<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 469</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250206" legis-day="20250205">February 6 (legislative day, February 5), 2025</action-date><action-desc><sponsor name-id="S376">Ms. Ernst</sponsor> (for herself, <cosponsor name-id="S330">Mr. Bennet</cosponsor>, <cosponsor name-id="S153">Mr. Grassley</cosponsor>, <cosponsor name-id="S411">Mr. Marshall</cosponsor>, <cosponsor name-id="S437">Mr. Justice</cosponsor>, <cosponsor name-id="S347">Mr. Moran</cosponsor>, <cosponsor name-id="S344">Mr. Hoeven</cosponsor>, <cosponsor name-id="S381">Mr. Rounds</cosponsor>, <cosponsor name-id="S343">Mr. Boozman</cosponsor>, and <cosponsor name-id="S384">Mr. Tillis</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To restore the exemption of family farms and small businesses from the definition of assets under title IV of the Higher Education Act of 1965.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H3BCCDF114DC449FC81DB1D93B97249C3"><section section-type="section-one" id="H0EB781075BEF47B0B91E33437CEC76E8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Family Farm and Small Business Exemption Act</short-title></quote>.</text></section><section id="H7522B70D7DDA41ACBFB969446F13AA04"><enum>2.</enum><header>Exempting family farms and small businesses from assets under the Higher Education Act of 1965</header><subsection id="H7A1D11884C054A64B90567E59FCC9E53"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 480(f)(2) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087vv">20 U.S.C. 1087vv(f)(2)</external-xref>) is amended—</text><paragraph id="H88122A884FC7470C893FEE0934E99454"><enum>(1)</enum><text>by striking <quote>net value of the</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="H98289034F3924300BCE228EDBBC44020"><text>net value of—</text><subparagraph id="H13AC1B18170B4630B71CE5A9237ADBF8"><enum>(A)</enum><text>the</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H55C125307B35405EA2396C5EFCBFF705"><enum>(2)</enum><text>by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="H0471DFF1084341AEB6B3BAC70A6C2C33"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5D69EC701D3148959D69D38720CD848A"><subparagraph id="H403D02484C074F7B887FBEFFBAF5D112"><enum>(B)</enum><text>a family farm on which the family resides; or</text></subparagraph><subparagraph id="H602F0E2A1AAA4D88A37A287DB3491801"><enum>(C)</enum><text>a small business with not more than 100 full-time or full-time equivalent employees (or any part of such a small business) that is owned and controlled by the family.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H77E8E04679FF4215B350A467120C561F"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply to need analysis conducted under part F of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087kk">20 U.S.C. 1087kk et seq.</external-xref>) for award years beginning on or after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
