Antideficiency.</toc-entry></toc></subsection></section><section commented="no" display-inline="no-display-inline" id="idab63a791b6b5457e944bcd3e194486c1"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="idcf38ab7b427a4b85a5db6e259d692aca"><enum>(1)</enum><text>to achieve a fair, equitable, and final settlement of all claims to water rights in the Rio Chama Stream System in the State for—</text><subparagraph id="id9a92214ae272460e9f0a530670091954"><enum>(A)</enum><text>Ohkay Owingeh; and</text></subparagraph><subparagraph id="id792301e1ab5e4a579ed3e082b80f33ec"><enum>(B)</enum><text>the United States, acting as trustee for Ohkay Owingeh;</text></subparagraph></paragraph><paragraph id="idafb41c52761447eba757c1a47f7e5c85"><enum>(2)</enum><text>to authorize, ratify, and confirm the Agreement entered into by Ohkay Owingeh, the State, and various other parties to the extent that the Agreement is consistent with this Act;</text></paragraph><paragraph id="idf87abf5e542c40dbbe68c191fa8a6081"><enum>(3)</enum><text>to authorize and direct the Secretary—</text><subparagraph id="id72bd383148424edfa5a52b7a1b9544c3"><enum>(A)</enum><text>to execute the Agreement; and</text></subparagraph><subparagraph id="id37a6ea67ac374d0ea9028b6eb57249a5"><enum>(B)</enum><text>to take any other actions necessary to carry out the Agreement in accordance with this Act; and</text></subparagraph></paragraph><paragraph id="id6abe4e0f1ba34a04aa685a46c5606bd5"><enum>(4)</enum><text>to authorize funds necessary for the implementation of the Agreement and this Act.</text></paragraph></section><section id="ide5dcb990752b4f159021fe95a65b18f0"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id1aba8a6783bd4504aa89bfe5e582c9ba"><enum>(1)</enum><header>Adjudication</header><text>The term <term>Adjudication</term> means the general stream adjudication of water rights in the Rio Chama Stream System entitled <quote>State of New Mexico ex rel. State Engineer v. Aragon</quote>, Civil No. 69–CV–07941–KWR/KK, pending, as of the date of enactment of this Act, in the United States District Court for the District of New Mexico.</text></paragraph><paragraph id="id4bf63a7418354212ba9e6c763a24e4d1"><enum>(2)</enum><header>Agreement</header><text>The term <term>Agreement</term> means—</text><subparagraph id="id6fee991f2765404f82934193a6050672"><enum>(A)</enum><text>the document entitled <quote>Ohkay Owingeh Rio Chama Water Rights Settlement</quote> and dated July 5, 2023, and the exhibits attached thereto; and</text></subparagraph><subparagraph id="id18c39a568e22435488553679d6424df9"><enum>(B)</enum><text>any amendment to the document referred to in subparagraph (A) (including an amendment to an exhibit thereto) that is executed to ensure that the Agreement is consistent with this Act.</text></subparagraph></paragraph><paragraph id="idb87e02179a9d4ef89a7881651cfef63c"><enum>(3)</enum><header>Bosque</header><text>The term <term>bosque</term> means a gallery forest located along the riparian floodplain of a stream, riverbank, or lake. </text></paragraph><paragraph id="id72138b63181e4438b0557de29b8391ad"><enum>(4)</enum><header>City of Española</header><text>The term <term>City of Española</term> means a municipal corporation of the State.</text></paragraph><paragraph id="id45d1e65ba74045d2af379aae198917d2"><enum>(5)</enum><header>Enforceability Date</header><text>The term <term>Enforceability Date</term> means the date described in section 8<italic></italic>.</text></paragraph><paragraph id="idbe7d20024aef420bad27d15fd1325ec7"><enum>(6)</enum><header>Ohkay Owingeh; Pueblo</header><text>The terms <term>Ohkay Owingeh</term> and <term>Pueblo</term> mean the body politic and federally recognized Indian nation.</text></paragraph><paragraph id="iddeb8db9376424c079d42aa4ee21c7df4"><enum>(7)</enum><header>Partial Final Judgment and Decree</header><text>The term <term>Partial Final Judgment and Decree</term> means a final or interlocutory partial final judgment and decree entered by the United States District Court for the District of New Mexico with respect to the water rights of Ohkay Owingeh in the Rio Chama Stream System—</text><subparagraph id="ida4a010f1f0f54d5bb80f928c0b030998"><enum>(A)</enum><text>that is substantially in the form described in the Agreement, as amended to ensure consistency with this Act; and</text></subparagraph><subparagraph id="id539f1ce8c6534f29b5635bfc0e57466e"><enum>(B)</enum><text>from which no further appeal may be taken.</text></subparagraph></paragraph><paragraph id="id3599075061a94b6a9d765806d6483be2"><enum>(8)</enum><header>Pueblo Grant</header><text>The term <term>Pueblo Grant</term> means the land recognized and confirmed by the Federal patent issued to Ohkay Owingeh (then known as the <quote>Pueblo of San Juan</quote>) under the Act of December 22, 1858 (11 Stat. 374, chapter V).</text></paragraph><paragraph id="id486295da7a8c4344b988cd8a8cb37e54"><enum>(9)</enum><header>Pueblo Land</header><text>The term <term>Pueblo Land</term> means any real property that is—</text><subparagraph id="id8253d3cfc71f412dad5f2e8b8df440b5"><enum>(A)</enum><text>held by the United States in trust for Ohkay Owingeh within the Rio Chama Stream System;</text></subparagraph><subparagraph id="id35ef3bfe48c8490a977a679bbc5ad45f"><enum>(B)</enum><text>owned by the Pueblo within the Rio Chama Stream System before the Enforceability Date; or</text></subparagraph><subparagraph id="id0d96b86945db44438984e3b77e5ba84d"><enum>(C)</enum><text>acquired by the Pueblo within the Rio Chama Stream System on or after the Enforceability Date if the real property is located—</text><clause id="id0ad5a9a0ec664b6b912465405087ba90"><enum>(i)</enum><text>within the exterior boundaries of the Pueblo Grant; or</text></clause><clause id="id356a9f613ea64d479418e2c7239162a8"><enum>(ii)</enum><text>within the exterior boundaries of any territory set aside for the Pueblo by law, Executive order, or court decree.</text></clause></subparagraph></paragraph><paragraph id="id2b67dfcfead54c69ae4bc9e9689d9bba"><enum>(10)</enum><header>Pueblo Water Rights</header><text>The term <term>Pueblo Water Rights</term> means the water rights of Ohkay Owingeh in the Rio Chama Stream System—</text><subparagraph id="id9f611cb4773845a59181a8f247adf23e"><enum>(A)</enum><text>as identified in the Agreement and section 5<italic></italic>; and</text></subparagraph><subparagraph id="id0cf42aadf3c341c78539cede030f1e9f"><enum>(B)</enum><text>as confirmed in the Partial Final Judgment and Decree.