Stafford Disaster Relief and Emergency Assistance Act with respect to the implementation of building codes, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idd7b2b1c3-175f-49f3-b66e-9c7c733a11f0" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Resilient Buildings Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id1ee59b9b-e943-4577-8007-5b1dbf0a407a" changed="not-changed"><enum>2.</enum><header>Predisaster hazard mitigation</header><text display-inline="no-display-inline">Section 203(a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>) is amended—</text><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id3e25576f51384d0fb0cefaf50cf2a7fb"><enum>(1)</enum><text>by striking the subsection heading and inserting <quote><header-in-text style="OLC" level="subsection">Definitions</header-in-text></quote>;</text></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id073c0be871de43e3a8c3f0b025cfc6d3"><enum>(2)</enum><text>by striking <quote>In this section, the term</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id30373341-121a-49ae-b6b0-f9d3bca60c4b"><paragraph id="idcfded5b61aec438ea54585b0450e0956"><enum>(2)</enum><header>Small impoverished community</header><text>The term</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id40ab6b19a6c1475b921c864358893b12"><enum>(3)</enum><text>by inserting before paragraph (2), as so designated, “In this section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id40CCCED7D0AA40FB8DC340D0A034B76E"><paragraph id="idbdf0ae1a135a48fd809277046880b271"><enum>(1)</enum><header>Latest published editions</header><text>The term <term>latest public editions</term> means the 2 most recently published editions of relevant consensus-based codes, specifications, and standards.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id7904154b-05b9-4d77-926f-a79362d8124b" changed="not-changed"><enum>3.</enum><header>Hazard mitigation revolving loan fund program</header><text display-inline="no-display-inline">Section 205(f) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5135">42 U.S.C. 5135(f)</external-xref>) is amended—</text><paragraph id="id0a18cdcc-d0d6-4df8-801e-2d7a52f981f7" changed="not-changed"><enum>(1)</enum><text>by striking paragraph (5); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8ca71d2e6ef14baf9fe981cff5962240" changed="not-changed"><enum>(2)</enum><text>by redesignating paragraphs (6), (7), and (8) as paragraphs (5), (6), and (7), respectively.</text></paragraph></section><section id="idd96635758dd640419072d2b6dcbb4b97" changed="not-changed"><enum>4.</enum><header>Residential retrofit and resilience pilot program</header><subsection commented="no" display-inline="no-display-inline" id="ida9e9251c10fc49a9b3279e485491ab5b" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id79832fb081b24f1892ffdb101a6c36d7" changed="not-changed"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency.</text></paragraph><paragraph id="id9aa8f033d4414e19bf07e2dbc7c40bf4" changed="not-changed"><enum>(2)</enum><header>Residential resilient retrofit</header><text>The term <term>residential resilient retrofit</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id83dfed18a87448069f069c727df5b672" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">means a project that—</text><clause id="id2578ac38763e4acaa6e1137828c54dcb" changed="not-changed"><enum>(i)</enum><text>is designed to increase the resilience of an existing home or residence using mitigation measures that the Administrator determines reduce damage and impacts from natural disaster hazards and risks that are most likely to occur in the area where the home is located; and</text></clause><clause id="id45bbcf9ceaab418795bd3a9146e9ec44" changed="not-changed"><enum>(ii)</enum><text>to the extent applicable, are consistent with—</text><subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="id62be88e17caf425c88e6a7e6f8c24af5"><enum>(I)</enum><text display-inline="yes-display-inline">the 2 most recently published editions of relevant consensus-based codes, specifications, and standards, including any amendments made to those codes by State, local, or Indian tribal governments; and</text></subclause><subclause changed="not-changed" commented="no" display-inline="no-display-inline" id="idf4f14c135858445cb72adcd895ebcc07"><enum>(II)</enum><text display-inline="yes-display-inline">specifications and standards that, for the purpose of protecting health, safety, and general welfare of users of buildings against disasters—</text><item changed="not-changed" commented="no" display-inline="no-display-inline" id="idc89e199d093249f1a79b9923c8484ab4"><enum>(aa)</enum><text display-inline="yes-display-inline">incorporate the latest hazard-resistant designs; and</text></item><item changed="not-changed" commented="no" display-inline="no-display-inline" id="id0c52ddbdcb3a489486d442bda1317d57"><enum>(bb)</enum><text display-inline="yes-display-inline">establish criteria for the design, construction, and maintenance of residential structures and facilities that may be eligible for assistance under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>); and</text></item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc84220f6bc0a4a2494b2b6a76f39c790" changed="not-changed"><enum>(B)</enum><text>includes—</text><clause