<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 413</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250205">February 5, 2025</action-date><action-desc><sponsor name-id="S341">Mr. Blumenthal</sponsor> (for himself, <cosponsor name-id="S270">Mr. Schumer</cosponsor>, <cosponsor name-id="S331">Mrs. Gillibrand</cosponsor>, and <cosponsor name-id="S364">Mr. Murphy</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of the Interior to conduct a study of Plum Island.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Plum Island Preservation Study Act</short-title></quote>.</text></section><section id="idf95de25855914eba805836d4a14c50c8"><enum>2.</enum><header>Plum Island preservation study</header><subsection id="id97f65228a3664ecebf151ffb5a28677a"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id2476ec82fb314243a7179c138223b7a5"><enum>(1)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8f30a14c334242bca37f2208126cd067"><enum>(2)</enum><header>Study area</header><text display-inline="yes-display-inline">The term <term>study area</term> means the consolidated Federal asset commonly known as <quote>Plum Island</quote> in the State of New York and all improvements on and to the Federal asset, including—</text><subparagraph id="id25b6cd82d0e44e5d95295afc069e4d22"><enum>(A)</enum><text>the Orient Point facility; and</text></subparagraph><subparagraph id="id0e1215400bbb40f38cce203418b595af"><enum>(B)</enum><text>all real and personal property, all transportation assets, and all associated infrastructure that support—</text><clause id="id60502e87996c44cea97fb9530f626e7f"><enum>(i)</enum><text>Plum Island operations; and</text></clause><clause id="id22725974e4ec48d791a44a209fddcafa"><enum>(ii)</enum><text>access to Plum Island.</text></clause></subparagraph></paragraph></subsection><subsection id="id728cf12bef9a4e81930407d3b6c6b756"><enum>(b)</enum><header>Study</header><paragraph commented="no" display-inline="no-display-inline" id="idda259cdb7c9f4f6d967b8d8c2c09fec1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall conduct a study to determine the appropriateness of—</text><subparagraph id="idee270cbb7b3e4319add3f17392f100a7"><enum>(A)</enum><text>designating all or a portion of the study area as a unit of the National Park System or a unit of the National Wildlife Refuge System; or</text></subparagraph><subparagraph id="id6f8d637f0b4a4d85abc40d38f5a2bc70"><enum>(B)</enum><text>providing protection for the resources of the study area by other means.</text></subparagraph></paragraph><paragraph id="id5f3903f43fe944e7bd8a7c2f529dce5b"><enum>(2)</enum><header>Contents</header><text>In conducting the study under paragraph (1), the Secretary shall—</text><subparagraph id="id347f0956d9e74de1a74bbc4576ba4df5"><enum>(A)</enum><text>evaluate the national significance of the study area;</text></subparagraph><subparagraph id="id562e93481c294399b59b0b206bd07424"><enum>(B)</enum><text>consult with interested Federal agencies, State or local governmental entities, private and nonprofit organizations, or any other interested individuals; and</text></subparagraph><subparagraph id="id72420e2f8b224693b1cba0f460aa6ffa"><enum>(C)</enum><text>identify cost estimates for any Federal acquisition, development, interpretation, operation, and maintenance associated with the alternatives considered. </text></subparagraph></paragraph><paragraph id="id494789c6b78c4924be632a25718b1308"><enum>(3)</enum><header>Report</header><text>Not later than 3 years after the date on which funds are first made available to carry out the study under paragraph (1), the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report that describes—</text><subparagraph id="idbcc3cf6a0e314428a6e1cb156ee32305"><enum>(A)</enum><text>the findings and conclusions of the study; and</text></subparagraph><subparagraph id="idba7ef4fc558545a5a33aed9a6e528f17"><enum>(B)</enum><text>any recommendations of the Secretary. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
