which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the intentional hindering of immigration, border, and customs controls, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transnational Criminal Organization Illicit Spotter Prevention and Elimination Act</short-title></quote>.</text></section><section id="id82C25AF40E1D48E39E89C17FFE6B8E6A"><enum>2.</enum><header>Unlawfully hindering immigration, border, and customs controls</header><subsection id="id177AD63961A14990BD51461B1DBA189C"><enum>(a)</enum><header>Enhanced penalties</header><paragraph id="idA27738FBA6B349EDA4FA1860268DDB11"><enum>(1)</enum><header>In general</header><text>Chapter 9 of title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1351">8 U.S.C. 1351 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1768CC3282824FC88A5EBBBE13A28DD5"><section id="id5DC9227C685646F89914E93BAD97A09B"><enum>295.</enum><header>Unlawfully hindering immigration, border, and customs controls</header><subsection commented="no" display-inline="no-display-inline" id="idb119096b-f6d0-41e5-9848-188753e58b15"><enum>(a)</enum><header display-inline="yes-display-inline">Illicit spotting</header><text display-inline="yes-display-inline">Any person who knowingly transmits, by any means, to another person the location, movement, or activities of any Federal, State, local, or tribal law enforcement agency with the intent to further a Federal crime relating to United States immigration, customs, controlled substances, agriculture, monetary instruments, or other border controls shall be fined under title 18, United States Code, imprisoned not more than 10 years, or both.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3297ea04-8bf4-48ee-9f59-acc99d233b00"><enum>(b)</enum><header display-inline="yes-display-inline">Destruction of United States border controls</header><text display-inline="yes-display-inline">Any person who knowingly and without lawful authorization destroys, alters, or damages any fence, barrier, sensor, camera, or other physical or electronic device deployed by the Federal Government to control the border or a port of entry or otherwise seeks to construct, excavate, or make any structure intended to defeat, circumvent, or evade any such fence, barrier, sensor camera, or other physical or electronic device deployed by the Federal Government to control the border or a port of entry—</text><paragraph commented="no" display-inline="no-display-inline" id="id91A435D51E3C41229DD24837BC010BC4"><enum>(1)</enum><text display-inline="yes-display-inline">shall be fined under title 18, United States Code, imprisoned not more than 10 years, or both; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6FB92F59C27B42F8AC52431BA4C3CEED"><enum>(2)</enum><text display-inline="yes-display-inline">if, at the time of the offense, the person uses or carries a firearm or who, in furtherance of any such crime, possesses a firearm, shall be fined under such title 18, imprisoned not more than 20 years, or both.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id22708383-c88b-4155-bd8f-008bd998174c"><enum>(c)</enum><header display-inline="yes-display-inline">Conspiracy and attempt</header><text display-inline="yes-display-inline">Any person who attempts or conspires to violate subsection (a) or (b) shall be punished in the same manner as a person who completes a violation of such subsection.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7a9d7855-5a54-407b-9bc7-7d1b6b053d55"><enum>(2)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in the first section of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended by inserting after the item relating to section 294 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida4579625-bd6a-42a9-9d1a-3dc649957e42"><toc><toc-entry bold="off" level="section">Sec. 295. Unlawfully hindering immigration, border, and customs controls.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ideb25064a-834f-443b-91e5-b0915e3b2948"><enum>(b)</enum><header display-inline="yes-display-inline">Prohibiting carrying or use of a firearm during and in relation to an alien smuggling crime</header><text display-inline="yes-display-inline">Section 924(c) of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id60C296306CFC40A893FB12FFA5EFE44B"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd0c5249f-d58e-400e-86b4-c4d0079779c9"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), in the matter preceding clause (i), by inserting <quote>, alien smuggling crime,</quote> after <quote>crime of violence</quote> each place that term appears; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0b7b2adf-b216-48e6-99b3-9c41d35d5866"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (D)(ii), by inserting <quote>, alien smuggling crime,</quote> after <quote>crime of violence</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAFB72BD033F740359B87668C49186215"><enum>(2)</enum><text>by striking paragraphs (2) through (4);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id011373C98DE1418582E0F103BE5C1212"><enum>(3)</enum><text>by redesignating paragraph (5) as paragraph (2); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id43AEB3B2121A440C9B6303F708ED6B9F"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id03c3f1f7-6f04-41fa-8632-1ab68b73ec8f"><paragraph