Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To implement a 5-year pilot program establishing a performance-based pay structure for certain Federal employees in order to enhance productivity, accountability, and employee satisfaction in public service.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Employee Performance and Accountability Act of 2025</short-title></quote>.</text></section><section id="id3fc6243c2bdc4e9ebe17b14fb5e21c97"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idb1f774dcc830421ab2c5dde7df2f6741"><enum>(1)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24b62e9bd6954ab9a85d1d218f4f6512"><enum>(2)</enum><header display-inline="yes-display-inline">Eligible employee</header><text>The term <term>eligible employee</term> means an employee of an Executive agency employed in a position that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf49b7821b881474faa9f4adfd19e4e7a"><enum>(A)</enum><text>is—</text><clause commented="no" display-inline="no-display-inline" id="ida6061a0b83394df9814995a2b4379662"><enum>(i)</enum><text display-inline="yes-display-inline">at the GS–11, GS–12, GS–13, GS–14, or GS–15 level; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idbb0d67277f584d4490d5a3a3dc3a8efb"><enum>(ii)</enum><text>a senior-level position, which shall be defined as a position classified above the GS–15 level under section 5108 of title 5, United States Code; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4be21729da99476e9ea164ca60b8c40d"><enum>(B)</enum><text display-inline="yes-display-inline">has clearly measurable performance criteria, such as—</text><clause commented="no" display-inline="no-display-inline" id="ide34fb7c1712b4eec9888968bc1f03bdf"><enum>(i)</enum><text display-inline="yes-display-inline">a project management position;</text></clause><clause commented="no" display-inline="no-display-inline" id="id27bba9025093496695678b17826b294a"><enum>(ii)</enum><text display-inline="yes-display-inline">a position involving administrative or policy analysis;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1d3aad2ce4894c118ea9afc8c27a6754"><enum>(iii)</enum><text>an information technology, finance, or procurement specialist;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1b8a8d89fcde4a6d8488e15403a187a6"><enum>(iv)</enum><text>a leadership position that involves managing a team, evaluating program performance, or supervising operations;</text></clause><clause commented="no" display-inline="no-display-inline" id="id45692553ef8f4f8fa8af780ea59f4f75"><enum>(v)</enum><text>a customer service representative; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idf95692ee2064409e8dba38d75dcb0805"><enum>(vi)</enum><text display-inline="yes-display-inline">a claims processor.</text></clause></subparagraph></paragraph><paragraph commented="no" id="id5c763eab325b42ce813321c347c8ce3c"><enum>(3)</enum><header>Executive agency</header><text>The term <term>Executive agency</term> has the meaning given the term in section 105 of title 5, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id15dae7550e284026bbbcee5a34f9f594"><enum>(4)</enum><header>Participating agency</header><text>The term <term>participating agency</term> means an Executive agency, 1 or more employees of which are participating employees in accordance with section 3(b)(1).</text></paragraph><paragraph id="id3895b032db1f45d1b1ec7287e3768d09"><enum>(5)</enum><header>Participating employee</header><text>The term <term>participating employee</term> means an eligible employee who participates in the Program.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id81cc6019c1564f7dac84b578223db5c7"><enum>(6)</enum><header display-inline="yes-display-inline">Performance metrics</header><text>The term <term>performance metrics</term>, with respect to a participating agency, means standards for participating employees tailored to functions that are specific to the participating agency, which may include—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9c95d273a67e4e2abfa8d428b76a3b5e"><enum>(A)</enum><text display-inline="yes-display-inline">productivity standards, which measure quantifiable outputs such as completed cases, projects, or responses per quarter;</text></subparagraph><subparagraph id="idbb9e95ca8d224c3cad1402f02061d30a"><enum>(B)</enum><text>quality standards, which measure compliance with protocols, accuracy, and customer satisfaction rates; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9cd3a7bf031e495ba12bf1c73f518190"><enum>(C)</enum><text>timeliness standards, which measure compliance with processing deadlines, efficiency improvements, and timely task completion.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3e30323ea3184181b0e3eabef7857efb"><enum>(7)</enum><header>Program</header><text>The term <term>Program</term> means the pilot program established under section 3(a).</text></paragraph></section><section id="id6b479e57dd5741b593fb3d79182ce272"><enum>3.</enum><header>Pilot program eligibility and program scope</header><subsection commented="no" display-inline="no-display-inline" id="id147f25e872a14e4986179b00d79ba7f3"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">During the 5-year period beginning on the date that is 180 days after the date of enactment of this Act, the Director shall carry out a pilot program that establishes a performance-based pay structure for participating employees.