<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 568</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250213">February 13, 2025</action-date><action-desc><sponsor name-id="S330">Mr. Bennet</sponsor> (for himself and <cosponsor name-id="S408">Mr. Hickenlooper</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize compensation to individuals, organizations, and companies impacted by the Gold King Mine wastewater spill of 2015, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gold King Mine Spill Compensation Act of 2025</short-title></quote>.</text></section><section id="id10315d7173ec4a8e9243814bc829e239"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id7a1b82ef10534e7b8e6b9fe9a2a8871c"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideba69c9ebec643fc9b8891d7b8d44e8a"><enum>(2)</enum><header>BPMD contamination</header><text>The term <term>BPMD contamination</term> means a release or threatened release of hazardous substances that occurred or is occurring on or before the date of enactment of this Act at or from mining-related sources within the Bonita Peak Mining District Superfund Site in San Juan County, Colorado, Environmental Protection Agency Docket ID No. EPA HQ-OLEM2016-0152, as published in the final rule of the Environmental Protection Agency entitled <quote>National Priorities List</quote> (81 Fed. Reg. 62397 (September 9, 2016)), including all areas of that site that the Environmental Protection Agency has ever defined or described for purposes of, or in relation to, the National Priorities List developed by the President in accordance with section 105(a)(8)(B) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9605">42 U.S.C. 9605(a)(8)(B)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idef1e9fcace4a4300bf4ebd0ddecd23fd"><enum>(3)</enum><header>Covered claim</header><text>The term <term>covered claim</term> means a written request for monetary compensation of a certain amount under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code (commonly known as the <quote>Federal Tort Claims Act</quote>), submitted to the Administrator on or before August 5, 2017, by an injured person for compensation for covered damages.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4c190beb5878491f9a9eea26063de579"><enum>(4)</enum><header>Covered damages</header><subparagraph commented="no" display-inline="no-display-inline" id="idc5d597b02cdb4473906ba700c41f5dc0"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>covered damages</term> means any of the following types of adequately documented, as determined by the Administrator, damages suffered by an injured person as a result of the Gold King Mine spill that is otherwise uncompensated:</text><clause commented="no" display-inline="no-display-inline" id="id451C094BD6894A6C87F11573574768D6"><enum>(i)</enum><text display-inline="yes-display-inline">Injury.</text></clause><clause commented="no" display-inline="no-display-inline" id="id54983D28309346E88299A032240B0C06"><enum>(ii)</enum><text>Lost business income incurred during the period beginning on August 5, 2015, and ending on December 31, 2015, excluding lost business income from vacation rentals.</text></clause><clause commented="no" display-inline="no-display-inline" id="id86D4727D2C294ADF94DD17621C2A64F8"><enum>(iii)</enum><text>Expenses arising from relocating livestock and providing alternative water supplies incurred during the period beginning on August 5, 2015, and ending on October 15, 2015.</text></clause><clause commented="no" display-inline="no-display-inline" id="id0FC64A80ECE641DB8DF97C4F28A89E7D"><enum>(iv)</enum><text>Diminished yield or loss of agricultural crops occurring during the period beginning on August 5, 2015, and ending on December 31, 2015.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idafd360143f404869a58bb46117d2df52"><enum>(B)</enum><header>Exclusions</header><text>The term <term>covered damages</term> does not include—</text><clause commented="no" display-inline="no-display-inline" id="id306b3efb1e8843d8adc170ab6236f24f"><enum>(i)</enum><text display-inline="yes-display-inline">costs for response (as defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)); or</text></clause><clause commented="no" display-inline="no-display-inline" id="idecac1d9f6ee34164a6fcabbce19b1666"><enum>(ii)</enum><text>emotional distress.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide5f3a56529964f7cb8676c6d5037f3bd"><enum>(5)</enum><header>Gold King Mine spill</header><text>The term <term>Gold King Mine spill</term> means the release, on August 5, 2015, of more than 3,000,000 gallons of acid mine drainage containing heavy metals from the Gold King Mine located in San Juan County, Colorado, into downstream waters, including the Animas and San Juan Rivers, that occurred during a removal site evaluation by the Environmental Protection Agency. </text></paragraph><paragraph id="id213f77a383074477bfb5bcec1bca3a56"><enum>(6)</enum><header>Injured person</header><subparagraph commented="no" display-inline="no-display-inline" id="idf01539e97f3c48b9ba53da77bae95e6a"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the term <term>injured person</term> means a homeowner, a livestock grazer, a farmer, or a recreation company or other business—</text><clause commented="no" display-inline="no-display-inline" id="id03989c91c0c34116930076808e350bca"><enum>(i)</enum><text display-inline="yes-display-inline">that, as a result of the Gold King Mine spill, suffered covered damages;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7c186e4fc6d94e38984477e50b07bce5"><enum>(ii)</enum><text display-inline="yes-display-inline">that has not, prior to the date of enactment of this Act, entered into a settlement agreement with the United States for any amount exceeding $2,500, or had a judgment entered by any court in any case related to BPMD contamination or the Gold King Mine spill; and</text></clause><clause id="idfa41ffc29c884773b0752890b7d859ed"><enum>(iii)</enum><text>to which the Administrator—</text><subclause commented="no" display-inline="no-display-inline" id="id5d9790050b024e78ae5acc026612a32f"><enum>(I)</enum><text display-inline="yes-display-inline">denied a covered claim; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idde2354365dbd4fcfa86388fc96d2f480"><enum>(II)</enum><text>did not fully compensate the individual or entity for covered damages described in a covered claim.