which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize the PROTECT Our Children Act of 2008, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PROTECT Our Children Reauthorization Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id65a1f2f4624b47d89f66e32a3e6596fe"><enum>2.</enum><header>Reauthorization</header><subsection commented="no" display-inline="no-display-inline" id="id516367e965064b15ade53bc65812aa2f"><enum>(a)</enum><header>Establishment of National Strategy for Child Exploitation Prevention and Interdiction</header><text>Section 101 of the PROTECT Our Children Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/34/21111">34 U.S.C. 21111</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idcb638998f7f04cc7bb698b9a31d081fb"><enum>(1)</enum><text>in subsection (b), by striking <quote>every second year</quote> and inserting <quote>every fourth year</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida0ec4d77a92a4dab86c59bafebf8d10b"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7EAC497C46854CCC889F4170FB7779F2"><subsection id="id1502b50f94704ee08599de712bb184d2"><enum>(c)</enum><header>Required contents of National Strategy</header><text>The National Strategy established under subsection (a) shall include the following:</text><paragraph id="id7d1087d1c84f4aca99cdeea5746deda2"><enum>(1)</enum><text>An analysis of current trends, challenges, and the overall magnitude of the threat of child exploitation.</text></paragraph><paragraph id="iddec2e055b41b479d968cc656b7519152"><enum>(2)</enum><text>An analysis of future trends and challenges, including new technologies, that will impact the efforts to combat child exploitation.</text></paragraph><paragraph id="id5dd15f33895043c7b725627e2e7efb73"><enum>(3)</enum><text>Goals and strategic solutions to prevent and interdict child exploitation, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id67f0a64c0bd94c64986c46df92142b28"><enum>(A)</enum><text display-inline="yes-display-inline">plans for interagency coordination;</text></subparagraph><subparagraph id="id32999b1668ed4b9f96b7bf1d40304c8f"><enum>(B)</enum><text>engagement with the judicial branches of the Federal Government and State governments;</text></subparagraph><subparagraph id="id6376EDE5C598401C9A053041BC3B0940"><enum>(C)</enum><text>legislative recommendations for combating child exploitation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida0cbac8b3c8c47d69043523cb2d8b5a7"><enum>(D)</enum><text display-inline="yes-display-inline">cooperation with international, State, local, and Tribal law enforcement agencies; and</text></subparagraph><subparagraph id="id91d059cfeea5489798b14f19181c4f82"><enum>(E)</enum><text>engagement with the private sector and other entities involved in efforts to combat child exploitation.</text></subparagraph></paragraph><paragraph id="id594a618c918c410983fb32d7f4c167df"><enum>(4)</enum><text>An analysis of Federal efforts dedicated to combating child exploitation, including—</text><subparagraph id="id9f375e1bea7f489489fa7961724c1a6a"><enum>(A)</enum><text>a review of the policies and work of the Department of Justice and other Federal programs relating to the prevention and interdiction of child exploitation crimes, including training programs, and investigative and prosecution activity; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5199947aac8f496491779aee5d9f5be6"><enum>(B)</enum><text display-inline="yes-display-inline">a description of the efforts of the Department of Justice to cooperate and coordinate with, and provide technical assistance and support to, international, State, local, and Tribal law enforcement agencies and private sector and nonprofit entities with respect to child exploitation prevention and interdiction efforts.</text></subparagraph></paragraph><paragraph id="id390f0519284e433e89fb36175acae50d"><enum>(5)</enum><text>An estimate of the resources required to effectively respond to child exploitation crimes at scale by—</text><subparagraph id="id6F265E4210B84F969000DBC0C619295A"><enum>(A)</enum><text>each ICAC task force;</text></subparagraph><subparagraph id="id04C2A4A5E90544E3A2089188B1A70DEC"><enum>(B)</enum><text>the Federal Bureau of Investigation, including investigators, forensic interviewers, and analysts of victims, witnesses, and forensics;</text></subparagraph><subparagraph id="idA8FACD958A9640E4AA7CC06836C20F1E"><enum>(C)</enum><text>Homeland Security Investigations, including forensic interviewers and analysts of victims, witnesses, and forensics;</text></subparagraph><subparagraph id="id2D12541341794BEF84DB17982BC9CC77"><enum>(D)</enum><text>the United States Marshals Service;</text></subparagraph><subparagraph id="id98E253DE8AF7470BABC82B50605EBF6A"><enum>(E)</enum><text>the United States Secret Service;</text></subparagraph><subparagraph id="idAE1BA51B395543709B247BB7BA715078"><enum>(F)</enum><text>the United States Postal Service;</text></subparagraph><subparagraph id="idA6F02AFDA1A44AE19BA42ABD69BD5AE7"><enum>(G)</enum><text>the criminal investigative offices of the Department of Defense; and</text></subparagraph><subparagraph id="idCDAACBEDD3B14BA4BE66EE1E8D676481"><enum>(H)</enum><text>any component of an agency described in this paragraph.