BILL</legis-type><official-title>To reform the Federal hiring process, to restore merit to Government service, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restore Merit to Government Service Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idb973d46e8326490f9795a647d5af8ded"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="ida438fe08d55f4769bc0b68710d597757"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the U.S. DOGE Service Temporary Organization, or the head of any successor organization.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8c1f8a9df3924404be290197a950304c"><enum>(2)</enum><header>Agency</header><text>The term <term>agency</term> means the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="id76b02c0ad45342fab0e21f00d3177d3d"><enum>(A)</enum><text>Each of the Executive departments.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf043c35adc024aec8e8af5a4ab018bf8"><enum>(B)</enum><text display-inline="yes-display-inline">The Environmental Protection Agency.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id33e5a5f36c874429a9d1b36005116eb3"><enum>(C)</enum><text>The Office of Management and Budget.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id05e5719aa3ef45209c080505ee873ade"><enum>(D)</enum><text>The Small Business Administration.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id983ce9e1648a480b959a248960755979"><enum>(E)</enum><text>The Social Security Administration.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7362eb18c508475baa17ad10a17311e4"><enum>(F)</enum><text>The National Science Foundation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2ac9316cdf4f4ef58ad1eaf420bf8292"><enum>(G)</enum><text>The Office of Personnel Management.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idec008f5764f8430d9bee4f872ad90e0a"><enum>(H)</enum><text>The General Services Administration.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idead863dce21e4ce8933a20ed93bbe02e"><enum>(3)</enum><header>Executive departments</header><text>The term <term>Executive departments</term> has the meaning given the term in section 101 of title 5, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5aebad2520ba4d32af7b69db40031777"><enum>(4)</enum><header display-inline="yes-display-inline">Plan</header><text>The term <term>Plan</term> means the Federal Hiring Plan developed under section 4(a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id661c86724e5a4d92b63633784bbb022d"><enum>(5)</enum><header>Senior Executive Service position</header><text>The term <term>Senior Executive Service position</term> has the meaning given the term in section 3132(a) of title 5, United States Code.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ida16a64294f01413885dcf2a9ce6d7fbf"><enum>3.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id92fa5713eefc427a9239cc45b3c96199"><enum>(1)</enum><text>The people of the United States deserve an excellent and efficient Federal workforce that attracts the highest caliber of civil servants committed to achieving the freedom, prosperity, and democratic rule promoted by the Constitution of the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61557db0e79947a8b2bffdaf3a959298"><enum>(2)</enum><text>As of the date of enactment of this Act, the appointment practices of the Federal Government are broken, insular, and outdated and no longer focus on merit, practical skill, and dedication to the Constitution of the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2a253fe153a64d789a4a9a944a37d53a"><enum>(3)</enum><text>Appointments in the Federal Government should not be focused on impermissible factors, such as a commitment to— </text><subparagraph commented="no" display-inline="no-display-inline" id="id65bfb4f52fc645b4b9689bc58b273e23"><enum>(A)</enum><text display-inline="yes-display-inline">illegal racial discrimination under the guise of <quote>equity</quote>; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf07ca1683e5f43efafea61d57dfb8b78"><enum>(B)</enum><text display-inline="yes-display-inline">the invented concept of <quote>gender identity</quote> over sex.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id996881fac50449c5a7740c66260eb83d"><enum>(4)</enum><text>Inserting factors described in paragraph (3) into the Federal appointment process subverts the will of the people of the United States, puts critical Government functions at risk, and risks losing the best-qualified candidates.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id77a492d2163247ceb87a57d6b348c46c"><enum>4.</enum><header>Federal Hiring Plan</header><subsection commented="no" display-inline="no-display-inline" id="idf7aeb430879744178895ff96418706c7"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of this Act, the Assistant to the President for Domestic Policy, in consultation with the Director of the Office of Management and Budget, the Director of the Office of Personnel Management, and the Administrator, shall develop and submit to the head of each agency a Federal Hiring Plan that brings to the Federal workforce only highly skilled people of the United States who are dedicated to the furtherance of the ideals, values, and interests of the United States.