<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 542</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250212">February 12, 2025</action-date><action-desc><sponsor name-id="S434">Mr. Moreno</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To declare English as the official language of the United States, to establish a uniform English language rule for naturalization, and to avoid misconstructions of the English language texts of the laws of the United States, pursuant to Congress’ powers to provide for the general welfare of the United States and to establish a uniform rule of naturalization under article I, section 8, of the Constitution.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="H9DDF304057DD462B9BA4DD620027ACA9"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>English Language Unity Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HD592CADCB499492FB353A53D8736D808"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds and declares the following:</text><paragraph commented="no" display-inline="no-display-inline" id="HE85C636F36B94E2BB86BA42595D75B6F"><enum>(1)</enum><text display-inline="yes-display-inline">The United States is comprised of individuals from diverse ethnic, cultural, and linguistic backgrounds.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5B1619A272A84675B1F9FF91306800D5"><enum>(2)</enum><text display-inline="yes-display-inline">Throughout the history of the United States, a common thread binding citizens of differing backgrounds has been the English language.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1A6F1B3DC73E47ED875C474DCCF4383C"><enum>(3)</enum><text display-inline="yes-display-inline">Among the powers reserved to the States respectively is the power to establish the English language as the official language of the respective States, and otherwise to promote the English language within the respective States, subject to the prohibitions enumerated in the Constitution of the United States and in laws of the respective States.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H65D94BAD2DFE46E283C2121BB217B0F3"><enum>3.</enum><header display-inline="yes-display-inline">English as official language of the United States</header><subsection commented="no" display-inline="no-display-inline" id="HCAE9B35A9ABA4220857827A7AC3AC14"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title 4, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H7739B61C09C24AF98C02CCA3785F24A8"><chapter commented="no" level-type="subsequent" id="H16571BD07E4A467DBA83B538A219A133"><enum>6</enum><header display-inline="yes-display-inline">Official language</header><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H9D248EB33D214EEB92B8A8B7B73C3322"><enum>161.</enum><header display-inline="yes-display-inline">Official language of the United States</header><text display-inline="no-display-inline">The official language of the United States is English.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H039E3297E60043D797C801AD6511002D"><enum>162.</enum><header display-inline="yes-display-inline">Preserving and enhancing the role of the official language</header><text display-inline="no-display-inline">Representatives of the Federal Government shall have an affirmative obligation to preserve and enhance the role of English as the official language of the Federal Government. Such obligation shall include encouraging greater opportunities for individuals to learn the English language.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H440E4AC2052C4C64A15C52B87B91E035"><enum>163.</enum><header display-inline="yes-display-inline">Official functions of Government to be conducted in English</header><subsection commented="no" display-inline="no-display-inline" id="H0EB4403C755B47DEB34900325979E636"><enum>(a)</enum><header display-inline="yes-display-inline">Scope</header><text display-inline="yes-display-inline">For the purposes of this section—</text><paragraph commented="no" display-inline="no-display-inline" id="id7F88A5B4C0A849319EBDB6193CBA1ED5"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>official</term> refers to any function that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idB3361A6A72C94CEAA80E5336CDC32EBB"><enum>(A)</enum><text display-inline="yes-display-inline">binds the Government;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC4BF5CC418484B92A38AAD751D64ABA4"><enum>(B)</enum><text display-inline="yes-display-inline">is required by law; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA70D4BAE7B294872B83F0AD0D6DCBAD2"><enum>(C)</enum><text display-inline="yes-display-inline">is otherwise subject to scrutiny by either the press or the public; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id961A5783515B4F68A8297B6D98A2CE65"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>United States</term> means the several States and the District of Columbia.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5E62D42AD3D949CEAF7CEE85921D7C4F"><enum>(b)</enum><header display-inline="yes-display-inline">Official functions</header><text display-inline="yes-display-inline">The official functions of the Government of the United States shall be conducted in English.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H93E2E53D899046A58C98D53BDCD766A3"><enum>(c)</enum><header display-inline="yes-display-inline">Practical effect</header><text display-inline="yes-display-inline">This section—</text><paragraph commented="no" display-inline="no-display-inline" id="id22FE14635E814CEE9E5CA6942B09A96D"><enum>(1)</enum><text display-inline="yes-display-inline">shall apply to all laws, public proceedings, regulations, publications, orders, actions, programs, and policies; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBD6F6C626E5D492388D464B96EE783DE"><enum>(2)</enum><text display-inline="yes-display-inline">shall not apply to—</text><subparagraph commented="no" display-inline="no-display-inline" id="H3D97D76257A34B31A9C19BF34D8BC3D5"><enum>(A)</enum><text display-inline="yes-display-inline">teaching of languages;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H63E5A43E82954457BD4166B49CD4A7B8"><enum>(B)</enum><text display-inline="yes-display-inline">requirements under the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3D7A8BBD45A6477F84B5B72002478CB"><enum>(C)</enum><text display-inline="yes-display-inline">actions, documents, or policies necessary for national security, international relations, trade, tourism, or commerce;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3751333EBCDD43E2002DB980C86FE0B"><enum>(D)</enum><text display-inline="yes-display-inline">actions or documents that protect the public health and safety;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA77325CBEABE47E78FAEC04D306BA26"><enum>(E)</enum><text display-inline="yes-display-inline">actions or documents that facilitate the activities of the Bureau of the Census in compiling any census of population;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H84EA3B85E91F4EF489294C00623149A6"><enum>(F)</enum><text display-inline="yes-display-inline">actions that protect the rights of victims of crimes or criminal defendants; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF29E473BAFB6497ABEC2AB55BD9F0035"><enum>(G)</enum><text display-inline="yes-display-inline">using terms of art or phrases from languages other than English.