</text></subsection><subsection id="idf3989bfdbf1b4ffe9b66e6fd4122cccd"><enum>(b)</enum><header>Participation</header><paragraph commented="no" display-inline="no-display-inline" id="idbfdae2ffd3ea4c20a212763f225ffaa2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Subject to paragraph (2), the head of each Executive agency shall ensure that not less than 1 percent and not more than 10 percent of eligible employees of the Executive agency participate in the Program.</text></paragraph><paragraph id="idd272c6995f2741d1a9b704c04f85115e"><enum>(2)</enum><header>Opt-out</header><subparagraph commented="no" display-inline="no-display-inline" id="ida305c4349db4416b98cc3202f4a1aad4"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The head of an Executive agency may elect to not have the Executive agency participate in the Program if the head of the Executive agency determines that participation could pose risks to national security or public safety.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddccdaa01e1284150964a0ab976cf8909"><enum>(B)</enum><header>Transparency requirement</header><text display-inline="yes-display-inline">If the head of an Executive agency determines that the Executive agency should not participate in the Program pursuant to subparagraph (A), the head of the Executive agency shall submit to the Director a written justification for the decision.</text></subparagraph></paragraph></subsection></section><section id="id7fedf6162d56447a9eb26c4f568bc32a"><enum>4.</enum><header>Performance measurement and accountability</header><subsection id="id58eb63f9d780427389a655d78cbc81c2"><enum>(a)</enum><header>Annual performance metrics</header><text>A participating agency shall establish annual performance metrics for each participating employee related to core functions and public service delivery, focusing on productivity, quality, and timeliness.</text></subsection><subsection id="id1df9a86e26b84725ac66e1ebb0c1eec6"><enum>(b)</enum><header>Evaluation process</header><text>The Director shall establish, and each participating agency shall implement, a standardized, objective performance evaluation system that includes periodic review of the performance of a participating employee.</text></subsection><subsection id="idc1f311581856423bb1d9abf3bce88bba"><enum>(c)</enum><header>Employee support and training</header><text>A participating agency shall provide training and resources to support participating employees in understanding and meeting performance metrics, including an introductory training course and quarterly performance feedback sessions.</text></subsection></section><section id="id8806caf412614681878d9914251bfc67"><enum>5.</enum><header>Incentive pay structure and non-monetary benefits</header><subsection id="ide1296251e488441991186bc674e01426"><enum>(a)</enum><header>Tiered salary increase structure</header><paragraph commented="no" display-inline="no-display-inline" id="id86883830c6d3419aa1bb56d87cdf60d4"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>A participating agency shall implement a tiered salary adjustment system for participating employees based on their annual performance evaluations under section 4 under which, effective as of the first day of the first applicable pay period beginning on or after the first day of the second year of the Program, and of each year thereafter, a participating agency shall adjust (if applicable) the rate of basic pay of a participating employee in accordance with this subsection.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9334512b8a094a6abb4ed9332c00802b"><enum>(2)</enum><header>Tier 1 (exceeds expectations)</header><text>In the case of a participating employee who significantly exceeded established performance metrics during the preceding year (referred to in this section as a <term>tier 1 employee</term>), a participating agency shall increase the rate of basic pay of the participating employee by 15 percent.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaecc5e6d739a4f3a888aabadb5201ac8"><enum>(3)</enum><header>Tier 2 (meets expectations)</header><text display-inline="yes-display-inline">In the case of a participating employee who met established performance metrics during the preceding year (referred to in this section as a <term>tier 2 employee</term>), a participating agency may not adjust the rate of basic pay of the participating employee.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id28a0a3d4f5df47b9b121a29cc2032140"><enum>(4)</enum><header>Tier 3 (below expectations)</header><text display-inline="yes-display-inline">In the case of a participating employee who did not meet established performance metrics during the preceding year (referred to in this section as a <term>tier 3 employee</term>), the participating agency shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4173038c61604afda589ff2d17de910a"><enum>(A)</enum><text display-inline="yes-display-inline">reduce the rate of basic pay of the participating employee by 15 percent; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id65c913b2b057478996105572603c6e9b"><enum>(B)</enum><text>provide training or development opportunities to assist the participating employee in improving performance.</text></subparagraph></paragraph></subsection><subsection id="id0811b3b1a9bc4cd8acf33792deeb9280"><enum>(b)</enum><header>Bonuses</header><text>The head of a participating agency, at the discretion of the agency head, may award a bonus to a tier 1 employee.