which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To repeal the small business loan data collection requirements under the Equal Credit Opportunity Act.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HCE80BD1782034DB1879A1B8A91D24159"><section section-type="section-one" id="H20C045B1CF564E46926EB11EF06897E5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>1071 Repeal to Protect Small Business Lending Act</short-title></quote>.</text></section><section id="H4BB2F98660BB4AA3BE471B78B1200A71"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HB60CF111A0BA4D458324886DB3EE616C"><enum>(1)</enum><text display-inline="yes-display-inline">Section 704B of the Equal Credit Opportunity Act, as added by section 1071 of the Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/203">Public Law 111–203</external-xref>; 124 Stat. 2056), imposes data collection and reporting requirements on financial institutions regarding small business loans.</text></paragraph><paragraph id="H08F3CDC450A6408EB9FB1AFD4952AC4D"><enum>(2)</enum><text>These requirements have resulted in increased compliance costs for financial institutions, potentially reducing access to credit for small businesses.</text></paragraph><paragraph id="H8BA21B40A94B4ADB811000FC4AC9F48D"><enum>(3)</enum><text>The regulatory burdens created by these requirements disproportionately impact smaller financial institutions, such as community banks and credit unions, which are critical to small business lending.</text></paragraph><paragraph id="H8DF54653C1684999BC8E15B078FF1D7D"><enum>(4)</enum><text>Repealing these requirements will reduce regulatory barriers and support greater access to credit for small businesses.</text></paragraph></section><section id="H8C12F69A72E349E882F4260E33BB914E"><enum>3.</enum><header>Repeal of the small business loan data collection requirements</header><subsection id="HECC26B9095484C9D8A670270F98903CF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 704B of the Equal Credit Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1691c-2">15 U.S.C. 1691c–2</external-xref>) is repealed.</text></subsection><subsection id="H44087D10DB544BC5A57A9876AADDBC84"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="HACE1CCE7BCAE4530BCF2C4E554792474"><enum>(1)</enum><header>Dodd-Frank Wall Street Reform and Consumer Protection Act</header><text display-inline="yes-display-inline">The Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5301">12 U.S.C. 5301 et seq.</external-xref>) is amended—</text><subparagraph id="HE32A34F300494402891772BB55A21875"><enum>(A)</enum><text>in the table of contents in section 1(b) of such Act, by striking the item relating to section 1071; and</text></subparagraph><subparagraph id="HEBB7C8CEA70C4D7FBF6BA205A33EEEF3"><enum>(B)</enum><text>by striking section 1071 (<external-xref legal-doc="public-law" parsable-cite="pl/111/203">Public Law 111–203</external-xref>; 124 Stat. 1056).</text></subparagraph></paragraph><paragraph id="H4D60F907B29E458EA078E4569F179730"><enum>(2)</enum><header>Equal Credit Opportunity Act</header><text display-inline="yes-display-inline">The Equal Credit Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1691">15 U.S.C. 1691 et seq.</external-xref>) is amended—</text><subparagraph id="H09848A91D6624A9A81C32FF09475654F"><enum>(A)</enum><text>in the table of contents for such Act, by striking the item relating to section 704B; and</text></subparagraph><subparagraph id="HA3A56C6DD06F474984B4A780FE96E093"><enum>(B)</enum><text>in section 701(b) (<external-xref legal-doc="usc" parsable-cite="usc/15/1691">15 U.S.C. 1691(b)</external-xref>)—</text><clause id="HE0F63731324F4B889A0D69C96316562D"><enum>(i)</enum><text>in paragraph (3), by adding <quote>or</quote> at the end;</text></clause><clause id="H26102801BEBD45E8AE6722893C1EEF59"><enum>(ii)</enum><text>in paragraph (4), by striking <quote>; or</quote> and inserting a period; and</text></clause><clause id="H79C9938EE7FB4625B0ED1D94A4EBA7DE"><enum>(iii)</enum><text>by striking paragraph (5).</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