</text></subparagraph></paragraph><paragraph id="id6e00a977d5644a2392cb23ddaa454dcb"><enum>(11)</enum><header>Rio Chama Stream System</header><text>The term <term>Rio Chama Stream System</term> means the Rio Chama surface water drainage basin within the State, as illustrated in Exhibit A to the Agreement.</text></paragraph><paragraph id="id5f9f9aefd8204a428e1100da1d057a21"><enum>(12)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id66d19d1c303744e7a3678daaef8fd3ff"><enum>(13)</enum><header>Signatory Acequia</header><text>The term <term>Signatory Acequia</term> means an acequia that is a signatory to the Agreement.</text></paragraph><paragraph id="id0d6d168504394b2cb3223b22853bdc36"><enum>(14)</enum><header>State</header><text>The term <term>State</term> means the State of New Mexico.</text></paragraph><paragraph id="id89b3e0123493447e9caa7f896245c995"><enum>(15)</enum><header>Trust Fund</header><text>The term <term>Trust Fund</term> means the Ohkay Owingeh Water Rights Settlement Trust Fund established under section 6(a).</text></paragraph></section><section id="id5f40125de44a4aab94799b5bd4a185b0"><enum>4.</enum><header>Ratification of Agreement</header><subsection id="id4a4f4fd99c41409fb24e1b667706decd"><enum>(a)</enum><header>Ratification</header><paragraph id="idcb259440b735473a8632d62563ef9ba0"><enum>(1)</enum><header>In general</header><text>Except as modified by this Act, and to the extent that the Agreement does not conflict with this Act, the Agreement is authorized, ratified, and confirmed.</text></paragraph><paragraph id="id8c8c44d7527b46f89e08737b34174f49"><enum>(2)</enum><header>Amendments</header><text>If an amendment to the Agreement, or to any exhibit to the Agreement requiring the signature of the Secretary, is executed in accordance with this Act to make the Agreement consistent with this Act, the amendment is authorized, ratified, and confirmed.</text></paragraph></subsection><subsection id="idfc2193b9ff0d48e084627b9c97a554a9"><enum>(b)</enum><header>Execution</header><paragraph id="ida06047c5c01849e7a99d006ff66d4022"><enum>(1)</enum><header>In general</header><text>To the extent the Agreement does not conflict with this Act, the Secretary shall execute the Agreement, including all exhibits thereto or parts of the Agreement requiring the signature of the Secretary.</text></paragraph><paragraph id="id67f2efc45b7a4d5b9a0449ab66380f5e"><enum>(2)</enum><header>Modifications</header><text>Nothing in this Act prohibits the Secretary, after execution of the Agreement, from approving any modification to the Agreement, including an exhibit to the Agreement, that is consistent with this Act, to the extent that the modification does not otherwise require congressional approval under section 2116 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>) or any other applicable provision of Federal law.</text></paragraph></subsection><subsection id="id723909662b144981afefc2567e74339e"><enum>(c)</enum><header>Environmental compliance</header><paragraph id="id2c9ab959ecb14dc89a65e9b75e33ae5c"><enum>(1)</enum><header>In general</header><text>In implementing the Agreement and this Act, the Secretary shall comply with—</text><subparagraph id="id81b3302622fd4336becd98680eba0367"><enum>(A)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></subparagraph><subparagraph id="id77669bc6476b41d38752cef23972d15e"><enum>(B)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), including the implementing regulations of that Act; and</text></subparagraph><subparagraph id="idb4ad909bda584556875c7c49fc81d0f9"><enum>(C)</enum><text>all other applicable Federal environmental laws and regulations.</text></subparagraph></paragraph><paragraph id="id7bb2419c8a8945e1ae4eb0a091ed80dc"><enum>(2)</enum><header>Compliance and coordination</header><subparagraph id="idd903e807c22b468682060e4ea5ebc1e9"><enum>(A)</enum><header>In general</header><text>In implementing the Agreement and this Act, the Pueblo shall prepare any necessary environmental documents consistent with—</text><clause id="idcf969c2b9f694b91955b335ee1d9272f"><enum>(i)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></clause><clause id="idc4f2af82bd8e4307849e27296a5f139e"><enum>(ii)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), including the implementing regulations of that Act; and</text></clause><clause id="id64621f40953b4e7da0ab86d40780537b"><enum>(iii)</enum><text>all other applicable Federal environmental laws and regulations.</text></clause></subparagraph><subparagraph id="idafb622725e1245a6a0f7b2f8ae6590fc"><enum>(B)</enum><header>Authorizations</header><text>The Secretary shall—</text><clause id="id9c24198ec5634c40b86f7d929604c6ae"><enum>(i)</enum><text>independently evaluate the documentation required under subparagraph (A); and</text></clause><clause id="id0d5709853a4a449c99bf7b3309c34191"><enum>(ii)</enum><text>be responsible for the accuracy, scope, and contents of that documentation.</text></clause></subparagraph><subparagraph id="ida78c2828e24d46a4ab916062171db3f1"><enum>(C)</enum><header>Coordination with Army Corps of Engineers</header><text>For any bosque restoration or improvement project carried out by the Pueblo with funds appropriated under this Act, the Pueblo shall coordinate with the Corps of Engineers to ensure that work on the project shall not interfere with or adversely affect any authorized Federal project that is under the jurisdiction and authority of the Corps of Engineers.<italic></italic></text></subparagraph></paragraph><paragraph id="id50f56145a3e544cfa4a691d5b22099cf"><enum>(3)</enum><header>Effect of execution</header><text>The execution of the Agreement by the Secretary under this section shall not constitute a major Federal action under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></paragraph><paragraph id="id22ae548f738f489abed1904b66b8a14b"><enum>(4)</enum><header>Costs</header><text>Any costs associated with the performance of the compliance and coordination activities under this subsection shall be paid from funds deposited in the Trust Fund, subject to the condition that any costs associated with the performance of Federal approval or other review of that compliance work or costs associated with inherently Federal functions shall remain the responsibility of the Secretary, with the exception that costs for review of bosque restoration or improvement projects by the Corps of Engineers described in paragraph (2)(C) shall be paid from funds deposited in the Trust Fund.</text></paragraph></subsection></section><section id="id55bdc636913c4d7dab656087f1c0a6a4"><enum>5.