Stafford Disaster Relief and Emergency Assistance Act to allow Indian tribal governments to directly request fire management assistance declarations and grants, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id832D52772B9245468E7E696568860C99" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fire Management Assistance Grants for Tribal Governments Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idAF62DD1A058247E8980B0789438055F4" changed="not-changed"><enum>2.</enum><header>Indian tribal government eligibility</header><subsection commented="no" display-inline="no-display-inline" id="id65116ADB5A6A43ED99D09A6BC9B6D20B" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 420 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5187">42 U.S.C. 5187</external-xref>) is amended— </text><paragraph commented="no" display-inline="no-display-inline" id="idAB076EE4272E4F19AF2DE48D4B564B1D" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by inserting <quote>, Indian tribal government,</quote> before <quote>or local government</quote>; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6F8176E2FF0443128CB3E4ACE55AD2CA" changed="not-changed"><enum>(2)</enum><text>by redesignating subsections (b) through (e) as subsections (c) through (f), respectively; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34A25D405ADC40E9A0C137B0CB78A598" changed="not-changed"><enum>(3)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id00DF191476C84932BD39C5D3C14B2F5E" changed="not-changed"><subsection id="id48AB60391C624BC1BD4E9C9CF5522346" changed="not-changed"><enum>(b)</enum><header>Procedure for request</header><text>The Governor of a State or the Chief Executive of an Indian tribal government affected by a fire described in subsection (a) may directly submit a request to authorize assistance under this section.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id53AC92601565478398B82FF4D1B73841" changed="not-changed"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id79D44409A5834B738663FB0506F5EF40" changed="not-changed"><subsection id="id2D8C995299574DF1B6A56C07C2BBD2F0" changed="not-changed"><enum>(g)</enum><header>Savings provision</header><text>Nothing in this section shall prohibit an Indian tribal government from receiving assistance under this section pursuant to an authorization made at the request of a State under subsection (b) if assistance is not authorized under this section for the same incident based on a request by the Indian tribal government under subsection (b).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0E471D1969D84D0D9AB2CD744CA51842" changed="not-changed"><enum>(b)</enum><header>Regulations</header><paragraph commented="no" display-inline="no-display-inline" id="idCAE8CA645B5A445DADE0F9D62460E187" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Fire management assistance declaration defined</header><text>In this subsection, the term <term>fire management assistance declaration</term> means a declaration approved under section 204.21(a) of title 44, Code of Federal Regulations.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5B73BF6EF58A4AB1A4EE9AF91EB3FAAE" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Update</header><text>Not later than 1 year after the date of enactment of this Act, the President shall issue regulations updating part 204 of title 44, Code of Federal Regulations, to carry out the amendments made by subsection (a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBC47F5E140C44AB3BAA155DE38A44908" changed="not-changed"><enum>(3)</enum><header>Contents</header><text>In issuing the regulations required under paragraph (2), the President shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idAA058DABC449412499D943E89F756FCE" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">authorize the Federal Emergency Management Agency to directly receive a request for a fire management assistance declaration from an Indian tribal government and directly provide related grants and resources to Indian tribal governments;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC5942F49878F46CB8F5F9583D943A453" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">clarify that Indian tribal governments for which the President does not grant a request described in subparagraph (A) remain eligible to receive assistance under section 420 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5187">42 U.S.C. 5187</external-xref>) through assistance granted under a fire management assistance declaration made at the request of a State; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7171FF404DEB482E8727C6D91192CFE4" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">consider the unique conditions that affect the general welfare of Indian tribal governments; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8FA00FADFBE144AB8EA3C6665279EB41" changed="not-changed"><enum>(D)</enum><text>enter into government-to-government consultation with Indian tribal governments regarding the regulations. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
