<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 436</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250205">February 5, 2025</action-date><action-desc><sponsor name-id="S383">Mr. Sullivan</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to modify the organization and authorities of the Assistant Secretaries of Defense with duties relating to industrial base policy and homeland defense.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Modification of organization and authorities of Assistant Secretaries of Defense with duties relating to industrial base policy and homeland defense</header><subsection id="id16885840e9a44bd080905883adb33a4d"><enum>(a)</enum><header>Establishment of Assistant Secretary of Defense for International Industrial Base Development and Engagement</header><text display-inline="yes-display-inline">Section 138(b) of title 10, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ide2e1bb47f538463893aa31f8874aec62"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (7) and (8) as paragraphs (8) and (9), respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id644b68ede38a46658e27b87af7f38f6a"><enum>(2)</enum><text>by inserting after paragraph (6) the following new paragraph (7):</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB38B127CEC81491CA37E3F29736FB662"><paragraph commented="no" display-inline="no-display-inline" id="id962237c68e164e4382b195663259e79d" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">One of the Assistant Secretaries is the Assistant Secretary of Defense for International Industrial Base Development and Engagement, who shall report directly to the Under Secretary of Defense for Acquisition and Sustainment. The principal duty of the Assistant Secretary shall be to strengthen the United States defense industrial base through the promotion of cooperation with security partners and allies of the United States, including Taiwan.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd9650ba7c36340f3991bab897582dc29"><enum>(b)</enum><header>Renaming of Assistant Secretary of Defense for Strategy, Plans, and Capabilities as Assistant Secretary of Defense for Strategy, Plans, Capabilities, and Homeland Defense</header><paragraph commented="no" display-inline="no-display-inline" id="id879fd40f71c84720b856ba8f019b74ed"><enum>(1)</enum><header>In general</header><text>On and after the date of the enactment of this Act—</text><subparagraph commented="no" display-inline="no-display-inline" id="id093a4b3daca84e3d82c02a8922a2594d"><enum>(A)</enum><text display-inline="yes-display-inline">the Assistant Secretary of Defense for Strategy, Plans, and Capabilities shall be known as the Assistant Secretary of Defense for Strategy, Plans, Capabilities, and Homeland Defense; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6641c18c829f489781b29b207b01e197"><enum>(B)</enum><text display-inline="yes-display-inline">any reference in any law or regulation to the Assistant Secretary of Defense for Strategy, Plans, and Capabilities shall be deemed to be a reference to the Assistant Secretary of Defense for Strategy, Plans, Capabilities, and Homeland Defense.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id981ff1cc7e2d402192282791c94a1911"><enum>(2)</enum><header>Establishment</header><text display-inline="yes-display-inline">Section 138(b) of title 10, United States Code, as amended by subsection (a), is further amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBBC5F61CF443453CA2D79E497D445CBE"><paragraph commented="no" display-inline="no-display-inline" id="id75bc9ea851e64e73a34132273048ebd1" indent="up1"><enum>(10)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id51864f0c90724a67a865a95be0fc6ca7"><enum>(A)</enum><text>One of the Assistant Secretaries is the Assistant Secretary of Defense for Strategy, Plans, Capabilities, and Homeland Defense. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="ide1ce0d9bd1394e31a5919ee9371f53eb"><enum>(B)</enum><text display-inline="yes-display-inline">The principal duty of the Assistant Secretary shall be to advise the Secretary of Defense, the Deputy Secretary of Defense, the Under Secretary of Defense for Policy, and the Principal Deputy Under Secretary of Defense on—</text><clause commented="no" display-inline="no-display-inline" id="id6243be7efad54e36bbbc9d52adf8c9ad"><enum>(i)</enum><text display-inline="yes-display-inline">national security issues and defense strategy and the capabilities, forces, and contingency plans necessary to implement the defense strategy; </text></clause><clause commented="no" display-inline="no-display-inline" id="id893e4fd864f44e53bb70fca8b7d14b88"><enum>(ii)</enum><text display-inline="yes-display-inline">policy and planning oversight for—</text><subclause commented="no" display-inline="no-display-inline" id="idf63cc798b7504093b42f593f7774d3dd"><enum>(I)</enum><text display-inline="yes-display-inline">homeland defense and mission assurance by the Department of Defense; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida8e4b8fe1de4496f9b94102152e310a8"><enum>(II)</enum><text display-inline="yes-display-inline">support by the Department for civil authorities; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5def2fc10c44424496d471de736c469c"><enum>(III)</enum><text display-inline="yes-display-inline">Arctic and global resilience; and</text></subclause></clause><clause id="id09a356393347442a84ccfc72d502cd32"><enum>(iii)</enum><text>advancing and representing priority issues with—</text><subclause commented="no" display-inline="no-display-inline" id="id0712001da38c4af38d9606a212c7204b"><enum>(I)</enum><text display-inline="yes-display-inline">other Federal agencies; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0c56c43d555048d8b6ed876acc018874"><enum>(II)</enum><text display-inline="yes-display-inline">countries that are allies and partners of the United States; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5336938a3ff441149e593cbe0d73f937"><enum>(III)</enum><text display-inline="yes-display-inline">State, local, territorial, and Tribal governments; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idbdecf81c26de4d77b63916b88fdd9297"><enum>(IV)</enum><text display-inline="yes-display-inline">private sector organizations.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idadc211c7b8874155b62f9d74db4d973d"><enum>(c)</enum><header>Elimination of Assistant Secretary of Defense for Homeland Defense and Hemispheric Affairs</header><text>The position of Assistant Secretary of Defense for Homeland Defense and Hemispheric Affairs is eliminated.</text></subsection><subsection id="id4686a98cee6c46589af958c8af46cf97"><enum>(d)</enum><header>Expanded authority of Assistant Secretary of Defense for International Security Affairs</header><text>The responsibilities of the Assistant Secretary of Defense for International Security Affairs shall include responsibility for Western Hemisphere affairs. </text></subsection></section></legis-body></bill>