</text></subclause></clause></subparagraph><subparagraph id="idb7b31119b17e4349bceced007d78a239"><enum>(B)</enum><header>Limitations</header><text>The term <term>injured person</term> only includes an individual or entity described in subparagraph (A) that—</text><clause commented="no" display-inline="no-display-inline" id="id9f910a3d338546beb6dae6d42cc5e15d"><enum>(i)</enum><text display-inline="yes-display-inline">has, on or before August 5, 2017, submitted a covered claim to the Administrator;</text></clause><clause commented="no" display-inline="no-display-inline" id="id391d7d7d735a4886b23916ee1966478b"><enum>(ii)</enum><text>if the entity is a business, is in operation as of the date of a payment under this Act; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id192fbb0c16a0448ca7f27410420b2ffc"><enum>(iii)</enum><text>if the entity is a business, does not own a mine or perform any mine-related business.</text></clause></subparagraph></paragraph><paragraph id="id733e0c0475234d4bb8d6828c3b922c87"><enum>(7)</enum><header>Injury</header><text>The term <term>injury</term> has the same meaning as the term <term>injury or loss of property, or personal injury or death</term> as used in section 1346(b)(1) of title 28, United States Code. </text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id43283cb13d3a4ee5a0d1756225bcd4b6"><enum>3.</enum><header>Compensation for victims of Gold King Mine spill</header><subsection commented="no" display-inline="no-display-inline" id="idde14991b2cc940bca089483d92a5c7fe"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Each injured person shall be entitled to receive from the United States compensation for covered damages suffered by the injured person as a result of the Gold King Mine spill. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id6b95162becda4ff0b9bf059ea688154e"><enum>(b)</enum><header>Investigation of claims</header><paragraph commented="no" display-inline="no-display-inline" id="idbb759fbb27d743218928f79c35bf6d2a"><enum>(1)</enum><header>In general</header><text>The Administrator shall, on behalf of the United States, investigate, consider, ascertain, adjust, determine, grant, deny, or settle any covered claim for covered damages asserted in the covered claim by an injured person for covered damages suffered as a result of the Gold King Mine spill.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0d28be3d45f54d81bd5452901225b1cc"><enum>(2)</enum><header>Applicability of State law</header><text>Except as otherwise provided in this Act, the laws of the State of Colorado shall apply to the calculation of covered damages.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida58c22612b1b452389d2cca4695489fc"><enum>(3)</enum><header>Extent of damages</header><text>Any payment under this Act—</text><subparagraph id="id55c4cdda059847f996c382adeaa5f72f"><enum>(A)</enum><text>shall be limited to—</text><clause commented="no" display-inline="no-display-inline" id="idb1a81697150d486cb44265832440f02e"><enum>(i)</enum><text display-inline="yes-display-inline">actual compensatory damages measured by injuries suffered; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id92cf1c236743460cb1581e47f9300b66"><enum>(ii)</enum><text>the amount originally claimed by the injured person in the covered claim; and</text></clause></subparagraph><subparagraph id="id39ea45a7cbb242ea93df4496271d93b1"><enum>(B)</enum><text>shall not include—</text><clause id="id483aa277716e4ea3bfc755402b6fca55"><enum>(i)</enum><text>interest before or after settlement or payment of a covered claim; or</text></clause><clause id="id5b44f2d871724525b6dbe1d7f10e641e"><enum>(ii)</enum><text>punitive damages. </text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="iddc44a9d418aa4539bdd843458b441411"><enum>(c)</enum><header>Payment of covered claims</header><paragraph commented="no" display-inline="no-display-inline" id="id8c43fc428b074053bddf5923b68ec72d"><enum>(1)</enum><header>Determination required</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall determine and fix the amount, if any, to be paid for the covered claim.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9b4174278d8a416389ec5615d59bbbe0"><enum>(2)</enum><header>Parameters of determination</header><text>In determining and settling a covered claim, the Administrator shall determine only—</text><subparagraph id="id5b44e640fb55475f8a05cf76e9b9522b"><enum>(A)</enum><text>whether the claimant is an injured person;</text></subparagraph><subparagraph id="idccfbf6fb3dfe4afabe211d64c525806c"><enum>(B)</enum><text>whether the injury that is the subject of the covered claim resulted from the Gold King Mine spill;</text></subparagraph><subparagraph id="id18dfe751306b4999ae3d7da7ab3c92ea"><enum>(C)</enum><text>the amount, if any, to be allowed and paid under this Act; and</text></subparagraph><subparagraph id="idc758a429db1041f3bae6b636d582c3fc"><enum>(D)</enum><text>the person or persons entitled to receive the amount.