</enum><header>Pueblo Water Rights</header><subsection id="idad36b5308bde41a787f2e45c95a3cc4c"><enum>(a)</enum><header>Trust status of the Pueblo Water Rights</header><text>The Pueblo Water Rights shall be held in trust by the United States on behalf of Ohkay Owingeh in accordance with the Agreement and this Act.</text></subsection><subsection id="idff2c2407ee92424199a793ae18079fd0"><enum>(b)</enum><header>Forfeiture and abandonment</header><paragraph id="id580c12fc3426484a9fbfe467839298c4"><enum>(1)</enum><header>In general</header><text>The Pueblo Water Rights shall not be subject to loss through non-use, forfeiture, abandonment, or other operation of law.</text></paragraph><paragraph id="idbb80577249a8485f956559963b35cc7e"><enum>(2)</enum><header>State law-based water rights</header><text>State-law based water rights acquired by Ohkay Owingeh, or by the United States on behalf of Ohkay Owingeh, after the date for inclusion in the Partial Final Judgment and Decree, shall not be subject to forfeiture, abandonment, or permanent alienation from the time they are acquired.</text></paragraph></subsection><subsection id="id5eb17e4536a342d09abdda4ee615c2dc"><enum>(c)</enum><header>Use</header><text>Any use of the Pueblo Water Rights shall be subject to the terms and conditions of the Agreement and this Act.</text></subsection><subsection id="id7e8c599c802f4e8bbbf18dab5b558918"><enum>(d)</enum><header>Authority of the Pueblo</header><paragraph id="id362dd5dd409a423aadd117243771f067"><enum>(1)</enum><header>In general</header><text>Ohkay Owingeh may allocate, distribute, and lease the Pueblo Water Rights for use on Pueblo Land in accordance with the Agreement, this Act, and applicable Federal law, including the Act of August 9, 1955 (<external-xref legal-doc="usc" parsable-cite="usc/25/415">25 U.S.C. 415 et seq.</external-xref>) (commonly known as the <quote>Long-Term Leasing Act</quote>).</text></paragraph><paragraph id="id8a85be6601cd4f04815e3f7761282f62"><enum>(2)</enum><header>Use off Pueblo Land</header><subparagraph commented="no" display-inline="no-display-inline" id="id39116cc50e354bdeb616cb03aa1756db"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Ohkay Owingeh may allocate, distribute, and lease the Pueblo Water Rights for use off Pueblo Land in accordance with the Agreement, this Act, and applicable Federal law, subject to the approval of the Secretary.</text></subparagraph><subparagraph id="iddb899135028642f99ccb1c1cc1c73069"><enum>(B)</enum><header>Maximum term of leases</header><text>The maximum term of any lease, including all renewals, under this paragraph shall not exceed 99 years.</text></subparagraph></paragraph></subsection><subsection id="id146074e0b0504e3bb0c4b70536c28480"><enum>(e)</enum><header>Administration</header><paragraph id="ida9dad5b771fe4be79304a31902d05e38"><enum>(1)</enum><header>No alienation</header><text>The Pueblo shall not permanently alienate any portion of the Pueblo Water Rights.</text></paragraph><paragraph id="id9a37e52793ac4b38945155409dd0546a"><enum>(2)</enum><header>Purchases or grants of land from Indians</header><text>An authorization provided by this Act for the allocation, distribution, leasing, or other arrangement entered into pursuant to this Act shall be considered to satisfy any requirement for authorization of the action required by Federal law.</text></paragraph><paragraph id="idadfcb4443dec4121b8e2863c50148748"><enum>(3)</enum><header>Prohibition on forfeiture</header><text>The non-use of all or any portion of the Pueblo Water Rights by any water user shall not result in the forfeiture, abandonment, relinquishment, or other loss of all or any portion of the Pueblo Water Rights.</text></paragraph></subsection></section><section id="id003794df1ff7416dacd93467a55bc940"><enum>6.</enum><header>Settlement Trust Fund</header><subsection id="id724c6d8d3dc54ad396f934083d6cd656"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a trust fund, to be known as the <quote>Ohkay Owingeh Water Rights Settlement Trust Fund</quote>, to be managed, invested, and distributed by the Secretary and to remain available until expended, withdrawn, or reverted to the general fund of the Treasury, consisting of the amounts deposited in the Trust Fund under subsection (b), together with any investment earnings, including interest, earned on those amounts for the purpose of carrying out this Act.</text></subsection><subsection id="idd7f0abdfcc114ff29731ff1dd45c64bc"><enum>(b)</enum><header>Deposits</header><text>The Secretary shall deposit in the Trust Fund the amounts made available pursuant to section 7(a).</text></subsection><subsection id="idbc565da384504c53914884886900f704"><enum>(c)</enum><header>Management and interest</header><paragraph id="id335b9a4bb0974342b6cc1db32b73291e"><enum>(1)</enum><header>Management</header><text>On receipt and deposit of funds into the Trust Fund under subsection (b), the Secretary shall manage, invest, and distribute all amounts in the Trust Fund in a manner that is consistent with the investment authority of the Secretary under—</text><subparagraph id="idb6b90e562e71440ba6e5fb70adf1b1f5"><enum>(A)</enum><text>the first section of the Act of June 24, 1938 (<external-xref legal-doc="usc" parsable-cite="usc/25/162a">25 U.S.C. 162a</external-xref>);</text></subparagraph><subparagraph id="id52f01ccac31d40398e45655a36c73878"><enum>(B)</enum><text>the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id020c6125443c4114bf091aa051f93d5f"><enum>(C)</enum><text>this subsection.</text></subparagraph></paragraph><paragraph id="id4976c9ebaee84f1aa798c2b5d1223fc8"><enum>(2)</enum><header>Investment earnings</header><text>In addition to the amounts deposited into the Trust Fund under subsection (b), any investment earnings, including interest, earned on those amounts held in the Trust Fund are authorized to be used in accordance with subsections (e) and (g).</text></paragraph></subsection><subsection id="id998a98965ee140ddacbb9231fb5f7df1"><enum>(d)</enum><header>Availability of amounts</header><paragraph id="idd0fd5f6e14484e1c9d495dfe4487164c"><enum>(1)</enum><header>In general</header><text>Amounts appropriated to, and deposited in, the Trust Fund, including any investment earnings (including interest) earned on those amounts, shall be made available to Ohkay Owingeh by the Secretary beginning on the Enforceability Date, subject to the requirements of this section, except for funds to be made available to Ohkay Owingeh pursuant to paragraph (2).