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idb3e48953fdc54616bbec4b3f7bbc2347"><enum>(c)</enum><header display-inline="yes-display-inline">Non-Monetary benefits</header><text>The head of a participating agency, at the discretion of the agency head, may provide a tier 1 employee with flexible scheduling, telework options, and other non-monetary benefits or incentives, such as technology upgrades and parking options.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id6ec5e0c74e47423fab847d4f81f021a1"><enum>(d)</enum><header>Relation to title 5 pay adjustments, step-Increases, and other monetary benefits</header><text>A participating employee shall not be eligible for any adjustment of pay, advancement in pay, or bonus or other type of additional monetary compensation under title 5, United States Code, based on any service performed while the employee is participating in the Program, including—</text><paragraph commented="no" display-inline="no-display-inline" id="id338dc27c937e463e8af3e59988eb345b"><enum>(1)</enum><text display-inline="yes-display-inline">adjustment of the rate of basic pay under section 5303, 5304, or 5304a of that title;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6b499ff1ddab466d9ced27655794df36"><enum>(2)</enum><text display-inline="yes-display-inline">advancement in pay to a higher rate within the grade in which the employee's position is placed under section 5335 or 5336 of that title;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideca90326f53748518c275cbdc77a4c5e"><enum>(3)</enum><text display-inline="yes-display-inline">bonuses under section 5753 or 5754 of that title; and</text></paragraph><paragraph id="idb34cfedc7cdf47438a21bad4f897eb62"><enum>(4)</enum><text>performance awards under section 5384 of that title.</text></paragraph></subsection></section><section id="id529a82f534aa48838da06449502dae03"><enum>6.</enum><header>Reporting and accountability</header><subsection id="id6f668b8ecde94c47bfa34eda9a35f9e2"><enum>(a)</enum><header>Annual agency productivity reports</header><paragraph commented="no" display-inline="no-display-inline" id="id5c76db33bc0b4038ba8f92ed12ddb061"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>For each year in which the Program is carried out, a participating agency shall submit a report to the Director that includes the following information:</text><subparagraph id="idb03a0e9bca2c4495b108d697fe438ced"><enum>(A)</enum><header>Quantitative outcomes</header><text>Data on cost savings, efficiency gains, and overall productivity metrics.</text></subparagraph><subparagraph id="id9f59941140b94d76b67f5be8019ceb9e"><enum>(B)</enum><header>Qualitative outcomes</header><text>Examples of how productivity improvements have positively impacted public service outcomes and employee satisfaction.</text></subparagraph></paragraph><paragraph id="ide7e2efb5c2714f88b30631ae7ac248fd"><enum>(2)</enum><header>OMB oversight and recommendations</header><text>The Director shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3a19ecfcb9e54d3385e5ec3fc299cfa5"><enum>(A)</enum><text display-inline="yes-display-inline">review each report submitted under paragraph (1); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id33dd8fe13cd0461cabc1cd13ae48c1f6"><enum>(B)</enum><text display-inline="yes-display-inline">recommend adjustments to participating agencies as appropriate.</text></subparagraph></paragraph></subsection><subsection id="ide2e3c1a1798b450fb94cd54e6ba762a4"><enum>(b)</enum><header>Annual OMB assessments</header><text>For each year in which the Program is carried out, the Director shall—</text><paragraph commented="no" display-inline="no-display-inline" id="ide7bba3b98e4d4ab587b728beec1da568"><enum>(1)</enum><text display-inline="yes-display-inline">assess the outcomes of the Program with respect to productivity, budgetary impact, and employee satisfaction; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd44cac6958ff416988400225f90cae49"><enum>(2)</enum><text>publish and submit to Congress a report on the assessment conducted under paragraph (1).</text></paragraph></subsection><subsection id="idc7af97f1e1de412dac24ef0b06274861"><enum>(c)</enum><header>Final review</header><text>Not later than 1 year after the date on which the Program terminates, the Comptroller General of the United States and the Director shall assess the success of the Program and submit to Congress a report on the impact of the Program on productivity, budgets, and employee engagement.</text></subsection></section><section id="id894b92ecaa324219bb539ec3c6a772aa"><enum>7.</enum><header>Funding</header><subsection commented="no" display-inline="no-display-inline" id="id96d5988d73804ac689910e48147271e8"><enum>(a)</enum><header display-inline="yes-display-inline">No additional funds</header><text display-inline="yes-display-inline">No additional funds are authorized to be appropriated to carry out this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idfee05a27643840cab506a4cabb3cbaaa"><enum>(b)</enum><header>Use of existing funds</header><text>The Office of Management and Budget, the Government Accountability Office, and each participating agency shall carry out the duties of the respective agency under this Act using amounts otherwise made available to that agency.</text></subsection></section></legis-body></bill>
