="section-one" id="H2E18DDDA603A4CDCA4C15F863F864C58"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Laken Riley Act</short-title></quote>. </text></section><section id="H793DBCBA2A07463588AC4F4FDBEDECAF"><enum>2.</enum><header>Detention of certain aliens who commit theft</header><text display-inline="no-display-inline">Section 236(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226(c)</external-xref>) is amended—</text><paragraph id="H22B29145005D4CC78FC8C242D8D2CAF6"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H9F952DFEAEF04F358687BF28E15AF049"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>or</quote>;</text></subparagraph><subparagraph display-inline="no-display-inline" id="H8838EDD503264F79852269A32FFFACE2"><enum>(B)</enum><text>in subparagraph (D), by striking the comma at the end and inserting <quote>, or</quote>; and</text></subparagraph><subparagraph id="H45FDDF408A584D06B9CBA8233AEB9971"><enum>(C)</enum><text>by inserting after subparagraph (D) the following:</text><quoted-block style="OLC" id="HCB343CE48F1147CE84A3A14A84B2E358"><subparagraph id="H90B7C7FE8B90462B85D5A1FD6FFAFCBB"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="H147304C5572147028DE7A07C3EC24954"><enum>(i)</enum><text display-inline="yes-display-inline">is inadmissible under paragraph (6)(A), (6)(C), or (7) of section 212(a); and</text></clause><clause id="H0A40D127B6AF4CC1B29290642DCC7A2E" indent="up1"><enum>(ii)</enum><text>is charged with, is arrested for, is convicted of, admits having committed, or admits committing acts which constitute the essential elements of any burglary, theft, larceny, or shoplifting offense,</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA24FB199E0B1452186683E75587B1181"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (4); and</text></paragraph><paragraph id="H0E983259549B495BB2DFE7A353002A31"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" id="H27490A80E9654E62BB5057DEF16130F5"><paragraph id="H2D9D5B1065174EFEBDB2A8E852C75F10"><enum>(2)</enum><header>Definition</header><text>For purposes of paragraph (1)(E), the terms <quote>burglary</quote>, <quote>theft</quote>, <quote>larceny</quote>, and <quote>shoplifting</quote> have the meaning given such terms in the jurisdiction in which the acts occurred.</text></paragraph><paragraph id="H2CFEC57ADAAF4689AB6F6703937675FD"><enum>(3)</enum><header>Detainer</header><text>The Secretary of Homeland Security shall issue a detainer for an alien described in paragraph (1)(E) and, if the alien is not otherwise detained by Federal, State, or local officials, shall effectively and expeditiously take custody of the alien.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H367693DF7C2642C698DCAA0B80D930C6"><enum>3.</enum><header>Enforcement by attorney general of a State</header><subsection id="HA02E085A94BB42CD92AA21BB4166193C"><enum>(a)</enum><header>Inspection of applicants for admission</header><text display-inline="yes-display-inline">Section 235(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)</external-xref>) is amended—</text><paragraph id="H596FDA3E5C2B4AE7B14772C965563E5E"><enum>(1)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></paragraph><paragraph id="HF0901321251B4D8EB4AC4C623F0A7E16"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0F0098F00DA54AE0A2AC61357AA835C8"><paragraph id="H5DCF6D2BE4054548AB31F74ADA9EE73F"><enum>(3)</enum><header>Enforcement by attorney general of a State</header><text display-inline="yes-display-inline">The attorney general of a State, or other authorized State officer, alleging a violation of the detention and removal requirements under paragraph (1) or (2) that harms such State or its residents shall have standing to bring an action against the Secretary of Homeland Security on behalf of such State or the residents of such State in an appropriate district court of the United States to obtain appropriate injunctive relief. The court shall advance on the docket and expedite the disposition of a civil action filed under this paragraph to the greatest extent practicable. For purposes of this paragraph, a State or its residents shall be considered to have been harmed if the State or its residents experience harm, including financial harm in excess of $100.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HDE93455F7FB24645B7A4B356753BF216"><enum>(b)</enum><header>Apprehension and detention of aliens</header><text display-inline="yes-display-inline">Section 236 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226</external-xref>), as amended by this Act, is further amended—</text><paragraph id="H95BAA435E4D147198723B14DAE3999B7"><enum>(1)</enum><text>in subsection (e)—</text><subparagraph id="H47E0835BAA184E45A93C823D3C9BD0C3"><enum>(A)</enum><text>by striking <quote>or release</quote>; and</text></subparagraph><subparagraph id="HB9BD23D83CB245439588F366295018BB"><enum>(B)</enum><text>by striking <quote>grant, revocation, or denial</quote> and insert <quote>revocation or denial</quote>; and</text></subparagraph></paragraph><paragraph id="HAF364A228A074BEEB9913D08FA66B78A"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0D234A791E2648CC8B0A7A332C4181EB"><subsection id="H64F44B568434432E96C93861CBADB8C8"><enum>(f)</enum><header>Enforcement by attorney general of a State</header><text display-inline="yes-display-inline">The attorney general of a State, or other authorized State officer, alleging an action or decision by the Attorney General or Secretary of Homeland Security under this section to release any alien or grant bond or parole to any alien that harms such State or its residents shall have standing to bring an action against the Attorney General or Secretary of Homeland Security on behalf of such State or the residents of such State in an appropriate district court of the United States to obtain appropriate injunctive relief. The court shall advance on the docket and expedite the disposition of a civil action filed under this subsection to the greatest extent practicable. For purposes of this subsection, a State or its residents shall be considered to have been harmed if the State or its residents experience harm, including financial harm in excess of $100.