</text></subparagraph></paragraph></subsection><subsection id="idc08fbeeb8af14437804bdcd9074893ee"><enum>(d)</enum><header>Acceptance of award</header><text>The acceptance by a claimant of any payment under this Act shall—</text><paragraph id="idfdded0cf1324451faa167a24cb05161a"><enum>(1)</enum><text>be final and conclusive on the claimant with respect to all covered claims arising out of or relating to the same subject matter;</text></paragraph><paragraph id="id4cd2f55ec1b74403b5f77f74e6835719"><enum>(2)</enum><text>constitute a complete release of all covered claims against the United States (including any agency or employee of the United States) under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code (commonly known as the <quote>Federal Tort Claims Act</quote>), or any other Federal or State law, arising out of or relating to the same subject matter; and</text></paragraph><paragraph id="id3bfa12e2bde2455cbd80eb4568ef5a26"><enum>(3)</enum><text>include a certification by the claimant, made under penalty of perjury and subject to the provisions of section 1001 of title 18, United States Code, that the covered claim is true and correct. </text></paragraph></subsection><subsection id="idf6bab94e97a84e438fcceaae1d1c6096"><enum>(e)</enum><header>Election of remedy</header><paragraph id="idb005097f69a44a46bb2e6a339e84af8a"><enum>(1)</enum><header>In general</header><text>An injured person may elect to seek compensation from the United States for 1 or more injuries resulting from the Gold King Mine spill by—</text><subparagraph id="id639524ae4ee740668b4e8ef139a3cb28"><enum>(A)</enum><text>pursuing compensation under a covered claim;</text></subparagraph><subparagraph id="id031a421053a94074a6fee68abf05a78a"><enum>(B)</enum><text>filing a claim or bringing a civil action under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code; or</text></subparagraph><subparagraph id="id0e315159afc047d0b47672b04db5529e"><enum>(C)</enum><text>bringing an authorized civil action under any other provision of law.</text></subparagraph></paragraph><paragraph id="id9a0f952899004acd9abc86c18f52d956"><enum>(2)</enum><header>Effect of election</header><text>An election by an injured person to seek compensation in any manner described in paragraph (1) shall be final and conclusive on the claimant with respect to all injuries resulting from the Gold King Mine spill that are suffered by the claimant.</text></paragraph><paragraph id="idfb1b5ecce3754199bdac66089928f17d"><enum>(3)</enum><header>No effect on entitlements</header><text>Nothing in this Act affects any right of a claimant to file a claim for benefits under any Federal entitlement program. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idbd354d1457c943b8bb9115323719e693"><enum>(f)</enum><header>Judicial review</header><paragraph id="idffceeda29bf24572a9e1263dcc047af6"><enum>(1)</enum><header>In general</header><text>Any claimant aggrieved by a final decision of the Administrator under this Act may, not later than 60 days after the date on which the decision is issued, bring a civil action in the United States District Court for the District of Colorado, to modify or set aside the decision, in whole or in part.</text></paragraph><paragraph id="id2c0847e3ae49438792debd5379567e7b"><enum>(2)</enum><header>Record</header><text>The court shall hear a civil action under paragraph (1) on the record made before the Administrator.</text></paragraph><paragraph id="id58a9d3a18b0d420490918f945f0f92ec"><enum>(3)</enum><header>Standard</header><text>The decision of the Administrator incorporating the findings of the Administrator shall be upheld if the decision is supported by substantial evidence on the record considered as a whole.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idac78025d19ba40028b1bcd0168f9ac79"><enum>(g)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which all covered claims have been processed under this Act, the Administrator shall submit to Congress a report that describes—</text><paragraph id="id6e175b2b2bcc45f8b6ae9daf4137a21d"><enum>(1)</enum><text>the amounts claimed;</text></paragraph><paragraph id="ide4edd23b124b4897a18e237339cbd903"><enum>(2)</enum><text>a brief description of the nature of the covered claims; and</text></paragraph><paragraph id="id9f1d97f4b7d64ec2993c2a50c356999c"><enum>(3)</enum><text>the disposition of the covered claims, including the amount of any payment under this Act.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id351fdf3447d74640be62228a05f2e750"><enum>4.</enum><header>Appropriation of funds</header><subsection id="idf9943c4e6be74181a127443f00edacc3"><enum>(a)</enum><header>In general</header><text>There are appropriated to the Administrator for fiscal year 2025, out of any amounts in the Treasury not otherwise appropriated, such sums as are necessary, but not to exceed $3,300,000, for the payment of claims in accordance with this Act, to remain available until expended.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ida91c407ebc7a4812a2c8e796923c1f79"><enum>(b)</enum><header>Emergency requirement</header><text>The entire amount made available under subsection (a) is designated by Congress as an emergency requirement under section 251(b)(2)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/901">2 U.S.C. 901(b)(2)(A)</external-xref>).</text></subsection></section></legis-body></bill>
