which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to require federally licensed firearms importers, manufacturers, and dealers to meet certain requirements with respect to securing their firearms inventory, business records, and business premises.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD2DEF176E080468AAB1D1A68D481031C"><section section-type="section-one" id="H049A7CACF48540F7897D3A2C47B3042A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safety Enhancements for Communities Using Reasonable and Effective Firearm Storage Act</short-title></quote> or the <quote><short-title>SECURE Firearm Storage Act</short-title></quote>.</text></section><section id="H8DDCEF8F37024A93BB92FE69462942CE"><enum>2.</enum><header>Security requirements for federally licensed firearms importers, manufacturers, and dealers</header><subsection id="H18C81AB664284A699F63E15DD636792F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 923 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF1274869D60D459A9F5FE7F1A92C647F"><subsection id="H1E61B2A7CB6145F39ECDBEAD64DC5755"><enum>(m)</enum><header>Security requirements</header><paragraph id="H09392C6AF9444BFDA419AC5C8BFC9B28"><enum>(1)</enum><header>Relation to provision governing gun shows</header><text display-inline="yes-display-inline">This subsection shall apply to a licensed importer, licensed manufacturer, or licensed dealer except as provided in subsection (j).</text></paragraph><paragraph display-inline="no-display-inline" id="H40E4A0AA06214D2597D0A1BCD844EF6E"><enum>(2)</enum><header>Firearm storage</header><subparagraph display-inline="no-display-inline" id="H3233CA3175C7498F8C6CD8AA21AA97A4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A person who is a licensed importer, licensed manufacturer, or licensed dealer shall keep and store each firearm in the business inventory of the licensee at the premises covered by the license.</text></subparagraph><subparagraph display-inline="no-display-inline" id="H472AAF04B803448396BEB2B66A65CE2B"><enum>(B)</enum><header>Means of storage</header><text display-inline="yes-display-inline">When the premises covered by the license are not open for business, the licensee shall, with respect to each firearm in the business inventory of the licensee—</text><clause id="H1AFB362F48B042C295F4603C3B7C7D87"><enum>(i)</enum><text display-inline="yes-display-inline">secure the firearm with a hardened steel rod <fraction>1/4</fraction> inch thick through the space between the trigger guard, and the frame or receiver, of the firearm, with—</text><subclause id="HC5AF1308D7E4441FAC0EAE1F085C152B"><enum>(I)</enum><text display-inline="yes-display-inline">the steel rod secured by a hardened steel lock that has a shackle;</text></subclause><subclause id="H31882E1906AE47B3A0C7D7677E6B4BE3"><enum>(II)</enum><text display-inline="yes-display-inline">the lock and shackle protected or shielded from the use of a bolt cutter; and</text></subclause><subclause id="HB3A0B1C53D8949B29D70E2F48B665F7C"><enum>(III)</enum><text display-inline="yes-display-inline">the rod anchored to prevent the removal of the firearm from the premises; or</text></subclause></clause><clause id="HD0123470CB9042EA9DF005DF20FBF916"><enum>(ii)</enum><text display-inline="yes-display-inline">store the firearm in—</text><subclause id="HF043EF67C3F74C398204056A14EDA0A0"><enum>(I)</enum><text display-inline="yes-display-inline">a locked fireproof safe;</text></subclause><subclause id="HD901959E4105486EA0A0E0C298C68411"><enum>(II)</enum><text display-inline="yes-display-inline">a locked gun cabinet (and if the locked gun cabinet is not steel, each firearm within the cabinet shall be secured with a hardened steel rod <fraction>1/4</fraction> inch thick, protected or shielded from the use of a bolt cutter and anchored to prevent the removal of the firearm from the premises); or</text></subclause><subclause id="H70C60F9C9A02441F9568924909D39463"><enum>(III)</enum><text display-inline="yes-display-inline">a locked vault.</text></subclause></clause></subparagraph></paragraph><paragraph id="H9EC089F1C37041DCA4CBFBB5510B6793"><enum>(3)</enum><header>Paper record storage</header><text display-inline="yes-display-inline">When the premises covered by the license are not open for business, the licensee shall store each paper record of the business inventory and firearm transactions of, and other dispositions of firearms by, the licensee at the premises in a secure location such as a locked fireproof safe or locked vault.</text></paragraph><paragraph display-inline="no-display-inline" id="H992B1476FEAB4FE49B5F83AE83D841FC"><enum>(4)</enum><header>Additional security requirements</header><text display-inline="yes-display-inline">The Attorney General may, by regulation, prescribe such additional security requirements as the Attorney General determines appropriate with respect to the firearms business conducted by a licensed importer, licensed manufacturer, or licensed dealer, such as requirements relating to the use of—</text><subparagraph id="H5F273CE219EA40E9B4C50F0461447242"><enum>(A)</enum><text>alarm and security camera systems;</text></subparagraph><subparagraph id="H5C378A0CB6DA46EFA45EDB2E0C454226"><enum>(B)</enum><text>site hardening;</text></subparagraph><subparagraph id="HDE3082F479A947DC9020B74ACE083C61"><enum>(C)</enum><text>measures to secure any electronic record of the business inventory and firearm transactions of, and other dispositions of firearms by, the licensee; and</text></subparagraph><subparagraph id="H65A5B851CE214437947694C32F009946"><enum>(D)</enum><text>other measures necessary to reduce the risk of theft at the business premises of a licensee.