id="idc8b127524edd413ab4ffc9bfc2e4f277" changed="not-changed"><enum>(i)</enum><text>elevations of homes and utilities within and around structures to mitigate damages;</text></clause><clause id="id3c6995515afb4e1c8193d0c6ea81b39a" changed="not-changed"><enum>(ii)</enum><text>floodproofing measures;</text></clause><clause id="ide12540bec3cc4ad18974ee826769de68" changed="not-changed"><enum>(iii)</enum><text>the construction of tornado safe rooms;</text></clause><clause id="id1543011d75be427d91c2a3af47b65def" changed="not-changed"><enum>(iv)</enum><text>seismic retrofits;</text></clause><clause id="id2b20ee06ac144606aa776129294538f5" changed="not-changed"><enum>(v)</enum><text>wildfire retrofit and mitigation measures;</text></clause><clause id="ide5e46a6058b84c61843cefa900ce3e86" changed="not-changed"><enum>(vi)</enum><text>wind retrofits, including roof replacements, hurricane straps, and tie-downs; and</text></clause><clause id="id7b027ac3e9dd469b97693d19be7ee8dc" changed="not-changed"><enum>(vii)</enum><text>any other measure that meet the requirements of subparagraph (A), as determined by the Administrator. </text></clause></subparagraph></paragraph></subsection><subsection id="id6108aa459c134d01a7661157b3ad34ca" changed="not-changed"><enum>(b)</enum><header>Establishment</header><text>The Administrator shall carry out a residential resilience pilot program through the program established under section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>) to make available assistance to States and local governments for the purpose of providing grants to individuals for residential resilience retrofits.</text></subsection><subsection id="idcec561c352ec42719338884df88818a7" changed="not-changed"><enum>(c)</enum><header>Amount of funds</header><text>The Administrator may use not more than 10 percent of the assistance made available to applicants on an annual basis under section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>) to provide assistance under this section.</text></subsection><subsection id="idae0ccad934624119b549f3aca31a1545" changed="not-changed"><enum>(d)</enum><header>Timeline</header><text>With respect to the pilot program carried out under subsection (b), the Administrator shall—</text><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id53890b9faeb94a5f9256e2fa2181c80b"><enum>(1)</enum><text display-inline="yes-display-inline">establish the pilot program not later than 1 year after the date of enactment of this Act; and</text></paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="idae8ff7f460214faaaee3fb7dd0122b4a"><enum>(2)</enum><text display-inline="yes-display-inline">terminate the pilot program on September 30, 2030.</text></paragraph></subsection><subsection id="idd5e84c8b3ec640e086fd1c9719422517" changed="not-changed"><enum>(e)</enum><header>Priority</header><text>In carrying out the pilot program under this section, the Administrator shall ensure that a State or local government receiving assistance under the pilot program provides grants to individuals that demonstrate financial need.</text></subsection><subsection id="id05c7d01a115d4744b3c19507e33de4ec" changed="not-changed"><enum>(f)</enum><header>Report</header><text>Not later than 4 years after the date of enactment of this Act, the Administrator shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that includes—</text><paragraph id="id3f91073486574099ba3c42a191c6ee9a" changed="not-changed"><enum>(1)</enum><text>a summary of the grant awards and projects carried out under this section;</text></paragraph><paragraph id="idc31003d3dd684f069d81b45359b7578d" changed="not-changed"><enum>(2)</enum><text>a detailed compilation of results achieved by the grant awards and projects carried out under this section, including the number of homes receiving retrofits, the types and average costs of retrofits, and demographic information for participants in the pilot program; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id03a3ccb009ad4985bd4661da8ca56320" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">an estimate of avoidance in disaster impacts and Federal disaster payments as a result of the grant investments carried out under this section, and whether that avoidance is different than other mitigation projects funded under section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>); and</text></paragraph><paragraph id="id56ed44dc57544cec8aae5658f6716cde" changed="not-changed"><enum>(4)</enum><text>any identified implementation challenges and recommendations for improvements to the pilot program established under this section.</text></paragraph></subsection><subsection id="id02685779416641dc96a7ec899cf29d9b" changed="not-changed"><enum>(g)</enum><header>Applicability</header><text>This section shall only apply with respect to amounts appropriated on or after the date of enactment of this Act.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id7ed67cf3982943c4a88f85c223237399" changed="not-changed"><enum>5.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to affect any program other than the predisaster hazard mitigation program or the hazard mitigation revolving loan fund program established under section 203 or 205, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>, 5135).</text></section></legis-body></bill>