</text></paragraph><paragraph id="id2d17de3a16bf4a5386da3eb7a26fd704"><enum>(2)</enum><header>Use of funds</header><text>Notwithstanding paragraph (1), not more than $100,000,000 of the amounts deposited in the Trust Fund, including any investment earnings, including interest, earned on those amounts, shall be available to Ohkay Owingeh for the following uses on the date on which the amounts are deposited in the Trust Fund:</text><subparagraph id="idbfeb1e7118ab46688ad9a6453cf42c83"><enum>(A)</enum><text>Diversions of surface water and groundwater to the Rio Chama bosque for immediate and essential restoration and maintenance of the bosque.</text></subparagraph><subparagraph id="id9784c6fcfc064bfaa4440c000a368f5f"><enum>(B)</enum><text>Fulfillment of the contribution of the Pueblo under the Agreement for improvements to senior acequias on Pueblo Land supplying water to the Pueblo and non-Indians.</text></subparagraph><subparagraph id="id284a671955d247ce86bcf2963bbcdd4b"><enum>(C)</enum><text>Establishment and operation of the water rights management administrative department of the Pueblo.</text></subparagraph><subparagraph id="idb61402b1dd6449c6904e23bd83b6e9a2"><enum>(D)</enum><text>Acquisition of water rights.</text></subparagraph><subparagraph id="idc324dd3995ed4cbc9a9636c46491c012"><enum>(E)</enum><text>Development of water infrastructure plans, preparing environmental compliance documents, and water project engineering and construction.</text></subparagraph></paragraph></subsection><subsection id="id6b9ecc0792604716a14c1d0dcdedcedd"><enum>(e)</enum><header>Withdrawals</header><paragraph id="id7482805b2b6d45bf86c69867ed60cf22"><enum>(1)</enum><header>Withdrawals under the American Indian Trust Fund Management Reform Act of 1994</header><subparagraph id="idd19cd58ca8e54d9c8015a42e954b195c"><enum>(A)</enum><header>In general</header><text>The Pueblo may withdraw any portion of the amounts in the Trust Fund on approval by the Secretary of a Tribal management plan submitted by the Pueblo in accordance with the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>).</text></subparagraph><subparagraph id="idecdef307ae944ef5a25ffba1dc667806"><enum>(B)</enum><header>Requirements</header><text>In addition to the requirements under the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>), the Tribal management plan under subparagraph (A) shall require that the Pueblo shall spend all amounts withdrawn from the Trust Fund, and any investment earnings (including interest) earned on those amounts through the investments under the Tribal management plan, in accordance with this Act.</text></subparagraph><subparagraph id="idb3e3041738374087905f58645453b6f7"><enum>(C)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary to enforce the Tribal management plan under subparagraph (A) to ensure that amounts withdrawn by the Pueblo from the Trust Fund under that subparagraph are used in accordance with this Act.</text></subparagraph></paragraph><paragraph id="id4678c72cb546429798b0dd4c4acd42ca"><enum>(2)</enum><header>Withdrawals under expenditure plan</header><subparagraph id="id3eed62e5dce24554936d954016ce5c73"><enum>(A)</enum><header>In general</header><text>Ohkay Owingeh may submit to the Secretary a request to withdraw funds from the Trust Fund pursuant to an approved expenditure plan.</text></subparagraph><subparagraph id="idac5e5720291347af94e9384cc03257d7"><enum>(B)</enum><header>Requirements</header><text>To be eligible to withdraw amounts under an expenditure plan under subparagraph (A), the Pueblo shall submit to the Secretary an expenditure plan for any portion of the Trust Fund the Pueblo elects to withdraw pursuant to that subparagraph, subject to the condition that the amounts shall be used for the purposes described in this Act.</text></subparagraph><subparagraph id="idd9d34d305a85425b9202e1ad7685fa7e"><enum>(C)</enum><header>Inclusions</header><text>An expenditure plan under subparagraph (A) shall include a description of the manner and purpose for which the amounts proposed to be withdrawn from the Trust Fund will be used by Ohkay Owingeh, in accordance with this subsection and subsection (g).</text></subparagraph><subparagraph id="id7bedb190ef9e4fb993090d31fa37946d"><enum>(D)</enum><header>Approval</header><text>The Secretary shall approve an expenditure plan submitted under subparagraph (A) if the Secretary determines that the plan—</text><clause id="id23deb06acac541f793a58be1f14c7989"><enum>(i)</enum><text>is reasonable; and</text></clause><clause id="id37966a7047454fe5b99db26c50af6481"><enum>(ii)</enum><text>is consistent with, and will be used for, the purposes of this Act.</text></clause></subparagraph><subparagraph id="id9b7fdd09099c45a08b33b58f563b5119"><enum>(E)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary to enforce an expenditure plan to ensure that amounts disbursed under this paragraph are used in accordance with this Act.</text></subparagraph></paragraph></subsection><subsection id="idc5539eb7c8ad4ba4852e99909b9ecd40"><enum>(f)</enum><header>Effect of section</header><text>Nothing in this section gives Ohkay Owingeh the right to judicial review of a determination of the Secretary relating to whether to approve a Tribal management plan under paragraph (1) of subsection (e) or an expenditure plan under paragraph (2) of that subsection, except under subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>).</text></subsection><subsection id="ida2a4dd9ab5484d83b5c99e11f204c40d"><enum>(g)</enum><header>Uses</header><text>The Trust Fund may only be used for the following purposes:</text><paragraph id="id095e0237e70f448a87229314d76eec7d"><enum>(1)</enum><text>Planning, permitting, designing, engineering, constructing, reconstructing, replacing, rehabilitating, operating, or repairing water production, treatment, or delivery infrastructure, including for domestic and municipal supply or wastewater infrastructure.</text></paragraph><paragraph id="id49c3f3c1d9fe406b9f0f054622750254"><enum>(2)</enum><text>Planning, permitting, designing, engineering, constructing, reconstructing, replacing, rehabilitating, operating, or repairing water production, treatment, or delivery infrastructure, acquisition of water, or on-farm improvements for irrigation, livestock, and support of agriculture.</text></paragraph><paragraph id="id7fbe8fcd119740e4ba834709e2297292"><enum>(3)</enum><text>Planning, permitting, designing, engineering, constructing, reconstructing, replacing, rehabilitating, operating, monitoring or other measures for watershed and endangered species habitat protection, bosque restoration or improvement (including any required cost shares for and allowable contributions to a Federal project or program), land and water rights acquisition, water-related Pueblo community welfare and economic development, and costs relating to implementation of the Agreement.