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H46B5A1263CAA457191BE79E4817D8947"><enum>164.</enum><header display-inline="yes-display-inline">Uniform English language rule for naturalization</header><subsection commented="no" display-inline="no-display-inline" id="H2436BDEF34324CB2B22EF304D243B74E"><enum>(a)</enum><header display-inline="yes-display-inline">Uniform language testing standard</header><text display-inline="yes-display-inline">All citizens of the United States should be able to read and understand generally the English language text of the Declaration of Independence, the Constitution of the United States, and the laws of the United States made in pursuance of the Constitution of the United States.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HEAE7DD14505643F79207FFDBFDB55D8D"><enum>(b)</enum><header display-inline="yes-display-inline">Ceremonies</header><text display-inline="yes-display-inline">All naturalization ceremonies shall be conducted in English.</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H7E8AD0A6E2384AF99896FDEE97C53B2"><enum>165.</enum><header display-inline="yes-display-inline">Rules of construction</header><text display-inline="no-display-inline">Nothing in this chapter shall be construed—</text><paragraph commented="no" display-inline="no-display-inline" id="H048DA146DDE742BC865D1904CB75BE92"><enum>(1)</enum><text display-inline="yes-display-inline">to prohibit a Member of Congress or any officer or agent of the Federal Government, while performing official functions under section 163, from communicating unofficially through any medium with another person in a language other than English (as long as official functions are performed in English);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3A500817A98F4AAB9D84D47D00818F6B"><enum>(2)</enum><text display-inline="yes-display-inline">to limit the preservation or use of Native Alaskan or Native American languages (as defined in the Native American Languages Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2901">25 U.S.C. 2901 et seq.</external-xref>));</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE96BB9AFAD85492187FD1C69F9C2A976"><enum>(3)</enum><text display-inline="yes-display-inline">to disparage any language or to discourage any person from learning or using a language; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6767EFD9F74C4881A532F83364EFA1B1"><enum>(4)</enum><text display-inline="yes-display-inline">to be inconsistent with the Constitution of the United States.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HCFB547DF7AAC4CA2BAF04C67765423A6"><enum>166.</enum><header display-inline="yes-display-inline">Standing</header><text display-inline="no-display-inline">A person injured by a violation of this chapter may in a civil action (including an action under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/151">chapter 151</external-xref> of title 28) obtain appropriate relief.</text></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H970164BF11E14F65A961724CDC91BDCF"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of chapters at the beginning of title 4, United States Code, is amended by inserting after the item relating to chapter 5 the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H83CC267D1FC94B3200B3F8A96C853197"><toc regeneration="no-regeneration"><toc-entry bold="off" level="chapter">Chapter 6. Official language</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H2A92EA75CBE0451EA53D77E0DF3FA7CD"><enum>4.</enum><header display-inline="yes-display-inline">General rules of construction for English language texts of the laws of the United States</header><subsection commented="no" display-inline="no-display-inline" id="H41B09C36562744E1B7AEE51121419799"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/1/1">Chapter 1</external-xref> of title 1, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H24747D50295F4709A5A0EA5811683998"><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HC23690F59FD14704BE2327211469AEDA"><enum>9.</enum><header display-inline="yes-display-inline">General rules of construction for laws of the United States</header><subsection commented="no" display-inline="no-display-inline" id="HFAAD8B5606A64EF0AD37F99EAB8EE38"><enum>(a)</enum><text display-inline="yes-display-inline">English language requirements and workplace policies, whether in the public or private sector, shall be presumptively consistent with the laws of the United States.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HB07EA0D4C1FB4C54B9776C9D57F68FF0"><enum>(b)</enum><text display-inline="yes-display-inline">Any ambiguity in the English language text of the laws of the United States shall be resolved, in accordance with the last two articles of the Bill of Rights, not to deny or disparage rights retained by the people, and to reserve powers to the States respectively, or to the people.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H0A95E522324046DBA000D8D786FF8CAB"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/1/1">chapter 1</external-xref> of title 1, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/1/8">section 8</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H8C683E318AD04E32848ED13319009F98"><toc regeneration="no-regeneration"><toc-entry bold="off" level="section">9. General rules of construction for laws of the United States.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H795184E9AC2449E0957645DF267D551E"><enum>5.</enum><header display-inline="yes-display-inline">Implementing regulations</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Homeland Security shall issue for public notice and comment a proposed rule for uniform testing English language ability of candidates for naturalization, which shall be based upon the principles that—</text><paragraph commented="no" display-inline="no-display-inline" id="H47B20578297D466481CCE27B66777230"><enum>(1)</enum><text display-inline="yes-display-inline">all citizens of the United States should be able to read and understand generally the English language text of the Declaration of Independence, the Constitution of the United States, and the laws of the United States which are made in pursuance thereof; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H86FC3A59AC584A1DADE5810967076285"><enum>(2)</enum><text display-inline="yes-display-inline">any exceptions to the standard described in paragraph (1) should be limited to extraordinary circumstances.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H78D00493A3E84CAE821F67EF005CC805"><enum>6.</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="no-display-inline">The amendments made by sections 3 and 4 shall take effect on the date that is 180 days after the date of enactment of this Act.</text></section></legis-body></bill>
