which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a mineral and mining innovation program within the Department of Energy to advance domestic mineral resources, economic growth, and national security, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Unearth Innovation Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id879c34f4c70549ca91aa403185f40c89"><enum>2.</enum><header>Mineral and mining innovation initiative</header><subsection commented="no" display-inline="no-display-inline" id="idf1039cd9411241a69613e6bb10835626"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id3B4AF8065C6942EBB8E3B7B13C2C87A9"><enum>(1)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="id12cf2ed1342d49b7ab2dff6920d65a9a"><enum>(2)</enum><header>Initiative</header><text>The term <term>initiative</term> means the mineral and mining innovation initiative established under subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7734F0D7EE2E4329B8D0DD005F269436"><enum>(3)</enum><header>Mining University</header><text>The term <term>mining university</term> means an institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>)) with a mining, metallurgical, geological, or mineral engineering program accredited by the Accreditation Board for Engineering and Technology, Inc.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBEB07D0253094E979FDCEFFF92071210"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB5F77B1E1E6D48FFABA2227A58D27116"><enum>(b)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish an initiative within the Department of Energy, the purposes of which are—</text><paragraph commented="no" display-inline="no-display-inline" id="id8ACB7A5C4FD640178C48373D71AE2BF9"><enum>(1)</enum><text>to support the research, development, deployment, and commercialization of emerging technologies and practices suitable for responsibly identifying, characterizing, mining, extracting, processing, recycling, and reprocessing the minerals required across multiple industries in the United States to advance domestic mineral resources, circularity, economic growth, national security, and other goals, as determined by the Secretary;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idADB49A818EF74ABA9A2636EC343136B9"><enum>(2)</enum><text>to accelerate the research, development, and integration of advanced technologies, data analytics, responsible mining and mineral recovery practices, advanced techniques for separation or processing facilities to minimize human impacts, and extractive processes intended to minimize environmental impact, increase per-unit productivity, optimize resource utilization, and promote technology adaptation, community engagement, and social acceptance of mining; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id14876785C6284A23B9C8674614710B84"><enum>(3)</enum><text>to coordinate with the National Institute of Occupational Safety and Health of the Centers for Disease Control and Prevention, the Office of Surface Mining Reclamation and Enforcement, and the Mine Safety and Health Administration of the Department of Labor on safety and mining innovation.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9DFED712540349228B21DD583785974C"><enum>(c)</enum><header>Duties</header><paragraph commented="no" display-inline="no-display-inline" id="id6E01BA167F05427F86276ECEDC69708B"><enum>(1)</enum><header>In general</header><text>In carrying out the initiative, the Secretary, in coordination with the Secretary of the Interior, shall identify, study, evaluate, test, and demonstrate hard rock mineral mining, unconventional mineral recovery, refining, and processing technologies and practices to improve—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9C742DB4AD9C4FE6958CA98F8705234A"><enum>(A)</enum><text>identification of new potential domestic mineral resources and trends;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD63077A0283F42A789E14AE5FB6B0627"><enum>(B)</enum><text>characterization and mapping of domestic mineral resources;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF29B9BE72DF54E5B9B6F778E720F5531"><enum>(C)</enum><text>statistical capabilities of the United States, with respect to domestic and global mineral resources;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBCECF07305734806939BC0C94FCA5717"><enum>(D)</enum><text>environmental performance of mining and mineral recovery, including—</text><clause commented="no" display-inline="no-display-inline" id="id529F9427E3364CE5BE99D7546B560C7C"><enum>(i)</enum><text>reducing air emissions and improving water management;</text></clause><clause commented="no" display-inline="no-display-inline" id="id82E038C17B1941A4A4F3C783C959D557"><enum>(ii)</enum><text>improving energy efficiency; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idD35C196C3C46485C9A92C8E27D5C402E"><enum>(iii)</enum><text>minimizing tailings and other waste, mining footprint, and environmental impact;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC44DEADC1DA34AC59F1FAAA3DC5CCAAC"><enum>(E)</enum><text>efficiency and productivity of mining, including co-mineral and byproduct recovery, mineral processing, and resource utilization;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0CB7FB87F31F49918A408766A2C8A704"><enum>(F)</enum><text>data collection, analytics, and sharing;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id71C1C947159A46E7B032F8A6ED0CCD98"><enum>(G)</enum><text>mine safety;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEA2DFEBAE6D74FBFBCF4A76109BE5243"><enum>(H)</enum><text>mine reclamation, remediation, and reuse;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0247349A73F849AA8A2191599EF7569A"><enum>(I)</enum><text>community engagement, consultation with Indian Tribes, and social perception of mining;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4D12F1C8B5094F6AB27CAD52D030BC11"><enum>(J)</enum><text>emerging and new technologies for mineral recovery from unconventional sources;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id061F8E8FB9494266923272AFB6ED02BA"><enum>(K)</enum><text>training and education for the mining workforce; and</text></subparagraph><subparagraph id="idd142f720e36b4779bef391e1c45d105b"><enum>(L)</enum><text>the usable lifespan of products containing critical minerals through reuse, repurposing, and repairability.