</text></paragraph><paragraph id="id18a45e8d265b4d62a5175b8710b61368"><enum>(4)</enum><text>The management and administration of any water rights of the Pueblo.</text></paragraph><paragraph id="id3014b2839104472dbce189649fd5c838"><enum>(5)</enum><text>Ensuring environmental compliance in the development and construction of projects under this Act.</text></paragraph></subsection><subsection id="ide1adb40b3663408cb2cb946f00b71763"><enum>(h)</enum><header>Liability</header><text>The Secretary and the Secretary of the Treasury shall not be liable for the expenditure or investment of any amounts withdrawn from the Trust Fund by the Pueblo under paragraph (1) or (2) of subsection (e).</text></subsection><subsection id="id63b1801b6dc84827906bc2366789e226"><enum>(i)</enum><header>Expenditure reports</header><text>Ohkay Owingeh shall annually submit to the Secretary an expenditure report describing accomplishments and amounts spent from use of withdrawals under a Tribal management plan or an expenditure plan under paragraph (1) or (2) of subsection (e), as applicable.</text></subsection><subsection id="id882eba99c8144450870fbbc153a12fc8"><enum>(j)</enum><header>No per capita distributions</header><text>No portion of the Trust Fund shall be distributed on a per capita basis to any member of Ohkay Owingeh.</text></subsection><subsection id="id305c26b2c1ed4a18ada9b9e74f4569ee"><enum>(k)</enum><header>Title to infrastructure</header><text>Title to, control over, and operation of any project constructed using funds from the Trust Fund shall remain in Ohkay Owingeh, except that title to projects that are improved with funds from the Trust Fund for the mutual benefit of the Pueblo and non-Indians, on property owned by non-Indians, shall remain with the underlying non-Indian owner.</text></subsection><subsection id="id70534a072ec742608b2598b8790202d6"><enum>(l)</enum><header>Operation, maintenance, and replacement</header><text>All operation, maintenance, and replacement costs of any project constructed using funds from the Trust Fund shall be the responsibility of Ohkay Owingeh.</text></subsection></section><section id="id221487b35ba14b9c9b4133d927cbee04"><enum>7.</enum><header>Funding</header><subsection id="id1222077a0ab54679a4958609fe4bdfed"><enum>(a)</enum><header>Mandatory appropriations</header><text>Out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary for deposit in the Trust Fund $745,000,000, to remain available until expended, withdrawn, or reverted to the general fund of the Treasury.</text></subsection><subsection id="ida2ec1c0b44344d179920a9489ccbda5c"><enum>(b)</enum><header>Fluctuation in costs</header><paragraph id="id3163fc7c5d7e4018bf9eb736529a59a9"><enum>(1)</enum><header>In general</header><text>The amount appropriated under subsection (a) shall be increased or decreased, as appropriate, by such amounts as may be justified by reason of ordinary fluctuations in costs, as indicated by the Bureau of Reclamation Construction Cost Index–Composite Trend.</text></paragraph><paragraph id="idd1e9f0d424dc4618b656cb34140987d6"><enum>(2)</enum><header>Construction costs adjustment</header><text>The amount appropriated under subsection (a) shall be adjusted to address construction cost changes necessary to account for unforeseen market volatility that may not otherwise be captured by engineering cost indices, as determined by the Secretary, including repricing applicable to the types of construction and current industry standards involved.</text></paragraph><paragraph id="id9e6bc0d0ed2f422ebe6a8c1f1a8cfbc2"><enum>(3)</enum><header>Repetition</header><text>The adjustment process under this subsection shall be repeated for each subsequent amount appropriated until the applicable amount, as adjusted, has been appropriated.</text></paragraph><paragraph id="ida69cc317f35f45f299325cfe0c5f88e3"><enum>(4)</enum><header>Period of indexing</header><text>The period of indexing adjustment under this subsection for any increment of funding shall start on June 1, 2023, and end on the date on which the funds are deposited in the Trust Fund.</text></paragraph></subsection><subsection id="id163738f652de422aab0de4b6baf9162d"><enum>(c)</enum><header>State cost share</header><text>Pursuant to the Agreement, the State shall contribute—</text><paragraph id="idcca60823874b44678bd25fcb77b4b132"><enum>(1)</enum><text>$98,500,000, as adjusted for inflation pursuant to the Agreement, for Signatory Acequias ditch improvements, projects, and other purposes described in the Agreement;</text></paragraph><paragraph id="idd80d7addeeeb4c35bb81c04fdf7d9799"><enum>(2)</enum><text>$32,000,000, as adjusted for inflation pursuant to the Agreement, for the City of Española for water system improvement projects; and</text></paragraph><paragraph id="id092ae9d6ac834e0bb5241fea7de5fdf4"><enum>(3)</enum><text>$500,000, to be deposited in an interest-bearing account, to mitigate impairment to non-Pueblo domestic and livestock groundwater rights as a result of new Pueblo water use.</text></paragraph></subsection></section><section id="idcc278d6078354261b5a500291cd781a0"><enum>8.</enum><header>Enforceability Date</header><text display-inline="no-display-inline">The Enforceability Date shall be the date on which the Secretary publishes in the Federal Register a statement of findings that—</text><paragraph id="id96e29f248e2848e38c03aac90808743b"><enum>(1)</enum><text>to the extent that the Agreement conflicts with this Act, the Agreement has been amended to conform with this Act;</text></paragraph><paragraph id="id7fb839710ae14cbba3ec9f23be6c0c0c"><enum>(2)</enum><text>the Agreement, as amended, has been executed by all parties to the Agreement, including the United States;</text></paragraph><paragraph id="id9f65477ec81c49169b4b96c97ac8cf92"><enum>(3)</enum><text>the United States District Court for the District of New Mexico has approved the Agreement and has entered a Partial Final Judgment and Decree;</text></paragraph><paragraph id="id758489efeda4405c9091521074cd1fa0"><enum>(4)</enum><text>all the amounts appropriated under section 7(a) have been appropriated and deposited in the Trust Fund;</text></paragraph><paragraph id="idf93717f883be4429908cc900cc86ba75"><enum>(5)</enum><text>the State has—</text><subparagraph id="id9e896dc41a31402d9c37116291ecd3e5"><enum>(A)</enum><text>provided the funding under section 7(c)(1) or entered into a funding agreement with the intended beneficiary for that funding;</text></subparagraph><subparagraph id="id9dd8544b148a48979c695826c7989181"><enum>(B)</enum><text>provided the funding under section 7(c)(2) or entered into a funding agreement with the intended beneficiary for that funding;</text></subparagraph><subparagraph id="id8eec07471c6140bcb1f2597e939d8e73"><enum>(C)</enum><text>provided the funding under section 7(c)(3) and deposited that amount into the appropriate funding account; and</text></subparagraph><subparagraph id="id299eaa627f2049da862b9670be429806"><enum>(D)</enum><text>enacted legislation to amend State law to provide that the Pueblo Water Rights may be leased for a term not to exceed 99 years, including renewals; and</text></subparagraph></paragraph><paragraph id="idd4314c2923984bfdbefce62462ed81c7"><enum>(6)</enum><text>the waivers and releases under section 9 have been executed by Ohkay Owingeh and the Secretary.