which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XIX of the Social Security Act to implement a minimum work requirement for able-bodied adults enrolled in State Medicaid programs.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HAB7303D421E0425F9BE45DE15C1FD5AD"><section section-type="section-one" id="H2F33EF5548B340CDB59E542831BB802E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Jobs and Opportunities for Medicaid Act</short-title></quote>. </text></section><section id="H9A4E97A7D28E48E197F26C319414076C"><enum>2.</enum><header>Work requirements for able-bodied adults</header><text display-inline="no-display-inline">Section 1902 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended—</text><paragraph id="H42D5D8511AE0470CA3D31C7FFC4C505A"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="H4778517433A845A38B1381BC62AD4EB7"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (86);</text></subparagraph><subparagraph id="H0B4B8EFEEEA54A1A92D9471133187F67"><enum>(B)</enum><text>by striking the period at the end of paragraph (87) and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H17A5BD84CBB844D099CC771760B059CA"><enum>(C)</enum><text>by inserting after paragraph (87) the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA6DFFC299732428AAF0727F93825ABE4"><paragraph id="H24A5042B331E498AAECD4551CEF5EB6D"><enum>(88)</enum><text display-inline="yes-display-inline">beginning January 1, 2026, not provide medical assistance with respect to a month to an able-bodied adult (as defined in subsection (uu)(2)) that has not met the work requirement described in subsection (uu)(1) for such month.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HC88A7411422440539E9BA348188AAFF5"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD869316CAF5C47A79A904DA3A8F2DB3E"><subsection id="H7C0F4CC639FD4662B091DB0FEC53467F"><enum>(uu)</enum><header>Work requirement for able-Bodied adults</header><paragraph id="H71931E96BF284C3E91BA60509D3602A9"><enum>(1)</enum><header>Work requirement described</header><text>For purposes of subsection (a)(88), the work requirement described in this subsection with respect to an able-bodied adult and a month is that such adult satisfies at least one of the following with respect to such month:</text><subparagraph id="H9235D1C970A0488791EE5628514FCEA9"><enum>(A)</enum><text>The adult works 20 hours or more per week, based on a monthly average.</text></subparagraph><subparagraph id="H222D13C628C546F6AE4878B3176C9D43"><enum>(B)</enum><text>The adult volunteers for 20 hours or more per week, based on a monthly average.</text></subparagraph></paragraph><paragraph id="HA55074826F8246C98F626609D8645931"><enum>(2)</enum><header>Able-bodied adult defined</header><text display-inline="yes-display-inline">In this subsection the term <term>able-bodied adult</term> means any individual who is not—</text><subparagraph id="HF262F219EEBA4466A3B487E69F222EBD"><enum>(A)</enum><text display-inline="yes-display-inline">under 18 years of age or over 65 years of age;</text></subparagraph><subparagraph id="HF926FB853B004F01839115D31A21FC4D"><enum>(B)</enum><text>medically certified as physically or mentally unfit for employment;</text></subparagraph><subparagraph id="H7699382256884CAA9E4318E0BD64F882"><enum>(C)</enum><text>pregnant;</text></subparagraph><subparagraph id="H15DE17AF4C7344ADAD304A00099E0495"><enum>(D)</enum><text>the primary parent or caretaker of a dependent child under 6 years of age;</text></subparagraph><subparagraph id="HA925999207C046869F071F998D7AA953"><enum>(E)</enum><text display-inline="yes-display-inline">the primary parent or caretaker of a dependent child with a serious medical condition or disability, as determined by the State agency established or designated to administer or supervise the administration of the State plan;</text></subparagraph><subparagraph id="HF9555494F25D4035BE8F1D27138D658C"><enum>(F)</enum><text>receiving unemployment compensation under State or Federal law and, as applicable, complying with work requirements under such State or Federal law; or</text></subparagraph><subparagraph id="H33F914EFBEDB4914AA1107E2AB15A692"><enum>(G)</enum><text>participating in a drug or alcohol treatment and rehabilitation program (as defined in section 3(h) of the Food and Nutrition Act of 2008).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