</text></subparagraph></paragraph><paragraph id="ide87680f8c54a4343acc8a0bd87d82222"><enum>(6)</enum><text>A review of the Internet Crimes Against Children Task Force Program, including—</text><subparagraph id="ida9c9eecaab6f4d29bbeb0735a8a872b9"><enum>(A)</enum><text>the number of ICAC task forces and the location of each ICAC task force;</text></subparagraph><subparagraph id="idd3f0bd0ae93448e4a5c8fe24bec1cf3d"><enum>(B)</enum><text>the number of trained personnel at each ICAC task force;</text></subparagraph><subparagraph id="ide67ddc0269e74694861de4ab3027a807"><enum>(C)</enum><text>the amount of Federal grants awarded to each ICAC task force; and</text></subparagraph><subparagraph id="id948b6a58689d42bbb8b4ac07f7754354"><enum>(D)</enum><text>an assessment of the Federal, State, and local cooperation with respect to each ICAC task force, including—</text><clause id="ida18f66110dd44bc08f710d431a89142f"><enum>(i)</enum><text>the number of arrests made by each ICAC task force;</text></clause><clause id="ided907e96875f4f1eb891cdd18819e891"><enum>(ii)</enum><text>the number of criminal referrals to United States attorneys for prosecution;</text></clause><clause id="id369fcb028b68464d8f5f86efbdc81fdd"><enum>(iii)</enum><text>the number of prosecutions and convictions from the referrals described in clause (ii);</text></clause><clause id="id7dfcfe4149f44415b69b314dfc5b573f"><enum>(iv)</enum><text>the number, if available, of local prosecutions and convictions based on ICAC task force investigations; and</text></clause><clause id="id264156289a1e4eaaaede568afd5c8710"><enum>(v)</enum><text>any other information determined by the Attorney General demonstrating the level of Federal, State, Tribal, and local coordination and cooperation.</text></clause></subparagraph></paragraph><paragraph id="id912E38A4880543B494A0EFE97C66A6FE"><enum>(7)</enum><text>An assessment of training needs for each ICAC task force and affiliated agencies.</text></paragraph><paragraph id="idcd11c49775954de48978184346ee4263"><enum>(8)</enum><text>An assessment of Federal investigative and prosecution activity relating to reported incidents of child exploitation crimes that include a number of factors, including—</text><subparagraph id="id40ac8122e5594209aef5c788a5202867"><enum>(A)</enum><text>the number of investigations, arrests, prosecutions and convictions for a crime of child exploitation; and</text></subparagraph><subparagraph id="id2b99d3e518114f9a8a46702847329e5f"><enum>(B)</enum><text>the average sentence imposed and the statutory maximum sentence that could be imposed for each crime of child exploitation.</text></subparagraph></paragraph><paragraph id="id5336abf1e614443c97c481fa3ad0d13b"><enum>(9)</enum><text>A review of all available statistical data indicating the overall magnitude of child pornography trafficking in the United States and internationally, including—</text><subparagraph id="id4b5aab6d86ac491091529e4eafe6bc63"><enum>(A)</enum><text>the number of foreign and domestic suspects observed engaging in accessing and sharing child pornography;</text></subparagraph><subparagraph id="id8cf27ee99d1e40bba79e9ef822e5be1b"><enum>(B)</enum><text>the number of tips or other statistical data from the CyberTipline of the National Center for Missing and Exploited Children and other data indicating the magnitude of child pornography trafficking; and</text></subparagraph><subparagraph id="id6cbd4ce8042f409186be81d254c57eb6"><enum>(C)</enum><text>any other statistical data indicating the type, nature, and extent of child exploitation crime in the United States and abroad.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idb7a61f5170054fb0a586f98b5d666a83"><enum>(b)</enum><header>Establishment of National ICAC Task Force Program</header><text>Section 102 of the PROTECT Our Children Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/34/21112">34 U.S.C. 21112</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idf872afb5506147dbb352df891e762cef"><enum>(1)</enum><text>in subsection (a)(1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id99fc0f67b90d45d2befa0e0c80897b06"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>, Tribal, military,</quote> after <quote>State</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7e7f77f8eefa425d81ece7300605dc08"><enum>(B)</enum><text>by striking <quote>and child obscenity and pornography cases</quote> and inserting <quote>child obscenity and pornography cases, and the identification of child victims</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7b0d67e6fdd84b5e991c6d4851b1afb0"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9b2ddb667a254a4fbb23afebfacd2ed4"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>consult with and consider</quote> and all that follows through <quote>track record of success.