</text></paragraph></section><section id="id6b40ae3972844967a025a28f44f5d558"><enum>9.</enum><header>Waivers and releases of claims</header><subsection id="idff03805cd4f444a4a727ab901321d278"><enum>(a)</enum><header>Waivers and releases of claims by Ohkay Owingeh and United States as trustee for Ohkay Owingeh</header><text>Subject to the reservation of rights and retention of claims under subsection (d), as consideration for recognition of the Pueblo Water Rights and other benefits described in the Agreement and this Act, Ohkay Owingeh and the United States, acting as trustee for Ohkay Owingeh, shall execute a waiver and release of all claims for—</text><paragraph id="id8830392c766d4b08b6868b2b887f79bb"><enum>(1)</enum><text>water rights within the Rio Chama Stream System that Ohkay Owingeh, or the United States acting as trustee for Ohkay Owingeh, asserted or could have asserted in any proceeding, including the Adjudication, on or before the Enforceability Date, except to the extent that such rights are recognized in the Agreement and this Act; and</text></paragraph><paragraph id="idffe3cac1e3764420a3d4d547d59abd7e"><enum>(2)</enum><text>damages, losses, or injuries to water rights or claims of interference with, diversion of, or taking of water rights (including claims for injury to land resulting from such damages, losses, injuries, interference, diversion, or taking of water rights) in the Rio Chama Stream System that accrued at any time up to and including the Enforceability Date.</text></paragraph></subsection><subsection id="id1f5ddf46597b4077bb2acde19b8cd130"><enum>(b)</enum><header>Waivers and releases of claims by Ohkay Owingeh against the United States</header><text>Subject to the reservation of rights and retention of claims under subsection (d), Ohkay Owingeh shall execute a waiver and release of all claims against the United States (including any agency or employee of the United States) for water rights within the Rio Chama Stream System first arising before the Enforceability Date relating to—</text><paragraph id="ide9f9bfae7ef44ecb8ea3e93017fa422b"><enum>(1)</enum><text>water rights within the Rio Chama Stream System that the United States, acting as trustee for Ohkay Owingeh, asserted or could have asserted in any proceeding, including the Adjudication, except to the extent that such rights are recognized as part of the Pueblo Water Rights under this Act;</text></paragraph><paragraph id="iddf805d36d63c4fb9863c104a40bbd9a5"><enum>(2)</enum><text>foregone benefits from non-Pueblo use of water, on and off Pueblo Land (including water from all sources and for all uses), within the Rio Chama Stream System;</text></paragraph><paragraph id="id6a1a3d1408464ee6b91d554df3de282e"><enum>(3)</enum><text>damage, loss, or injury to water, water rights, land, or natural resources due to loss of water or water rights (including damages, losses, or injuries to hunting, fishing, gathering, or cultural rights due to loss of water or water rights, claims relating to interference with, diversion of, or taking of water, or claims relating to a failure to protect, acquire, replace, or develop water, water rights, or water infrastructure) within the Rio Chama Stream System;</text></paragraph><paragraph id="idf37d513fda9f44d2813d593bb36c6335"><enum>(4)</enum><text>failure to establish or provide a municipal, rural, or industrial water delivery system on Pueblo Land within the Rio Chama Stream System;</text></paragraph><paragraph id="idcadca576219e4f53b2e15ce1614e5064"><enum>(5)</enum><text>damage, loss, or injury to water, water rights, land, or natural resources due to construction, operation, and management of irrigation projects on Pueblo Land or Federal land and facilities (including damages, losses, or injuries to fish habitat, wildlife, and wildlife habitat) within the Rio Chama Stream System;</text></paragraph><paragraph id="ida537ab54086d4c9eb3a680dea2f6992e"><enum>(6)</enum><text>failure to provide for operation, maintenance, or deferred maintenance for any irrigation system or irrigation project within the Rio Chama Stream System;</text></paragraph><paragraph id="idc60d9863436844ccbbd2c995460128ac"><enum>(7)</enum><text>failure to provide a dam safety improvement to a dam on Pueblo Land within the Rio Chama Stream System;</text></paragraph><paragraph id="id6559393bd9cf48c28785d66077d34de5"><enum>(8)</enum><text>damage, loss, or injury to the bosque area of the Rio Chama due to the construction, operation, and maintenance of Abiquiu Dam and its associated infrastructure and resulting Rio Chama flow management;</text></paragraph><paragraph id="id9f75cb2291a442a5b3f5b47174688cca"><enum>(9)</enum><text>the litigation of claims relating to any water right of Ohkay Owingeh within the Rio Chama Stream System;</text></paragraph><paragraph id="ideb5742592011470f973a93c5a4013cdc"><enum>(10)</enum><text>the taking of the bosque property of the Pueblo within the Pueblo Grant on the Rio Chama and Rio Grande as asserted in Ohkay Owingeh v. United States, No. 22–1607L (Court of Federal Claims);</text></paragraph><paragraph id="id2bba62de7d9240dda9174bfcafd64064"><enum>(11)</enum><text>failure of the United States to acknowledge and protect aboriginal rights to water in the Rio Chama Stream System;</text></paragraph><paragraph id="id32d703c4d7874e2d863705650eaae5e4"><enum>(12)</enum><text>the failure of the United States to develop the irrigation water resources in the Rio Chama Stream System on the Pueblo Grant, including failure to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id25e584ba734849ccb68fdd38f26cd1a6"><enum>(A)</enum><text display-inline="yes-display-inline">construct and deliver water through the Highline Canal;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3910ee3f90614ae2900b7084b4651c0f"><enum>(B)</enum><text display-inline="yes-display-inline">make improvements to the Chamita Ditch; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide260fd041295442680fad6229a58bd4a"><enum>(C)</enum><text display-inline="yes-display-inline">repurchase arable land unlawfully obtained by non-Indians;</text></subparagraph></paragraph><paragraph id="id4a965c54bb30453dbbfad64fa582e9ca"><enum>(13)</enum><text>the failure of the United States to prevent or remedy non-Indians’ trespass on or seizure of arable Pueblo lands in the Rio Chama Stream System on the Pueblo Grant; and</text></paragraph><paragraph id="id33b2dacf8c384334a218d2053aa28847"><enum>(14)</enum><text>the negotiation, execution, or adoption of the Agreement (including exhibits) and this Act.