which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Federal Energy Regulatory Commission to reform the interconnection queue process for the prioritization and approval of certain projects, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HBB3CD9DE0B5F4CD3A3ED1776FEB791B7"><section commented="no" section-type="section-one" id="H556E10DC074A4B12B51C169592C26234"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guaranteeing Reliability through the Interconnection of Dispatchable Power Act</short-title></quote> or the <quote><short-title>GRID Power Act</short-title></quote>. </text></section><section id="H69EB0D336F9A4323B583BFB8989CA27B"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id5f2c611562dc43c48975b6e710eeec83"><enum>(1)</enum><header>Bulk-power system</header><text>The term <term>bulk-power system</term> has the meaning given the term in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>).</text></paragraph><paragraph commented="no" id="H2EF35E57EC4D4CC584F530D282BD58DB"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Energy Regulatory Commission.</text></paragraph><paragraph commented="no" id="H4A4BC2D8AD2C4EA0B982EB25FAFC8F5D"><enum>(3)</enum><header>Dispatchable power</header><text>The term <term>dispatchable power</term> means an electric energy generation resource capable of providing known and forecastable electric supply in time intervals necessary to ensure grid reliability. </text></paragraph><paragraph commented="no" id="H84462BBD6840411DA22992191C61EAE7"><enum>(4)</enum><header>Grid reliability</header><text>The term <term>grid reliability</term> means the ability of the electric grid to deliver an adequate, secure, and stable flow of electricity in the quantity and with the quality demanded by users, taking into account the ability of the bulk-power system to withstand sudden disturbances.</text></paragraph><paragraph commented="no" id="HACA5C1D2B8DC405485B18515C27E3314"><enum>(5)</enum><header>Grid resilience</header><text>The term <term>grid resilience</term> means the ability of the electric grid to adapt to changing physical conditions and withstand and rapidly recover from significant disturbances, including natural disasters, cyber-attacks, and other unforeseen events.</text></paragraph><paragraph commented="no" id="H4320CFE779A84332B35A6FBC71E4711A"><enum>(6)</enum><header>Independent System Operator</header><text>The term <term>Independent System Operator</term> has the meaning given the term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>). </text></paragraph><paragraph commented="no" id="H96C16FF33E3C4F06AA6A8CB91C99C880"><enum>(7)</enum><header>Regional Transmission Organization</header><text>The term <term>Regional Transmission Organization</term> has the meaning given the term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>). </text></paragraph><paragraph commented="no" id="HB0D1A017E06748F4933890463D378BE9"><enum>(8)</enum><header>Resource adequacy</header><text>The term <term>resource adequacy</term> means the ability of the electric system to meet the aggregate electrical demand and energy requirements of end-use customers at all times, accounting for scheduled and reasonably expected unscheduled outages of bulk-power system components. </text></paragraph><paragraph commented="no" id="H186685EF90B143A98862E41B61484C34"><enum>(9)</enum><header>Transmission provider</header><text>The term <term>transmission provider</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf1a17befe34a424eade29732f2a510a3"><enum>(A)</enum><text display-inline="yes-display-inline">a public utility (as defined in section 201(e) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824">16 U.S.C. 824(e)</external-xref>)) that owns, operates, or controls 1 or more transmission facilities;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida96beb7d5a134896993c60f2f2fe11e6"><enum>(B)</enum><text display-inline="yes-display-inline">an Independent System Operator; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7f07d802fb8d4c3f9944d91cb9a83980"><enum>(C)</enum><text display-inline="yes-display-inline">a Regional Transmission Organization.</text></subparagraph></paragraph></section><section commented="no" id="HC1558E6181754AA6AEEF216909CC44D6"><enum>3.</enum><header>Rulemaking to improve interconnection queue flexibility</header><subsection commented="no" id="HB4559BEA1D504537938B1948F43B4F9D"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Commission shall initiate a rulemaking—</text><paragraph commented="no" id="H5F9E5B366E1B4D69AD83099A77988A30"><enum>(1)</enum><text display-inline="yes-display-inline">to address the inefficiencies and ineffectiveness of existing procedures for processing interconnection requests to ensure that new dispatchable power projects that improve grid reliability and resource adequacy can interconnect to the electric grid quickly, cost-effectively, and reliably; and</text></paragraph><paragraph commented="no" id="HED6C36B2DC294AF09B646AA23CBF6CD5"><enum>(2)</enum><text display-inline="yes-display-inline">to amend the pro forma Large Generator Interconnection Procedures and, as appropriate, the pro forma Large Generator Interconnection Agreement, promulgated pursuant to section 35.28(f) of title 18, Code of Federal Regulations (or successor regulations)—</text><subparagraph commented="no" id="H33E171D421E74986B855D01BBA4A25D6"><enum>(A)</enum><text display-inline="yes-display-inline">to authorize transmission providers to submit proposals to the Commission to adjust the interconnection queue of the transmission provider to prioritize new dispatchable power projects that will improve grid reliability and resource adequacy by assigning those projects higher positions in the interconnection queue; and</text></subparagraph><subparagraph commented="no" id="HBEAB6AB1B90A4B92A7A56D0DC2EC6A17"><enum>(B)</enum><text>to require transmission providers—</text><clause id="H4DB94235E61E49409E8CC5104A33B827"><enum>(i)</enum><text>to provide in any proposal described in subparagraph (A)—</text><subclause id="HA013271B0E25403D8972BFCF3C5EE68B"><enum>(I)</enum><text>a demonstration of need for prioritization of the relevant projects; and</text></subclause><subclause id="H08A191EEDE1F4C288155410A992F5291"><enum>(II)</enum><text>a description of how the prioritization of those projects will improve grid reliability or grid resilience;</text></subclause></clause><clause commented="no" id="H91A14AFF461F459985FE579265A60E9E"><enum>(ii)</enum><text>to provide a process for public comment and stakeholder engagement before a proposal described in subparagraph (A) is submitted to the Commission; and</text></clause><clause commented="no" id="H1EC405D8F6CE41039FF97CB59EFC8FAF"><enum>(iii)</enum><text>to provide regular reporting to the Commission on the state of grid reliability and grid resilience, including reporting on any actions taken pursuant to this Act.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="H4889B71B546C40E6BBDC97D02E432A60"><enum>(b)</enum><header>Commission approval</header><text display-inline="yes-display-inline">To ensure timely responses to grid reliability concerns, not later than 60 days after a proposal is submitted pursuant to subsection (a)(2), the Commission shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idc54885c88d314d069ae56a10a38995ec"><enum>(1)</enum><text display-inline="yes-display-inline">review the proposal; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id087a17aa12ea47c48fd761688be516b0"><enum>(2)</enum><text display-inline="yes-display-inline">approve or deny the proposal.</text></paragraph></subsection><subsection commented="no" id="HB6EEF7EB4E6D49AA818303A4E48A377A"><enum>(c)</enum><header>Deadline for final rule</header><text>Not later than 180 days after the date of enactment of this Act, the Commission shall promulgate final regulations to complete the rulemaking initiated under subsection (a).</text></subsection><subsection commented="no" id="H837F5994829D4F179EF099D155073550"><enum>(d)</enum><header>Periodic review</header><text display-inline="yes-display-inline">Not less frequently than once every 5 years, the Commission shall review and, if necessary, update the regulations promulgated under this section to ensure that those regulations remain effective and relevant to evolving grid reliability and grid resilience challenges.</text></subsection></section></legis-body></bill>