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0B0064E26B434041985E812C1BE47EF0"><enum>(2)</enum><header>Research and development areas of focus</header><text>In carrying out the initiative, the Secretary, in coordination with the Secretary of the Interior, shall focus research, development, deployment, and commercialization activities in areas related to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idD600E021ED454AA1AEAA49386AA2265C"><enum>(A)</enum><text>mineral exploration, discovery, and characterization science and technology, including—</text><clause commented="no" display-inline="no-display-inline" id="id3EE0C38DA6994F09AB1373C1FB28E3F6"><enum>(i)</enum><text>geophysical surveys;</text></clause><clause commented="no" display-inline="no-display-inline" id="id67366E781E4742079A390B839BA34E20"><enum>(ii)</enum><text>geochemical surveys;</text></clause><clause commented="no" display-inline="no-display-inline" id="idDAB8E0F878844E8C8FEE9D0FCB309DB9"><enum>(iii)</enum><text>uncrewed survey platforms, including uncrewed aerial vehicles;</text></clause><clause commented="no" display-inline="no-display-inline" id="id67F4E5CEFC9C41CDA6D96052317A7563"><enum>(iv)</enum><text>proximal sensing, including automatic spectroscopic scanning of drilling cores;</text></clause><clause commented="no" display-inline="no-display-inline" id="idD06A92367C014656BDB5233A950893C7"><enum>(v)</enum><text>characterizing mine waste, including mine-influenced water; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idAA5DFB9D55E1481DB29D3E23E5DF5684"><enum>(vi)</enum><text>other advanced technologies;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF66409FE838B4074B3EB2D2F7A237ECF"><enum>(B)</enum><text>mineral production and mine remediation and closure, including—</text><clause commented="no" display-inline="no-display-inline" id="id4F566568BE77408AAAB87014C54B71AA"><enum>(i)</enum><text>advanced drilling, sampling, and extraction technologies;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2F00329B14F44C6F934AB30C0E829FD3"><enum>(ii)</enum><text>mine design, including innovations that maximize resource use, environmental benefit, and end uses of land;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9902C702C50B490788D6DD9A36CF9CF0"><enum>(iii)</enum><text>digital mining solutions;</text></clause><clause commented="no" display-inline="no-display-inline" id="idF03DE012986548D7A4922FEA81E21D22"><enum>(iv)</enum><text>in-situ mineral recovery and other advanced extraction techniques;</text></clause><clause commented="no" display-inline="no-display-inline" id="id6F85DEF4EE3443DC81A6CF0A4A350F23"><enum>(v)</enum><text>processing techniques, including—</text><subclause commented="no" display-inline="no-display-inline" id="id6ABA978D63D348E8808F834A7AA5612C"><enum>(I)</enum><text>geometallurgy; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idB6363CD7E05C493AB430BA8B8475FADF"><enum>(II)</enum><text>beneficiation; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idB01540843F314DE8822F3AE598C0C33F"><enum>(III)</enum><text>extraction from increasingly low-grade ores and deeper mines;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5C7FE44D0CA2430B8A01BA4D8CC54A96"><enum>(IV)</enum><text>co-mineral and byproduct recovery;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idA5950448507144F18206E48008184405"><enum>(V)</enum><text>multimineral refining;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id69B4A7034BB44E0D98F89A675165C99C"><enum>(VI)</enum><text>whole rock processing; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id715446E0629340B5990D5DE21805C158"><enum>(VII)</enum><text>greenhouse gas reduction and sequestration; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id1AC2A88E179E4E7C940FEFFB2AB496C1"><enum>(vi)</enum><text>remediation techniques, including—</text><subclause commented="no" display-inline="no-display-inline" id="id060D17C22B114294AD830A5713CB37C6"><enum>(I)</enum><text>reclamation;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id227545B65E2A43E1806DDA8505CEEA28"><enum>(II)</enum><text>tailings and waste management; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id726B3D4B69E447C3AAC5D4DDB83AD01B"><enum>(III)</enum><text>extraction and reprocessing of valued materials from waste on abandoned mine land and at active and inactive mine sites;</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id95559189EBA7415281132E8552832BAD"><enum>(C)</enum><text>critical mineral recycling technologies, including battery recycling;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc11f106b311e49528dc6e4b5b0b5ef29"><enum>(D)</enum><text>social acceptance of mining and mineral processes, technologies, and projects, including—</text><clause commented="no" display-inline="no-display-inline" id="ide048b6a1f80b42aabe7445cb90bf5cae"><enum>(i)</enum><text