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5E1B6D46B7224B74986FD37D8ACEF172"><enum>(c)</enum><header>Penalties</header><text display-inline="yes-display-inline">Section 243 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1253">8 U.S.C. 1253</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBAE00C28F5BD47ECAE4D44BC8B940EC1"><subsection id="HDFC4CF2E2AA0402094E34BD02C0E1745"><enum>(e)</enum><header>Enforcement by attorney general of a State</header><text display-inline="yes-display-inline">The attorney general of a State, or other authorized State officer, alleging a violation of the requirement to discontinue granting visas to citizens, subjects, nationals, and residents as described in subsection (d) that harms such State or its residents shall have standing to bring an action against the Secretary of State on behalf of such State or the residents of such State in an appropriate district court of the United States to obtain appropriate injunctive relief. The court shall advance on the docket and expedite the disposition of a civil action filed under this subsection to the greatest extent practicable. For purposes of this subsection, a State or its residents shall be considered to have been harmed if the State or its residents experience harm, including financial harm in excess of $100.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6F115168EB264635916D6F9766E418ED"><enum>(d)</enum><header>Certain classes of aliens</header><text display-inline="yes-display-inline">Section 212(d)(5) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>) is amended—</text><paragraph id="HC39D24C5AA68464C825FACAF48730B3B"><enum>(1)</enum><text>by striking <quote>Attorney General</quote> each place such term appears and inserting <quote>Secretary of Homeland Security</quote>; and </text></paragraph><paragraph id="H1A3EEFCD7C9D4229A5D62EFA775A5B38"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4ED314D758414A9FB13C7185DC1688DF"><subparagraph id="HD57AC1F1FC3E4EE0AA4B4D75753BD885" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">The attorney general of a State, or other authorized State officer, alleging a violation of the limitation under subparagraph (A) that parole solely be granted on a case-by-case basis and solely for urgent humanitarian reasons or a significant public benefit, that harms such State or its residents shall have standing to bring an action against the Secretary of Homeland Security on behalf of such State or the residents of such State in an appropriate district court of the United States to obtain appropriate injunctive relief. The court shall advance on the docket and expedite the disposition of a civil action filed under this subparagraph to the greatest extent practicable. For purposes of this subparagraph, a State or its residents shall be considered to have been harmed if the State or its residents experience harm, including financial harm in excess of $100.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB4E64D93ED0A4D4A8A5B04011463C735"><enum>(e)</enum><header>Detention</header><text display-inline="yes-display-inline">Section 241(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(a)(2)</external-xref>) is amended—</text><paragraph id="H206DA743A32C41CEBAD3D12A201C3AC6"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>During the removal period,</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H397BEE956DDF4FF981243D70DC95D65B"><subparagraph id="H4607D35B12114D7F88EF9FB9A89B6ED9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">During the removal period,</text></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="H798204833B254E048D7980F251A3907F"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H39797C4EE45242B1A1889E71FE0C7D94"><subparagraph id="H67C1838B287B4536A48D440322F53480"><enum>(B)</enum><header>Enforcement by attorney general of a State</header><text display-inline="yes-display-inline">The attorney general of a State, or other authorized State officer, alleging a violation of the detention requirement under subparagraph (A) that harms such State or its residents shall have standing to bring an action against the Secretary of Homeland Security on behalf of such State or the residents of such State in an appropriate district court of the United States to obtain appropriate injunctive relief. The court shall advance on the docket and expedite the disposition of a civil action filed under this subparagraph to the greatest extent practicable. For purposes of this subparagraph, a State or its residents shall be considered to have been harmed if the State or its residents experience harm, including financial harm in excess of $100.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H977AAEC7443247DC8B8EF8FA4A3E1A1B"><enum>(f)</enum><header>Limit on injunctive relief</header><text display-inline="yes-display-inline">Section 242(f) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1252">8 U.S.C. 1252(f)</external-xref>) is amended by adding at the end following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H21A2977C31CF4E5599479544356D8C58"><paragraph id="HCF1EC6D0E36F410D970DA922745B4ED8"><enum>(3)</enum><header>Certain actions</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply to an action brought pursuant to section 235(b)(3), subsections (e) or (f) of section 236, or section 241(a)(2)(B).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body><endorsement><action-date date="20250107">January 7, 2025</action-date><action-desc>Read the second time and placed on the calendar</action-desc></endorsement></bill>