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9c51d93149cf4dd197adc91a0e93a98b"><enum>(b)</enum><header>Contents</header><text>The Plan shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id74b0e47a8b24420b955a82391bb15e7d"><enum>(1)</enum><text>prioritize the recruitment, by agencies, of individuals who are— </text><subparagraph commented="no" display-inline="no-display-inline" id="id3c96235eee194dd49b717d618313181e"><enum>(A)</enum><text display-inline="yes-display-inline">committed to— </text><clause commented="no" display-inline="no-display-inline" id="id8b4243e1d02b4b8ba722375006cee1a4"><enum>(i)</enum><text display-inline="yes-display-inline">improving the efficiency of the Federal Government; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf7be3c7919eb48d1a177885211aabf6c"><enum>(ii)</enum><text>upholding the rule of law and the Constitution of the United States; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfc5d34f9713f4295be8e668732288c16"><enum>(B)</enum><text>passionate about the ideals of the United States;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf0cd077d5a4848619f127be619e9a461"><enum>(2)</enum><text>prevent the appointment, by an agency, of any individual—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5e9d408e2f1343e59f58eaeab4772125"><enum>(A)</enum><text>based on the race, sex, or religion of the individual; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf3f7fb42387943d4bacd71fa99c15a6a"><enum>(B)</enum><text>who is unwilling to defend the Constitution of the United States or faithfully serve the executive branch of the Federal Government;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idec80bf8b054c4c96922329f076c3f458"><enum>(3)</enum><text>implement, to the greatest extent possible, technical and alternative assessments described in subparagraphs (A) and (B), respectively, of section 3304(c)(2) of title 5, United States Code, for use by agencies;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida344341386044dd6a8b6f40b182f88b0"><enum>(4)</enum><text>establish that the amount of time to appoint an individual to a position in an agency shall be less than 80 days, as measured from the date on which the agency first lists the position;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1a1c6859aa74468c89cdbd14493d664f"><enum>(5)</enum><text>improve communication with candidates for positions in agencies to provide greater clarity regarding application status, timelines, and feedback, including by providing regular updates on the progress of applications and explanations of appointment decisions, where appropriate;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4284db20d66c4aebbd077499aa08ecb9"><enum>(6)</enum><text>integrate modern technology to support the recruitment and selection process at agencies, including— </text><subparagraph commented="no" display-inline="no-display-inline" id="idacbf9b6002684b1c83dea35184ab897e"><enum>(A)</enum><text display-inline="yes-display-inline">through the use of data analytics to identify trends, gaps, and opportunities with respect to appointments; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9086088f92b048c69ccf06b230a72613"><enum>(B)</enum><text>by leveraging digital platforms to improve candidate engagement; </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id40a53f933a154754ab65b8157d74dcc7"><enum>(7)</enum><text>ensure that the heads of agencies, or the designees of those agency heads, are active participants in implementing the processes established by the Plan throughout the appointment process;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id635389f20ac94ce49fbc1f19872a6eba"><enum>(8)</enum><text>include particularized a plan for each agency to improve the allocation of Senior Executive Service positions within the agency to best facilitate democratic leadership, as required by law, within the agency; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide819dc4a7c354939983655e5eb4adbea"><enum>(9)</enum><text>provide specific best practices for the human resources functions within each agency, which the head of each agency shall implement with advice and recommendations, as appropriate, from the Administrator.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id2ecccb7a504646ff9dc095820fe89444"><enum>5.</enum><header>Accountability and reporting</header><text display-inline="no-display-inline">The Director of the Office of Personnel Management shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idc41d02d6dda74989a54060c1c4e8d5b7"><enum>(1)</enum><text>establish clear performance metrics to evaluate the success of the Plan;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd31dc24a5d08429ebb027eaf81adabdb"><enum>(2)</enum><text>on a regular basis, request analysis from the heads of agencies in order to perform the evaluations required under paragraph (1); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idda132ae52e1845c3903c6ef88aa2afcd"><enum>(3)</enum><text>consult with the heads of agencies, labor organizations, and other stakeholders to monitor progress with respect to the implementation of the Plan and ensure that the Plan is meeting the needs of candidates and agencies.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id0a7c0b66b8d244b998026121f8a191c5"><enum>6.</enum><header>General provisions</header><subsection commented="no" display-inline="no-display-inline" id="id95e9af5dd78b4196b9aa8128492056b8"><enum>(a)</enum><header>Rule of construction</header><text>Nothing in this Act may be construed to impair or otherwise affect—</text><paragraph commented="no" display-inline="no-display-inline" id="id08ee6fd69d7f407496e74d32384cfb06"><enum>(1)</enum><text>the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id07513698c8bb4e87b328241e7a5736ac"><enum>(2)</enum><text>the functions of the Board of Governors of the Federal Reserve System or the Federal Open Market Committee relating to the conduct of monetary policy.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd665301d96194b99822b90e7b9b00ab6"><enum>(b)</enum><header>Implementation</header><text>This Act shall be implemented consistent with applicable law and subject to the availability of appropriations.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id20e34ea0ca5f4f918a65c21d2308b47a"><enum>(c)</enum><header>No creation of rights or benefits</header><text>This Act is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, any agency of the United States, any employee of the United States, any agent of the United States, or any other person.</text></subsection></section></legis-body></bill>