</text></paragraph></subsection><subsection id="idc1232053acb245cfa41827e83d534b05"><enum>(c)</enum><header>Effective date</header><text>The waivers and releases described in subsections (a) and (b) shall take effect on the Enforceability Date.</text></subsection><subsection id="id4febc54224514d15a21591cfc833074d"><enum>(d)</enum><header>Reservation of rights and retention of claims</header><text>Notwithstanding the waivers and releases under subsections (a) and (b), the Pueblo and the United States, acting as trustee for Ohkay Owingeh, shall retain all claims relating to—</text><paragraph id="id2c40d349273947ccbad4d2dcc24d026a"><enum>(1)</enum><text>the enforcement of, or claims accruing after the Enforceability Date relating to, water rights recognized under the Agreement, this Act, or the Partial Final Judgment and Decree entered in the Adjudication;</text></paragraph><paragraph id="idf90f9cdbbca54a04a8455de945808ff7"><enum>(2)</enum><text>activities affecting the quality of water, including claims under—</text><subparagraph id="idad687dcdc2b440eba3321f7edd345a02"><enum>(A)</enum><text>the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>), including claims for damages to natural resources;</text></subparagraph><subparagraph id="id98c8437379f944b98f6dfb84b8030710"><enum>(B)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>);</text></subparagraph><subparagraph id="ida028605877d64c30804bc067d6f5b4c2"><enum>(C)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id96b5234841244be584d4557dbf57b57c"><enum>(D)</enum><text>any regulations implementing the Acts described in subparagraphs (A) through (C);</text></subparagraph></paragraph><paragraph id="id75ec5d74be1d4aa2a591a2f96171e960"><enum>(3)</enum><text>the right to use and protect water rights acquired after the date of enactment of this Act;</text></paragraph><paragraph id="id5ef15a5219fe45bc8970f0a511d45caf"><enum>(4)</enum><text>damage, loss, or injury to land or natural resources that is not due to loss of water or water rights, including hunting, fishing, gathering, or cultural rights;</text></paragraph><paragraph id="ide460ba4ccbdc48db8518d543ba39ab64"><enum>(5)</enum><text>all rights, remedies, privileges, immunities, and powers not specifically waived and released pursuant to this Act or the Agreement; and</text></paragraph><paragraph id="idec639818c69740d5b118ca66f72bcda6"><enum>(6)</enum><text>loss of water or water rights in locations outside of the Rio Chama Stream System.</text></paragraph></subsection><subsection id="id016d02f309e84e5e9e2337e3be612c20"><enum>(e)</enum><header>Effect of Agreement and Act</header><text>Nothing in the Agreement or this Act—</text><paragraph id="id1771fe6cb64340e4863237db72b5b786"><enum>(1)</enum><text>reduces or extends the sovereignty (including civil and criminal jurisdiction) of any government entity;</text></paragraph><paragraph id="idbbe8b63c01ed4f0ab2696ad2f2b4423f"><enum>(2)</enum><text>affects the ability of the United States, as sovereign, to carry out any activity authorized by law, including—</text><subparagraph id="id8c7f65d9be7a4901985befa847fa3c17"><enum>(A)</enum><text>the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>);</text></subparagraph><subparagraph id="ida9b360fcd32146d5a39ce5f746fb575c"><enum>(B)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>);</text></subparagraph><subparagraph id="idd068290940884a57b0c4a5b62f752cb1"><enum>(C)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>);</text></subparagraph><subparagraph id="id547713be46e849a898e183c5ab3a833b"><enum>(D)</enum><text>the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id3d07108a579442099a607f98ae668152"><enum>(E)</enum><text>any regulations implementing the Acts described in subparagraphs (A) though (D);</text></subparagraph></paragraph><paragraph id="idd542eb3b7e7b45b8b0e17d82f3cc2696"><enum>(3)</enum><text>affects the ability of the United States to act as trustee for the Pueblo (consistent with this Act), any other pueblo or Indian Tribe, or an allottee of any other pueblo or Indian Tribe;</text></paragraph><paragraph id="id5023d6a83b7a4406ac2c72b147f3789d"><enum>(4)</enum><text>confers jurisdiction on any State court—</text><subparagraph id="idf149a905738c47749fb89d59d8b5b25a"><enum>(A)</enum><text>to interpret Federal law relating to health, safety, or the environment;</text></subparagraph><subparagraph id="id345e96e96eed4647a0d6f14b22f2830a"><enum>(B)</enum><text>to determine the duties of the United States or any other party under Federal law relating to health, safety, or the environment;</text></subparagraph><subparagraph id="id13a875193e674852ac573ae7ceced336"><enum>(C)</enum><text>to conduct judicial review of any Federal agency action; or</text></subparagraph><subparagraph id="ide1df75c6a39c40a2b4c343d9a876a917"><enum>(D)</enum><text>to interpret Pueblo law; or</text></subparagraph></paragraph><paragraph id="id5c3c3fd03d70429a813cb99b934d6ae1"><enum>(5)</enum><text>waives any claim of a member of Ohkay Owingeh in an individual capacity that does not derive from a right of the Pueblo.</text></paragraph></subsection><subsection id="idf4973169a1f0487fb99720a6931cdc72"><enum>(f)</enum><header>Tolling of claims</header><paragraph id="id84de986724b04588ab423d3935fdf2be"><enum>(1)</enum><header>In general</header><text>Each applicable period of limitation and time-based equitable defense relating to a claim described in this section shall be tolled for the period beginning on the date of enactment of this Act and ending on the Enforceability Date.