</quote> and inserting <quote>, evaluate the task forces funded under the ICAC Task Force Program to determine if those task forces are operating in an effective manner.</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id38f408b2e2754f809ef778a37c185a15"><enum>(B)</enum><text>in paragraph (3)(B)—</text><clause commented="no" display-inline="no-display-inline" id="id4e6484d5dc2b4062bd5e25f1d5c42488"><enum>(i)</enum><text>by striking <quote>establish a new task force</quote> and inserting <quote>establish a new or continue an existing task force</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf2e45ee6b7894f80bdcbc36002647e16"><enum>(ii)</enum><text>by striking <quote>state</quote> and inserting <quote>State</quote>; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8440f245c68e49878065b2672cd6774c"><enum>(C)</enum><text>in paragraph (4)—</text><clause commented="no" display-inline="no-display-inline" id="idf03099f7424445cd9429cd5d6a97d136"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>may</quote> and inserting <quote>shall</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="idbe18c3494c574f5dbbc74039c1081d59"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking subparagraph (B); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id32cbab41971e407fb30b27868a721db1"><enum>(iii)</enum><text>by redesignating subparagraph (C) as subparagraph (B); and</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida51fba9d6b574f11825acc3dede6b42c"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB84B8ADD481A497081A9A99C341B6559"><subsection id="id154cbcae2b8045919911b68a0b32d484"><enum>(c)</enum><header>Limited liability for ICAC task forces</header><paragraph id="id3dcf276898ad4995b6295fa564d8583c"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), a civil claim or criminal charge against an ICAC task force established pursuant to this section and sections 103 and 104, including any law enforcement agency that participates on such a task force or a director, officer, employee, or agent of such a law enforcement agency, arising from the prioritization decisions with respect to leads related to Internet crimes against children described in section 104(8), may not be brought in any Federal or State court.</text></paragraph><paragraph id="id66f0313b31924527b0d8e0f3f8c4fc9d"><enum>(2)</enum><header>Intentional, reckless, or other misconduct</header><text>Paragraph (1) shall not apply to a claim if the ICAC task force or law enforcement agency, or a director, officer, employee, or agent of that law enforcement agency—</text><subparagraph id="id95e58bffa2c44f80911eb56a3f93fce8"><enum>(A)</enum><text>engaged in intentional misconduct; or</text></subparagraph><subparagraph id="idcebc0cfe84f14687a0876dccd95dba1b"><enum>(B)</enum><text>acted, or failed to act—</text><clause id="id195e572f06dc49eea39cc49986d76b61"><enum>(i)</enum><text>with actual malice;</text></clause><clause id="id60e9d9796b32490f980df5a48d98837c"><enum>(ii)</enum><text>with reckless disregard to a substantial risk of causing physical injury without legal justification; or</text></clause><clause id="id8382da0572554866887b4126e4aa2b91"><enum>(iii)</enum><text>for a purpose unrelated to the performance of any responsibility or function under section 104(8).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id54e876026d944cee99f1684191ebc06e"><enum>(c)</enum><header>Purpose of ICAC task forces</header><text>Section 103 of the PROTECT Our Children Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/34/21113">34 U.S.C. 21113</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idbeea881303534901b427f36f6d11d667"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>, and the identification of child victims of those crimes</quote> before the semicolon at the end;</text></paragraph><paragraph id="idf449058212564c6dbcd8ebd507c2b14f"><enum>(2)</enum><text>in paragraph (2), by inserting <quote>and prioritizing investigations that task force personnel, through the background, training and experience of those personnel and the consideration of all relevant circumstances, determine to be most likely to result in positive case outcomes and in the rescue of children</quote> before the semicolon at the end;</text></paragraph><paragraph id="id0ca148bd85884536a82609ffe1bb4d88"><enum>(3)</enum><text>in paragraph (3)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id82d831cb992842b2ba49c5e7b14287ad"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>and local law enforcement</quote> and inserting <quote>Tribal, military, and local law enforcement</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id845e9f788ad54bdb893c94bf5dc43925"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>, including probation and parole agencies, child advocacy centers, and child protective services,</quote> after <quote>enforcement agencies</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id27498ad14807453784bde668456f70c2"><enum>(4)</enum><text>in paragraph (8), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id931f3fe165004deab722df2ce784a64c"><enum>(5)</enum><text>in