display-inline="yes-display-inline">research to identify perspectives and priorities of communities local to prospective mining sites;</text></clause><clause commented="no" display-inline="no-display-inline" id="idc4efb7f81f7d4d03a93328964e033ef9"><enum>(ii)</enum><text>research to identify strategies for community engagement and potential short-term and long-term benefits of mining for local communities;</text></clause><clause commented="no" display-inline="no-display-inline" id="id62d0755031bd4819bd3df1e35d8e371d"><enum>(iii)</enum><text>research to provide socially-informed technology research, design, and development priorities;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2c0993ca94c14b058c09ddf36ad90a4b"><enum>(iv)</enum><text>best practices for developing community benefit agreements and plans that address community priorities and mitigate potential environmental and economic harm that may result from mining; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id111c828263f0475791fa381229b507b0"><enum>(v)</enum><text display-inline="yes-display-inline">consultation and engagement with Indian Tribes; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id336ca8f176c04094a8489cb20ace8b87"><enum>(E)</enum><text>other research areas, as determined by the Secretary, to support the program.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idac94e5db923e4254a5f6a0f47cab2bbe"><enum>(3)</enum><header>Areas of focus for reevaluation</header><text>Not less frequently than once every 5 years, the Secretary, in carrying out the initiative in coordination with the Secretary of the Interior, shall consult with Indian Tribes, representatives from academic institutions (including mining universities), National Laboratories, and the mining industry—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc02742c1268a4c72918f4404afa499da"><enum>(A)</enum><text display-inline="yes-display-inline">to reevaluate the status of, and opportunities for, mineral and mining research and development; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id029f4d9d4caa44f7ac8e80d09c4827b0"><enum>(B)</enum><text>to revise the list of areas described in paragraph (2)(E).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD0D0705AD0724848916F485ECCEA7B95"><enum>(d)</enum><header>Coordination</header><text>In carrying out this section, the Secretary shall coordinate with the Secretary of the Interior through, at a minimum—</text><paragraph commented="no" display-inline="no-display-inline" id="id399FC06F24BF44169694661C8602DBEA"><enum>(1)</enum><text>interagency activities associated with the research, development, deployment, and commercialization of hard rock mining and unconventional mineral recovery technologies;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddbf998481b9f48a99abfcf160290ce0c"><enum>(2)</enum><text>leveraging existing mineral research within Federal agencies; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF736B97792D04A548ACA5E56ADE267A3"><enum>(3)</enum><text>engagement with industry, academia, Indian Tribes, and nongovernmental entities to identify innovation gaps and opportunities related to minerals and mining;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1C94C8FA7A5D4588B31B95D22F888A9D"><enum>(4)</enum><text>alignment of applied academic and Federal mineral and mining research and development with economic, energy, and national security needs; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE298F8A000B34D61B3FDC2D6A808BCFD"><enum>(5)</enum><text>certification or validation of emerging technologies or best practices that demonstrate significant economic, environmental, and security benefits, including resource optimization, environmental sustainability, community engagement, and workforce development; and</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2FDDA779A4EF41F6AA5FB3CA1254FDF4"><enum>(e)</enum><header>Collaboration</header><paragraph commented="no" display-inline="no-display-inline" id="idA78092A2C9D240929B9BBCCE1AF60FAD"><enum>(1)</enum><header>In general</header><text>In carrying out this section, the Secretary and the Secretary of the Interior may enter into cooperative agreements, contracts, or other arrangements, including partnerships, with Indian Tribes and academic, public, private, and nongovernmental entities located in the United States, any territory or possession of the United States, or a country described in subparagraph (B) or (C) of section 12(3) of the Strategic and Critical Materials Stock Piling Act (<external-xref legal-doc="usc" parsable-cite="usc/50/98h-3">50 U.S.C. 98h–3(3)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7F5DDA0ACD884F02A4E46FB3DA855065"><enum>(2)</enum><header>Prioritization</header><text>In carrying out paragraph (1), the Secretary and the Secretary of the Interior shall, to the maximum extent practicable, prioritize entering into cooperative agreements, contracts, or other arrangements with academic institutions, including mining universities.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id887E318FC28E4404A85D186776BB4DCE"><enum>(f)</enum><header>Report</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary and the Secretary of the Interior shall submit to Congress a report describing the results of the duties carried out under subsection (c).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id41B14BE8397C4CFAA1A43DD22E18D330"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section $100,000,000 for each of fiscal years 2026 through 2035, to remain available until expended.</text></subsection></section></legis-body></bill>