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC90344DDCC4E4FA5A9662AF669A126AF"><enum>(b)</enum><header>Penalties</header><text>Section 924 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H92F555F708564B6A9BAEDF5123C43C41"><subsection id="HF3862840786C4725816B2DC25B7E3FBC"><enum>(q)</enum><header>Penalties for noncompliance with firearms licensee security requirements</header><paragraph id="HF6D4AF2BA4B34E43995E26219DC30E0A"><enum>(1)</enum><header>In general</header><subparagraph id="HE7873781D7E6417B9D4CBAB47D340A82"><enum>(A)</enum><header>Penalty</header><text>With respect to a violation by a licensee of section 923(m) or a regulation issued under that section, the Attorney General, after notice and opportunity for hearing—</text><clause id="H473BE98FEBCD4F62AD611DBE18895368"><enum>(i)</enum><text>in the case of the first violation or related series of violations on the same date, shall subject the licensee to a civil penalty in an amount equal to not less than $1,000 and not more than $10,000;</text></clause><clause id="HDE5B0DB4420D4C25A5CEBEC3167AA8AC"><enum>(ii)</enum><text>in the case of the second violation or related series of violations on the same date—</text><subclause id="HA51872A0B15B4416951A74A377D56896"><enum>(I)</enum><text>shall suspend the license issued to the licensee under this chapter until the licensee cures the violation; and</text></subclause><subclause id="H43B01EF379034E76B70812A14D1EDE86"><enum>(II)</enum><text>may subject the licensee to a civil penalty in an amount provided in clause (i); or</text></subclause></clause><clause id="HC1C991A3BD914BF5ABF082FB70CEB4C8"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of the third violation or related series of violations on the same date—</text><subclause id="H66BC1A7FDF024D338653D05D8956103E"><enum>(I)</enum><text display-inline="yes-display-inline">shall revoke the license issued to the licensee under this chapter; and</text></subclause><subclause id="H92E31F1BCA1F40C0B30B2D760AE752ED"><enum>(II)</enum><text display-inline="yes-display-inline">may subject the licensee to a civil penalty in an amount provided in clause (i).</text></subclause></clause></subparagraph><subparagraph id="HDE3A2E0F90214FCCACB62EBCB85A9865"><enum>(B)</enum><header>Review</header><text>An action of the Attorney General under this paragraph may be reviewed only as provided under section 923(f).</text></subparagraph></paragraph><paragraph id="H643C40ED1E65498095D1BC422EC6AD59"><enum>(2)</enum><header>Administrative remedies</header><text>The imposition of a civil penalty or suspension or revocation of a license under paragraph (1) shall not preclude any administrative remedy that is otherwise available to the Attorney General.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1E6CBA3946F64BCE8EBAFAE692496D2A"><enum>(c)</enum><header>Application requirement</header><text>Section 923 of title 18, United States Code, is amended—</text><paragraph id="H08DCCBF93DCC4D7FB543AC2C0EE5C0E1"><enum>(1)</enum><text>in subsection (a), in the second sentence, by striking <quote>be in such form and contain only that</quote> and inserting <quote>describe how the applicant plans to comply with subsection (m) and shall be in such form and contain only such other</quote>; and</text></paragraph><paragraph id="HE470AEE704A24261AB9BCD0BACC9F2C1"><enum>(2)</enum><text>in subsection (d)(1)—</text><subparagraph id="H84651876F39D4A5D92C6D45ABD1E0D6B"><enum>(A)</enum><text>in subparagraph (F), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H5909270D9E1C4471AD98103D861C245B"><enum>(B)</enum><text>in subparagraph (G), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H0D03EA05B2E9400BA004ACBB12795973"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE37084AE3D2B4382BFB8F3BE1ECCB423"><subparagraph id="H3E4F05CA733B426D9602B215A74609BB" indent="up1"><enum>(H)</enum><text display-inline="yes-display-inline">the Attorney General determines that the description in the application of how the applicant plans to comply with subsection (m) would, if implemented, so comply.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H43D5C3B9C7BD49A08DF9DFEFF9D421DD"><enum>(d)</enum><header>Effective dates</header><paragraph id="H51234EB348DF4F34B907416418D2F2EB"><enum>(1)</enum><header>Initial firearm storage requirements</header><text display-inline="yes-display-inline">Section 923(m)(2) of title 18, United States Code, as added by subsection (a), shall take effect on the date that is 1 year after the date of enactment of this Act.</text></paragraph><paragraph id="H0E56C1B5551441CB8FB0D2CCEEFC1AE6"><enum>(2)</enum><header>Initial paper records storage requirements</header><text display-inline="yes-display-inline">Section 923(m)(3) of title 18, United States Code, as added by subsection (a), shall take effect on the date that is 90 days after the date of enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