commented="no" display-inline="no-display-inline" id="idbce7834a-c115-489c-8667-94351b713637" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In this subsection—</text><subparagraph commented="no" display-inline="no-display-inline" id="id85D622ADB0464C97A53C81463EF688C1"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>alien smuggling crime</term> means any felony punishable under section 274(a), 277, or 278 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324(a)</external-xref>, 1327, and 1328);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCC78378D73034ACBBC314087690A15BB"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>brandish</term> means, with respect to a firearm, to display all or part of the firearm, or otherwise make the presence of the firearm known to another person, in order to intimidate that person, regardless of whether the firearm is directly visible to such person;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id813F5E4A323B4FE3BF9542A0A7AED26E"><enum>(C)</enum><text display-inline="yes-display-inline">the term <term>crime of violence</term> means an offense that—</text><clause commented="no" display-inline="no-display-inline" id="idAF69870052B742C3A831DB029E2FE649"><enum>(i)</enum><text display-inline="yes-display-inline">is a felony; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id560FB25947704E938137D0B048C98727"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id2EC55356E9204E2BB3B2E15E7E248BB6"><enum>(I)</enum><text display-inline="yes-display-inline">has, as an element, the use, attempted use, or threatened use of physical force against the person or property of another; or</text></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="idAC65E2D8DF65441A8A3CCF058DE89AF0"><enum>(II)</enum><text display-inline="yes-display-inline">by its nature, involves a substantial risk that physical force against the person or property of another may be used in the course of committing the offense.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFC511D8F344640A096E50725BD0FFD08"><enum>(D)</enum><text display-inline="yes-display-inline">the term <term>drug trafficking crime</term> means any felony punishable under the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/951">21 U.S.C. 951 et seq.</external-xref>), or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/705">chapter 705</external-xref> of title 46.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id7e67261c64c14b0e97c984841b057544"><enum>(c)</enum><header>Conforming amendments</header><paragraph id="id4C59D08234EE46A6B4C4D2FC5BCD52D9"><enum>(1)</enum><header>Bankruptcy code</header><text>Section 707(c)(1)(B) of title 11, United States Code, is amended by striking <quote>section 924(c)(2)</quote> and inserting <quote>section 924(c)(3)(D)</quote>.</text></paragraph><paragraph id="idE8BF63A3F07E40FAB9891812CD4DC82F"><enum>(2)</enum><header>Criminal code</header><text>Title 18, United States Code, is amended—</text><subparagraph id="id695F30216E9C49CFAC3FE10C5CD679D4"><enum>(A)</enum><text>in section 844(o)—</text><clause id="idEA1DD643E0814EA1960163C768A686DE"><enum>(i)</enum><text>by striking <quote>section 924(c)(3)</quote> and inserting <quote>section 924(c)(3)(C)</quote>; and</text></clause><clause id="id47E5B19CEA1D4E19969B9A41A0E9C407"><enum>(ii)</enum><text>by striking <quote>section 924(c)(2)</quote> and inserting <quote>section 924(c)(3)(D)</quote>;</text></clause></subparagraph><subparagraph id="idB7953A42CC954423A8C817BE7B5FBF42"><enum>(B)</enum><text>in section 1028(b)(3)(B), by striking <quote>section 924(c)(3)</quote> and inserting <quote>section 924(c)(3)(C)</quote>; and</text></subparagraph><subparagraph id="id48760B3F6ADA4B3A841CA26F4332C738"><enum>(C)</enum><text>in section 4042(b)(3)—</text><clause id="idBD1DF151D45641BCA815A17F7A4B014C"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>section 924(c)(2)</quote> and inserting <quote>section 924(c)(3)(D)</quote>; and</text></clause><clause id="id4F44B854C01A42839C338643DAEF6D2A"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>section 924(c)(3)</quote> and inserting <quote>section 924(c)(3)(C)</quote>.</text></clause></subparagraph></paragraph><paragraph id="id51C61B824F854D82A7092B3178FCCB4F"><enum>(3)</enum><header>Prisons</header><text>Section 3(1) of the Interstate Transportation of Dangerous Criminals Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/34/60102">34 U.S.C. 60102(1)</external-xref>) is amended by striking <quote>section 924(c)(3)</quote> and inserting <quote>section 924(c)(3)(C)</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3773364B03024D5A94A7FCA98F912DDB"><enum>(d)</enum><header>Statute of limitations</header><text display-inline="yes-display-inline">Section 3298 of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id8DD2153C86C44C85BAE21696B6E8DC29"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>or 295</quote> after <quote>274(a)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5810C162A1474AD880A39E06F5F87353"><enum>(2)</enum><text>by inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324(a)</external-xref> and 1363b)</quote> after <quote>Immigration and Nationality Act</quote>.</text></paragraph></subsection></section></legis-body></bill>