</text></paragraph><paragraph id="id5dc870f5d99943ab956c67e33cd7377e"><enum>(2)</enum><header>Effect of subsection</header><text>Nothing in this subsection revives any claim or tolls any period of limitation or time-based equitable defense that expired before the date of enactment of this Act.</text></paragraph><paragraph id="idb3957f3c569842e0909756406fd67158"><enum>(3)</enum><header>Limitation</header><text>Nothing in this section precludes the tolling of any period of limitation or any time-based equitable defense under any other applicable law.</text></paragraph></subsection><subsection id="idfe365b66293f4970aa53f93f0c471d43"><enum>(g)</enum><header>Expiration</header><paragraph id="iddd000d599c8d4cb3be4284b66dc8464f"><enum>(1)</enum><header>In general</header><text>This Act shall expire in any case in which the Secretary fails to publish a statement of findings under section 8 by not later than—</text><subparagraph id="id26fe2e0739c247f0a044cc82174f3236"><enum>(A)</enum><text>July 1, 2038; or</text></subparagraph><subparagraph id="id1a237b3276fa42c6b8b503e5c22bac10"><enum>(B)</enum><text>such alternative later date as is agreed to by Ohkay Owingeh and the Secretary, after providing reasonable notice to the State.</text></subparagraph></paragraph><paragraph id="id89ef064fd37f407ab883f87fee214e5b"><enum>(2)</enum><header>Consequences</header><text>If this Act expires under paragraph (1)—</text><subparagraph id="idb7b7f84bcce6474a947852c6de3bd4a6"><enum>(A)</enum><text>the waivers and releases under subsections (a) and (b) shall—</text><clause id="id813b48c7505f44cb91971f006656f2a8"><enum>(i)</enum><text>expire; and</text></clause><clause id="id8a479f3945b24cdf9d75ecb3c46224f8"><enum>(ii)</enum><text>have no further force or effect;</text></clause></subparagraph><subparagraph id="id9669c97e5fc64338b5e5501fcfc49e2c"><enum>(B)</enum><text>the authorization, ratification, confirmation, and execution of the Agreement under section 4 shall no longer be effective;</text></subparagraph><subparagraph id="id0f55f2a9e1d64e2580e0482d8a6158c9"><enum>(C)</enum><text>any action carried out by the Secretary, and any contract or agreement entered into, pursuant to this Act shall be void;</text></subparagraph><subparagraph id="id50dc11880df14a33903c327a45c2fb3d"><enum>(D)</enum><text>any unexpended Federal funds appropriated or made available to carry out the activities authorized by this Act, together with any interest earned on those funds, and any water rights or contracts to use water and title to other property acquired or constructed with Federal funds appropriated or made available to carry out the activities authorized by this Act shall be returned to the Federal Government, unless otherwise agreed to by Ohkay Owingeh and the United States and approved by Congress; and</text></subparagraph><subparagraph id="ida9dda4890ce6414bad91c9a0ae8c90f6"><enum>(E)</enum><text>except for Federal funds used to acquire or construct property that is returned to the Federal Government under subparagraph (D), the United States shall be entitled to offset any Federal funds made available to carry out this Act that were expended or withdrawn, or any funds made available to carry out this Act from other Federal authorized sources, together with any interest accrued on those funds, against any claims against the United States—</text><clause id="idd329962c1b1142cfb01c3c58c28e4bdb"><enum>(i)</enum><text>relating to—</text><subclause id="idc1fa7018ccbe4208a7303050c6a74074"><enum>(I)</enum><text>water rights in the State asserted by—</text><item id="id93b1525262a24c0382bd2adb6867237e"><enum>(aa)</enum><text>Ohkay Owingeh; or</text></item><item id="id486fbbfb61cc4a078f33b456febe018e"><enum>(bb)</enum><text>any user of the Pueblo Water Rights; or</text></item></subclause><subclause id="id9e2cecc4dd0d450897a086a42e8f9c49"><enum>(II)</enum><text>any other matter covered by subsection (b); or</text></subclause></clause><clause id="id8840da5dcdc54c43a1df99ccbe5bb538"><enum>(ii)</enum><text>in any future settlement of water rights of Ohkay Owingeh.</text></clause></subparagraph></paragraph></subsection></section><section id="ide53906073d68401faeca0e8dab5e214a"><enum>10.</enum><header>Satisfaction of claims</header><text display-inline="no-display-inline">The benefits provided under this Act shall be in complete replacement of, complete substitution for, and full satisfaction of any claim of Ohkay Owingeh against the United States that is waived and released by Ohkay Owingeh pursuant to section 9(b).</text></section><section id="id5a4f751ed7694c9ead94fe5f66d4fd2b"><enum>11.</enum><header>Miscellaneous provisions</header><subsection id="id893f84a86d554cdc9f2e693d180491b9"><enum>(a)</enum><header>No waiver of sovereign immunity by the United States</header><text>Nothing in this Act waives the sovereign immunity of the United States.</text></subsection><subsection id="id68da0f5b8dd84696924fa9c7b5000881"><enum>(b)</enum><header>Other Tribes not adversely affected</header><text>Nothing in this Act quantifies or diminishes any land or water right, or any claim or entitlement to land or water, of an Indian Tribe, band, pueblo, or community other than Ohkay Owingeh.</text></subsection><subsection id="id88f7a2bb6f384c83a051d36484e59b30"><enum>(c)</enum><header>Effect on current law</header><text>Nothing in this Act affects any provision of law (including regulations) in effect on the day before the date of enactment of this Act with respect to pre-enforcement review of any Federal environmental enforcement action.</text></subsection><subsection id="idd91aa3306cb64b4db4b6f423aa97c0ff"><enum>(d)</enum><header>Conflict</header><text>In the event of a conflict between the Agreement and this Act, this Act shall control.</text></subsection><subsection id="id2e0e4f0554e24b01a699e483d5ae9183"><enum>(e)</enum><header>Hold harmless</header><text>For any bosque restoration or improvement project carried out by the Pueblo with funds appropriated under this Act, the Pueblo shall hold and save the United States free from damages due to the construction or operation and maintenance of the project.</text></subsection></section><section id="id554cb2e722754beaa19fe3129acfe73c"><enum>12.</enum><header>Antideficiency</header><text display-inline="no-display-inline">The United States shall not be liable for any failure to carry out any obligation or activity authorized by this Act, including any obligation or activity under the Agreement, if adequate appropriations are not provided expressly by Congress to carry out the purposes of this Act.</text></section></legis-body></bill>