paragraph (9), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8d1b7fe59bbe4735a81c5c259f1b3c6c"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id577E47DCE34940EEB2C84530F7724EE3"><paragraph id="id9c4300231c9942cc8750dc455fa144fc"><enum>(10)</enum><text>educating the judiciary on—</text><subparagraph commented="no" display-inline="no-display-inline" id="id50c34f879c8e47f79967c4268dac6407"><enum>(A)</enum><text display-inline="yes-display-inline">the link between intrafamilial contact offenses and technology-facilitated crimes; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida0523d9b6c8c4f82a23349f667148665"><enum>(B)</enum><text display-inline="yes-display-inline">characteristics of internet offenders, including the interest of online offenders in incest-themed material, sadism, and other related paraphilias or illegal activity.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8a0b1ea98d714065917d064b4e6fc398"><enum>(d)</enum><header>Duties and functions of task forces</header><text>Section 104 of the PROTECT Our Children Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/34/21114">34 U.S.C. 21114</external-xref>) is amended—</text><paragraph id="idb370ba6104bc41269e686cbf8102aa47"><enum>(1)</enum><text>in paragraph (3)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3d7eaf4daa7e42beb1cca598dd53de7f"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>reactive and</quote> before <quote>proactive</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id08354b3aad6444b9b413e43d60b60778"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>conduct digital</quote> before <quote>forensic examinations</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8d620d1d23114347b7f55913b28a141c"><enum>(C)</enum><text>by inserting <quote>engage in</quote> before <quote>effective prosecutions</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idda124a0b45994868bbeb973a6adecb21"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (8) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5608D37738F9405E8290479DFEA09693"><paragraph id="idd9829ef55e9a46f28c1e69cdf15b01f2"><enum>(8)</enum><text>investigate, seek prosecution with respect to, and identify child victims from leads relating to Internet crimes against children, including CyberTipline reports, with prioritization determined according to circumstances and by each task force, as described in section 102;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id524ddf19b1da4f7da13d23a758be5e32"><enum>(3)</enum><text>by striking paragraph (9); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95d7b35d860244a59d463871867ef3a5"><enum>(4)</enum><text>by redesignating paragraphs (10) and (11) as paragraphs (9) and (10), respectively.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8105bd335767494c88e66f47d5a6e878"><enum>(e)</enum><header>National Internet Crimes Against Children Data System</header><text>Section 105 of the PROTECT Our Children Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/34/21115">34 U.S.C. 21115</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idea883988df5b44828c7d3534af9094cf"><enum>(1)</enum><text>in subsection (a), by striking <quote>shall establish</quote> and inserting <quote>may establish</quote>;</text></paragraph><paragraph id="iddbd26fd2931d4eefb27b760121940a76"><enum>(2)</enum><text>in subsection (b) by striking <quote>continue and build upon Operation Fairplay developed by the Wyoming Attorney General's office, which has established a secure, dynamic undercover infrastructure that has facilitated</quote> and inserting <quote>facilitate</quote>; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd6bd9d632ee242c19d508e5e414da370"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (g)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id95580ea4a39e4386a403714901f1eb0a"><enum>(A)</enum><text>by striking paragraph (3);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id01487351bea044b68ded62668d66b6e4"><enum>(B)</enum><text>by redesignating paragraphs (4) through (8) as paragraphs (3) through (7), respectively; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id739a886d6329476f930786737245e4ba"><enum>(vi)</enum><text display-inline="yes-display-inline">provide wellness training.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" id="ideada39846c604b47a7b9d7c85fba7cf5"><enum>(2)</enum><text>in subsection (d)(1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc951a04322664fa591a6481f979177bb"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text><clause commented="no" display-inline="no-display-inline" id="id3b139019863a4db6adf4e478880cf026"><enum>(i)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text></clause><clause commented="no" display-inline="no-display-inline" id="id6dbab0d531a2435c8032bdda688db604"><enum>(ii)</enum><text display-inline="yes-display-inline">in clause (iii), by striking <quote>, including</quote> and all that follows through <quote>such crime under State law.</quote> and inserting <quote>;
